WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS WHEREAS theTraf?cSafetyAct,R.S.A.2000,c.T-6,section13providesthata MunicipalCouncilmaypassa Bylaw withrespecttoregulationofparkingandtheuseofhighwaysunderitsdirection,controlandmanagement. pursuanttosection14oftheTraf?cSafetyActthecouncilofa municipalitymaypass bylawsgoverningthe parkingofvehiclesonprivatelyownedproperty; pursuanttosection108oftheTraf?cSafetyActthecouncilofa municipalitymaypass bylawsprescribing speedlimitsthataredifferentfromthespeedlimitsestablishedinthatAct; pursuanttosection48ofthe HighwaysDevelopmentandProtectionActthecouncilofa municipalitymay pass bylawsregulatingtheplacingofroadsideimprovementsonprivatelyownedproperty; pursuanttosection7 ofthe MunicipalGovernmentActthecouncilofa municipalitymaypass bylawsfor municipalpurposesrespectingthesafety,healthandwelfareofpeopleandtheprotectionofpeopleand propertyandtheenforcementofbylaws; Councilhasdeemeditnecessaryto rescindandreplaceBylaws15-80,6-84,7-84,9-85,13-86,6-87,17-90, 14-91.15-91,5-92,6-92,19-92,8-97and2-98. NOWTHEREFORE,THECOUNCILOFTHETOWNOFATHABASCA, INTHEPROVINCEOFALBERTA,DULY ASSEMBLED,ENACTSASFOLLOWS: 1. TITLE 1.1 ThisBylawmaybecitedas the "TownofAthabascaTraf?cBylaw". 2. DEFINITIONS 2.1 Thede?nitionscontainedinthe TrafficSafetyAct,R.S.A.2000,c.T-6and regulationsthereundershallapplyto this bylawunlessa contraryintentionisspeci?callystatedinthisbylaw. 2.2 InthisBylaw: (8) lb) (0) (d) (0 "C.A.O."meansthe ChiefAdministrativeOfficeroftheTownofAthabasca; "Council"meanstheMunicipalCounciloftheTownofAthabasca; "Curb"meanstheactualconcreteorasphaltcurb,orintheabsenceofone.thedividinglineofa highway betweentheedgeoftheroadwayandthesidewalk; "Disabledparkingzone" meansa spaceorportionofa highwayorparkinglotset apart anddesignated exclusivelyfortheparkingofvehiclesbearinga validdisabledplacardorlicenseplateissuedorrecognized bythe RegistrarofMotorVehicleServices,andso markedwitha signorothermarkingauthorizedbythe C.A.O.; "HeavyVehicle"meansa vehicleora vehiclewitha trailerattachedthathasa grossweightof4 tonsor more,withorwithouta load,orexceeds6.5metersinoverallength,excludingrecreationalvehicles. 'Loadingzone" meansa portionofthestreetadjacenttothecurbdesignatedbytrafficcontroldevicefo theexclusiveuse ofvehiclesloadingorunloadingpassengersormaterials; , 3.1 (i) (D (k) (l) (m) (S) BYLAW02-15 "MunicipalTag" meansa tagorsimilardocumentissuedbytheTownpursuanttothe Municipal GovernmentActforthepurposeofnotifyinga Personthatan offencehasbeencommittedforwhicha prosecutionmayfollow; "Procession"meansanygroupofpedestrians(exceptfuneralprocessions)numberingmorethantwenty- ?ve(25) whoaremarching,walking,running,standingorracingona roadwayorsidewalk,andincludes anygroupofvehicles(exceptingfuneralprocessions)numberingten(10)ormorethatareinvolvedina processionona roadway,whichalsoincludesthetermsofparade,raceorspecialevent; "Parkingstall"meansa portionofa roadwayorpublicparkinglotindicatedbymarkingsas a parking spaceforonevehicle; "Peace Officer"meansanymemberoftheRoyalCanadianMountedPolice,a CommunityPeaceOf?cer whoseappointmentincludesenforcementoftheTown'sBylawsanda BylawEnforcementOf?cerappointed bytheTown; "Person"meansanyindividual,?rm,partnership.association,corporation,trustee,executor,administrator orotherlegalrepresentative; "Refuse"meansanysubstanceormaterialdiscardedordisposedofwithintheTownotherthanbylawful depositata disposalsiteandincludesanimalwaste,drywaste,constructionwaste,garbage,industrial waste,chemicalwaste, yardwaste, litter.ashes, medicalwasteandanyothertypesofrefuseorwaste whatsoever; "Municipa|ity"or "Town"meanstheCorporationoftheTownofAthabascaortheareacontainedwithin thecorporateboundariesoftheTown,as thecontextrequires; "Track"meanstoallow,causeorpermitanysubstanceormaterial,excludingsnoworiceclingingto vehiclesduetowinterconditions,frombeingdepositedbybecominglooseordetachedfromthetiresor anyotherpartofa vehiclewhetherthevehicleismovingorstationary; "TrafficControlDevice"meansanytemporaryorpermanentsign,signal,markingordeviceplaced, markedorerectedundertheauthorityofthisBylawforthe purposeofregulating,warningorguidingtraf?c orgoverningparking; "Truckloadingzone" meansa spaceorsectionoftheroadwayso markedwitha signorothermarking authorizedbytheC.A.O.orhisauthorizeddesignatepermittingparkingforthe periodoftimereasonably necessarytoloadorunloadgoods,materialsormerchandise; "Truckroute"meansa highwaywithintheTownuponwhichtheoperationofHeavyVehiclesispermitted, andwhichhas beendesignatedas suchinthisBylaw; "Vehiclestorage area" meansanyareawhichisat leastonehundredand?fty(150)metersawayfromthe nearestresidential,institutionalorassemblyoccupancy,andthathas beenso designatedandapprovedby theC.A.O.orhisauthorizedesignate; "ViolationTicket"meansa ticketissuedpursuanttoeitherPart2 orPart3 oftheProvincialOffences ProcedureAct;; TRAFFICCONTROLDEVICESANDAUTHORITY TOPLACE Pursuanto section110oftheAct,theC.A.O.isherebydelegatedtheauthorityto place,erect, displayoraltertraf?c controldevicesat suchlocationswithintheTownas he maydetermine,oras Councilmaybyresolutiondirect,forthe purposeofcontrollingandregulatingtraf?c,including,butnotlimitedto,thefollowingspeci?cpurposes: (8) (b) To dividethesurfaceofa roadwayintotraf?clanesmarkedbysolidorbrokenlines; To prohibit"U"turnsat anyintersection; To designateany intersectionorotherplaceon a highwayas an intersectionor placeat whichnolefthand turnorrighthandturnshallbe made; Todesignateas a one-waystreetanyroadwayorportionthereof; 3.2 3.3 3.4 3.5 4.1 5.1 BYLAW02-15 (e) Todesignate"SchoolZones"and "PlaygroundZones"; (f) Todesignateroadwaysorportionsthereofas truckroutes,parkinglots,andvehiclestorageareas; (g) Toset apartas a "through--street" anyroadwayorpartofa roadwayandtocontrolentryto anyroadwayby meansofa "stop"signor"yield'sign; (h) Todesignatea crosswalkuponanyroadway; (i) Todesignate"parking"zones,passengerandtruckloadingzones,disabledparkingzones,"noparking"and "nostopping"zones.andthetimesanddayswhentherestrictionsofsuchzonesareineffect; 0) Tocloseorrestricthe useofanyhighway,oranypartofanyhighway,eitheras tothefullwidthoras topart of the widthwithrespect to any class or classesof vehiclesor withrespect to any class or classesof pedestrians; (k) To prohibit,restrictor regulatetheparkingofvehiclesor any particularclassofvehiclesonanyhighwayor otherpublicplaceoranyportionthereofduringsuchhoursas he maydetermine; (I) Todesignateandmarkguidelinesforparkingonanyhighwayorotherpublicplaceoranyportionthereof; (m) Toindicatethemaximumspeedlimitsforanyroadway; TheC.A.O.isherebydelegatedtheauthoritytoplace.orcausetobeplaced,temporarytrafficcontroldevicesprohibiting the parkingof vehicleson a roadwayforsnowcleaningand maintenancepurposesat least 12hourspriorto such cleaningormaintenance. TheC.A.O.shallcausea recordto be keptofthelocationofalltraf?ccontroldevicesplacedpursuanttothissection andthisrecordshallbe opento publicinspectionduringnormalbusinesshours. Traf?ccontroldevicesplacedand locatedpursuantto thissectionare deemedto have beenmade pursuantto this Bylaw. NotwithstandinganyprovisionofthisBylawalltraf?ccontroldevicesplaced,erectedormarkedalonghighwayslocated intheTownpriortothepassingofthisBylawshallbedeemedtobe dulyauthorizedtrafficcontroldevicesuntilaltered pursuantto theprovisionsofsection3.1ofthisBylaw. TEMPORARY CLOSINGOFROADWAYS Inanycasewhere,byreasonofanyemergencyoranyotherspecialcircumstances,itistheopinionoftheC.A.O.that itisdesirableandinthepublicinteresttodoso.theC.A.O.: TemporarilyclosewithintheTown,anyroadway.sidewalk,boulevardorpublicparkinglot,inwholeorinpart,totraf?c. Ifanyroadwayis inTownlimitsbutis a majorhighway,permissionmust be receivedfromAlbertaTransportationto closethatsectionoftheroadway; Temporarilysuspendparkingprivilegesgrantedbythe provisionofthisor anyotherbylawand takesuchmeasures necessaryforthetemporaryclosingofsuchroadways,sidewalks,boulevardsorpublicparkinglotsorsuspensionof parkingand placebarricadesor post appropriatenoticeson or near the roadways,sidewalks,boulevardsor public parkinglotsconcerned; SPEEDLIMITS UnlessotherwisedirectedbypostedTrafficControlDevicesnopersonshalldrivea vehicleat a speed inexcessof?fty (50)kilometersperhouronanyroadwaywithintheTown. 5.2 5.3 5.4 6.1 (fl (9) (i) (l) (l) BYLAW02-15 TheC.A.O.may,bysignspostedalonga roadway,temporarilytixa maximumspeedgreaterorlesserthanthespeed prescribedbytheRegulationsandPart5 ofthisBylaw.Suchdesignationis fora maximumof90days. inallcases, Councilmustgive?nalapprovaltomakethemaximumspeed permanent. Notwithstandingsection5.1,nopersonshalldrivea motorvehicleinanyalleyat a greaterrateofspeedthantwenty (20)kilometersperhour. The C.A.O.maybysignspostedalonga roadway,?xa maximumspeed limitinrespectofany partofthehighway underconstructionorrepairor ina state ofdisrepairapplicableto allvehiclesorto anyclassorclasses ofvehicles whiletravelingoverthatpartofthehighway. PARKINGRESTRICTIONS ANDPROHIBITIONS GENERALPROVISIONS ACommunityPeaceOfficerorotherpersonauthorizedtoenforcethisBylawisherebyauthorizedtoplaceanerasable chalkmarkonthetreadfaceofthetireofa parkedvehicle,andtoissueandplacea l?olationTicketandMunicipalTag upona parkedvehicle,withouthatpersonortheTownincurringanyliabilityfordoingso. Avehicleparkedona highwayshallbe parallelparkedwiththesidesofthevehicleparalleltothecurboredge ofthe roadway,unlessotherwisedirectedbya Traf?cControlDevice. Exceptwhenactivelyengagedinloadingorunloadingpassengers,nopersonshallparkorstopa vehicleinapassenger loadingzone. Unlessauthorizedbyspecialpermitapprovedbythe C.A.O.,nopersonshallparkorstop a vehicleina truckloading zonefora periodoftimelongerthantwenty(20)minutes. Nopersonshallparkavehicleinanalleyexceptforsuchperiodoftimeas maybereasonablynecessaryfortheloading orunloadingofpassengersorgoodsfroma vehicle,andinanycasenotlongerthanone(1)hour. Exceptforsection6.1(e),nopersonshallparka vehicleinanalleyina mannerthatobstructsthesafepassageofother vehiclesalongthealley. No person shallpark any unattachedtrailer,whetherdesignedfor occupancyor for the carryingof goods and equipment,uponanyroadwayexceptforthe purposeofloadingorunloadingfora periodnottoexceedforty-eight(48) hours,andonlyifitis locatedon thatportionofthe roadwaythatliesimmediatelyadjacentto the propertyitis being loadedfromorunloadedto, andisparkedinthesamedirectionoftravelwithnoslidesextended.Attheexpirationof theforty-eight(48)hourperiod,thetrailermustbemovedtoanoff-roadway. Whereanytypeofmotorvehiclehasremovablecampingaccommodationinstalledonit,theoperatororownerofthe vehicleshallnotremoveandleavethecampingaccommodation onorextendingoveranysidewalk,boulevard,alleyor anyportionoftheroadway. Nopersonshallparkanycommercialicensedvehicle,ofanydesigncapacityofmorethanone(1)tonne,includingbut not limitedto a truck,bus, trailer,ordeliveryvan,on anyroadwayina residentialareaexceptwhensuchvehicleis activelyengagedinbona?de delivery,transport,orothersimilaractivities. Nopersonshallparkanyvehicleona roadwayorpublicparkinglotownedbyorinthecare,custodyandcontrolofthe TownofAthabasca,unlessotherwiseprovidedforinthisBylaw,fora periodexceeding72hours. Nopersonshallparkanyvehicleonanyportionofa highwayinthe Towninsucha manneras to constitutea hazard tootherpersonsusingthehighway,includingthoseusinga sidewalk. NopersonshallparkanyvehicleuponanylandownedbytheTownwhichtheTownusesorpermitstobeusedas a playground,recreationarea,publicparkand greenspaceexceptonsuchpartsclearlysignedorotherwiseauthorized bytheC.A.O.forvehicleparking. 6.3 6.4 BYLAW02-15 Whereparkinglinesarevisibleona roadwayorparkinglotnopersonshallparka vehicleexceptwithinthelimitsofthe linesdesignatingtheparkingstall. Exceptinthecase ofsudden vehiclebreakdown,a personshallnotstandor parkanyvehicleon anyportionof a highwayintheTownforthepurposeofservicingorrepairingthevehicle. TheTown,afterclearlypostingorsigninga roadwayor publicparkinglota minimumoftwelve(12)hourspriormay cause a roadwayor publicparkinglotto be clearedofvehiclesforthe purposeofstreetcleaning,snowremovalor highwayrepair. Insuchcases, theTownmaytowand impoundvehiclesblockingstreetcleaningorrepairequipment at thevehicleowner'sexpense. Nopersonshallparka vehicleinanangleparkingzonewheresuchvehicleexceeds6.2metersinoverallength. Nopersonshallparka vehicleona roadwayorparkinglotwiththemotorrunninginsuchcircumstancesandlocation as tocausea disturbanceto residentswithinthearea. DISABLEDPARKING TheC.A.O.isherebyauthorizedtoestablish,signorotherwisedesignatethelocationofDisabledParkingZoneswithin theTown. Theowner,tenant,occupantorpersonincontrolofprivatepropertywithintheTowntowhichvehiclesdrivenbythe publicgenerallyhaveaccessmaydesignate.Thesignageormarkingsusedtosodesignatesuchparkingspacesshall beina formsimilartothatapprovedandusedbytheC.A.0. Nopersonshallparkor stop a vehiclewhichdoes notdisplaya disabledplacardor licenseplatethat is issuedor recognizedby the Registrarof MotorVehicleServicesin a parkingspace clearlysignedor otherwisedesignated pursuantto sections6.2(a)or6.2(b)ofthisBylaw. PARKCAUSINGOBSTRUCTION (a) (i) No person shallpark a vehicleon a sidewalk,boulevardor medianexcept, under special circumstancesandbyrequesttotheTown,whenauthorizedbytheC.A.O. (ii) Where permissionis grantedpursuantto Section6.3(a)(i).any resultantdamage willbe the responsibilityoftheownersofthevehicle. Nopersonshallparka vehicleinsucha manneras to obstructor interferewithan entrance orexitofanypublicor commercialbuildingopentothegeneralpublic. Nopersonshallparka vehicleinsuch a manneras to obstructor interferewithan entrancewayto any?re hallor ambulancestationorhospital. Nopersonshallparka vehicleinsucha manneras to obstructorinterferewiththe useofa doorwayintendedas a ?re oremergencyexitor?reoremergencylanedesignatedas suchfromanybuilding. Nopersonshallparka vehicleinfrontoforinanymannerso as topreventaccesstoandcollectionofa refusecollection container,binorgarbagestoragearea.Thisdoesnotapplytosidewalklitterbinsforgeneraluse. SECONDANDSUBSEQUENTPARKINGOFFENCES (a) Fortimedparkingoffencesunderparagraph6.1ofthisBylaw,secondandsubsequentoffencesaredeemed to have been committedwhen a vehiclethat has been issued a violationticketremainsparked in contraventionofthe Bylawfora secondorfurtherperiodoftimeinexcessofthe maximumtimeallowed. 7.1 7.2 7.3 7.4 7.5 7.6 7.7 (cl 9.1 BYLAW02-15 (b) For all otheroffencesunderthis section,secondand subsequentoffencesare deemedto have been committedwhena vehiclethathasbeenissuedaviolationticketremainsparkedincontraventionoftheBylaw 24hoursaftertheviolationticketwasissued. OPERATIONOFVEHICLES Nopersonshallridea bicycleoruserollerbladesora skateboardona roadway,sidewalk,boulevardormedianina mannerthatisunsafeorthatinterfereswithpedestrianormotorvehicletraffic. Nopersonshallride,pullorusea sled,toboggan,skisorwagonona roadway (a) Wherea sidewalkparallelssuchroadwayanditisreasonableandpracticabletousethesidewalk,or (b) Wherethereis no sidewalkparallelingthe roadway,in any mannerthat interfereswith,obstructsor is hazardoustovehiculartraf?contheroadway. (a) Nopersonshalldrive a motorvehicleona boulevard,median,playground,recreationarea,publicpark,green space,bicycletrail,naturetrail,ornaturepreserveexceptas pennittedbya traf?ccontroldeviceor, under specialcircumstancesandbyrequesttotheTown,whenauthorizedbytheChiefAdministration Of?cer. (b) WherepermissionisgrantedpursuanttoSection7.3(a)anyresultantdamagewillbetheresponsibilityofthe ownersofthevehicle. Nopersonshalldrive,operateor permitto be drivenoroperated,anyvehicleorequipmentinsucha manneras to trackupona roadway. Anypersonwhotracksupona roadwayshall,inadditiontothepenalty,be liabletocleanuporremovethesubstance or materialtrackeduponthe roadway,indefaultof whichtheTownmayarrangefor cleanup or removalof such substanceormaterialat the expenseofthepersontrackingortheownerorregisteredownerofthe equipmentfrom whichthe substanceormaterialwastracked. Nopersonshall,drivinga motorvehicleapproachinganintersectioncontrolledbya traf?clight,stopsignorothertraf?c controldevice,exittheroadwayontoprivateorpublicpropertyandcontinueontothesameroadwayoranintersecting roadwayforthepurposeofavoidingthetraf?ccontroldevice. Nopersonshalloperatea vehicleonanystreetwithina residentialareaso as to undulydisturbresidentsofanystreet orpartthereof Obstructheentranceto anybuilding. PROCESSIONS Anypersonthat intendsto holda processioninvolvinga roadway,sidewalk,boulevard,medianor townparkinglot withintheTownofAthabascashallat leastthirty(30)days priortothescheduleddate,makeapplicationinwritingto theC.A.O.forpermissionandshallprovidetotheC.A.O.informationwithrespectto thefollowing,namely: (a) Thenameandaddressofthe applicant,andiftheapplicantisanorganization,thenames,addressesofthe executiveoftheorganization. (b) Thenatureandpurposeofsuchparade,procession,raceorspecialevent. Dateandtimes. (d) Theintendedroute. 9.2 9.3 9.4 9.5 9.6 9.7 9.8 9.9 9.10 BYLAW02-15 (e) Theapproximatenumberofpersonswhowilltakepart. (f) Theapproximatesize,numberandnatureof?ags,banners,placardsorsuchsimilarthingstobe carriedand particularsofsigns,inspectionsandwordingto be exhibitedthereon;andthewrittenapplicationshallbear thesignaturesandaddressesofthe personswhowillbe incontrolofthe paradeor processionorspecial eventandwhoundertaketoberesponsibleforthegoodorderandconductoftheprocession. TheC.A.O.mayeithergrantpermission,withorwithoutconditions,orrefusepermissionforanyreasonsthatare determinedtobeappropriateconcernsinallthecircumstances.Inthecaseofa refusaltheapplicanthasa rightof appealtoCouncil,whomaygrantorrefusepermissionfortheprocession. Ifa refusalforanapplicationforpermissiontoholda processionisappealedtoCouncilpursuanttosection9.2,Council may: (a) Grantpermissionwithoutconditions; (b) Grantpermissionwithconditions;or (c) Refusepermission. Wherepermissionhas been grantedpursuantto sections9.2or 9.3, the C.A.0.shall?xthe hourand routeofthe processionandmayrequiretobe erectedtemporarybarriersortrafficcontroldevicesas he deemsnecessary. Ifanyfuneralprocessionis inprocessofformationorproceedingalonganyroadway,anyCommunityPeace Of?cer mayregulatealltrafficinthevicinityandallpersonswhetheronfootorinvehiclesshallobeytheorderanddirectionof theCommunityPeaceOf?cerso regulatingtraffic. Beforea funeralprocessionentersupon,crossesorturnsintoa roadwaydesignatedandmarkedas a through-street bya stoporyieldsign,the?rstvehicleinthefuneralprocessionshallcometoa completestopandshallnotdrivethe vehicleintotheintersectionuntilitissafetodoso. Avehiclethatfollowsinthefuneralprocessionmaythenenterinto the intersectionwithoutstoppingif: (a) Thevehicle'sheadlampsandhazardwarningarealight, (b) The vehicleis travellingimmediatelybehindthe vehicleinfrontofitinthe funeralprocessionso as to forma continuouslineoftraffic, (c) Theleadvehicleinthefuneralprocessionisshowinga purples?ashinglight,and (d) Thepassage intotheintersectioncanbe madeinsafety. Theprovisionsofthissectionshallnotapplyatanintersectionwheretrafficiscontrolledbya CommunityPeaceOf?cer orbya trafficcontrolsignal. Exceptfor funeralprocessions,no personshallholdor organizeany processionunless permissionhas been ?rst grantedbytheC.A.0.orCouncilpursuanttothissection. Nopersondrivinganyvehicle,or ridingor drivinga horse, shalldriveor ridethrough,norshallanypedestrianwalk through,theranksofa militaryorfuneralprocession(thevehiclesofwhichhavetheirlightson),northroughtheranks ofanotherauthorizedprocessions,orinanywayobstruct,impedeorinterferewiththesame. Nopersonshalltakepartintheorganizationofa paradeorprocessionorparticipateinaprocession,whichisconducted withoutpermissionhaving?rstbeengrantedpursuantto the provisionsofthisBylaw. Nopersonshallcarryoutoralloworcausetobecarriedouta processionthatdoesnotconformtoconditionsimposed ina permitissuedbytheC.A.OorCouncil. 9.11 10.2 10.3 11.2 12. 12.1 12.2 BYLAW02-15 Nothinginthissectionwaivestherequirementoobtaina permithroughanyotherpermitauthorizingbody,Provincial, Federalorotherwiseforprocession.Ex.- SpecialEventspermithroughAlbertaTransportation FIRESANDFIRELINES Incase ofa ?rewithintheTown,anyPeace Of?cerormemberoftheFireDepartmentoftheTownofAthabascamay designateinanymannera lineorlinesnearthelocationofthe?rebeyondwhichnomemberofthepublicshallpass, andnounauthorizedperson,whetheronfootorina vehicle,shallcrosssuchlineorlines. HEAWANDOVER-DIMENSION VEHICLESANDTRUCKROUTES Nopersonshalloperatea heavyvehicle,excludinga motorhome,on a roadwayor publicparkinglotownedand operatedbytheTownexceptona designatedtruckrouteas outlinedinSchedule"B"ofthisBylaw,theSchedulebeing herebyincorporatedintoandmadepartofthisBylaw. Thefollowingshallbe deemednotto be operatingor parkinga heavyvehicleincontraventionofsection11.1ifthe heavyvehiclewasbeingoperatedontheshortestroutebetweenthedelivery,pick-uporotherlocationconcernedand thenearesttruckrouteby: (a) Apersondeliveringor collectinggoods,materialsor merchandiseto or fromthe premisesofa bona?de customer; (b) Apersongoingtoorfromthebusinesspremisesoftheowneroftheheavyvehicle,a heavyvehiclerepairor maintenancefacility.oranapproved"vehiclestoragearea"forheavyvehicles; (c) Apersontowinga disabledvehiclefromoralonga roadwayprohibitedtoheavyvehicles;and (d) Apersonactivelyengagedinlawfulpublicworksrequiringhimbytheverynatureofsuch workto deviate fromestablishedtruckroutes. MAXIMUM WEIGHTSOFVEHICLES Nopersonshalldriveor parkuponany roadwaywithintheTowna vehicleorcombinationofattachedvehicleswitha weight,includingorexcludinganyloadthereon,inexcessofthemaximumallowableweightpursuanttotheCommercial VehicleDimensionandWeightRegulation. Apersondrivingorinchargeorcontrolofa vehicleorcombinationofattachedvehiclessuspectedbya PeaceOf?cer ofbeingon a roadwayincontraventionofsection12.1shall,whenrequestedbythe PeaceOf?cer,produceforthe of?cer'sinspectionanyof?cialregistrationcerti?cateor interimregistrationforthe vehicleorvehiclesthatmayhave beenissuedbytheProvinceofAlbertashowingthemaximumallowableweightofthevehicleorcombinationofattached vehicles. Nopersonshallwash,repair,orservicea vehiclenearanyroadway,sidewalk,boulevardormedianwithintheTownin a mannerthatallowssoapsuds,mud,cement,refuse,debris,tar,oil,grease,antifreezeorothervehicle?uids to?ow ontoorenterupontheroadway,sidewalk,boulevardormedianorenteranystormwatersystem. Nopersonshallparka vehicleon a roadwayorpublicparkinglotwithinthe Townthat,duetothestateofthevehicle, resultsin mud,cement, refuse,debris,tar, oil,grease,antifreezeor othervehicle?uids beingdepositeduponthe roadwayorpublicparkinglotorentera stormwatersewersystem. Wherean offenceundersection13.3,13.4or 13.5occursresultingindamageto a roadway,sidewalk,boulevardor medianor othertownpropertyor resultinginspillageor depositofdirt,gravel,vehicle?uids or othermaterialon a roadway,sidewalk,boulevardormedian,noticemaybegivento (a) Thepersonresponsible,or (b) Incases involvinga vehicle,totheregisteredownerofthevehicle,or (c) Iftheoffenceoccurredonprivateproperty,totheoccupantorowneroftheprivateproperty totakereasonablecleanupordamagerepairmeasures. Ownersoroccupantsofprivatepropertylocatedatanintersectionofroadways,excludinganintersectionwithanalley, shallnotallowanyvegetationwithinthetriangularportionofthepropertyclosesttotheintersection,measuredfromthe comeroftheintersectiontoa distanceofeight(8)meterseachdirectionalongtheedgeofthecurbor,intheabsence ofa sidewalk. theedgeoftheroadway,togrowtoheightgreaterthanone(1)meteror, inthecaseoftreesorshrubs overhangingtheportionoftheproperty,toa heightat leasttwo(2)metersabovetheground. Ownersoroccupantsofprivatepropertyshallremoveanyvegetationoverhanginga sidewalk,boulevard,roadwayor alley,toa heightat leastfour(4)metersabovethesidewalk,boulevard,roadwayoralley. Ownersoroccupantsof privatepropertyin the Townshallnotparka vehicleor build,place,erect or continuethe existenceofa fence,wall,dirtpile,snowpileorotherobjectadjacenttoandwithineight(8)metersofthenearestcomer ofa streetintersectionwhensuchvehicle,fence,wall,dirtpile,snowpileorotherobjectinterfereswithgoodvisibility forsafetraf?c?ow. Whereanoffenceundersections13.7,13.8,or13.9occurs,noticemay begiventotheoccupantorowneroftheprivate propertyrequiringremedialactiontobringthepropertywithincomplianceofthisbylawora citationmaybewrittenby a Peace Officer. Nopersonshallplaceordeposit,orallowthe placementordeposit,ofany object,refuse,buildingor othermaterials, dumpsters,snow,earth,sand,gravel,sod,oranyothermatterona roadway,sidewalk,boulevardormedianwithinthe Town,exceptingvehiclesandmaterialsforwhichspecificpermissionhas beengrantedbytheC.A.O.. Whereanoffenceundersection13.11occurs,noticemaybe giventotheoccupantorownerofthepropertyadjacent towherethe materialswereplacedtotakespeci?cremedialaction. AnynoticeissuedpursuanttothisBylawshallspecify: Thecivicaddressorphysicallocationwhereremedialactionisrequired; Theconditionthat is not incompliancewiththe Bylaw,includingreferenceto the applicableprovisionofthe Traf?c Bylaw; (c) Remedialactionrequired; 13.14 (b) 13.15 13.16 13.17 13.18 13.19 13.20 14.2 14.3 14.4 14.5 BYLAW02-15 (d) Adeadlineforcompliance. Anynoticeservedpursuantto thisBylawwillbe deemedto havebeensuf?cientlyservedinthecase ofan offence involvingprivateproperty: (a) Ifservedpersonallyuponthepersontowhomitisdirected,or (b) Ifpostedata conspicuouslocationontheproperty,or Ifmailedbyregularorregisteredmailtotheaddressofthepersontowhomthenoticewasdirected.ortotheownerof theprivatepropertyinvolvedusingtheaddressonrecordwiththeTownofAthabasca,or Ifgivenverbally,includingallinformationas requiredinsection13.13,bya peaceof?ceranddirectedto theoccupant orowneroftheprivatepropertyinvolved. Incases involvingownersofprivateproperty,theexpensesincurredbytheTownfortheworkdone,whereapplicable, maybe recoveredwithcostsbyactionincourtofcompetentjurisdictionorina likemanneras municipaltaxes. Nopersonotherthanthe ownerordriverofa vehiclewillremovea noticeissuedpursuantto thisBylawaffixedtothe vehicle. Nopersonotherthanthe occupantor ownerof privatepropertywillremovea noticeissuedpursuantto thisBylaw affixedtoa conspicuouslocationona privateproperty. PENALTIESANDENFORCEMENT PROCEDURES APeace Of?cermaycauseanyvehicleto be removedandimpoundedwhenthe vehicleis parkedincontraventionof thisBylaworwhereemergencyconditionsrequirethatthevehiclebe removed. APersonwhocontravenesorfailstocomplywithanyprovisionofthisBylawisguiltyofan offence. A Personwhois guiltyofan offenceis liableto a ?ne notlessthan$300.00and not exceeding$2,500.00,and to imprisonmentfornotmorethansixmonthsfornon-paymentofa ?ne. Withoutrestrictingthegeneralityofsection14.3,thefineamountsestablishedforuseonMunicipalTagsandViolation Ticketsifa voluntarypaymentoptionifofferedareas set outinSchedule"A". APeace Of?cerisherebyauthorizedand empoweredto issuea MunicipalTag toany PersonwhothePeace Of?cer has reasonableandprobablegroundsto believehas contravenedanyprovisionofthisBylaw. 14.6 14.7 14.8 14.9 14.10 14.11 14.12 14.13 14.14 14.15 BYLAW02-15 AMunicipalTagmaybeserved: (a) Personallytotheaccused; (b) Mailedtotheaddressoftheregisteredownerofthevehiclesconcerned,orthePersonconcerned;or (c) Attachedtoorleftuponthevehiclewithrespectofwhichtheoffenceisallegedtohavebeencommitted. I TheMunicipalTag shallbeina formapprovedbytheC.A.O.andshallstate: (a) ThenameofthePersontowhomtheMunicipalTagisissued,ifknown; (b) AdescriptionoftheoffenceandtheapplicableBylawsection; (c) Theappropriatepenaltyfortheoffenceas speci?edinSchedule"A"ofthisBylaw; id) Thatthe penaltyshallbe paidwithinfourteen(14)days ofthe issuanceofthe MunicipalTag inorderto avoid prosecution;and (e) Anyotherinformationas maybe requiredbytheC.A.O. Wherea contraventionof thisBylawis of a continuingnature.furtherMunicipalTags maybeissuedby a PeaceOf?cer,providedthat no morethan one MunicipalTag shall be issuedforeach day thatthe contraventioncontinues. APersonto whoma MunicipalTag has beenissuedmaypaythepenaltyspeci?edon the MunicipalTag and if the amountis paidon or before the requireddate, the Person willnot be prosecutedforthe offenceandthelesserofthetwoamountsinScheduleAshallapply. NothinginthisBylawshallpreventa PeaceOf?cerfromimmediatelyissuinga ViolationTicket. Wherea MunicipalTag has been issued and the penaltyspeci?edon the MunicipalTag is notpaid withinthe prescribedtime, a Peace Of?ceris herebyauthorizedand empoweredto issue a Violation Ticket pursuantto eitherPart2 orPart3of theProvincialO?encesProcedureAct. NotwithstandingSection14.11ofthisBylaw,a Peace Of?cermayimmediatelyissuea ViolationTicketto anyPersonwhomthe Peace Of?cerhas reasonableand probablegroundsto believehas contravened anyprovisionofthisBylaw. A l?olationTicketissuedwithrespect to a contraventionof thisBylawshallbe serveduponthe Person responsibleforthecontraventioninaccordancewiththe ProvincialOffencesProcedureAct. Ifa Violation Ticketis issuedinrespect of anoffence.theViolationTicketmay: (a) specifythe line amount establishedby this Bylawfor theoffenceinSchedule"A";or (b) Requirea Personto appear in court withoutthe alternativeofmakingavoluntarypayment. APersonwhocommitsan offencemay: (a) Ifa ViolationTicketis issuedinrespect oftheoffence;and (b) ifa Violation'l"lcketspeci?es the ?ne amountestablishedbythisBylawfortheoffence; makea voluntarypaymentequaltothespeci?ed?ne. 14.16 14.17 14.18 14.19 15.2 15.3 15.4 15.5 BYLAW02-15 Whena clerkrecordsin the Courtrecordsthe receiptofa voluntarypaymentpursuanttothisBylawand theProvincialOffencesProcedureAct,theact ofrecordingreceiptofthatpaymentconstitutesacceptance ofthe guilty pleaandalsoconstitutesa convictionand the impositionof a ?ne in the amountofthe speci?edpenalty. Ifa vehicleis involvedin an offenceunderthisBylaw.theregisteredownerofthatvehicleisguiltyofan offence. Section14.17does not applyifthe ownerof the vehiclesatis?esthe court that,at the time thatthe vehiclewas involvedinanoffence: (a) Inthecase ofa vehiclethatwasinmotion, (i) Theownerofthevehiclewasnotdrivingthevehicle,and (ii)Noother personwas drivingthe vehiclewiththe owner'sexpressedorimpliedconsent, and (b) Inthecase ofa vehiclethatwasparked, (ii)Theownerdidnotparkthevehicle.and (iii)Nootherpersonparkedthevehiclewiththeowner's expressedorimpliedconsent. An ownerwho is guiltyof an offence undersection14.17is notliableto imprisonmentin respect of hat offenceor in respect of a defaultofa ?neimposedinrespect ofthatoffence. GENERAL ItistheintentionoftheCounciloftheTownthateach provisionofthisBylawshouldbe consideredas beingseparate andseverablefromallotherprovisions.ShouldanysectionorprovisionofthisBylawbefoundtohavebeenimproperly enacted,thensuchsectionor provisionshallbe regardedas beingseverablefromtherestofthisBylawandthatthe Bylawremainingaftersuchseveranceshallremaineffectiveandenforceable.
