BEING A BYIAW OF THE TOWN OF ATHABASCA IN THE PROVINCE OF ALBERTA, TO PROVIDE FOR THE CONTROL AND OPERATION OF PARKS, CAMPGROUNDS, TRAILS, SPORTSFIELDS, PLAYGROUNDS, AND RECREATION AREAS UNDER THE JURISDICTION OF TOWN COUNCIL. WHEREAS authoritiesare vested in Councilfor the Town of Athabasca under the provisionof the MunicipalGovernment Act, ChapterM-26,R.S.A. 1980and amendmentsthereto, and WHEREAS it has been deemednecessary to controlthe operationof parks and campgrounds, NOW THEREFORE the Council of the Town of Athabasca in the Province of Alberta, duly assembled,enacts as follows: 1. That this by-lawbe referred to as the "ParksBy-law". 2. That in thisby-law a. "Animal"means a domesticanimal and includes an animal that is wild by nature but has been domesticated: b. "CampingAccommodationUnit" means: i. a tent ii. a trailer iii. a tent trailer iv. a motor home v. a van or vi. a truck camper used by a person as shelter equipment while camping; c. "Council"means the Councilof the Town ofAthabasca. d. "Weapon" means any device that propels a projectile by means of explosion,spring, air, string,wire or elasticmaterial or any combinationof those things; e. "Nuisance"means: a. any noisethat disturbsthe publicunnecessarily b. obscenity c. any action whichinterfereswith the rights of others to the peacefulenjoymentof a Park; f. "Park"means land designatedas park, campground,or trail by the Council; g. "Recreation facility"means any man-made structure within designated or developedpark areas that is used for recreational, culturalor publicactivities. h. "By-lawEnforcement Officer"or "ParksOfficer"means a person appointed under authorit y of this by-lawor who are dulyappointedby Councilfor the express purpose of enforcin g the rules and regulationsstipulatedin thisby-law. 3. That for the purpose of administeringthisby-law,a By-lawEnforcement O?icer may: a. Order any person in a park or recreationfacility to cease or refrain from any action , omission,or conductthat in the opinionof the O?icer is dangerous to life or property or detrimentalto the use and enjoymentof the park or recreationfacilityby other persons; b. Remove from a park or recreationfacility". i. any person makingan unauthorizeduse of the park or recreation facility ii. any person failingto complywithany provisionsof thisby-law, or iii. any person creating a nuisance or disturbanceor committing a trepass or an y undesirableact. 4. Where a person failsto complywith any provisionof this by-law,and where steps are necessary to rectify the noncompliance,the cost of doingso is recoverablefrom the person as a debt. 5. A person engaged in any activitywithinthe boundariesof the park or recreation facility shall be subject to a registrationor user fee in the amount set byTown Councilor the RecreationBoard. 6. Littering is prohibited and a person using a park shall keep the land and facilities in a condition satisfactory to a By-lawEnforcement Officer. No person who has been removed from a park or recreationfacility pursuant to the provisionsof this by-lawshall,withinthe followingseventy-two (72) hour period,enter or attempt to enter that park or recreationfacility. No person shall deface, injure, or destroy any object in a park or recreation facility, whether createdby natural means or otherwise. No person shalldisplayor post any signsor advertisementsin the park or recreation facilityother than signsand advertisementsapprovedby the By-lawEnforcement Officer or Council. That in this by-law a. No person shall bring commercialor residentialwaste matter into a park or recreation facilityfor disposal. b. In areas where waste disposalreceptacles are not provided,waste matters shall be carried out of the area for disposal. That in this by-law a. No person havingthe custodyor controlof an animalshallbring the animalinto a park or recreationfacilitywhere suchactionis prohibited. b. In areas where animalsare allowed,no person shallallowthe animalto enter or remain in a park or recreation facilityunless it is in a cage or is restrainedby a leash, chain,or other devicethat is not greater than two (2) meters in length. c. In areas where animalsare allowed, any person havingthe custody or control of an animal shallbe responsiblefor cleaningup after said animal. A Parks Officer may refuse to admit to a park or recreation facility or require to be removed from these areas any animal if he/sheconsiders it is not under control or may be a nuisance or cause damage to the life, safety, health, property, or comfort of any other persons in the park or recreation facility. No person shall set, light, or maintain a fire in a park except in a fireplace,pit, or other facilities designedfor that purpose. No person shall cut any trees or vegetationwithin the boundariesof the park or recreatio n facility. No person shallleave a fire unattendedor allowit to spread. A person shall extinguishall fires, hot coals,or smoldering materials before leavingthe individua l campsite. No person shall park or leave a motor vehicle,boat, trailer, camping accommodationunit in a park or recreation facility other than in parking areas designatedfor that purpose by the Counci l or RecreationBoard. The Council may provide for and designate areas within its parks for camping and day-use purposes. No person shallcamp overnightin a park or outdoor facilityexcept in an' area designatedfor that purpose,unless otherwiseauthorizedbyCouncil. No person shallalter a campingpermit,nor transfera campingpermitto another person. 'Wherea campgroundwithina park is developed into individualcampsites,only the followin g vehicles and camping accommodationunits are permitted to be kept in the campsite unles s Councilgivespermissionto the contrary: i. one motor vehicle,whether or not it is a campingaccommodationunit; ii. in addition to the motor vehiclereferred to in clause (i) one campingaccommodationuni t of any kind, includinga campingaccommodationunit that is a motor vehicle. No person who is visitinga person camped in an individualcampsite,shall park his/hervehicl e on the campsite: i. after 11:00p.m., or ii. in a manner or at a locationthat impedestraffic No person shall camp for more than 14 (fourteen) consecutivedays in the same campsite in a park withoutthe writtenpermissionof Council. That in thisby-law a. A campsite shall be consideredto be unoccupied,and the permit therefore cancelle d, when, without the written permission of Council, the permittee leaves the campsit e unattended for a continuousperiod of more than 24 (twentyfour) hours during the perio d of the permit. A Parks Officer, duly authorized by Council, may cancel a camping permit on writte n notice to the permittee if the permittee contravenes this by-law, and the permittee shal l vacate the campsitewithinone hour from receivingsuchnotice, and shall not be entitled to a re?md of the registrationfee. Upon the notice of cancellationof a camping permit, the permit holder shall ensure that the campsite is vacated and that all shelter equipment and other property belongingto the permi t holder or persons in that group is removed. The Council may add to, delete, or vary the terms and conditionsto whicha permit issuedunder thisby-lawis subject. The use of dangerousweaponsis controlledthroughprovisionsas outlinedin By-law21-90 of th e Town ofAthabasca. Any person violatingthe terms of this by-lawshall be subject to the provisionsoutlinedin th e generalpenaltyBy-lawbeing By-lawNo. 21-90of the Town of Athabasca.
