## Summer Village of Betula Beach In the Province of Alberta By-law # 02-2009 ## BEING A BY-LAW RELATING TO PREVENTION AND REGULATION OF FIRES AND FIREWORKS Whereas: Section 7 and 8 of the Municipal Government Act R.S.A. 2000, chapter M-26 provide that Council may pass bylaws for the prevention or extinguishing of fires, the preservation of life and property, the protection of persons from injury or destruction by And whereas: the Forest and Prairie protection Act R.S.A. 2000 chapter F-19 ("Forest and Prairie Protection Act grants addition powers to the Summer Village of Betula Beach Council enacts the following: ## Definitions: - b. "Display fireworks" are commonly referred to as high hazard fireworks, used by trained professionals. Examples include, but not limit to: rockets, serpents, shells, bombshells, tourbillions, waterfalls. 2. "Consumer fireworks" are commonly referred to as low hazard generally used for recreation. Examples include, but are not limited to: showers, golden rod, lawn lights, pinwheels, roman candles, volcano's and sparklers. These are classed as Type fl explosives in the regulation. 3. с. "Fireworks" means the fireworks listed in class 7, division 1 and diversion 2, subdivision 1 and 2, in section 14 of the "Explosives Act (Canada) and regulations under the Act. - e. Fire Permit: Required to light a structure fire or piles of debris. Must be obtained from a Fire Chief or designate. - d. Fire pit: a non- combustible enclosure for the purpose of an outdoor fire. The fire pit must be safely located away from buildings and other combustibles. A screen to control sparks is a requirement. ## Offences: - b. Persons discharging low hazard fireworks on property other than their own must first obtain written permission from the registered property owner. 2. No person shall light an outdoor fire, a structure fire or discharge without a fire permit if required under this bylaw. - c. Persons lighting fires or setting off low hazard fireworks when weather conditions are a hazard will be held responsible for costs incurred or damages sustained. - d. No person under the age of 18 years is allowed to possess or discharge low hazard fireworks. ## Summer Village of Betula Beach Bylaw 02-2009 Regulation of Fire and Fireworks - e. No person shall discharge low hazard recreational fireworks within the Summer Village of Betula except as follows: - f. When low hazard fireworks are stored in a dwelling they must be kept in: 1. A secure container 2. In a cool dry area and 3. Away from: Open Flame, excessive heat and sparking equipment or tools. News Years: 20:00 December 31$* -0:100 January 1st. Canada Day: 20:00 - 23:59 July 1St. Labour Day: 20:00 - 23:59 on the first Monday of September All fireworks shall be stored, used and ignited in accordance with provisions of the Explosives Act (Canada) and the Alberta Fire Code and their regulations and in accordance with those conditions determined solely by the Summer Village of Betula Beach.
