## BYLAW NO. 1-2023
## THIS IS A BYLAW OF THE SUMMER VILLAGE OF BETULA BEACH, IN THE PROVINCE OF ALBERTA, TO ESTABLISH A DEVELOPMENT AUTHORITY WITHIN AND FOR THE MUNICIPALITY.
WHEREAS Section 624 of the Municipal Government Act, RSA 2000 requires each municipality to provide for a Development Authority to exercise development powers and duties on behalf of the municipality;
AND WHEREAS the Summer Village of Betula Beach desires to establish and define the Development Authority for the municipality;
NOW THEREFORE, the Council of the Summer Village of Betula Beach, in the Province of Alberta, duly assembled, enacts as follows:
## TITLE
1. This Bylaw may be referenced as the "Development Authority Bylaw"
## DEFINITIONS
2. In this Bylaw, the following terms shall have the following meanings:
2. 2.1. "Act" means, unless expressly defined otherwise, the Municipal Government Act, RSA 2000, c M26, and the regulations thereunder, as amended from time to time;
3. 2.2. "Bylaw" means this Development Authority Bylaw;
4. . "Council" means the municipal council of the Summer Village of Betula Beach;
5. 2.3. "CAO" means the Chief Administrative Officer for the Summer Village of Betula Beach;
6. 2.5. "Development Officer" has the same meaning as defined in the Municipal Government Act.
## INTERPRETATION
3. In this Bylaw the following shall apply to interpretations:
2. 3.1. Any reference in this Bylaw to any statutes, regulations, bylaws or other enactments is to those statutes, regulations, bylaws or other enactments, as amended or replaced from time to time, and to any lawful amendments thereto;
3. 3.2. Whenever a singular or masculine form of a word is used in this Bylaw it shall be interpreted to include the plural, feminine or neutral form of the word as the context requires;
4. 3.3. The headings in this Bylaw do not form part of this Bylaw and shall not affect its interpretation.
## GENERAL
4. The following are the General Provisions of this Bylaw:
2. 4.1. The Development Authority for the Summer Village of Betula Beach is hereby established and is referred to hereafter as the "Development Authority;"
- 4.2. The Development Authority for the Summer Village of Betula Beach shall operate under the name of the Development Authority for the Summer Village of Betula Beach;
- 4.3. The position of Development Officer is hereby established, and the Development Officer shall serve as the Development Authority for the Summer Village of Betula Beach;
- 4.4. The Development Officer, whether employed directly by the municipality or engaged through a service contract, shall be appointed by resolution of Council and confirmed annually, or as often as required, as part of the Organizational Meeting, notwithstanding the CAOs authority to hire and designate authorities under the Act or any applicable enactment;
- 4.5. The Development Officer, on behalf of the Development Authority, may sign any order, decision, approval, notice or other thing made or given by it;
- 4.6. The powers, duties and functions of the Development Authority, and Development Officer, shall be carried out in accordance with the Summer Village of Betula Beach Land Use Bylaw, as amended from time to time, and subject to such powers as described under the Act.
## COMING INTO FORCE
5. This Bylaw shall come into force and affect the date of the third and final reading and signing of this Bylaw by the Mayor and Chief Administrative Officer.
## SEVERABILITY
6. If any portion of this bylaw is declared invalid by a court of competent jurisdiction, then the invalid portion must be severed, and the remainder of the bylaw is deemed valid and remains in force.
