A BYLAW OF THE TOWN OF BLACKFALDS IN THE PROVINCE OF ALBERTA TO
REGULATE STREET, WALKS AND PEDESTRIAN TRAFFIC WITHIN THE TOWN
A Bylaw of the Town of Blackfalds, in the Province of Alberta, pursuant to the provisions of the
Municipal Government Act, being Chapter M 26.1 of the Revised Statutes of Alberta, 2000 and
amendments thereto, for the municipal purposes respecting the safety, health and welfare and the
protection of people and property; for people, activities and things in or on or near a public place or
place that is open to the public; including transport and transportation systems.
WHEREAS By authority of the Municipal Government Act, R.S.A 2000, chapter. M-26 and
amendments thereto:
NOW THEREFORE the Municipal Council of the Town of Blackfalds, duly assembled hereby
enacts:
PART 1 - TITLE
1.
That this Bylaw may be cited as the "Traffic Bylaw".
PART 2 - DEFINITIONS
2.
The definitions contained in the Traffic Safety Act, R.S.A. 2000, c.T-6 and regulations there
under shall apply to this bylaw unless a contrary intention is specifically stated in this Bylaw.
3.
In this Bylaw, the following terms shall have the meanings shown:
a)
"Bicycle" means any device propelled by human power upon which any person may
ride and is fitted with pedals intended to be capable of propelling it regardless of the
number of wheels it may have. It:
i.
May be propelled by muscular or mechanical power;
ii.
Is fitted with pedals that are continually operable to propel it;
iii.
Weighs no more than thirty-five (35) kilograms;
iv.
Has a motor that produces not more than seven hundred fifty (750) watts and
that is driven by electricity or has an engine displacement of not more that
fifty (50) cubic centimetres
v.
Has no hand or foot operated clutch or gearbox driven by the motor that
transfers the power to the driven wheel; and
vi.
Does not have enough power to enable it to obtain a speed greater than
thirty-five (35) kilometres per hour on level ground within a distance of two (2)
kilometres from a standing point; and
vii.
Excludes mopeds.
b)
"Boulevard" means that part of a highway that is usually at the center or sides of the
lanes of travel used for trees, grass, or flowers;
c)
"Business Section" means that part of the Town designated in the Land Use By-
law as Downtown and Highway Commercial Districts
d)
"Caterpillar Treads" mean a system of vehicle propulsion in which modular metal
plates are linked into a continuous band driven by wheels.
e)
"Chief Administrative Officer" means the Chief Administrative Officer appointed by
the Town of Blackfalds.
f)
"Crosswalk" means:
i.
that part of a roadway at an intersection included within the connection of the
lateral line of the sidewalks on the opposite sides of the highway measured
from the curbs or, in the absence of curbs, from the edges of the roadway; or
ii.
that part of a roadway at an intersection, or elsewhere, distinctly indicated for
pedestrian crossing by traffic control devices or by lines or other markings on
the road surface; a marked part of a roadway where pedestrians have the
right of way to cross;
g)
"Council" means the Town of Blackfalds elected officials.
h)
"Curb" means the concrete or asphalt edge or the roadway as per the Town design
Guidelines and if there is no curb in existence, Curb shall mean the division of a
highway between that part thereof intended for the use of vehicles and that part
thereof intended for the use of pedestrians.

"Dependant" means a person who is or appears to be relying on another person for
support or a child who is or appears to be under the age of 10 years.
"Director" means the Director of Infrastructure and Property Services as appointed
by the Town of Blackfalds.
"Emergency Vehicle" means a motor vehicle used;
i.
for police duty
ii.
by a fire department
iii.
as an ambulance
iv.
for purposes relating to maintenance of public utility and designated as an
emergency vehicle by the RCMP.
I)
"Heavy Vehicle" means any vehicle whose gross vehicle weight exceeds 7,500 kg
or whose length exceeds 10 m or whose height exceeds 4.5m. Motorhomes, buses
or recreation vehicles shall be excluded from being considered heavy vehicles.
m)
"Loading zones" means a portion of a street set aside adjacent to a curb
designated for the exclusive use of vehicles for the loading or unloading of
passengers or of materials.
n)
"Master Trails Plan" means a network of trails, sidewalks and streets which form
an integral part of the circulation system within the Town as set out in Schedule C.
o)
"Municipal Ticket" means a ticket issued on behalf of the Town in a form prescribed
by the C.A.O. allowing for voluntary payment to the Town of a fine amount
established by this Bylaw as set out in Schedule A.
p)
"Parade or Procession" means any group of persons or trail of persons or vehicles,
except military and funeral processions, using the highway within the Town for show
or display."
q)
"Park" means Town owned Land that includes Municipal Reserve, Urban Reserve,
Public Utility Lands and/or Environmental Reserve.
r)
"Passenger Unloading Zone" means a space on the highway marked with a Town
authorized sign with the words " Passenger Unloading Zone Only" permitting parking
therein for a period of no longer that 15 minutes while in the active process of loading
or unloading passengers.
s)
"Peace Officer" includes a member of the Royal Canadian Mounted Police, a Bylaw
Enforcement Officer, Community Peace Officer appointed through the Alberta
Solicitor General, or any employee of the Town appointed or assigned to enforce the
provisions of this bylaw as a Bylaw Enforcement Officer;
t)
"Provision of Disabled Parking" means the owner or operator of a motor vehicle,
which is identified by the vehicle displaying a placard or license plate issued or
recognized by the Registrar for a person with a disability, and the vehicle is operated
by, or, is being used to transport a person with a disability.
u)
"Residential" means that part of the Town of Blackfalds which is designated as
residential in the Land Use By-Law.
v)
"Sidewalk" means that part of the road especially adapted to the use of, or ordinarily
used by, pedestrians, and includes that part of the outside of the curb.
w)
"Town" means the Town of Blackfalds.
x)
"Town Forces" means any employee working on behalf of the Town.
y)
"Traffic Control Device" means any sign, signal, marking or device placed, marked
or erected under the authority of this Bylaw for the purpose of regulating, warning or
guiding traffic.
z)
"Violation Ticket" means a ticket as defined in the Provincial Offences Procedure
Act, RSA 2000, c. P-34, as amended.
PART 3 - PEDESTRIAN, BICYCLES OR OTHER CONVEYANCES

No pedestrian shall cross any highway at a point where signs prohibit such crossing.
No person shall obstruct, impede or inconvenience vehicular or pedestrian traffic or a
parade or precession.

6.
No person shall stand upon or walk along a highway for the purpose of soliciting a ride
from the driver of any vehicle.
7.
No person shall operate or park a motor vehicle on any sidewalk, path or any public lands
owned by the Town.
8.
Any person using a scooter, skateboard, or other conveyance on a sidewalk where it is not
prohibited, shall yield to all pedestrians on the sidewalk and operate such conveyance
safely
9.
No person, other than a Dependant, can ride a bicycle on the sidewalk, unless the sidewalk
is part of the Town's Master Trails Plan.
10.
No person shall leave any bicycle, scooter, roller blades, skate board or other conveyance
lying or left in any manner unattended so as to create a hazard upon any highway, public
area or public sidewalk in the Town.
11.
No person, except if accompanying a Dependant, shall ride a bicycle, on sidewalks within
the Business Section of the Town.
12.
A Peace Officer may seize and impound for a period of up to 14 days any bicycle, scooter,
skateboard, or other conveyance which is used or operated in contravention of this Bylaw.
PART 4 - HEAVY VEHICLE RESTRICTIONS AND TRUCK ROUTES
13.
The routes designated in Schedule "B" attached to this By-Law, are designated as "Truck
Routes".
14.
Except as provided in Part 4 Section 13, no person shall operate a Heavy Vehicle upon a
highway with the Town of Blackfalds other than on a highway designated as a Truck Route
in Schedule B of this Bylaw, unless prior written authorization has been obtained by the
owner of the Heavy Vehicle from the Director.
15.
Section 14 shall not apply to Heavy Vehicles being operated in their normal business when
providing services in Residential areas if they are on the most direct and practicable route
between the premises or location concerned and the nearest Truck Route as designated in
Schedule B of this Bylaw.
16.
No person shall stop or park a Heavy Vehicle within the Town of Blackfalds other than in
an area designated as a Truck Route as set out in Schedule B of this Bylaw."
17.
No person shall operate, drive, propel or move on any highway any vehicle having lugs,
cleats or bands projecting from the surface of the wheels or tires of such vehicle or any
vehicle having Caterpillar Treads unless the owner of such vehicle has obtained written
authorization from the Director.
18.
The Director may, when an emergency exists with regards to restricted loads on certain
portions of a highway, ban the highway to the passage of "Heavy Vehicles" and erect
signs, governing load limits regardless of exemptions under Section 14 prohibiting said
vehicles from passage thereupon.
PART 5 - PARADES AND PROCESSIONS
19.
Any person desiring to hold a parade or procession within the Town shall, at least ten (10)
days prior to the time they desire to hold the same, make application in writing to the Chief
Administrative Officer, and such application shall furnish information with respect to the
following:
a)
The name and address of the applicant, and if such applicant is an organization, the
name, address and occupations of the executive thereof.
b)
The nature and object of such parade or procession.
c)
The day, date and hours during which same will be held.
d)
The intended route thereof.
e)
The approximate number of persons who will take part therein.
f)
The approximate size, number and nature of flags, banners, placards or such similar
things to be carried therein, and particulars of signs, inscriptions, and workings to be
exhibited thereof, and such written application shall bear the signatures and
addresses of the person will be in control of the parade or procession, and who
undertake to be responsible for the good, order, conduct thereof.

20.
The Chief Administrative Officer may for any reasons refuse to issue a permit, but in the
event of such refusal, the applicants may apply to Council, and Council may, by resolution,
direct the issue of such permit subject to the provisions of the Bylaw.
21.
The Chief Administrative Officer shall fix the hour and route of the parade or procession as
in his opinion will prevent any unnecessary or unreasonable obstruction to the street or
sidewalk and tend to prevent a breach of the peace and shall make the necessary
arrangements for the proper policing of the streets in connection with such parade or
procession.
22.
No parade or procession shall obstruct the movement, use or operation of any Emergency
Vehicle.
23.
Any person who holds or takes part in any parade or procession, without first having
obtained a permit in accordance with the provisions of this Bylaw, is guilty or an offence.
24.
Every member of a parade or procession, and the organizers or leaders thereof, shall be
guilty of an offence for each and every violation of the provisions of Part 5.
PART 6 - PARKING WITHIN THE TOWN
25.
Except as required or permitted by this Bylaw, no person, except Town Forces, shall park,
stop or leave any vehicles at the following locations:
(a)
in a construction area marked by a sign,
(b)
at an entrance to a Town building.
26.
No person shall load or unload goods to a business from the front side of the business,
except for businesses which are permitted to load and unload from the front side of the
business by written authorization from the Director.
27.
No person shall park or leave any vehicles parked on private land or property, that has
been clearly marked as such by a sign or signs, erected by the owner or his agents, unless
the owner has obtained land use authorization from the Town, to use the land as a parking
lot on the said land or property.
28.
An owner, tenant, occupant or person in charge or control of private land or property, if
personally satisfied that any person is violating the prohibition set forth in this Section may
fill out the standard Town complaint form for said vehicle and submit it to the Town.
29.
No person, except Town Forces, shall park or drive any vehicle on any park land at any
time within the Town without obtaining prior written authorization from the Director.
30.
No person, except Town Forces, shall park or drive any vehicle on any Town land at any
time within the Town without obtaining prior written authorization from the Director.
31.
All signs, designating parking zones for disabled parking, restricted time parking and no
parking, shall be specified by Council and may be updated from time to time by Resolution
of Council.
32.
No person, except Town Forces, shall park any vehicle in a restricted zone as specified in
Part 6.
33.
No person shall stop or park a vehicle in a parking space, or any part thereof, that is
marked or designated for the use of persons with disabilities, unless:
a)
the Vehicle displays a placard or license plate issued or recognized by the Registrar
for a person with a disability; and
b)
the Vehicle is operated by, or, is being used to transport a person with a disability.
34.
Where, pursuant to Section 33, the vehicle is identified by a placard for a person with a
disability, the owner or operator shall have such placard visibly displayed while the vehicle
is stopped or parked in a parking space designated for disabled parking.
35.
Except as required or permitted by this bylaw, be a traffic control device, or in compliance
with the directions of a Peace Officer, a person shall not stop, park or leave standing, an
attended or unattended vehicle:
:_(a)
on a Sidewalk or boulevard;
(b)
on a crosswalk;

(c)
within an intersection other than immediately next to the curb in a "T" intersection;
(d)
at an intersection nearer than 5 metres to the projection of the lateral curb line of the
highway at right angles to the direction of travel of the vehicle;
(e)
within 5 meters of the approach to a stop sign or yield sign;
(f)
within 5 metres of either side of a fire hydrant, or when the hydrant if not located at
the curb, within 5 metres of the point on the curb nearest the hydrant;
(g)
within 1.5 metres of an access to a garage, private road or driveway, or a vehicle
crossway over a sidewalk;
(h)
within 5 metres of the near side of a marked crosswalk;
(i)
alongside or opposite any street excavation or obstruction when the stopping or
parking would obstruct traffic;
U)
at any other place where a traffic control device prohibits stopping or parking, during
the times stopping or parking is prohibited;
(k)
on the road side of a vehicle parked or stopped at the curb or edge of the roadway;
(I)
on a highway in excess of the time designated and marked on a sign posted for the
purpose of restricting the time for parking a vehicle in that location;
(m)
at or near the site of any fire, accident or other emergency, if stopping or parking
would obstruct traffic or hinder Emergency Vehicles or Peace Officers, fire
personnel, Town Forces, ambulances or rescue officers or volunteers.
36.
No person shall park a vehicle in an alley, unless a sign permits parking, but alleys may be
used for,
a)
the loading or unloading of goods from a commercial vehicle for a period not
exceeding 30 minutes; or
b)
the loading or unloading of goods or passengers from vehicles other than a
commercial vehicle for a period not exceeding 5 minutes;
provided that the vehicle concerned in such loading or unloading of passengers or goods
does not obstruct the alley as to prevent other vehicles or persons from passing along such
lane.
37.
No person shall park a recreation vehicle (including a camper or holiday trailer), utility
cargo trailer or boaUATV trailer upon any highway unless it is attached to a motor vehicle
by which it is carried, drawn or propelled, unless that portion of the highway is designated
by a sign allowing for such parking.
38.
No person shall park any motor vehicle, off-highway vehicle, boat or any trailer (empty or
loaded) upon a vacant lot in a Residential area.
39.
No person shall park a recreation vehicle on a highway for longer than 72 hours and shall
move to an off-highway location for at least 48 hours before returning to the original parking
spot on the highway.
40.
No person shall park a vehicle with a registered weight of 4500 kilograms or greater in any
Residential district within the Town.
PART 7 - SPEED LIMIT
41.
Unless otherwise provided for in this Bylaw, or unless highway signs prescribe a lesser or
greater speed limit, the speed limit in the Town shall be 40 kilometres per hour.
42.
No person shall drive a vehicle in an alley at a speed in excess of 20 kilometres per hour.
43.
No person shall drive a vehicle at a speed in excess of 20 kilometres per hour on any land
which is part of a manufactured home park, school, condominium property or any of the
Town's public facilities or parking lots.
44.
No person, other than Town Forces, shall operate a slow-moving vehicle on a highway
within the Town boundaries, except Highway 2A, between the hours of 7:00am to 9:00am
or between the hours of 4:00pm and 6:00pm, Monday to Friday inclusive.
45.
No person shall drive within a school zone at a rate of speed greater than 30 kilometres per
hour between the hours of 7:30 a.m. and one hour after sunset every day.
46.
No person shall drive within a playground zone at a rate of speed greater than 30
kilometres per hour between the hours of 7:30 a.m. and one hour after sunset every day.

4 7.
The Director shall have appropriate signs placed and maintained wherever necessary on
the highways of the Town to indicate to drivers of Heavy Vehicles the highway restricted to
the use of Heavy Vehicles and designate those highways which are Truck Routes.
48.
The Director shall have appropriate traffic control devices placed and maintained where
necessary on the highways of the Town to indicate school zones, playground zones, speed
limits and/or devices deemed necessary to provide proper control of traffic.
49.
The location type and placement of all traffic control devices shall be placed in the Town in
accordance with the standards set by the Roads and Transportation Association of
Canada. The maps and schedules pertaining to the location, type and placement of traffic
control devices shall be updated accordingly.
50.
The Director, is hereby authorized to, take such measures for the temporary closing of
highways, or the suspension of parking privileges and place barricades or post appropriate
notices on, or near the highway concerned, for repairs, maintenance or emergency, or any
special circumstances as may be considered necessary in the circumstances.
51.
No person shall:
(a)
Tear down, remove, destroy or interfere with any barricades or notices of closing or
suspension, erected or posted under authority of this Section.
(b)
Do anything in contravention of any notice posted under authority of this Section.
PART 9 - SNOW ON HIGHWAY
52.
No person shall place, or cause to be placed, upon any highway any snow, ice, dirt or other
obstruction, except in places where the building is directly adjacent to the sidewalk.
53.
Any person who contravenes Section 52 shall remove any such snow, ice, dirt, or
obstruction, from the highway within 48 hours of the time that such snow, dirt, or
obstruction was placed thereon.
54.
The Town may, after the expiry of the 48 hours aforesaid, or if deemed necessary at any
time, remove and clear away the snow, ice, dirt, or obstruction required to be removed in
Section 52.
55.
The person who has placed, caused or allowed to be placed the snow, ice, dirt, or
obstruction contrary to Section 52, shall pay the Town on demand all costs of removal
incurred in Section 54.
56.
No employee of the Town shall be liable for contravention of Sections 54 when acting in
the performance of his/her duties.
PART 10 - SNOW ON SIDEWALKS
57.
All persons owning or occupying premises in the Town, shall be responsible for the
removal and clearing away all snow, ice, dirt and other obstructions from the sidewalk
situated on land adjoining the property owned or occupied by them, within 48 hours of the
time that such snow, ice, dirt or other obstructions was deposited thereon.
58.
The Town may after the expiry of the 48 hours aforesaid, or if deemed necessary at any
time, remove and clear away all snow, ice, dirt, or obstruction, required to be removed in
Section 57.
59.
The owner or occupier who fails to comply with Section 57, with respect to removal of snow
or ice, shall make payment to the Town on demand by the Town of all costs or removal
incurred under Section 58 and if unpaid will be added to the tax roll in respect of the parcel.
60.
The owner or occupier who fails to comply with Section 57, with respect to removal of dirt
and other obstructions from the sidewalk, shall make payment to the Town on demand by
the Town of all costs of removal incurred under Section 58.
PART 11 - MISCELLANEOUS
61.
No person shall place or shall cause, suffer, permit, or allow to be placed a light, sign, or
any object that emits or reflects light in such a manner so as to distract, or interfere with the
, vision of persons operating vehicles on any highway in the Town.

62.
No person shall allow himself to be pulled by a vehicle while he is on a sled, toboggan,
skateboard, skis, or other conveyance.
63.
No person shall permit any livestock, horse drawn vehicle or sleigh, to stand, or be upon,
any highway so as to obstruct traffic thereon without a permit from the Town.
64.
No person shall damage any highway or walkway or remove any earth, gravel, concrete,
pavement, or other highway appurtenances or make any excavation within or under any
highway or highway within the Town without having first obtained a permit from the
Director.
65.
No person shall allow the draining or leaking of the radiator or other fluid from a vehicle so
that the contents thereof fall upon or flow onto the highway.
66.
No person shall place, or allow to be placed, an extension cord, rope or any other potential
tripping hazard across any sidewalk, walkway or pathway within the Town.
PART 12 - MAINTENANCE
67.
An owner or occupant of private property shall ensure that trees or shrubs growing on his
property, and on adjacent boulevards within his property line, shall be trimmed so that no
branches project over a sidewalk at elevations less than 225cm (7.5 ft) or over a highway
or alley at an elevation of less than 412 cm (13.5 ft).
68.
No owner or occupant of private property shall permit any hedge, shrub, or tree, whenever
planted, to grow, or to remain at a height greater than one (1) metre above the
established elevation of an intersection of the highway at a place on such parcel of land at
or adjacent to and within the distance of six (6) metres measured on the radius of the
intersection of the highway nearest to the property.

69.
No person shall remove, pollard, destroy, or injure any tree that is planted or growing on a
boulevard planting strip or on any Town lands without prior written approval from the Parks
and Facilities Manager. Where such permission is granted, the person with permission
shall be responsible for all costs associated with the removal and value of the tree as
determined by the Parks and Facilities Manager.
70.
The Director may require any person concerned to comply with and remedy a breach of the
provisions of Sections 67, 68, or 69. If a person fails to comply with such notice, the
Director may direct employees or agents of the Town to carry out the work and to enter
private property, if necessary, for such purpose.
71 .
The person who fails to comply with Sections 67, 68, or 69 shall make payment to the
Town on demand by the Town of all costs incurred by it under Section 70.
PART 13 - REMOVAL AND IMPOUNDMENT OF VEHICLES
72.
A Peace Officer is hereby authorized to remove or cause to be removed any vehicle or
trailer:
a)
operated or parked in contravention of any provision of this Bylaw; or
b) ~
ere emergency conditions may require such removal.
73.
When a vehicle or trailer are removed or caused to be removed pursuant to Section 72
such vehicle or trailer may be removed to a place designated by the Director, where it will
remain until claimed by the owner thereof or his agent.

74.
No impounded vehicle shall be released to its owner or his agent until the impounding
charge and removal charge on the vehicle have been paid, such charges shall be in
addition to any fine or penalty imposed in respect of any violation, or to any payment made
in lieu of prosecution as hereinafter provided. The Town is not responsible for impounding,
towing or removal charges.
75.
Notwithstanding anything herein contained, in conjunction with snow removal, street
cleaning or road repair operations, carried on by the Town employees or contractors, the
Town may tow or remove vehicles from the street being cleaned, cleared or repaired and,
without impounding them, may remove them to an adjacent street, or impound them as per
Section 73 and 7 4.
76.
Where a vehicle is driven, used, parked or left in contravention of any provision of this
bylaw, the owner of the vehicle is liable for the contravention and shall make payment of
the penalty prescribed herein unless there is evidence before the court that at the time of
the contravention, the vehicle was not driven, used, parked or left by him or by any other
person with his consent, express or implied.
77.
A copy of any record of the Town, certified by the CAO as a true copy of the original, shall
be admitted in evidence as prima facie proof of the facts stated in the record without proof
of the appointment or signature of the person signing it.
PART 14 - PROSECUTION OF OFFENCES
78.
Any person who contravenes any provision or this Bylaw is guilty of an offence and liable to
the penalties set out in Schedule A herein, and where no penalty is specified for the
offence in Schedule A herein, is liable on summary conviction to a fine of not less that
$300.00 and not more than $10,000.00.
79.
For the purposes of this Bylaw, the owner of a vehicle includes any person registered as an
owner at the Registrar of Motor Vehicle Services.
80.
Where a Peace Officer has reasonable grounds to believe a person has contravened any
provision of this Bylaw, he/she may issue such a person a municipal ticket allowing the
payment of the specified penalty to the Town which shall be accepted by the Town in lieu
of prosecution for the offence.
81.
Service of a municipal ticket shall be sufficient if it is:
a)
personally served; or
b)
attached to the vehicle in respect of which an offence is alleged to have been
committed; or
c)
mailed to the address of the registered owner of the vehicle as recorded at the
Registrar of Motor Vehicle Services in Alberta or to the address of the person in
possession of said vehicle.
82.
Notwithstanding Section 12(3) herein, a Peace Officer is hereby authorized and
empowered to issue a Violation ticket, without first issuing a Municipal ticket, to any person
who the Peace Officer has reasonable grounds to believe has contravened any provision
of this Bylaw.
83.
If a Violation ticket is issued in respect of an offence, the Violation ticket may:
a)
specify the fine amount established by this Bylaw for the offence; or
b)
require a person to appear in Court without the alternative of making a voluntary
payment.
84.
A person who is issued a Violation ticket in respect of any offence may, if the Violation
ticket specifies the fine amount established by this Bylaw for the offence, make a voluntary
payment equal to the specified fine by delivering the Violation ticket and the specified fine
to the Provincial Court Office specified on the Violation ticket.
PART 15 - REPEAL
84.
That Bylaw 114 7 /1 2 and amendments thereto are hereby rescinded.
PART 16 - DATE OF FORCE
85.
That this Bylaw shall come into effect, upon the date on which it is finally read and passed.
