## BYLAW 2024-59
BEING A BYLAW OF THE TOWN OF DIAMOND VALLEY IN THE PROVINCE OF ALBERTA, TO REGULATE TRAFFIC AND OTHER ACTIVITIES UPON HIGHWAYS WITHIN THE TOWN OF DIAMOND VALLEY, ALBERTA.
WHEREAS pursuant to the Municipal Government Act, RSA 2000, Chapter M-26 as amended, a municipal Council has authority to govern and the authority to pass Bylaws for municipal purposes respecting the safety, health and welfare of people and the protection of people and property and the enforcement of Bylaws;
AND WHEREAS pursuant to the Traffic Safety Act, Chapter T-6, R.S.A. 2000 and amendments thereto, a municipal Council has authority to pass Bylaws for the regulation and control of Vehicles and Pedestrian traffic;
AND WHEREAS the Council of the Town of Diamond Valley deems it necessary to regulate traffic and other activities upon Highways within the Town of Diamond Valley;
THEREFORE, BE IT RESOLVED THAT the Council of the Town of Diamond Valley, duly assembled in Council Chambers in Diamond Valley, Alberta, enacts as follows:
- 1.0 TITLE
- 1.1 This Bylaw may be cited as the "Traffic Bylaw".
- 2.0 INTERPRETATION AND DEFINITIONS
- 2.1 In this Bylaw and any schedules to this Bylaw, the following terms, phrases, words and their derivations shall have the following meanings.
- Act means the Traffic Safety Act and amendments thereto.
- c) Bicycle means any device propelled by human power upon which any Person may ride and is fitted with pedals intended to be capable of propelling it regardless of the number of wheels it may have. For the purposes of this Bylaw, a Bicycle includes an electric or Power-assisted Bicycle while the power-assist function is disengaged.
- b) Alley means a narrow Highway providing and offering access to the rear of buildings and parcels of land.
- Boulevard means that portion of Highway that:
- (i) is not Roadway; and
- (ii) is the part of the Sidewalk that is not especially adapted for the use of, or ordinarily used by, Pedestrians.
- f) CAO means the Chief Administrative Officer of The Town of Diamond Valley or the employee of The Town of Diamond Valley who has been delegated the authority to exercise the powers, duties, and functions of the Chief Administrative Officer under
- Bylaw means a Bylaw of the Town of Diamond Valley.
- Commercial Vehicle means a Vehicle operated on a Highway by or on behalf of a Person for the purpose of providing transportation but does not include a private
- h) Council means the duly elected Council of the Town of Diamond Valley.

- i) Crosswalk means:
2. (ii) any part of a Roadway at an Intersection or elsewhere distinctly indicated for Pedestrian crossing by signs or by lines or by other markings on the road surface.
3. (i) that part of a Roadway at an Intersection included within the connection of the lateral lines of the Sidewalks on opposite sides of the Highway measured from the Curbs or, in the absence of Curbs, from the edges of the Roadway; or
- i) Curb means the concrete or asphalt edge of a Roadway or the division point between the Roadway and a Boulevard or Sidewalk;
- k) Disabled Parking Place means any Parking place designated by:
6. (i) the CAO; or
7. (ii) the Owner, tenant, occupant or Person in control of private property for the exclusive use of Persons with disabilities who operate or travel by Motor Vehicle and which Parking place is marked with signs.
- 1) Driver or Operator means a Person who drives or is in actual physical control of a Vehicle.
- m) Emergency Vehicle means a Motor Vehicle used:
10. (i) by a Fire Department;
11. (ii) as an ambulance; or
12. (iii) by a Peace Officer.
13. (i) a Vehicle, with or without a load, weighing six thousand (6,000) kgs or more, or exceeding 12 metres in length, or
- n) Heavy Vehicle means:
15. (ii) a Vehicle with a Trailer, with or without a load, weighing six thousand (6,000) kgs or more in total weight, or exceeding 12 metres in total length.
- o) Highway means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, Traffic Lane, Alley, square, bridge, causeway, trestle way or other place whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage or Parking of Vehicles, and includes:
17. (i) a Sidewalk (including the Boulevard portion of the Sidewalk);
18. a ditch which lies adjacent to and parallel with the Roadway; and
19. a Highway right of way that is contained between fences or between a fence and one side of the Roadway, all the land between the fence and the edge of the
20. Intersection means the area embraced within the prolongation or connection of:
21. (ii) the exterior edges of the Roadway; or
22. (i) the lateral Curb lines or, if none;
23. (iii) of two (2) or more Highways which join one another at an angle whether or not one Highway crosses the other.
24. Maintenance Route means that portion of a Roadway that is signed, either permanently or temporarily, for the purpose of conducting maintenance activities by or on behalf of the Town, including but not limited to:
25. (i) snow clearing or removal;
26. (ii) street cleaning; or
- r) Mobility Aid means a device used to facilitate the transport, in a normal seated orientation, of a Person with a physical disability.
28. (iii) any other activity that may be required on such Roadway.

## s) Motor Vehicle means:
- (ii) a moped,
- (i) a Vehicle propelled by any power other than muscular power; or
- (iii) but does not include a Bicycle, an aircraft, a tractor whether equipped with rubber tires or not, an implement of husbandry or a Motor Vehicle that runs only on rails.
- t) Non-motorized Vehicle means a device in, on, or by which a Person or thing may be transported or drawn and which is propelled by human muscular power, and includes, but is not limited to Bicycles, roller skates, inline skates, Skateboards, scooters, skis, roller skis, toy vehicles, and a child's tricycle.
- Off-Highway Vehicle means any motorized mode of transportation built for crosscountry travel on land, water, snow, ice or marsh or swamp land or on other natural terrain and, without limiting the generality of the foregoing, includes, when specifically designed for such travel,
- 4-wheel drive Vehicles,
- (ii) low-pressure tire Vehicles,
- motorcycle and related 2-wheel Vehicles,
- amphibious machines,
- miniature Motor Vehicles,
- all terrain Vehicles,
- (vii) snow Vehicles,
- (vili) minibikes, and
- (ix) any other means of transportation that is propelled by any power other than muscular power or wind,
## but does not include
- (x) motor boats, or
- (xi) any other Vehicle exempted from being an Off-Highway Vehicle by Regulation.
- w) Parades, Procession or Special Roadway Event means any group or train of Persons or Vehicles using the Highway within the Town for show or display but shall not include any military or funeral Parade or Procession.
- v) Owner means the Person who owns a Vehicle and includes any Person renting a Motor Vehicle or having the exclusive use of it under a lease or otherwise for a period of more than thirty (30) days.
- x) Park or Parking means allowing a Vehicle (whether occupied or not) to remain standing in one place, except:
- (i) when standing temporarily for the purpose of and while actually engaged in loading or unloading passengers; or
- (ii) when complying with a direction given by a Peace Officer or Traffic Control Device.
- Parking Ban means a declaration by the CAO, based on road conditions and/or maintenance requirements, to restrict, for a specified period of time, the Parking of Vehicles on specified Maintenance Routes.
- Pathway means a multi-purpose thoroughfare controlled by the Town and that is set aside for use by Pedestrians, cyclists and Persons using Mobility Aids or Non-motorized Vehicles, but does not include a Sidewalk.
- aa) Peace Officer means any individual(s) designated and appointed, from time to time, by the Town of Diamond Valley for the purpose of administration and enforcement of

this Bylaw and includes a Person designated as a Peace Officer appointed pursuant to the Peace Officer Act, S.A. 2006, c P-3.5, or a police officer under the Police Act, R.S.A. 2000, c. P-17.
## bb) Pedestrian means:
- (i) a Person on foot, or
- (ii) a Person in or on a Mobility Aid,
- cc) Person means an individual or any other legal entity including a firm, partnership, joint venture, proprietorship, corporation, association, or society.
and includes those Persons designated by Regulation as Pedestrians.
- Power-assisted Bicycle means a Bicycle with a motor output that does not exceed 500w (0.671 hp) and cannot travel faster than 32 km/h (20 mph) and is required to have fully operable pedals.
- ff) Recreational Vehicle means any type of live-in Recreational Vehicle that is designed for travel and without limiting the generality of the foregoing includes the following:
- ee) Public Place means any publicly owned park, parkway, Highway, or square to which the public is permitted access, or a Parking area designated for the public by a business, government or institution.
- (i) travel Trailers;
- (ii) truck campers;
- (iii) fifth wheel Trailers;
- (iv) motorhomes and conversions;
- (v) pop-up camping Trailers.
- g8) Regulation means the Use of Highway and Rules of the Road Regulation, (A.R. 304/2002) made pursuant to the Act.
- hh) Roadway means that part of a Highway intended for use by vehicular traffic.
- її) Sidewalk means that part of Highway especially adapted to the use of or ordinarily used by Pedestrians and includes that part of a Highway between the Curb line (or edge of the Roadway, where there is no Curb line) and the adjacent property line, whether or not paved or improved.
- jj) Skateboard means a wheeled device controlled or propelled by gravity or by the muscular energy of the rider, including roller skates, in-line skates, scooters or other similar recreational devices; but does not include any Bicycle, unicycle, tricycle, wheelchair, Mobility Aid, baby or invalid carriage.
- (i) when required, a complete cessation from vehicular movement; and
- kk) Stop means:
- (ii) when prohibited, any halting even momentarily of a Vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Peace Officer or Traffic Control Device.
- Street Furnishings means items such as poles, Traffic Control Devices, waste receptacles, benches, bus enclosures, trees, plants, grass, utilities, planters, Bicycle racks, newspaper boxes, or any other similar property placed on a Highway.
- nn) Traffic Control Device means any sign, signal, marking or device placed, marked or erected under the authority of this Bylaw for the purpose of regulating, warning or guiding traffic.
- mm) Town means the municipality of the Town of Diamond Valley in the Province of Alberta, or where the context so requires, its municipal boundaries.
- 00) Traffic Lane means a longitudinal division of a Roadway into a strip of sufficient width to accommodate the passage of a single line of Vehicles.

- pp) Trailer means a Vehicle so designed that it may be attached to or drawn by a Motor Vehicle and intended to transport property or Persons but does not include machinery or equipment used in the construction or maintenance of Highways.
- (i) greater than eleven (11) metres in length, or
- 99) Truck means any Vehicle, other than a registered disabled Person's Vehicle, Recreational Vehicle, school bus or transit Vehicle, that is:
- (ii) registered (in any jurisdiction) to operate at a maximum gross weight of eight thousand (8,000) kg or more.
- ss) Violation Tag means a notice or tag in a form as approved by the CAO, issued by the Town allowing a voluntary payment option of a fine established under this Bylaw.
- rr) Vehicle means a device in, on or by which a Person or thing may be transported or drawn on a Highway.
- tt) Violation Ticket means a ticket issued pursuant to Part Il of the Provincial Offences Procedure Act, and any amendments or regulations thereto.
- 2.2 The headings in this Bylaw do not form part of this Bylaw and do not affect its interpretation.
- 2.3 Any references in this Bylaw to any Statutes are to the Province of Alberta Statutes as amended or replaced from time to time and any amendments thereto.
- 2.4 Within the text of this Bylaw;
- (a) use of a pronoun or determiner which indicates one gender includes all genders, unless the context requires otherwise, and
- (b) use of the singular includes the plural and the plural includes the singular, as the context requires.
- 2.5 The word "may" when used in this Bylaw is to be construed as permissive and empowering, and the words "must" or "shall" when used in this Bylaw are to be construed as imperative.
- 2.6 Where this Bylaw refers to another Act, Bylaw, regulation or agency, it includes reference to any Act, Bylaw, regulation or agency that may be substituted therefore.
- 2.7 All schedules attached to this Bylaw form part of this Bylaw.
- 2.8 Wherever used in the Bylaw, the Definitions used in section 2.1 have the meanings respectively ascribed to them in that section. Any definition not defined in this Bylaw will have the meaning as defined in the Traffic Safety Act and Use of Highway and Rules of the Road Regulation (AR 304/2002).
- 2.9 If a Vehicle is involved in an offence under this Bylaw, the Owner of that Vehicle is guilty of an offence unless the Owner of that Vehicle satisfies the Court that the Owner was not in control of the Vehicle and that the Person having control of the Vehicle at the time of the offence had control of the Vehicle without the Owner's express or implied consent.
- 3.0 PARKING
- 3.1 When Parking a Vehicle on a Roadway where permitted, a Person may only Park a Vehicle:

- (a) with
- (i) the sides of the Vehicle parallel to the Curb or edge of the Roadway; and
- (ii) the right wheels of the Vehicle not more than 500 millimetres from the right Curb or edge of the Roadway; or
- (b) in the case of a one-way Highway where Parking on either side is permitted, with
- (i) the sides of the Vehicle parallel to the Curb or edge of the Roadway;
- (i) the wheels that are the closest to a Curb or edge of the Roadway not more than 500 millimetres from that Curb or edge; and
- (iii) the Vehicle facing in the direction of travel authorized for the Highway.
- 3.2 Notwithstanding section 3.1, a Person may Park a motorcycle:
- (a) at an angle, other than perpendicular, to the Curb or edge of the Roadway; and with
- (b) with the wheel of the motorcycle not more than 500 millimetres from the Curb or edge of the Roadway.
- 3.3 Section 3.1 does not apply where angle Parking is permitted or required.
- 3.4 A Person driving a Vehicle must not, unless required or permitted by the Act, the Regulation, this Bylaw, or a Traffic Control Device, or in compliance with a direction given by a Peace Officer, or to avoid conflict with other traffic, Stop or Park the Vehicle at the following locations:
- (a) on a Sidewalk or Boulevard;
- (b) on a Crosswalk or on any part of a Crosswalk;
- (c) within an Intersection other than immediately next to the Curb in a "T" Intersection;
- (e) in the case of an approach to a Stop sign or yield sign, within 5 metres from the Stop sign or yield sign;
- (d) at an Intersection nearer than 5 metres to the projection of the corner property line immediately ahead or immediately to the rear, except when the Vehicle is Parked in a space where a Traffic Control Device indicates Parking is permitted;
- (f) within 5 metres from any fire hydrant, or, when the hydrant is not located at the Curb, within 5 metres from the point on the Curb nearest the hydrant;
- (g) within 1.5 metres from an access to a garage, private road or driveway or a Vehicle crossway over a Sidewalk;
- (h) within 5 metres from the near side of a marked Crosswalk;
- (i) alongside or opposite any Roadway excavation or obstruction when the Stopping or Parking would obstruct traffic;
- = on any bridge or on the approach to any bridge;
- (k) at any place where a Traffic Control Device prohibits Stopping or Parking, during the times Stopping or Parking is so prohibited;
- (1) in contravention of a Traffic Control Device;
- (m) on the Roadway side of a Vehicle that is Parked or Stopped at the Curb or edge of the Roadway;
- (n) at or near the site of any fire, accident or other emergency, if Stopping or Parking would obstruct traffic or hinder Emergency Vehicles or Peace Officers, Firefighter, or ambulance personnel;

- (o) if a Highway is divided into 2 or more Roadways by a Boulevard, ditch or other physical barrier, on that portion of the Highway that is to the left of the yellow line except in an emergency situation where the Vehicle is disabled and it is not practicable to move the Vehicle to the far right side of the Highway;
- 3.5 Where a Traffic Control Device restricts the Parking of Vehicles to a certain period of time, it shall be an offence to Park a Vehicle in excess of the time so designated and marked on the Traffic Control Device.
- When a Vehicle is Parked on any Highway, Parking lot or Public Place and is in violation of a provision of this Bylaw or Regulation, it may be removed and impounded, and the cost thereof may be charged against the Owner and/or Operator of said Vehicle.
- 3.7 No Person shall Park a Motor Vehicle in such a manner as to constitute a hazard to other Persons using the Highway.
- 3.8 No school bus, farm or Commercial Vehicle shall be Parked on any residential Roadways in the Town except when conducting normal business.
- 3.9 No Person shall leave a Vehicle unattended on a Highway while it is supported by a jack or similar device.
- 3.10 No Person shall leave a Vehicle on a Highway for the purpose of servicing or repairing the Vehicle, unless in the case of a breakdown or emergency preventing the Vehicle from being moved.
- 3.11 No owner or Operator of any Vehicle which:
- a) is not equipped in accordance with the Act; or
- b) is not in operable condition
shall cause or permit such Vehicle to be Parked or left standing on any street.
- 3.12 Section 3.11 does not apply to a vehicle which has been left Parked because of a breakdown or other emergency if the Person in charge or control of the vehicle can establish that he has taken immediate action to arrange for the removal of the vehicle forthwith.
## 4.0 ALLEY PARKING
- 4.1 No Person shall Park a Vehicle in an Alley except when actively loading or unloading goods or passengers from the Vehicle.
- 4.2 Section 4.1 does not apply to the Alley located on the south side in the 500 Blk of Sunset Boulevard, and Blacklock Way.

## 5.0 TRAILER PARKING
- 5.1 No Person shall Park any Trailer, whether designed for occupancy or load carrying, on any Highway unless such Trailer is attached to a Vehicle by which it may be propelled or drawn and when so attached, the Trailer shall be considered a part of the towing Vehicle and subject to any regulations pertaining to the Vehicle.
- 5.2 No Person shall Park or stand any Vehicle with a Trailer attachment exceeding an overall length of twelve and a half (12.5) metres on a residential Roadway, unless:
- (a) the Trailer is in the immediate process of being loaded or unloaded;
- (b) the Trailer is currently being used to aid with construction, landscaping or demolition.
- 5.3 Section 5.2 of this Bylaw does not apply to Recreational Vehicles.
## 6.0 RECREATIONAL VEHICLE PARKING
- 6.1 No Person shall Park or stand any Recreational Vehicle on any Highway within the Town for a period of more than 72 hours, following which the Owner or Operator shall remove the Recreational Vehicle from any Highway within the Town for a period of not less than 48 consecutive hours before which the Recreational Vehicle may be Parked again on any Highway within the Town.
- 6.2 No Person shall Park or stand any Recreational Vehicle on a Highway within the Town between November 1 and April 1 of each year unless they are in the immediate process of loading or unloading.
- 6.3 No Person shall Park or stand any Recreational Vehicle on a Highway within the Town for the purposes of occupying it as a dwelling unit.
- 6.4 No Person shall Park or stand any Recreational Vehicle on a Highway within the Town in such a manner as to constitute a hazard to other Persons using the Roadway or Sidewalk.
## 7.0 DISABLED PARKING
- 7.1 No Person shall Park or Stop a Motor Vehicle in a Disabled Parking Place unless that Motor Vehicle is visibly displaying a current disabled Parking placard or licence plate and unless they are or have with them or are picking up the Person to whom such pass or licence plate was issued.
## 8.0 TRACKED VEHICLES
- 8.1 No Person shall drive, propel or move on any Highway any Vehicle having metal spikes, lugs, cleats or bands projecting from the surface of the wheel or tire of such Vehicles or any Vehicle having a stud tractor tread. Studded snow tires are exempted.
- 8.2 Section 8.1 does not apply to any Vehicle owned or operated by the Town, a public utility or agents of either the Town or a public utility.

## 9.0 SPECIAL CLASSES OF VEHICLES
- 9.1 No Driver of a Vehicle shall Park a Vehicle on any Highway within the Town, where the Vehicle is over eight (8) metres in length, excluding attachments, other than in areas designated by the CAO or a Traffic Control Device for such purposes.
- 9.2 No Driver of a Vehicle shall Park a Vehicle on any Highway within the Town where the Vehicle is over two (2) metres in width, other than in areas designated by the CAO or by a Traffic Control Device for such purposes.
- 9.3 No Driver of a Vehicle shall apply or engage engine retarder brakes on any Truck in any part of the Town.
- 9.4 The provisions of sections 9.1 and 9.2 do not apply to Recreational Vehicles, however Owners must remain in compliance with section 6 of this Bylaw.
- 9.5 No Driver of a Vehicle shall drive a Motor Vehicle on a Highway, with or without attachments, where the box of the Motor Vehicle, the Trailer, or the body of the Vehicle is filled with refuse, sand, gravel, rocks, earth or other loose material, whether similar or dissimilar, unless the box, Trailer or body is completely covered and secured by a tarpaulin or other covering.
## 10.0 PARKING ON PRIVATE PROPERTY
- 10.1 No Owner or Operator of a Vehicle shall Park or permit Parking of the Vehicle on any private property that has been clearly marked as such by a sign or signs posted thereon without the prior permission of the Owner, tenant, occupant, or Person in control of the property.
## 11.0 ABANDONMENT OF VEHICLE
- 11.1 Any Vehicle left on a Highway for more than seventy-two (72) consecutive hours without moving, may be deemed to be abandoned.
- 11.2 Any Vehicle left on public or private property for more than seventy-two (72) consecutive hours without the consent of the Owner or Person in possession or control of the property may be deemed to be abandoned.
## 12.0 IDLING OF VEHICLES
- 12.1 No Person shall cause, permit or allow a Motor Vehicle to idle for more than five minutes total in any continuous thirty-minute period on any Highway, or within ten (10) metres of a place designated as a learning institution or medical facility.
- 12.2 Section 12.1 shall not apply to:
- (a) any emergency or enforcement Vehicle;
- (b) Vehicles when the outdoor temperature is less than Zero degrees Celsius (0°C) and only to allow safe Vehicle operation and to maintain clear windows; or

- (c) Vehicles in which the engine is used to operate auxiliary equipment or machinery that is essential to the basic function of the Vehicle and/or Vehicles containing equipment or machinery that must be operated inside or in association with the Vehicle.
## 13.0 PARKING BANS
- 13.1 The CAO, when in the opinion of the CAO it is necessary to do so, may declare a Parking Ban by providing public notification of such Parking Ban.
- 13.2 Unless a matter of public safety, notification of the Parking Ban will be no less than 24 hours in advance of the Parking Ban being in effect:
- (a) for the specified times; and
- (b) for the specified locations; and
- (c) as declared in the public notification unless:
- (i) sooner terminated; or
- (ii) further extended;
- (iii) by a subsequent Parking Ban declaration.
- 13.3 Reasonable notice of a Parking Ban is met if one or more of the following occurs:
- (a) posting of a Traffic Control Device on the Highway;
- (b) posting on the Town's webpage;
- (c) posting on the Town's social media site;
- (d) radio station announcement; or
- (e) publishing in the local newspaper.
- 13.4 No Person shall Park, or permit the Parking of, any Vehicle in a location specified in a declared Parking Ban, at any time during a declared Parking Ban.
- A Parking Ban is in effect until the portable notification Traffic Control Devices are removed. All methods of notification of the Parking Ban declaration will be used to notify of the conclusion of the Parking Ban.
## 14.0 "TEMPORARY REPAIRS AND HIGHWAY MAINTENANCE
- 14.1 The CAO may cause movable signs to be placed on or near a Highway to restrict Parking during emergency street repairs, general maintenance, snow removal, street cleaning and utility repair and when so marked, such signs shall take precedence over all other Traffic Control Devices.
- 14.2 The Town shall ensure that any temporary signage that limits Parking on a specific Highway or area is installed no less than twenty-four (24) hours prior to when the commencement of work is scheduled to begin. The notification requirements of this section shall not apply to emergency street or utility repairs.

- 14.3 The Town must use reasonable means to attempt to notify Persons residing adjacent to or that use that Roadway of the impending Parking restrictions of the Roadway. The means of notifying Vehicle Owners may include any of the following:
- (a) posting of a Traffic Control Device on the Highway;
- (b) posting on the Town webpage;
- (c) posting on the Town social media site;
- (d) publishing in the local newspaper;
- (e) radio station announcement;
- (f) attaching a warning tag to the Vehicle prior to the commencement of work;
- contacting the registered Owner, at the phone number listed on the Owner's Driver's licence; or
- (h) if the Owner of the Vehicle resides within the Town of Diamond Valley, attending the residence listed on the Vehicle's certificate of registration.
- 14.4 No Owner of a Vehicle shall Park a Vehicle or permit a Vehicle to be Parked on a Highway from the time a sign or signs referred to in section 14.3 have been placed, and until such sign or signs have been removed.
- 14.5 The failure to remove a Vehicle from the Highway, as directed in section 14.4 of this Bylaw, shall be an offence pursuant to this Bylaw, which may result in the issuance of a Violation Tag and the impoundment of the Vehicle.
- 14.6 Where the Vehicle was Parked prior to the placement of the signs referred to in section 14.3, no Driver of a Vehicle shall leave that Vehicle Parked or permit that Vehicle to remain Parked on the Highway after the expiration of 24 hours from the time the sign or signs were placed, and until such sign or signs have been removed.
## 15.0 EXEMPTION FROM PARKING PROVISIONS
- 15.1 Notwithstanding anything elsewhere contained in this Bylaw the provisions relating to Stopping or Parking of Vehicles do not apply to:
- (b) service Vehicles used in conjunction with the servicing of public utilities including telephone systems, electrical systems, natural gas systems;
- (c) municipal and other Government Public Works Vehicles;
- (d) funeral cars; or
- (e) towing Vehicles;
while any such Vehicle is being used in work that requires the Vehicle to be Parked at that location.
- 15.2 Where the Owner or Operator of a Vehicle Stops, stands, or Parks pursuant to section 15.1 or contrary to other provisions of this Bylaw they shall take due precaution to indicate the presence of such Vehicle on any Roadway while so Parked or Stopped.
- 15.3 Notwithstanding anything in this Bylaw, the CAO may issue a permit exempting a Vehicle for any period of time and from such provisions of this Bylaw pertaining to Stopping or Parking

Vehicles as may be specified therein, which permit shall not be valid unless attached to the inside of the Vehicle in respect of which it is issued so as to be clearly legible from the outside thereof.
## 16.0 SPEED LIMITS
- 16.1 No Person shall drive a Motor Vehicle in or on any Alley at a speed greater than 15 km/h.
- 16.2 No Person shall drive a Motor Vehicle in a playground zone at a speed greater than 30 km/h.
- 16.3 No Person shall drive a Motor Vehicle in a school zone at a speed greater than 30 km/h.
- 16.4 Upon third reading of this Bylaw, the speed limit for all Roadways included in that portion of the Town of Diamond Valley formerly known as the Town of Turner Valley shall be 40 km per hour, unless otherwise posted.
- 16.5 Effective September 1, 2024, the speed limit for all Roadways throughout the Town of Diamond Valley shall be 40 km per hour, unless otherwise posted.
## 17.0 PARADES, PROCESSIONS AND SPECIAL ROADWAY EVENTS
- 17.1 No Person shall hold or take part in any Parade, Procession or Special Roadway Event unless authorized in writing by the CAO.
- 17.2 Notwithstanding section 17.1, funeral and military Processions do not require a permit; however, organizers may contact the Town for traffic assistance if deemed necessary.
- 17.3 Where a permit has been granted for a Parade, Procession or Special Roadway Event, a Person must not join or otherwise interfere with the Parade, Procession or Special Roadway Event without the permission of the permit holder.
- 17.4 A Person who joins or otherwise interferes with a Parade, Procession or Special Roadway Event, without permission from the permit holder must depart the immediate area of the Parade, Procession or Special Roadway Event after having been directed to do so by a Peace
- 17.5 The CAO may issue a permit for the Parade, Procession or Special Roadway Event and may impose conditions on a Parade, Procession or Special Roadway Event including specifying the route to be followed, the time that the Parade, Procession or Special Roadway Event will take place, the type of Vehicles, floats, animals, displays or other things that will be allowed to take part, and any other conditions that the CAO deems necessary.
- 17.6 A permit holder must comply with all conditions set out in the permit. Where the permit holder fails to comply with the conditions set by the CAO, the CAO may cancel the permit.
- 17.7 Where an application has been approved with conditions, or refused, an applicant may make an appeal to Council, by written submission to be included on the next open Regular Council

Meeting Agenda. Council may uphold, repeal or modify the decision of the CAO. The decision of Council is final.
- 17.8 Where a permit has been granted for a Parade, Procession or Special Roadway Event despite any provisions of this Bylaw, a Person or Persons may congregate on the Sidewalks or a portion of a Roadway designated for that purpose to view the Parade or participate in the Special Roadway Event;
- 17.9 Where permission is obtained allowing floats, Vehicles or animals to be placed in or on the route of a Parade, the Person or Persons sponsoring the Parade shall indemnify and save harmless the Town from and against any and all claims for injury to any Person or Persons and damage to any real or personal property arising by reason of or in any way connected with the entry, placing or operation of the Vehicle or float in the Parade or Procession whether prior to, during or after the Parade or Procession, and whether arising out of, or directly or indirectly caused by, any act, omission or negligence of the Town, its employees or agents.
- 17.10 Notwithstanding section 17.9 of this Bylaw, the Driver or Operator of the Vehicle or float and all Persons on such Vehicle or float taking part in the Parade or Procession shall ensure that:
- (a) no part of the Vehicle or float will damage the Roadways, electric or telephone poles or wires, streetlights, cables or supports, traffic signal lights or signs, fire hydrants, or any other property of the Town or a public utility in, upon, over or beside a Roadway;
- (b) the Vehicle, the float or anything thereon or attached thereto will not injure any Person or cause damage to any real or personal property; and
- (c) no portion of the Vehicle, or float, and nothing erected, placed on or attached to the Vehicle or the float will come in contact with any telephone wire or any wire charged with or carrying out electric current.
## 18.0 PEDESTRIANS, SIDEWALKS, HORSE-DRAWN CARRIAGES, CYCLISTS
- 18.1 No Person shall run or race on any Highway or Sidewalk in a manner that is distracting or dangerous to other people. This section shall not apply to any organized or authorized road race that has been approved by the Town.
- 18.2 No Person shall:
- (a) throw any dangerous objects, stones, refuse, litter, snowballs or other objects onto or over any Highway;
- (b) use any bow and arrow or catapult or other similar mechanism on any Highway;
- (c) set off or throw any fireworks or thing of like nature onto or over any Highway or other Public Place without a permit authorizing such use by the Diamond Valley Fire Department; or
- (d) set fire to any combustible material or light a bonfire on any Highway.
- 18.3 No Person shall climb any railing or fence or tree or any post, pole or structure lawfully erected on or adjacent to a Roadway, without proper authorization.

- 18.4 No Person shall pull down, deface or destroy any sign, board or notice lawfully placed on or adjacent to any Roadway.
- 18.5 No Person shall leave, store or deposit or permit to accumulate on any Roadway or Sidewalk any article or thing that may be dangerous or in any way interfere with the proper use of the Roadway or Sidewalk or interrupt the free flow of vehicular or Pedestrian traffic, nor shall any waste paper, debris, or things be left on any Roadway, Alley, Highway, Sidewalk or Public Place in the Town.
- 18.6 Nothing shall be construed as prohibiting the assembly of Persons for the purpose of watching a Parade or Procession duly authorized by the CAO.
- 18.7 A Person operating a Bicycle on a Sidewalk shall:
- (a) yield the right of way to Pedestrians;
- (b) use a bell or other audible signal before overtaking and passing a Pedestrian; and
- (c) not operate the Bicycle in a reckless manner.
- 18.8 A Person may draw, push or propel the following, on or along a Sidewalk, in such a way as to not interfere with others using the Sidewalk:
- (a) a wheeled shopping cart or similar grocery carrier;
- (b) a baby carriage or other wheeled device for carrying a child or other Person;
- (c) a Mobility Aid; or
- (d) a Non-motorized Vehicle operated by a Person eleven (11) years of age and under, or a Bicycle operated by a Person over twelve (12) years of age who is accompanying a Person eleven (11) years of age or under who is operating a Non-motorized Vehicle. Notwithstanding the above, a Power-assisted Bicycle may be operated on a Pathway, with the power-assist function engaged, subject to section 18.7.
- 18.9 No Person shall ride a horse or any other animal upon a Sidewalk or Boulevard.
- 18.10 The Person operating or in charge of any horse-drawn Vehicle on a Highway shall remain upon such Vehicle while it is in motion or shall walk beside the horse drawing such Vehicle.
- 18.11 No Person shall place any electric cord, hose, ropes, pipe or similar obstruction above or across a Sidewalk or Boulevard.
- 18.12 Skateboards may be used or operated on or at any Public Place unless such activity is prohibited by a sign posted with such restriction or prohibition. Operation of Skateboards in or on a Public Place is subject to the following conditions:
- (a) the use of Skateboards does not damage the Public Place; and
- (b) the use of Skateboards does not unnecessarily impede or endanger Pedestrians.
- 18.13 No Person under the age of 18 shall operate or ride as a passenger on a Bicycle unless that Person is properly wearing a safety helmet that meets ANSI, Snell or CSA standards.

## 19.0 OFF-HIGHWAY VEHICLES
- 19.1 No Person shall operate any Off-Highway Vehicle on a Highway, Public Place or within the areas designated as parks or urban reserve within the Town.
## 19.2 Section 19.1 shall not apply to:
- (a) a Person engaged in the act of loading and unloading an Off-Highway Vehicle from or onto a Trailer or Vehicle;
- (c) any Vehicles owned or leased by or in service of the Town and employed on the business of the Town;
- (b) any Peace Officer in the performance of their duties;
- (d) a Person driving an Off-Highway Vehicle in accordance with section 120(3) of the Traffic Safety Act; or
- (e) any commercial entity, that is utilizing the Vehicle solely for the purpose of snow clearing on a commercial property or the Sidewalks adjacent to that property.
- 19.3 No Person shall operate or allow anyone to operate an Off-Highway Vehicle on Private Property unless permission or authorization of the Owner or Person having possession or control of the property has been given for such operation of an Off-Highway Vehicle.
## 20.0 WEIGHT RESTRICTIONS
- 20.1 No Person shall operate a Commercial Vehicle, Heavy Vehicle or Truck on a Highway under the direction, control, and management of the Town other than in accordance with the weight limitations as specified in the Traffic Safety Act, and regulations made under the authority of this Bylaw.
- 20.2 No Person shall Park any Commercial Vehicle, Heavy Vehicle or Truck upon any Highway except where such Parking is expressly permitted, except for the purpose of loading or unloading such Vehicle.
- 20.3 The CAO may require any Person desiring to haul goods and materials on a local Roadway to provide such security to the Town to ensure compliance with the terms of any overweight permit.
- 20.4 Any Person issued an overweight permit, issued under the authority of this Bylaw shall at all times ensure that the conditions attached to any overweight permit are complied with. Failure to comply with this Bylaw will make the issued permit null and void.
- 20.5 Any Person issued an overweight permit shall produce it on demand of a Peace Officer.
## 21.0 TRUCK ROUTES
- 21.1 The designated Truck Routes in the Town of Diamond Valley shall be as shown on attached Schedule "B".

- 21.2 No Person shall operate a Heavy Vehicle or Truck outside of the designated Truck Routes within the Town limits.
- 21.3 Section 21.2 shall not apply to Heavy Vehicles or Trucks required to exit the designated Truck Routes for the purposes of loading or unloading goods/supplies, or providing some work or service provided that the Driver takes the most direct accessible connection between the nearest Truck Route and the destination and returns to the Truck Route using the same connection.
- 21.4 No Heavy Vehicle or Truck is permitted to be Parked in a residential area, unless that Truck is in the process of being loaded or unloaded, or actively involved in construction or demolition at that exact location.
## 22.0 SUNDRY RESTRICTIONS
- 22.1 No Person shall drive, operate or allow to be driven or operated, any Vehicle or equipment of any nature or kind in such a manner as to track a substance or material upon a Highway.
- 22.2 Any Person who tracks a substance or material upon a Highway shall, in addition to the penalties specified, be liable to clean up or remove the substance or material tracked upon the Highway in default of which the Town may clean up or remove such substance or material at the expense of the Person who tracked the substance or material.
- 22.3 No Person shall place, cause or allow an industrial or commercial waste container, a storage container, or any other obstruction upon a Highway unless they have obtained a Permit.
- 22.4 No Person shall place, cause or allow a driveway aid, or sporting equipment, such as but not limited to basketball or hockey nets, upon a Highway from November 1 to April 30.
- 22.5 No Person shall offer, sell or display goods or place any temporary or permanent structure relating to the offering, selling or displaying of such goods on a Roadway, unless they have obtained a permit.
- 22.6 No Person shall Park on a Highway a Vehicle displayed for sale or a Vehicle displaying advertising directing Persons to any private property, business or commercial establishment unless a permit is first obtained from the Town. This section shall not apply to Vehicles advertising a garage sale or a real estate open house.
- 22.7 No Person shall place or allow to be placed upon a Highway or upon an abutting Public Place, including public walks and trails, a sign which displays advertising directing Persons to any private property, business or commercial establishment, unless they have obtained a permit.
- 22.8 Any sign placed on or beside a Highway or upon an abutting Public Place without a permit shall be liable for removal by the Town and must be claimed within thirty (30) days of removal.
- 22.9 No Person shall post or affix a sign on any Street Furnishing unless they have obtained a permit. The Town may remove and destroy any sign posted or affixed in contravention of this Bylaw.

- 22.10 In the absence of evidence to the contrary, if the sign indicates that the event therein is being promoted by a specific Person, then that Person shall be presumed to have authorized and caused its posting or affixing.
- 22.11 In the absence of evidence to the contrary, the Person who is promoted by a sign shall be presumed to have authorized and caused its posting or affixing.
## 23.0 AUTHORITY OF PEACE OFFICER
- 23.1 In case of fire or other emergency, or in order to expedite traffic or safeguard Pedestrians, Peace Officers are hereby authorized to direct traffic in such manner as they deem necessary, whether or not in conformity with the provisions of this Bylaw.
- 23.2 In case of fire or other emergency, if no Peace Officer is present, officers of the fire department are hereby authorized to direct traffic in such manner as they deem necessary, whether or not in conformity with the provisions of this Bylaw.
- 23.3 In case of a fire or other emergency, every Person shall comply with any traffic signal or direction of a Peace Officer or of any officer of the fire department.
- 23.4 Every Peace Officer is duly authorized and entitled to place an erasable chalk mark on the tread surface of the tire of a Parked or Stopped Vehicle without that Peace Officer or the Town incurring any liability for doing so, in order to enforce the Parking provisions of this Bylaw.
- 23.5 Every Peace Officer is duly authorized and entitled to place a sticker on the Driver's side glass window of a Parked or Stopped Vehicle without that Peace Officer or the Town incurring any liability for doing so, in order to enforce the Parking provisions of this Bylaw.
- 23.6 A Peace Officer is hereby authorized and empowered to issue a Violation Tag or Violation Ticket to any Person who is believed on reasonable and probable grounds to have contravened any provisions of this Bylaw.
- 23.7 In accordance with section 77 of the Traffic Safety Act, a Peace Officer may tow and impound any Vehicle found to be Parked in contravention of any provisions of this Bylaw. Such Vehicle shall not be released from impoundment before the costs of impoundment, towing and storage have been paid.
## 24.0 AUTHORITY OF CAO
## 24.1 The CAO is hereby duly authorized to:
- (a) prescribe where Traffic Control Devices, either permanent or temporary are to be located;
- (b) authorize the placing, marking or erection of Traffic Control Devices. The CAO shall cause such devices to be placed correctly such that they are clearly recognizable in all reasonable light and weather conditions;
- (c) designate Crosswalks upon any Highway in the Town, and to mark same;

- (d) designate Highway Intersections or other places on a Highway as a place at which no left-hand turn or no right-hand turn or both may be made, and shall cause the said place to be indicated by a Traffic Control Device, provided however that a Traffic Control Device may allow for special classes of Vehicles to make such turns;
- (e) designate any Highway or any part of a Highway for one-way traffic and shall cause the same to be marked with Traffic Control Devices;
- (f) designate any Highway as one that is closed temporarily in whole or in part to traffic, and shall cause the Highway to be marked as such;
- (g) designate any Highway as one to be divided into Traffic Lanes of such number as are considered proper;
- (h) designate angle Parking, parallel Parking or no Parking on any Highway and to cause the same to be marked by Traffic Control Devices;
- (i) reduce weight limits upon Highways in the case of unfavourable road conditions provided however that:
- (i) when an emergency situation or pressing requirement exists, Heavy Vehicles exceeding the posted percentage gross Vehicle weight may operate on posted Highways subject to being given a permit signed by the CAO, or a Peace Officer, or a member of the RCMP, and;
- (ii) Vehicles weighing up to and including three thousand (3,000) kilograms will be allowed to operate loaded without a permit;
- (i) prohibit or restrict by Traffic Control Devices, the movement of Vehicles from a private driveway onto a Highway or from a Highway onto a private driveway where such prohibition or restriction is deemed advisable in the public interest and for the better regulation of traffic;
- (k) designate "School Zones" and "Playground Zones" and cause such zones to be marked with Traffic Control Devices;
- (I) designate portions of any Highway where a school bus is allowed to use flashing lights or a Stop arm;
- (m) establish Vehicle speed limits on Roadways and cause Traffic Control Devices to be erected indicating those speed limits;
- (n) prescribe where emergency or construction Traffic Control Devices are to be located on any Highway, and cause the same to be marked;
- (0) designate distances from any Intersection within which no Parking is allowed and cause same to be marked with Traffic Control Devices;
- (q) designate Highways or any portion thereof as passenger or Vehicle loading zones for such time limits as appropriate and cause same to be marked by Traffic Control Devices;
- (p) designate certain Parking locations for the exclusive use of Persons with disabilities and cause same to be marked by pavement markings or Traffic Control Devices;
- (r) designate portions of a Highway where Parking is limited to a period of time and cause same to be marked by Traffic Control Devices;
- (t) designate Highways as restricted for the purposes of this Bylaw;
- (s) authorize the creation of any Vehicle access onto a Highway;
- (u) designate Highways as Truck Routes;
- (v) declare a Parking Ban on Highways;
- (w) authorize the operation of Off-Highway Vehicles within the Town for the purpose of maintenance or public security;
- (x) issue overweight permits on behalf of the Town;

- (y) authorize the operation of motorized Vehicles within areas designated as parks or urban reserve within the Town for the purpose of maintenance or public security;
- (z) issue and establish terms and conditions to be met for a permit under any section of this Bylaw that requires a permit; and
- (aa) delegate any powers, duties or functions under this Bylaw to an employee of the Town.
## 25.0 OBSTRUCTION
- 25.1 No Person shall resist or willfully obstruct or attempt to obstruct a Peace Officer or a member of a Fire Department in the lawful execution of their duties.
## 26.0 MINIMUM AND SPECIFIED PENALTIES
- 26.1 Any Person who contravenes any provision of this Bylaw is guilty of an offence and is liable on summary conviction to a fine of not more than Ten Thousand ($10,000) Dollars or in default of payment one (6) months imprisonment, or to both fine and imprisonment in such amounts.
- 26.2 Where a Peace Officer believes that a Person has contravened any provision of this Bylaw, they may commence proceedings by issuing a Violation Ticket in accordance with the Provincial Offences Procedure Act, R.S.A. 2002, c. P-34.
- 26.3 Where there is a minimum penalty listing for an offence in Schedule "A" to this Bylaw, that amount is the minimum penalty for the offence.
- 26.4 Where there is a specified penalty listing for an offence in Schedule "A" to this Bylaw, that amount is the specified penalty for the offence.
- 26.5 Notwithstanding sections 26.3 and 26.4 of this Bylaw, the minimum and specified penalties for a second offence against this Bylaw within a one (1) year period shall be double the amounts listed in Schedule "A" for the offence, and the minimum and specified penalties for a third or subsequent offence against this Bylaw within a one (1) year period shall be triple the amounts listed in Schedule "A" for the offence.
- 26.6 A Peace Officer may seize and impound, for a period not exceeding 60 (sixty) days, any Nonmotorized Vehicle, or other similar device used or operated in contravention of this Bylaw.
- 26.7 Where a Non-motorized Vehicle, or other similar device has been seized and impounded by a Peace Officer as provided for in this Bylaw, the Owner or Operator of such seized device shall, aside from any fine or penalty to which they may be subject, be liable for all reasonable costs incidental to the seizure and impounding of the device.
## 27.0 SEVERABILITY
- 27.1 It is the intention of the Town Council that each provision of this Bylaw should be considered as being separate and severable from all other provisions. Should any section or provision of this Bylaw be found to have been improperly enacted, or otherwise of no force or effect, then such section or provision shall be regarded as being severable from the remainder of this Bylaw, and that the Bylaw remaining after such severance shall remain of full force and effect.

## 28.0 STRICT LIABILITY OFFENCE
- 28.1 Any Person who contravenes any provision of this Bylaw by:
- (a) doing any act or thing which the Person is prohibited from doing; or
is guilty of an offence and any offence created pursuant to this Bylaw is a strict liability offence for the purposes of prosecution under this Bylaw.
- (b) failing to do any act or thing the Person is required to do;
## 29.0 REPEAL OF PRIOR BYLAWS
- 29.1 This Bylaw repeals the following Bylaws in their entirety and all amendments thereto:
- (a) Town of Black Diamond "Traffic Bylaw" 2021-09; and
- (b) Town of Turner Valley "Traffic and Parking Control Bylaw" 20-1106.
## 30.0 GENERAL PROVISIONS AND COMING INTO FORCE
- 30.1 If any term, clause or condition of this Bylaw or the application thereof is found to be invalid or unenforceable, the remainder of this Bylaw or application of such term, clause or condition shall not be affected and shall remain in force and effect.
- 30.2 Nothing in this Bylaw relieves any Person from compliance with any other Bylaw or any applicable federal or provincial law, regulation or enactment.
- 30.3 In the event of a conflict between this Bylaw and any other Bylaw or any applicable federal or provincial law, regulation or enactment respecting public health and safety, the other Bylaw, law, regulation or enactment shall prevail to the extent of the conflict.
- 30.4 This Bylaw shall come into force and effect on the date of third and final reading.
