September 9, 2013 Bylaw 481-13 A BY-LAW OF THE VILLAGE OF HEISLER, IN THE PROVINCE OF ALBERTA, FOR THE REGULATION AND CONTROL OF VEHICLE, ANIMAL AND PEDESTRIAN TRAFFIC. WHEREAS, pursuant to Section 13 of the Traffic Safety Act, 2000 a Council may make bylaws for the regulation and control of vehicle, animal and pedestrian traffic; NOW THEREFORE, the Council of the Village of Heisler duly assembled ENACTS as follows: SECTION 1, INTERPRETATION AND DEFINITIONS 1.1 This By-Law shall be cited as the "Traffic By-Law". 1.2 Alley means a narrow roadway intended chiefly to give access to the rear of buildings and parcels of land. 1.3 Boulevard means the area between a roadway and a sidewalk. 1.4 Bylaw Officer means the person contracted by the Village to enforce bylaws within the Village. 1.5 Chief Administrative Officer means the Chief Administrative Officer for the Village of Heisler 1.6 Council means the elected officials forming the municipal council of the Village of Heisler. 1.7 Crosswalk means the part of a Roadway at an Intersection included within the connection of the lateral lines of the Sidewalks on opposite sides of the roadway measured from the curbs or, in the absence of curbs, from the edge of the Roadway; or the part of a Roadway at an Intersection or elsewhere distinctly indicated for Pedestrian crossing by signs or by line or other markings on the road surface. 1.8 Curb means the actual curb, if there be one, and should there be no curb in existence, shall mean the division of a roadway between that parts thereof intended for the use of vehicles and that part thereof intended for the use of Bylaw 481-13 Village of Heisler 2 pedestrians. 1.9 Entity means an enforcement agency that is not employed by or contracted by the Village. This can include but is not limited to Royal Canadian Mounted Police and Peace Officers. 1.10 Highway means any thoroughfare, street, road, trail, avenue, parkway, alley, driveway, viaduct, lane, square, bridge, causeway, trestle-way or other place, whether publicly or privately owned. 1.11 Motor Vehicle means a vehicle propelled by any power other than muscular power. This does not include a bicycle, a power bicycle, an aircraft, an implement of husbandry or a motor vehicle that runs only on rails. 1.12 Person means an individual, proprietorship, partnership, and or a corporation. It shall also include but is not limited to church organization, non-profit organizations. Professionals, provincial and federal governments. 1.13 Roadway means that portion of a Highway intended for vehicular traffic. 1.14 Sidewalk means that part of a Highway especially adapted to the use of or ordinarily used by Pedestrians, and includes that part of a Highway between the Curb line (or the edge of the Roadway, where there is no Curb line) and the adjacent property line, whether or not paved or improved. 1.15 Trailer means a vehicle so designated that it may be attached to or drawn by a Vehicle and intended to transport property or persons and includes any trailer that is designed, constructed and equipped as a dwelling place, living abode or sleeping place, either permanently or temporarily, but does not include machinery or equipment used in the construction or maintenance of Highways. 1.16 Traffic Control Device means any sign, signal, marking, or device whether manually, electrically or mechanically operated placed, marked or erected under the authority of this Bylaw for the purposes of regulating, warning or guiding traffic. 1.17 Village means the Municipal Corporation of the Village of Heisler, in the Province of Alberta or where the context requires a duly authorized official of Bylaw 481-13 Village of Heisler 3 the Municipal Corporation of the Village of Heisler or where the context requires the area that is contained in the boundaries of the Village of Heisler. 1.18 Vehicle means a device in, on or with which a person or thing may be transported or drawn on a Highway. SECTION 2, SCOPE 2.1 The Village Council is hereby delegated the power to: a) Prescribe where traffic control devices are to be located including traffic control devices restricting the speed of vehicles and such traffic control devices shall be deemed to have been made by a by-law of the Village of Heisler, and shall provide for a record of all the locations to be kept which shall be open to public inspection during normal business hours. b) To control the use of all highways within the municipal boundaries. 2.2 With the passing of this Bylaw all enforcement agency personal, which includes Royal Canadian Mounted Police, Peace Officers, Municipal By law Enforcers as well as contracted or otherwise Municipal Police Services, can issue tickets where the person(s) responsible for breaking the provisions of this bylaw will pay the respected fining enforcement agency. SECTION 3. TRAFFIC CONTROL DEVICES 3.1 Unless required or permitted by the Traffic Safety Act or by this by-law or by a traffic control device, or in compliance with the direction of a Peace Officer, or to avoid conflict with other traffic, a driver shall not stop or park his vehicle: a) On a sidewalk or boulevard. b) On a crosswalk or on any part of a crosswalk. c) Within an intersection other than immediately next to a curb in a "T" intersection. Bylaw 481-13 Village of Heisler 4 d) At an intersection nearer than 1 meter to the projection of the corner property line immediately ahead or immediately to the rear, except when a vehicle is parked in a space where a parking meter or other control device indicates parking is permitted. e) Within 1 meters on the approach to a stop sign or yield sign. f) Within 2 meters of any fire hydrant or when the hydrant is not located at the curb, within 2 meters of the point on the curb nearest the hydrant. g) In a way that would block access to a garage, private road or driveway, or a vehicle crossway over a sidewalk. h) Within 1 meters of the nearside of a marked crosswalk. i) Alongside or opposite any street excavation or obstruction when the stopping or parking would obstruct traffic. j) At any other place where a traffic control device prohibits stopping or parking during the times stopping or parking is so prohibited. k) On the roadway side of a vehicle parked or stopped at the curb or edge so prohibited. l) At or near the site of any fire, explosion, accident or other incident, if stopping or parking would obstruct traffic or hinder police officers, firemen, ambulance drivers or assistants, or rescue officers or volunteers. m) In any alley when the stopping or parking would obstruct traffic, except when standing temporarily for the purpose of engaged loading or unloading. 3.2 The marking of a curb with yellow paint shall be deemed to be a traffic control device to prohibit stopping/parking on the roadway immediately adjacent to the marked curb. SPEED LIMITS 4.1 The speed limit of all vehicular traffic within the Village limits will be 30 (thirty) kilometers per hour or less depending on road conditions except on the following roadways. 4.1.1 Lougheed Avenue (highway 855 within the municipal limits) previously known as Railway Avenue will have a speed limit of 60 (sixty) kilometers per hour or less depending on road conditions. SECTION 5. MISCELLANEOUS VIOLATIONS 5.1 No person shall park a vehicle on Main Street when gross vehicle weight exceeds 7500 kilograms. 5.1.1 The route for vehicles over a gross weight exceeding 7500 kilograms within the Village shall be Manning Avenue, Sifton Street, Lougheed Avenue and Strom Street. 5.3 No person shall drive in a manner that is, under the discretion of an entity, dangerous in anyway. SECTION 6. FEES AND FINES 6.1 Any person who contravenes any provision of this Bylaw and is found guilty of an offence is subject to provincial and federal law and will be fined accordingly. 6.2 The fines and fees are found on the attached Schedule "A" 6.3 If an entity that is not employed or contracted by the Village should find a person breaking this bylaw the fine or fee will follow that entities rubric in the case that a person's actions breaks provincial or federal law. 6.4 Bylaw Violation Tags may be placed on offending vehicles or given to offending drivers or pedestrians by entities or by a bylaw officer. Bylaw 481-13 Village of Heisler 6 SECTION 7, SCHEDULES 7.1 The fines and fees are found on the attached Schedule "A" 7.2 Schedule "B" will be the locations of the Traffic Control Devices SECTION 8, PAST AND CURRENT BYLAWS 8.1 With the passing of this By-Law, By-Law 460-11 is hereby repealed.
