Village of Holden Traffic Bylaw - No. 4-2017 Page 1 of 1 BYLAW NO. 4-2017 A BYLAW OF THE VILLAGE OF HOLDEN IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF REGULATING AND CONTROLLING TRAFFIC WITHIN THE MUNICIPALITY WHEREAS the Traffic Safety Act R.S.A. 2000, c. T-6, as amended or repealed and replaced from time to time, authorizes a municipal council to pass Bylaws not inconsistent with the Traffic Safety Act, respecting Highways under its direction, control and management, for the regulation and control of traffic within the boundaries of the Municipality; AND WHEREAS, the Council for the Municipality deems it to be in the best interests of the public to regulate traffic within the Municipality; NOW THEREFORE, the Council of the Village of Holden, duly assembled, enacts as follows: 1. SECTION 1- SHORT TITLE 1.1 This Bylaw may be cited as the "Traffic Bylaw" 2. SECTION 2- DEFINITIONS 2.1 "Alley" means a narrow Highway intended chiefly to give access to the rear of buildings and parcels of land 2.2 "Boulevard" means that part of a Highway in an urban area that is not Roadway and is that part of the Sidewalk that is not especially adapted to the use of or ordinarily used by pedestrians. 2.3 "Bylaw Enforcement Officer" shall mean a person appointed by the Municipality pursuant to the provisions of the Municipal Government Act and may include a Peace Officer or a member of the Royal Canadian Mounted Police; 2.4 "CAO" means the Chief Administrative Officer of the Municipality and whatever subsequent title may be conferred on that officer by Council or statute, or his designate; 2.5 "Council" means the Council of the Municipality; 2.6 "Curb" means the actual Curb if there is one, and if there is no Curb in existence, shall mean the division of a Highway between the Roadway and a Boulevard or Sidewalk. 2.7 "Highway" means any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, Alley, square, bridge, causeway, trestle way or other place or part of any of them, whether publicly or privately owned, that the public is ordinarily entitled or permitted to use for the passage or parking of Vehicles and includes: a) A Sidewalk, including a Boulevard adjacent to the Sidewalk; b) If a ditch lies adjacent to and parallel with the Roadway, the ditch, and c) If a highway right of way is contained between fences or between a fence and one side of the Roadway, all the land between the fences, or all the land between the fence and the edge of the Roadway, as the case may be. 2.8 "Land Use Bylaw" means the Municipality's Land Use Bylaw, Bylaw No. 3-2013, as amended or repealed and replaced from time to time; 2.9 "Municipality" shall mean Village of Holden 2.10 "Municipal Government Act" means the Municipal Government Act, R.S.A. 2000, c. M-26, as amended or repealed and replaced from time to time; Village of Holden Traffic Bylaw - No. 4-2017 Page 2 of 2 2.11 "Over-dimension Vehicle" means a Vehicle, without or without a load, exceeding the maximum length, height or weight, or combination thereof, as established in Schedule "B" of this Bylaw, but does not include Recreational Vehicles. 2.12 "Parade" or "Procession" means a group of Vehicles, animals, pedestrians or combination thereof on a Highway which is likely to block, obstruct, impede, hinder or otherwise interfere with pedestrian or vehicular traffic, excluding a funeral procession and military parade. 2.13 "Provincial Offences Procedure Act" means the Provincial Offences Procedure Act, R.S.A. 2000, c. P-34, as amended or repealed and replaced from time to time; 2.14 "Recreational Vehicle" means a Vehicle or Trailer that is designed, constructed and equipped, as temporary accommodation for travel, vacation or recreational use, and without limiting the generality of the foregoing includes travel trailers, motor homes, slide-in campers, chassis- mounted campers and tent trailers. 2.15 "Roadway" means that part of a Highway intended for use by vehicular traffic. 2.16 "Sidewalk" means that part of a Highway especially adapted to the use of or ordinarily used by pedestrians and includes that part of a Highway between the Curb line or where there is no Curb line, the edge of the Roadway and the adjacent property line, whether or not it is paved or improved. 2.17 "Traffic Control Device" means any sign, signal, marking or device placed, marked or erected under the authority of this Bylaw, whether on permanent or temporary basis, for the purposes of regulating, warning or guiding traffic. 2.18 "Violation Tag" means a tag or similar document issued by the Municipality pursuant to the Municipal Government Act; 2.19 "Violation Ticket" means a ticket issued pursuant to Part 2 of the Provincial Offences Procedure Act and any Regulations thereunder. 2.20 "Vehicle" means a vehicle propelled by any power other than muscular power but does not include a bicycle, a power bicycle, an aircraft, an implement of husbandry or a vehicle that runs only on rails; 3. SECTION 3- TRAFFIC CONTROL DEVICES 3.1 Every person shall obey the instructions of all Traffic Control Devices authorized under this or any other Bylaw, unless otherwise directed by a Bylaw Enforcement Officer. 3.2 The necessity and location of Traffic Control Devices within the Municipality will be decided by resolution of Council including, but not limited to: a) Prescribing the location and placement of stationary Traffic Control Devices in the Municipality; b) Designating crosswalks upon any Highway and causing the same to be marked with signs, lines painted on the Highway surface, or both; c) Designating any Highway intersection or other place on a Highway as a place at which left hand turns, right hand turns, or turning generally, is prohibited, and directing the placement of signs, barricades or other devices at such locations to indicate the nature of the prohibition; d) Designating "School Zones" and "Playground Zones" and causing such zones to be marked by signs posted along the Highway, by markings on the Highway surface, or both; and e) Designating any zones or locations where parking is permitted and causing signs to be erected thereon. 3.3 Measures required for temporary Traffic Control Devices and administration of all Traffic Control Devices within the Municipality is delegated to the CAO or designate including, but not limited to: Village of Holden Traffic Bylaw - No. 4-2017 Page 3 of 3 a) Directing the placement of temporary Traffic Control Devices along a portion of a Highway for the purpose of setting a temporary maximum speed limit due to construction, maintenance or a state of disrepair; b) Causing moveable signs to be placed on or near a Highway to indicate "No Parking", "Emergency Repairs", "Snow Removal" or such other temporary moveable signs deemed necessary; and c) Keeping a record of locations and placements of all Traffic Control Devices, whether stationary or temporary, and making such records available to the public for inspection during regular business hours. 3.4 No person shall park a Vehicle on a Highway in a manner contrary to the directions set out on a moveable sign, as described at section 3.3.b when such a sign has been placed on or near the Highway. 3.5 Where a person has parked a Vehicle on a Highway prior to the placement of a moveable sign as set out in section 3.3.b, the person shall move the Vehicle as soon as reasonably possible but in any event within TWENTY FOUR (24) Hours of the moveable sign being placed on or near the Highway. 3.6 No person shall remove, deface, modify or damage any Traffic Control Device, sign, board or notice lawfully placed on any street. 4. SECTION 4- SPEED 4.1 The maximum rate of speed within the Municipality shall not exceed Forty (40) kilometers per hour unless otherwise indicated by a Traffic Control Device. 4.2 Notwithstanding section 4.1 or any posted speed limit, no driver shall travel at any rate of speed that is, in the opinion of a Bylaw Enforcement Officer, unreasonable having regard to all the circumstances, including but not limited to: a) The nature, condition and use of the Highway; b) The weather or other conditions that might affect the visibility of the driver or the control of the Vehicle; c) The amount of traffic on the Highway; and d) The mechanical condition of the Vehicle or any equipment of the Vehicle. 4.3 No person shall drive a Vehicle in any Alley at a speed greater than FIFTEEN (15) kilometers per hour. 4.4 No person shall, on any school day between the hours of 7:30 am and 5:00 pm operate a Vehicle within a School Zone at a rate of speed greater than THIRTY (30) kilometers per hour. 4.5 No person shall operate a Vehicle within a Playground Zone which has the speed limit posted, at any rate of speed greater than THIRTY (30) kilometers per hour from one hour before sunrise to one hour after the following sunset each day. 5. SECTION 5- PARKING 5.1 No person shall park a Vehicle on a Highway contrary to a Traffic Control Device. 5.2 No person shall park a Vehicle on the Roadway side of a Vehicle already parked at the Curb or edge of a Highway. 5.3 No person shall park any Vehicle, trailer or Recreational Vehicle: a) On any Sidewalk, or on a Boulevard where a concrete curb, with or without gutter, is Village of Holden Traffic Bylaw - No. 4-2017 Page 4 of 4 installed; b) On a crosswalk or any part of a crosswalk or so as to obstruct the use of the crosswalk; c) In any driveway designated for use by emergency vehicles; d) Where such Vehicle will obstruct, or in any way interfere with the use of any doorway intended and marked as an emergency exit from any building abutting the Highway; e) Within FIVE (5) meters (16 feet) of any intersection corner, stop sign, or yield sign, except where otherwise permitted by a Traffic Control Device; f) Within FIVE (5) meters (16 feet) of any fire hydrant; g) In such a manner as to obstruct access to a garage, private road or driveway; h) Alongside or opposite any street excavation or obstruction when stopping or parking would obstruct traffic; i) In an area designated by a Traffic Control Device or marking as a parking place for persons with disabilities unless that person displays a disabled placard or license plate issued or recognized by the Registrar of Motor Vehicle Services; j) On the opposite side of a Highway contrary to traffic flow, including where a boulevard with no concrete curb is used for parking; or k) Over or outside of the boundary lines where the Highway surface has been marked with such lines for the purpose of delineating the boundaries of a single angle, perpendicular or parallel parking stall. 5.4 No person shall park a truck-tractor unit or Over-dimension Vehicle on any Highway within the Municipality, whether or not a trailer is attached to the truck-tractor or not, except where such parking is expressly permitted or except for the purpose of loading or unloading such Vehicle. 5.5 No person shall park a Vehicle in an Alley except where actively loading or unloading goods or passengers from the Vehicle, and provided that the Vehicle does not obstruct the Alley in a manner that prevents the passage of other Vehicles. 5.6 No person shall occupy, or use for lodging, a Recreational Vehicle that is parked on any Highway. 5.7 No person shall park a Recreational Vehicle or any type of trailer for carrying goods or equipment such as a cargo or flat-bed trailer, whether connected to a vehicle or unconnected, on a Highway for a period greater than FORTY EIGHT (48) consecutive hours. 5.8 No person shall park a Recreation Vehicle on any Highway so that it is wholly or partially blocking any access to private or public property. 5.9 No person shall park a Vehicle on private land, unless such person has obtained the permission of the owner or occupant of the land. a) An owner or occupant may report to a Bylaw Enforcement Officer, the make, model, license number and location of a Vehicle parked on private land in contravention of this Bylaw. b) A person making such a report to a Bylaw Enforcement Officer shall provide their name and contact information to the Bylaw Enforcement Officer at the time of making the report. 6. SECTION 6- PARADES AND PROCESSIONS 6.1 No person shall hold, instigate, or organize a Parade or Procession without first having obtained a permit from the CAO, or designate. A permit may specify the hours and route of the Parade or Procession and such other terms and conditions determined by the CAO, or designate, to prevent any unnecessary or unreasonable obstruction to the Highway. 6.2 The driver of the lead vehicle in a funeral Procession shall obey all Traffic Control Devices. Drivers of Vehicles following the lead Vehicle of a funeral Procession may, during daylight hours, proceed Village of Holden Traffic Bylaw - No. 4-2017 Page 5 of 5 through intersections without stopping if the Vehicle is traveling immediately behind the Vehicle in front of it, the headlamps of the Vehicle are alight and passage into the intersection can be done safely. 7. SECTION 7- SIDEWALKS & PEDESTRIANS 7.1 No person shall run, ride a bicycle, roller-skate, in-line skate, skateboard or ride a scooter upon a Sidewalk at any rate of speed that is, in the opinion of a Bylaw Enforcement Officer, unreasonable having regard to the nature, condition, use of the Sidewalk, or the amount of and nature of pedestrian traffic that is, or might reasonably be expected to be, on the sidewalk. 7.2 No person shall ride a bicycle on any sidewalk except a child's bicycle having an overall wheel diameter of less than 51 centimeters (20 inches), or a bicycle equipped with outrigger wheels while the rider is learning to ride the said bicycle. 7.3 No person shall project or throw, or cause to be projected or thrown, any stones, balls of snow or ice, or any other projectiles dangerous to the public on any sidewalk, at other pedestrians, into traffic, or onto private property. 7.4 No person shall drive on any Sidewalk except where an approved driveway or an Alley crosses the public Sidewalk. 7.5 No person shall place any goods, wares, merchandise, or other materials upon a Sidewalk, Boulevard or Roadway so as to, in the opinion of a Bylaw Enforcement Officer, obstruct pedestrian or vehicular traffic, or so as to interfere with the safe use of the Sidewalk, Boulevard or Highway, except when and where permitted by the Municipality. 7.6 No person or group of persons shall occupy a Sidewalk in any manner that, in the opinion of a Bylaw Enforcement Officer, is likely to obstruct pedestrian or vehicular traffic or to interfere with the safe use of the Sidewalk or Highway, unless permitted by the Municipality. 7.7 No pedestrian shall cross a Highway at any point other than an intersection or crosswalk. 7.8 No pedestrian shall cross an intersection or crosswalk if a Traffic Control Device prohibits such crossing. 7.9 Notwithstanding anything contained in this Bylaw, the driver of a Vehicle is not relieved of his or her obligation to exercise due care and attention to pedestrians at all times when operating a Vehicle on a Highway. 8. SECTION 8- TRUCK ROUTES 8.1 No person shall operate or park an Over-dimension Vehicle on a Highway other than on a designated truck route, as set out in Schedule "C" of this Bylaw, which may be amended by resolution of Council from time to time. 8.2 Section 8.1 shall not apply where an Over-dimension Vehicle is: a) engaged in the delivery or collection of goods, wares or merchandise to or from customers; b) going to or from any premises abutting a Highway for the purpose of servicing or making repairs to another Vehicle, and travelling along the most direct and practicable route between the business premises and the designated truck route; c) towing or hauling a non-operational Vehicle to or from a location not adjacent to a designated truck route; d) a public utility vehicle being operated for the installation, servicing or repair of public utilities; or e) the subject of a valid and subsisting permit from the Municipality allowing the Over- dimension Vehicle to drive or park on a Highway other than a designated truck route. Village of Holden Traffic Bylaw - No. 4-2017 Page 6 of 6 8.3 The CAO or his designate may impose a road ban restricting the maximum weight of classes of Vehicles travelling on the Municipality's Highways. 8.4 No Vehicle or trailer has metal spikes, lugs, cleats or bands projecting from the surface of the wheel or tire, or having caterpillar tracks or skids, may be operated on any Highway except for studded tires on passenger Vehicles. 8.5 No person shall drive an Over-dimension Vehicle or other industrial Vehicle over or onto any Curb, gutter, Sidewalk or Boulevard in such a manner as to cause damage, intentionally or unintentionally, to the Curb, gutter, Sidewalk or Boulevard. 8.6 Section 8 shall not apply to emergency Vehicles or municipal Vehicles, whether the Vehicles are owned by the Municipality or under contract with the Municipality for a specific purpose, including but not limited to snow removal, Highway construction or maintenance, or the maintenance of municipal property. 9. SECTION 9- GENERAL PROHIBITIONS 9.1 No person shall load or unload any goods, wares or merchandise across a Sidewalk or Boulevard where dedicated loading and unloading facilities are available. 9.2 No person shall allow trees, hedges or shrubs on private property or on boulevards within 4.5 meters (14.8 feet) of a Highway intersection, as measured from the corner point of the Curbs or edges of the Roadways, to grow to such a height or breadth that proper visibility for safe traffic flow is interfered with. 9.3 No person shall erect or cause to be erected, build or place a fence, wall or other object on private property within 4.5 meters (14.8 feet) of a Highway intersection, as measured from the corner point of the Curbs or edges of the Roadways, so that good visibility for safe traffic flow is interfered with. 9.4 No person shall mark any Curb, gutter, Boulevard, Roadway or Highway with paint or any other permanent marking substance except for Municipal employees. 9.5 No person shall conduct maintenance of repairs upon any Vehicle, Recreational Vehicle, or machinery or equipment in such a manner as to deposit mud, grease, oil, ice or any similar substance upon a Highway, Boulevard or Sidewalk. 9.6 Except in the event of an emergency, no person shall stop or park any Vehicle on any Highway for the purpose of performing maintenance or repairs. 9.7 The owner of a Vehicle, including Recreational and Over-dimension Vehicles, shall ensure that the Vehicle is operated, at all times, in a manner consistent with this Bylaw, when that Vehicle is being operated by a third party with the permission of the Owner. 10. SECTION 10- AUTHORITY OF BYLAW ENFORCEMENT OFFICER 10.1 A Bylaw Enforcement Officer is hereby authorized to enforce the provisions of this Bylaw. 10.2 In the case of fire or other emergency, or in order to expedite traffic or safeguard pedestrians, Bylaw Enforcement Officers are hereby authorized to direct traffic in such a manner as determined to be necessary, in the Bylaw Enforcement Officer's sole determination, whether or not such directions are in conformity with the provisions of this Bylaw. 10.3 A Bylaw Enforcement Officer is authorized to place an erasable chalk mark on the tread face of the tire of any parked or stopped Vehicle for the purpose of enforcement of the parking provisions of this Bylaw. 10.4 A Bylaw Enforcement Officer is hereby authorized to remove and impound or cause to be removed and impounded any Vehicle or Recreational Vehicle: Village of Holden Traffic Bylaw - No. 4-2017 Page 7 of 7 a) Parked in contravention of this Bylaw; b) Where, in the opinion of a Bylaw Enforcement Officer, emergency conditions require that the Vehicle or Recreational Vehicle be removed; or c) Where the Vehicle or Recreational Vehicle is interfering with snow removal or other public works being carried out by the Municipality, and the location in which the Vehicle or Recreational Vehicle is parked has previously been marked for snow removal by a permanent traffic control device, or a temporary sign pursuant to section 3.3. 10.5 No impounded Vehicle or Recreational Vehicle shall be released to its owner or his or her agent until the removal and impoundment charges have been paid. 11. SECTION 11- OFFENCES & PENALTIES 11.1 Any person who contravenes any provision of the Bylaw is guilty of an offence and is liable upon summary conviction, to the specified penalty for that offence as set out in Schedule "A" to this Bylaw. 11.2 In the event that the identity of the person responsible for operating or parking a Vehicle, Over- dimension Vehicle or Recreational Vehicle in a manner contrary to this Bylaw is unknown to the Bylaw Enforcement Officer, the registered owner of the vehicle shall be deemed to be the person responsible for the contravention. 11.3 Notwithstanding section 11.1 of this Bylaw, any person who commits a second or subsequent offence under this Bylaw within one (1) year of committing a first offence under this Bylaw, is liable on summary conviction to double the fine set out in Schedule "A" to this Bylaw, for that offence. 11.4 Under no circumstances shall a person contravening any provision of this Bylaw be subject to the penalty of imprisonment. 12. SECTION 12- VIOLATION TAGS 12.1 A Bylaw Enforcement Officer is hereby authorized and empowered to issue Violation Tags to any person who the Bylaw Enforcement Officer has reasonable and probable grounds to believe has contravened any provision of this Bylaw. 12.2 A Violation Tag may be issued to such person: a) Either personally; or b) By mailing a copy, via registered mail, to such person at their last known postal address. 12.3 A Violation Tag shall be in a form approved by the CAO of the Municipality and shall state: a) The name of the person; b) The offence; c) The appropriate penalty for the offence as specified in Schedule "A" of this Bylaw; d) That the penalty shall be paid within THIRTY (30) day of the issuance of the Violation Tag; and e) Any other information as may be required by the Municipality. 12.4 Where a Violation Tag issued pursuant to this Bylaw, the person to whom the Violation Tag is issued may in lieu of prosecution of the offence, pay the Municipality the specified penalty set out on the Violation Tag. 12.5 Nothing in this Bylaw shall prevent a Bylaw Enforcement Officer from immediately issuing a Violation Ticket. SECTION 13- VIOLATION TICKETS 13.1 In those cases where a Violation Tag has been issued and the penalty specified on the Violation Tag has not been paid within the prescribed time, a Bylaw Enforcement Officer is hereby authorized and empowered to issue a Violation Ticket. 13.2 Notwithstanding section 12.1, the Bylaw Enforcement Officer is authorized and empowered to immediately issue a Violation Ticket to any person who the Bylaw Enforcement Officer has reasonable and probably grounds to believe is responsible for a contravention of this Bylaw. 13.3 A Violation Ticket issued with respect to a contravention of this Bylaw shall be served upon the person responsible for the contravention in accordance with the Provincial Offences Procedure Act. 13.4 The person to whom the Violation Ticket has been issued may, in the case of a Violation Ticket issued pursuant to Part II of the Provincial Offences Procedure Act plead guilty by making a voluntary payment in respect of the Summons by delivering to the Provincial Court, on or before the initial appearance date, the Violation Ticket together with an amount equal to the specified penalty for the offence as provided for in the Schedule "A" of this Bylaw; 13.5 When a Clerk of the Provincial Court records the receipt of a voluntary payment pursuant to section 13.4 and the Provincial Offences Procedure Act, the act of recording constitutes acceptance of the guilty plea and also constitutes a conviction and the imposition of a fine in the amount of the specified penalty. 14. SECTION 14- SEVERABILITY 14.1 Should any provision of this Bylaw be found invalid, the invalid provision shall be severed and the remaining bylaw shall be maintained. 15. SECTION 15- REPEAL 15.1 Bylaw No. 5-2006 is hereby repealed. 16. SECTION 16- EFFECTIVE DATE 16.1 This Bylaw shall come into force upon receipt of its third and final reading. READ a first time in Council this 17th day of July, 2017. READ a second time in Council this 18th day of September, 2017.
