VILLAGE OF IRMA BYLAW NO. 14-02 A BYLAW TO PROVIDE FOR THE CONTROL AND MANAGEMENT OF TRAFFIC ON HIGHWAYS AND TO REGULATE AND CONTROL PUBLIC PLACES WITHIN THE VILLAGE OF IRMA. PURSUANT TO THE PROVISIONS OF THE MUNICIPAL GOVERNMENT ACT, CHAPTER M-26, RSA 2000, AND AMMENDMENTS THERETO: WHEREAS a municipality has direction, control, and management of all roads within the municipality; AND WHEREAS the Traffic Safety Act, R.S.A. 2000, Chapter T-6, as amended, enables the council of the Village of Irma to pass bylaws not inconsistent with the Traffic Safety Act respecting highways under its direction, control, and management for the regulation and control of vehicle, animal, and pedestrian traffic within the Village of Irma; NOW THEREFORE, THE COUNCIL OF THE VILLAGE OF IRMA, IN THE PROVINCE OF ALBERTA, DULY ASSEMBLED, ENACTS AS FOLLOWS: 1.0 TITLE AND DEFINITIONS 1.1 TITLE This bylaw shall be called the "Irma Traffic, Streets, and Public Places Bylaw" 1.2 GENERALITY IMPLIED Wherever the singular or masculine is used within this bylaw, the same shall be construed to mean the plural or feminine respectively where applicable 1.3 DEFINITIONS For the purpose of this bylaw: Section 1 (definitions) of the Traffic Safety Act is hereby incorporated as part of this bylaw. "Alley" references a narrow roadway intended to give access to the rear of a parcel of land. "Boulevard" is the portion of highway right-of-way which lies between the edge of the road surface and the adjacent property. "Commercial loading or unloading space" means a space on a highway, marked by a sign authorized by this bylaw, for the purpose of loading and unloading goods. "Construction Trailer" is in reference to a trailer used to store and/or transport construction tools, materials, or equipment. "Curb" means the edge of the roadway, or the actual curb if present. "Director of Public Works" is the head of the Public Works department or any designate. "Highway" means any street, or road designated for vehicle traffic which resides in the village of Irma. "Holiday" means; New Year's Day Family Day Good Friday Easter Monday Victoria Day Canada Day Civic Holiday (first Monday in August) Labour Day Thanksgiving Day Remembrance Day Christmas Day Boxing Day "Holiday Trailer" refers to a trailer that is constructed as a permanent or temporary dwelling, or any structure constructed as a permanent or temporary dwelling and is capable of being loaded onto a trailer or vehicle. "Parade" references a group of pedestrians numbering more than 50 and marching or walking in the street, or any group of vehicles numbering more than ten (10). This excludes funerals. "Passenger loading or unloading space" is a space on the vehicle portion of the roadway which is marked by a sign, authorized by this bylaw, to allow for loading and unloading, not to exceed five (5) minutes. "Peace Officer" refers to a member of the Royal Canadian Mounted Police, or anyone else following under the Peace Officer Act, S.A. 2006. "Public Land" refers to all Village owned land. "Recreational Vehicle" means a refers to a motorized vehicle that acts as a temporary dwelling. "Sign" is in reference to any sign, signal, marking, or device placed, marked, or erected under the authority of this bylaw for the purpose of regulating, warning, or guiding traffic, persons, or public land use. "Traffic Safety Act" shall mean the Traffic Safety Act, R.S.A. 2000, Chapter T-6, and amendments thereto. "Utility Trailer" refers to a trailer used for the transportation of goods, equipment, or materials, and is designed to be towed by a half ton or smaller. "Village" means the Village of Irma and its legal boundaries. 2.0 TRAFFIC OPERATIONS 2.1 SPEED LIMITS Unless posted or mentioned in this bylaw otherwise, the Village boundary speed limit is set at fifty (50) kilometres an hour. ALLEY SPEED LIMITS Alley speed limits in the Village are set at twenty (20) kilometres an hour. 2.2 VEHICLE ON SIDEWALK No vehicle shall either operate or be parked on a public; sidewalk, bicycle path, or walking path. 2.3 VEHICLE ON PUBLIC LAND Except for a Village agent, or employee no person shall operate or park a vehicle on public land unless designated. 2.4 OBSTRUCTING TRAFFIC No vehicle operator will drive or park in such a manner as to obstruct traffic. Where the obstruction is due to mechanical failure the operator is not in breach of this section as long as they take immediate action to attempt to remedy the situation. 2.5 VEHICLE TOWING CONVEYANCE No person shall draw or allow themselves to be drawn by a vehicle on a sled, toboggan, skateboard, skis, bicycle, ice or in-line skates. 2.6 BICYCLES AND SKATEBOARDS No person should ride a bicycle or skateboard on a sidewalk unless under twelve (12) years old. 2.7 ANIMAL TRAFFIC No person will permit any horse or other beast of burden and any vehicle intended to transport such an animal to stand upon a highway as to obstruct traffic. No person shall drive, lead, or ride a horse or beast of burden on any public land other than a roadway. No person will leave a horse or beast of burden upon public land. Any person in charge of either a beast of burden or a horse shall cause the immediate removal of any defecation from such an animal on public land. 2.8 DIRECTING TRAFFIC In case of an emergency a member of the Village fire department, designate, or Peace Officer is authorized to direct traffic in such a manner as they deem necessary whether the directions conform to this bylaw or not. 3.0 PARKING 3.1 ANGLE PARKING From forty ninth (49) avenue to fifty first (51) avenue on fifty (50) street (Main Street) the parking for both sides will be angle parking and on 50th Avenue from 50 street to west alley. 3.2 PARALLEL PARKING No person shall park on a roadway (except in section 3.1) unless the side of their vehicle is parallel to the curb and both tires directly parallel meet the required provincial distance. The vehicle is also required to face the direction traffic would be traveling along that roadway. 3.3 GENERAL PARKING RESTRICTIONS Unless required to by bylaw, emergency worker, or Peace Officer a driver shall not stop or park his vehicle; on a sidewalk, boulevard, crosswalk, in an intersection, within 5 meters of an intersection, within 1.5 meters of a driveway or alleyway, within 5 meters of a fire hydrant or parallel to a yellow curb. 3.4 PARKING ZONES No person shall park a vehicle for any period of time at the following locations: school bus stop, passenger loading zone, emergency doors, entrance of a fire hall, any portion of roadway marked by a "No Parking sign", or a portion marked by a "fire lane sign". 3.5 ABANDONING OF A VEHICLE No person shall leave a vehicle on a roadway for any continuous period in excess of one hundred and sixty eight (168) hours (7 days). 3.6 ALLEYS No person should park in an alley unless loading or unloading for a period not to exceed thirty (30) minutes, and as long as the vehicle does not block access to another property. 3.7 TRAILERS AND RECREATIONAL VEHICLES No person shall park any recreational vehicle, attached trailer, or holiday trailer on a highway except for the purpose of loading or unloading for a period not to exceed 48 hours and only if it is located on the portion of highway directly adjacent to the property that is being loaded. Except for allowed under subsection three (3.7 A and B), no person shall park any trailer upon any highway unless said trailer is attached to a vehicle able to propel the trailer. Notwithstanding, a person may park a construction trailer unattached on a highway between the hours of seven 7:00 A.M. and 7:00 P.M. on the conditions of: a) The construction trailer is involved with work being done on a work site, AND b) The construction trailer is parked directly adjacent to the work site. 3.8 TEMPORARY PARKING BAN The Director of Public Works is authorized to put forth temporary parking bans along highways for the purpose of; snow removal, road repair, and emergencies. Citizens will be notified by temporary signs, letters, or markings and given twenty four (24) hour notice to relocate the vehicle. The organizers of a parade are permitted to erect temporary no parking signage along the route, as long as the residents have been given at least twenty four (24) hour notice. No person shall remove temporary signage, barricades, signals, or other items used to communicate a temporary parking ban. 3.9 PARKING FOR PEOPLE WITH DISABILITIES A marked parking area for a person with a disability is to be used only by a person who displays the proper permit according to the Traffic Safety Act. 3.10 PARKING ON VILLAGE PROPERTY No person shall park on Village property used as a boulevard, playground, public park, or recreation area, unless designated by sign. No person shall abandon a vehicle in a Village parking lot for more than thirty six (36) hours. The Village of Irma is not liable for any damage or loss which occurs to parked vehicles on Village property. 4.0 COMMERCIAL VEHICLES 4.1 OVER DIMENSION/WEIGHT PERMIT No person should operate or allow too operate within Village boundaries, a vehicle which exceeds any one dimension, or weight cited in the Alberta Traffic Safety Act without obtaining a permit. 4.2 VEHICLES WITH METAL LUGS Unless permission is given by either the CAO or the Director of Public Works no vehicle with metal spikes, or lugs is allowed to drive on Village roads. 4.3 HEAVY VEHICLE A heavy vehicle is one which exceeds: a) Two (2) axels b) Eleven (11) meters in length including or excluding trailer c) A licensed gross weight over seven thousand five hundred (7500) kilograms 4.4 RECREATIONAL VEHICLE EXCLUDED The above section (4.3) does not apply to recreational vehicles, holiday trailers, and or utility trailers. 4.5 EXEMPTIONS TO HEAVY VEHICLES The following shall not be deemed operating a heavy vehicle and do not violate section (4.3). a) An operator delivering goods to a customer b) An operator moving a building as long as they hold the proper permit c) An operator going to or coming from a business which services heavy vehicles d) An operator going to or coming from a business which requires heavy vehicle use e) An operator driving a public passenger vehicle f) An operator driving a Village owned vehicle engaged in Village operations g) Any emergency vehicles required for either medical treatment or fire fighting 5.0 PEDESTRIANS 5.1 STREET CROSSING No pedestrian should cross any highway or roadway except at a point where there is a sign, marking, or is the end of a block. 5.2 OBSTRUCTING TRAFFIC No individual or groups shall stand, sit, or lie on any highway, roadway, or sidewalk, as to disrupt vehicle or pedestrian traffic. 5.3 WATCHING PARADE Nothing in section (5.2) shall apply in the situation as people watching a parade. 5.4 PUBLIC MEETINGS Nothing in section (5.2) applies to a group listening to a public speaker, as long as other people are able to drive by, or move by. 6.0 PROTECTION OF HIGHWAYS 6.1 CLEARING OF SIDEWALKS All people occupying property in the Village of Irma shall remove and clear away snow, ice, dirt, and other obstructions from the Village sidewalk situated on the land adjoining their property within forty eight (48) hours after the completion of the event. a) Nothing in section (6.1) applies to properties that are adjacent to secondary highway 881 due to large vehicles and street cleaning vehicles spreading snow, ice, and dirt onto sidewalks. 6.2 PROTECTION OF SIDEWALKS FROM DAMAGE No person shall operate a heavy vehicle on any sidewalk except at a curb or approved crossing without first making a plank to protect the sidewalk. 6.3 DAMAGE TO HIGHWAYS No person shall drive or drag any vehicle or thing on a highway in a way that may cause damage to the roadway or improvement. 6.4 EXCAVATIONS No person will remove any earth, gravel, concrete, pavement, or any other roadway material on any Village highway without written consent from the Director of Public Works or CAO. The person accepts all liability, and responsibility for the work and any accidents. Any unnecessary damage caused to the roadway will result in a fee to repair the roadway. 6.5 SIGHT DISTANCES AT INTERSECTIONS No person shall allow trees or shrubs on private property whether planted before or after the date of the passing of this bylaw to grow to such an extent that good visibility for safe traffic flow is thereby interfered with. 6.6 MAINTENANCE OF BOULEVARDS Property owners or occupants are responsible for the maintenance of the boulevard adjacent to their property, including grass cutting and weeding. 6.7 MAINTENANCE OF TREES No property owner will allow trees, shrubs, or other vegetation growing on his property, whether planted by them or a previous owner, to grow so that the clearance of any branches are less than two point three (2.3) meters on a sidewalk or four point six (4.6) meters on a highway, street, or alley. 7.0 PUBLIC LAND 7.1 DISCARDED OR STORED MATERIALS No person shall place or store debris, material, or equipment on Village public land without written permission from either the Director of Public Works or the CAO. A person who stores an object or thing on Village land shall move it as soon as reasonably possible in the immediate twenty four (24) hours they are notice or else the Village will remove it and the cost of removing it shall be sent to the owner. 8.0 OFF ROAD VEHICLES 8.1 All off road vehicles must have registration and proper provincial plates to drive on village highways and must take the quickest roadway out of town. 8.2 The exception to section 8.1 is when an off road vehicle has an equipment addition added to the vehicle for lawn maintenance, or snow removal. 9.0 AUTHORITY OF COUNCIL 9.1 POWER TO DESIGNATE Council is hereby authorized to designate: a) The location of crosswalks on highways b) Any intersection, or highway when U-turns are prohibited c) Any highway which is temporary closed to traffic d) Any area where parking privileges are temporarily suspended e) Location of school and playground zones and areas f) A boulevard upon which parking is permitted g) Passenger, or commercial loading and unloading spaces h) The distance from an intersection where parking is prohibited i) A portion of highway where parking is limited by a time j) The location where traffic control devices or markings are installed k) Location and number of disability parking spots l) Speed limits not contrary to the Traffic Safety Act 9.2 COUNCIL PREROGATIVE Council may: a) Approve all signs, content, and traffic control devices for the Village b) Temporarily close a portion of a highway for an event, construction, or emergency 10.0 ENFORCEMENT 10.1 OWNER RESPONSIBLE Whenever an owner is in contravention of this bylaw in any form they are responsible for any fines or costs to remedy the contravention. 11. IMPLEMENTATION 11.1 REPEAL This Bylaw shall repeal Bylaw #540 and amendments thereto upon this bylaw coming into force. 11.2 EFFECTIVE DATE THIS BYLAW SHALL COME INTO EFFECT UPON PASSING OF THE THIRD READING.
