Summer Village of Larkspur
A BY-LAW OF THE SUMMER VILLAGE OF LARKSPUR, PROVINCE OF ALBERTA, REGULATING
VEHICULAR TRAFFIC, PROTECTING THE INTERNAL NETWORK OF HIGHWAYS, AND PROVIDING
PENALTIES FOR INFRACTIONS

WHEREAS the Municipal Government Act, RSA 2000, c. M-26, and its amendments; the Traffic Safety
Act, RSA 2000, c. T-6, and its amendments; and the Transportation of Dangerous Goods Act, RSA
2000, c. T-10, and its amendments, authorize Council to enact bylaws for the safety, protection of
people and property, and the creation of offences with corresponding fines and/or remedies;
AND WHEREAS the Council of the Summer Village of Larkspur deems it necessary to enact such
provisions for the benefit of property owners, residents, and others within the Summer Village;
NOW THEREFORE, the Council of the Summer Village of Larkspur, duly assembled, enacts as follows:
1. Definitions
In this bylaw:
(a) "Act" refers to the Traffic Safety Act, the Municipal Government Act, or any other relevant
statutes of Alberta as applicable.
(b) "Summer Village" refers to the Summer Village of Larkspur, Alberta.
(c) "Vehicle" means any motorized form of transportation, including but not limited to automobiles,
trucks, motorcycles, and other vehicles that may be used for the movement of persons or goods
on highways.
(d) "Council" refers to the governing body of the Summer Village of Larkspur, consisting of the
elected officials responsible for passing bylaws and resolutions.
(e) "Highway" means any public road, street, avenue, or other thoroughfare within the Summer
Village, as defined in the Traffic Safety Act.
(f) "Traffic Control Device" means any device, sign, signal, marking, or other apparatus placed on or
near a highway to regulate, warn, or guide traffic.
(g) "Bylaw Enforcement Officer" refers to a person authorized by the Summer Village to enforce the
provisions of this bylaw and any other bylaws of the Summer Village.
(h) "Peace Officer" means a law enforcement officer, including a member of the Royal Canadian
Mounted Police or other police services, authorized to enforce traffic laws in Alberta.
(i) "Infraction" refers to any act that violates the provisions of this bylaw, including but not limited
to speeding, illegal parking, and road surface disturbances.
(j) "Penalties" refers to the financial or remedial consequences imposed for violating the provisions
of this bylaw.
(k) "Road Ban" means a restriction placed on certain vehicles based on their weight, designed to
protect the infrastructure of the Summer Village's roadways.

(l) "Road Surface Restoration" refers to the act of repairing and returning a disturbed road or
highway surface to its original or acceptable condition, as determined by the Summer Village.
(m) "Signage" refers to the physical markers, such as signs or posts, placed along roadways to
indicate traffic control measures, such as speed limits, stop signs, or parking restrictions.
(n) "Moving Violation" refers to an infraction committed while a vehicle is in motion, such as
speeding or failing to stop at a stop sign.
(o) "Non-Moving Violation" refers to an infraction committed when a vehicle is stationary, such as
parking in a no-parking zone or obstructing traffic.
(p) "Weight Limit" refers to the maximum allowable weight for vehicles traveling on specific
roadways, as set by Council to protect road surfaces from excessive damage.
(q) "Emergency Vehicles" refers to vehicles used in emergencies, including fire trucks, police
vehicles, ambulances, and other vehicles used for emergency response.
(r) "Disturbance of Highway Surface" refers to any action that disrupts the integrity of the road
surface, such as digging, excavation, or the creation of a ditch, and which requires restoration.
(s) "Person" refers to any individual, corporation, company, partnership, or other legal entity who
may be subject to the provisions of this bylaw.
2. Speed Limits
The maximum speed limit on all highways within the Summer Village is 30 kilometers per hour, unless
otherwise authorized by Council resolution and posted.
3. Traffic Control Devices
Traffic control devices, including but not limited to stop signs, yield signs, lights, "no vehicular traffic"
signs, "no parking" signs, and other necessary signage, may be established by Council resolution and
must be posted accordingly.
4. Parking Restrictions
(a) No parking zones or areas may be designated by Council resolution. These restrictions are
effective when appropriate signage is posted, whether temporary or permanent.
(b) It is an offence to park in a manner that obstructs the movement of traffic or blocks access to or
from any property within the Summer Village, unless the owner of the vehicle and the property
are the same.
(c) Parking is strictly prohibited on both sides of Larkspur Drive at all times, whether or not signage
is posted.
5. Weight Restrictions
(a) Road bans and vehicle weight limit restrictions may be established by Council resolution based
on vehicle weight, road conditions, and other factors. These restrictions may apply to all vehicles
or specific types of vehicles.
(b) Weight restrictions may apply as a percentage of the vehicle's licensed axle weights and may be
permanent or temporary, depending on road conditions.

6. Disturbance of Highway Surfaces
No person or entity shall disturb highway surfaces (including ditching, digging, or other similar activities)
without first notifying the Summer Village Administration Office. All disturbances must be restored to
their original condition, including proper compaction of the highway sub-surface and surface.
7. Use of Thoroughfares
(a) All thoroughfares within the corporate limits of the Summer Village are public highways and are
open for use by anyone who desires to use them for their intended purpose. No private person
has the right to obstruct or interfere with their intended use.
(b) The Summer Village Administration will arrange for semi-annual inspections of the
thoroughfares, conducted in the spring and fall, to identify any potential hazards or necessary
maintenance.
(c) Roads will be graded and/or snow plowed as needed on an annual agreement basis, depending
on weather and road conditions.
(d) Council may, by bylaw, pass additional regulations governing vehicular traffic, including both
moving and stationary vehicles, as deemed necessary to protect the public and maintain safe
road usage.
8. Serving and Type of Notice
A notice of infraction under this bylaw shall be deemed sufficiently served if:
(a) Delivered personally to the accused.
(b) Mailed by registered mail to the registered owner of the vehicle or the company associated with
the vehicle, or to the person involved.
(c) Attached to or left upon the vehicle involved in the alleged infraction.
(d) Notices may be issued by a Peace Officer or Bylaw Enforcement Officer in a format approved by
Council, and must include all required details (time, date, location, vehicle description, license
number, etc.).
9. Penalties and Remedies
(a) Non-Moving Violations (e.g., parking violations): A penalty in accordance with the Fees and
Charges Bylaw, payable within 21 days to the Summer Village.
(b) Moving Violations: Penalties as specified under applicable Provincial Statutes or Acts, with
payment due within 21 days of issuance.
(c) Weight Restriction Violations: Penalties as per applicable Provincial Statutes or Acts. In addition,
all costs related to road damage and restoration must be paid by the person convicted, within
the timeframe set by the Courts or within 21 days of notice.
(d) Disturbance of Highway Surfaces: The responsible party must restore the highway to its original
condition within 7 days of notice. If the Summer Village must perform the restoration, all
associated costs must be paid within 21 days.
(e) Unpaid Penalties: If any penalty remains unpaid beyond the due date, the penalty may be added
to the tax roll of the property associated with the infraction. Such penalties will be subject to the
same collection processes as property taxes.

10. Fees and Charges Bylaw
Failure to pay penalties or comply with remedies specified in this bylaw will be subject to enforcement
under the Fees and Charges Bylaw of the Summer Village.
11. Repeal of Previous Bylaws
Bylaw 3/96 and Bylaw 2/95 are hereby repealed.
12. Effective Date
This bylaw shall come into full force and effect on the date of the third (3rd) reading.
