Medicine Hat noise rules

Medicine Hat's captured bylaw defines nighttime as 10 p.m. until 7 a.m. on weekday mornings or 9 a.m. on weekend and holiday mornings. Residential nighttime noise has a 50 dB(A) limit at the specified measurement location. Disturbing noise may be an offence even without exceeding a measured limit; construction has its own exceptions and weekend restrictions.

What are the quiet hours?

Nighttime starts at 10 p.m. and ends at 7 a.m. on weekday mornings or 9 a.m. on weekend/holiday mornings. Section 16 sets a residential nighttime limit of 50 dB(A), measured outside the property line. Exceptions and the general disturbance rule also apply.

Is daytime noise unrestricted?

No. A person may breach the general disturbing-noise prohibition even if no sound measurement is taken or the measured sound does not exceed a limit. Time, type, duration, volume and the surrounding area can be considered.

When can construction take place?

The captured section 19 exempts daytime construction subject to section 7. Section 7 restricts residential construction before 8 a.m. or after 9 p.m. Saturday, and before 9 a.m. or after 9 p.m. Sunday or a holiday. An exemption or site-specific modification may affect a particular project.

What about lawn and garden equipment?

Section 19 includes a daytime exception for motorized garden tools or grass cutting on residential and non-residential property, and a separate 6–9 a.m. golf-course exception. Specified exceptions can be modified or revoked on a site-specific basis.

Sections 19–24 address emergency vehicles, conditional construction and snow clearing, garden tools, City work, community events, federal/provincial activities and exemption permits. Several exceptions are subject to site-specific modification.

What penalties are specified?

The captured schedule distinguishes specified and minimum penalties. For example, causing disturbing noise is listed at $400 specified/$300 minimum; prohibited construction at $350/$250. Section 32 sets a conviction maximum of $10,000. Current amendments and enforcement should be confirmed.
