## BYLAW NO. 8/2020 BEING A BYLAW OF THE MUNICIPAL DISTRICT OF PEACE NO. 135 IN THE PROVINCE OF ALBERTA
A BYLAW OF THE MUNICIPAL DISTRICT OF PEACE NO. 135 IN THE PROVINCE OF ALBERTA FOR THE PURPOSE OF PRESCRIBING SPEED LIMITS THAT ARE DIFFERENT FROM THE SPEED LIMITS ESTABLISHED UNDER SECTIONS 106 OR 107 OF THE TRAFFIC SAFETY ACT.
WHEREAS, under the provisions of Part 5, Division 1 of the Traffic Safety Act, being Chapter T-6 of the Revised Statutes of Alberta 2000, and amendments thereto, the Council of a municipality may prescribe speed limits for highways under its control, direction and management; and
WHEREAS, the Council of the Municipal District of Peace No. 135 deems it advisable to establish maximum speed limits for certain highways subject to such control, direction and management.
NOW THEREFORE, the Council of the Municipal District of Peace No. 135, in the Province of Alberta, duly assembled, enacts as follows:
1. This bylaw may be called the "Speed Limits Bylaw".
2. That "highway" shall have the same meaning as is in the Traffic Safety Act RSA 2000, c T-6 as amended or replaced from time to time.
3. That a maximum speed limit of 50 (fifty) kilometres per hour be established for all highways within all multi-parcel residential subdivisions which contain more than 4 (four) lots, as described in Schedule "A" attached and forming part of this Bylaw.
4. That a maximum speed limit of 50 (fifty) kilometres per hour be established for all highways within all multi-parcel commercial industrial subdivisions as described in Schedule "B" attached and forming part of this Bylaw.
5. That a maximum speed limit of 60 (sixty) kilometers per hour be established on the local road east of Sections 26 and 23-83-23-W5 (commonly known as the Golf Course Road).
6. That a maximum speed limit of 50 (fifty) kilometres per hour be established for all hamlet roads and lanes subject to the direction, control and management of Municipal District of Peace No. 135.
7. That a maximum speed limit of 50 (fifty) kilometres per hour be established on the local road between E ½ 28, E ½ 21-83-23-W5 and W ½ 27, W ½ 22-83-23-W5 (commonly known as the Wilderness Park road) when vehicles are passing pedestrians or bicycles.
8. That a maximum speed limit of 30 (thirty) kilometres per hour be established on the portion of local road within Lac Cardinal Recreational Lease 800035 located on NE2283-24-W5.
9. That a maximum speed limit of 50 (fifty) kilometres per hour be established on the portion of road beginning from the north boundary of the NE 27-83-22-W5, thence southerly along the roadway to the CN railroad right-of-way.
10. That Council delegates to the Chief Administrative Officer the authority to erect and post the required speed limit signs along the affected highways.
11. That this Bylaw shall come into force and take effect on the date of its final passage.
12. This Bylaw Rescinds Bylaw No. 674, Bylaw No. 847, Bylaw No. 9/95, Bylaw No. 10/2000 and Bylaw No. 9/2013.
13. Should any provision of this Bylaw be invalid then such invalid provision shall be By Aw severed and the remaining bylaw shall be maintained.
