TOWN OF NOBLEFORD
IN THE PROVINCE OF ALBERTA
BYLAW NO. 682
BEING A BYLAW OF THE TOWN OF NOBLEFORD, IN THE PROVINCE OF ALBERTA, TO
ESTABLISH AND REGULATE THE KEEPING OF WILD OR DOMESTIC ANIMALS OR POULTRY IN
THE TOWN OF NOBLEFORD.
WHEREAS the Town of Nobleford Council is of opinion that the keeping of wild or domestic animals
within the limits of the Town of Nobleford is likely to cause a nuisance.
AND WHEREAS the Town of Nobleford Council deems it desirable to allow the keeping of chickens in
urban areas of the Town.
NOW THEREFORE, under the authority and subject to provisions of the Municipal Government Act,
Revised Statutes of Alberta 2000, Chapter M-26, as amended, the Council of the Town of Nobleford in
the Province of Alberta, duly assembled, does hereby enact the following:
1. TITLE AND DEFINITIONS
1.1. This bylaw shall be known as the "Keeping of Wild or Domestic Animals or Poultry"
1.2. The following definitions shall apply when used within this bylaw:
a.
Animal: means any bird, reptile, amphibian or mammal excluding Humans and wildlife;
b.
Domestic Pet: any commonly accepted household pets such as cats, dogs, rabbits,
hamsters, fish, etc.
c.
Livestock: means horses, cattle, sheep, swine, donkeys, goats, rabbits, and fur-bearing
animals.
d.
Poultry: means roosters, turkey, geese, and ducks but shall not include chickens which are
under Bylaw 581, a Bylaw of the Town of Nobleford regulating the keeping of urban hens
within the Town of Nobleford.
e.
Wildlife: means any animal which is wild by nature and has the instinctive propensity to bite
or attack human beings. This includes any wild rodent or bird.
2.
GENERAL
2.1. The licensing and regulating of "dogs" will come under Bylaw #641 (Dog Control Bylaw).
2.2. The licensing and regulating of "cats" will come under Bylaw #642 (Cat Control Bylaw).
2.3. The licensing and regulating of "chickens" will come under Bylaw #681 (Urban Hen Bylaw).
2.4. Other small domestic pets may be kept within the limits of the Town of Nobleford provided that
the same are housed in a structure that has been specifically built for that type of pet and that
the pet is not allowed to roam off the property owned or rented by the owner of the pet.
2.5. No person shall keep wildlife, livestock animals or poultry within the limits of the Town of
Nobleford except as hereinafter provided:
a.
Livestock animals may be kept on a temporary basis in veterinary clinics, on the rodeo
grounds, in auction marts, in livestock sales yards, in slaughter houses or in similar
establishments provided that such animals are held temporarily for short periods of time and
are held in pens or other enclosures used exclusively for purposes which are incidental to
that business conducted on the premises and provided further that such pens or other
enclosures have been approved by the Medical Health Officer.
3. PENAL TIES
3.1. Any person contravening a provision of this Bylaw is guilty of an offence and liable on summary
conviction to a fine not exceeding $500.00 inclusive of costs and in default of payment to
imprisonment for a period not exceeding thirty (30) days unless the fine and costs, including the
costs of committal are sooner paid.
Bylaw 521 is hereby rescinded.
This Bylaw shall come into force and effect upon third reading by Council.
