## TOWN OF VULCAN PROVINCE OF ALBERTA ## BYLAW NO. 1331-05 ## A SILUE OF THE TOWN OF VULCAN TO REGULATE AND CONTROL TRAFFIC WHEREAS by vete of the powers confered upon at by the Trufle Sodi des, the Coanell arche Town of Vulcan may pass a Hylaw providing for the regulation and control of velle, animal and pedestran trafic: AND WHEREAS the Council ofthe Town of Vulcan, in the Province of Alberta, deces it expedient to puss much a Evlaw: NOW THEREFORE, THE COUNCIL OF THE TOWN OF VULCAN DULY ASSEMBLED HEREBY ENACTS AS FOLLOWS: - 1, Tile This Bylaw may he cited as the "Traffic Control Bylaw" ## Definitions la this Bylaw, unless the context otherwise requires: - 1.Act means the Trife Safety Aer - 2 Alley incans a caron Highway intended chiefly to give access to the rear of buddings and parcels of land: - Bicycle nocuns ony cycle propelled by human power on which a person can ride, regardless of the number of wheels it may have - Boulevard means: - that part of a Highway that is not Roadway, and B. is that part of a Roadway that is between the curb and the property line - Chef Administrative Officer means the Chief Admanstrative Offiper or Towm Manager for the Town 6. Council means the elected officials forming the municipal council of the Town - Crosswalk meani - a. that part of a Roodway at an Inenection incloded within the connection of the lateral linus of the Sidewalks on opposite sides of the Highway measured from the curbs or, in the absence of curbs, from the edge of the Roadway; or - b. any part ofa Roodway at an Indersechon or elsewhere distinctly indicated for Pedestrian crossing by signs or by lines or other mackings on the road surface: - Crele means a biescle power bicycle, motor cycle or moped - Curb means the actual curb, if dere be one. and should there be no curb in exience, shall meun the edge of the travel portion of the Highway. - Duagerass Goods moms any product, subutance, or organium spocified in the regulatioos persist to the Dingers Good Tramportain and Molling der, 454 2000 Chaper 04 der or included by its nature in any of the classes lised in said regulations: 22. lassenger Loading Zome means a space or soction ofa Highway asarked wall a Trafle Canimal device or marking perting parking therein for a period necessary to load or unload passengers - 23 Peace Cfficer means - a. a Spocal Comtable as apported under the Pollce dar. - b a Police Officer as apppinted ander the Modice Aot, or - Eila menber of the Royal Canadian Mounted Police. - 24 Pedestrian means a person ufoot or a person in a wheelchair. 25. Playgroand Zone means a zone on a Highway designated as such by de Town and dotified - a. Trattie Courol Device as an unca where childien: - b may be expectod to be on the Highway, or - E are permitled to cross the Highway. - 26.1 Private Passenger Vehicle means a Vehicle ssed solely for personal transportation including de transportation of goods which are the property of the Diner and intended for ise use ur enpoyment of the Owner or members of their houschold; but not including the transportation of goods in connestion will any line of business except dis of a salesman conveying cases ur display poods which are not for delivery or re-sale: - 27 Public Vehicle means a Vehicle uperated on a Highway for the transporation of: a passengen; I goods, or c. a velicle operated on a highway for trunsportation of passengers and goods, but does not - include a private passenger vehecie - Roadway mcana that porton of a Highway intended for vehicular traffic: - School Zone means a zone on a Highway designased as such by the Town and sendied hy u Traffie Condrol Device as an area where childien: <!-- image --> # may be expocted to be on thie Highway, or b. are permutied to cross the Highway. - 30 Sidewalk means that part of'a Highway especially adapted to ihe see of or ordinanily wed by Pedestrians, and includes that part of'a Highway belween the Curb line for the edus of the Roadway, where there is no Carb line) and the adjacent propeny line, whether or not paved an unproved. - Towa means the Minicipal Corporation of the Town of Vulcan, in the Promoe of Alberto ar whete the contest resures a dily authoned official of the Municipal Corporation of the Town of Vulcan or where the contest requires the area that in contained in the boundaries afthe Town of Vulcan. - Traffic Control Device means any sign, signal, marking, or device whether minually. electrically or mechanically operated placed, marked or crocted under the authority of this Bylaw for the porposes of regulating warning or guiding baffle - Trailer mcans a vehicle so designised that it may be attached to or drawn by a Vehicle and intended io trumport property or persons and melodes any trailer that o desed, consucted and equipped an a dwelling place, living ubode or sleeping place, either permanently or temporatily, but does not include machinery or coupment used in the consruction or insistenance of Highways - Vehicle rocans a device in, on or by which a person or thing may be transported or drawn on a Highway ## Speed Limits - No daver shall drive a Vehicle within a Park or Playground Zone at a greater rue of spood Than 30 kilomeires per hour. - The Town shall case signs to be posted indicating a greater or lesser speed for Vehicks than that prescribed by the Act or indicating that the prescribed pood mut hai consed io apply. - No person shall drive a Vehicle in an Alley at a greater rate of speed than 20 kilometres per boar. - The Town may pust sgne along a Highway ander construction or repair or in a sue of disrepair to fix a maximian spoed lamit applicable io all Vehicles or to any class or classes or Vehicles ranelling over any part of the Highway, ## Traffic Coutrol Devices - The Town may prescribe where Traffic Control Devices are so be located, including Traffie Control Devices restricting the speed of Vehicles - The Town shall place Tratne Control Devices at such locations and may from time to tiere alter the location foe the following purposes: - a, to chide the surface of a Highway into traffic lanes marked by solid or broken lines: - b. to prohibe "U" turis al an latersection! - e. To probibit lem hand sums or right hand turns; - d. to designate a Roadway or portion thereof as a une-way sireet - e. to despite School Zonei and Playground Zanes; - E to denmate a iruck route: - # lo control entry to a Highway by means of a "stop' sign or tyield" agn - h. to desigrate a Crosswalk; - i. to designate Parking Stande for use of any particular clams of Vehicle, - 1 to close or restriet the use of any Highway, subway, bridge or overpass or any part of any Highway, subway, bridge or overpass cither as to the full width thereof or as to port of the with thereof with respect to any class or classes of Vehocles or with respect to any class or classes of Pedentiami: - k to prohibit, roarict or regulate the parkung of Vehicles or any particular class of Vehicles on any Highway or other public place or any portion thereof during such hours as may be deirmined: - I to designate and mark guide lines for angle or parallel parking an any Haghway or other public place or any portion therent - The Town shall case a record to be kept of the location fall Traffic Control Devices which record shall be epon to public inspection during normal husiness haurs - Notwithstanding any provision of this Bylaw, all Traffic Control Devices placed, cocted or marked an the Town prior to the passing of the Bylaw shall be decred to be daly authoried Traffie Control Devices until altered pursuant to the provisions of this Bylaw ## Parades and Processions - Any person desiring to hold a Parade or Procession within the Town shall at leost seven days prior to the time they desire to hold the same, make application to the Town for a Pande Permit in the fon provided by the Town and shown in Schedule D.. <!-- image --> <!-- image --> comturation of attached Vehicles. - An official registration conficase or interu registration certificate produced pursuant to Section 9:5 af thin Rylaw may he schmitted in evidence an Count and shall be prima facie proud of the authenticity of such certificale and if the particulars thereun ## 10. Dangerous Goods - Any vehicle transporting dangerous goods within the Town of Vulcan Tunis, will comply with "Tramportatio and Handing of Dogerous Good" Acram/ Repparen 2. No Vehicle transporting Dangerous Goods shall sop within the Town excepe - a la load or ninad Danperous Goods; 5. in compliaoce with a valid permit andior with drcctions of a Peace Offcer on Traffe Canteel Device: - d. due to mcchanical failure of the Vehicle or an accident involving the Vehicle this occurs drever nast unfor the RCMP of the nature of the Dingtrous Goods: ot - d. to refuel or repair the Vchicle provided die notes to a particular service station or parugs conform to those routes described in this Bylum e at a permitted storage location - meaning any area which is at cast twenty five mctors (25) away iron the nearest residential institutional or assembly occupancy and is apprived by the Fire Chief 1. When requested by a Peace Officer, a driver of u Vehicle trunsporting Dangerous Goode shall produce - i. a bill of lading: or 3. 5 a permit issued pursuant to this Bylan, or 4. can industrial waste report, or - d. documents indicating the origin and destination of the Vchicle and a description of the Dangerous Goods. 6. Documents obtaned by a Peace Officer pursant to Section I0.5 of this Hyde may be auberutted in cadence in Court and shall be prima lacie proof of the unthenticity of such documents and the particulars cheren ## 11. Pedestrians - Al a Crosswalk at an Intersection marked with lines a Pedestrian shall cross either of the intersecting Higles ays of the Emersection within the limits of such lines - Where Crosswalks ane marked in a School Zone, no person shall cross any stoct or arenue within a School Zone between the hoom of eight o'clock in the forenoon and five o'clock in die alertoon an a school day, except within the limits of a marked Crosswalk - No Pedestrian shall be upon a Roadway in a manner as impeding or Ikely to impode traffic upon such Roudway. - No Podestnan shall stand upon or walk along a Roadway for the purpose of suliciting a ride. - No Pedestrian shall stani on a Highway in such a manner as to amnoy or inconvenience any other person lawfully upon such Hegliway: - No Pedesiran shail stand on a Highway in such a manner as to obstruct the entrance to any huilding - No person shall sand in a group of thece or more persoes or so near to cach odor on a Highway as so obutruct the enirance to buildings or to obstruct or prevent other persons wing such a Highway and forthwith after roques has heen made by a Peace Officer or other persoo duly authorized no do su shall disperse anil move away. - Nothing in Section F1.8 of this Bylas shall be construed as probiling the unembly of persons for the purpose of watching a Parade of Procession daly authonged by the Town - No person shall race or couse s race upon a Roadway unless so muthorized by the Town in writing ## 12 Parking - No person shall park a Public Vehicle on a Highway or Private Driveway unless the Public Vehicle h parked in a spoclically desagnated Public Vehicle parking aren - Notwithstanding Section 12.1 of this Bylaw, no persun shall park a Public Velicle on a Roadway: parking lane ur shoulder portions of a Highway except. - i when the Pable Vehicle is incupable of moving under its one power; - b. where some other emergency arses, or - as is ocherwue permined by this Bylaw 3. Nothing in the Section shall be construed so prohibit police Vehicies, ambulances or Vehicles engaged in Highway repair, maintenance or impolion work or by employees of the Town or applicable government agencies in carrying out their work from parking apon a Rasdway when itis advisable la do sur - a. ba peevent accidents: - Hi. so give warning of hazards or of persons on the Haghway: - c lo remove injured person: - d. to repair the Reachsay, or - .. for aimlar purposes - Section 12, I of this Bylaw does not probibit the driver ofa Vehicle of a public unility fron parking the Vehicle upon a Roadway when it is advisable or necessary to do so for the murposes of the construction repair, maintenance or inspection of public utility facilities adjaccat 1o, along: ever or under the Highway - Nuing in this secome shat! be constried so probibit the driver of a schoot bus from parking he school bus on a Roadway for the purposes of loading or unloading passengers if the driver connor park off the Roadway and still have suitable spuce available on the ground for the passengers being loaded or unlooded. - Unless required or permalied by this Bylaw, by the Act, by a Traffic Control Deuce, in compliance with the directions of'a Peace Officer, or to avoid conflies with traffic, a driver shall not stop or park his Vehicle: - I on a Sidewalk or Boolevand; - b any part of'a Crosswalk, - Within an Intersection other than unmediately nest to the Curb in oT Indersection, - $ at an Intersection ocarer than five mebres to the projection of the comer priperty line immedianely alicad or innediately to the rear, except when the Vehicle is porked in a space when a parking mete or other Traffie Contral Device indicapes pucking is permitted; - e. within five metres upon the approach to any stop sign or yield aign. - within five metres of any fire hydrant located at a Curb; - within five meires of the point on a Curb nearest a fire hydrant: - h. within one and a half metres of an access to a garage, privane rood, driveway, or Vehicle crossway over a Sidewall - within five metres of the nearside of a murked Croswalk; ¿ alongside or oppose a sacet excasation or obstruction so an so obitruct tallic: den a bridge of in any subway or approaches thereto: 1. at any other place where a Trafia Control Device profubite parking ne Mopping during such limies as slopping or parking is so prohibited, dr m. on the Ropdway side of a Vehicle parked or stopped at the Curb or eige of the Roadway - The Town is hereby authoried and empowered to mark portions of Highways where porking is a resiniced in any particular class or classes of Vehicles; D. prolubued at any ume, or c. restricted to fifteen minutes, twenty mimes, city minutes, one lour, tho hour, three hour or four hour parking of Vehicles between the hours of mine o'clock in the forenoon and five-thins eleck in the afternoon of any day of the week. - No person shall park a Vehicle for any penod of time exceeding the time tone so designated. - No person shall park a Vchicle other than a Vehicle of such class or classes on the portions of'a Highway as marked 10. No person shall park a Vehicle in an Alley except foe such period of time as muy be reasonahly necessary for the loading and unnading of passengers or goods from the Vehicle, provided that such Vehicle does not provcat other Vehicles of Pedestrans from passing aloeg the Alley. - The Town is hereby authorized and empowered to murk portions of Highways us Passenger Laading Zooes and Loading Zones. - Except when loading or unloading pussengers, no person shall park or stand a Vehicle for any period of time BE a. a Passenger Loading Zone or Loading Zone; b a "No Parking" area: or 6. the front of a mum entrance or doorway of'a public burlding 15. No person shall pork a Vehicle in a Loading Zone for longer thim fifteen minutes. 14. No person shall park any Trailer whether designed for occupuncy by persons or for the carrymg of goods and equipment), upon any Highway unless said Trailer in attached to a Vehicle, by which it may be propelled or drawn when so atlached, the Trailer shall be deemed part ofthe Vehicle and subject to tie laws and regulations pertaining to Vichicles 4. 15: The Town is herehy authoriand and emponcted to mark soch parts of Highways as may be necessary to provide adequase, sale and convenient slopping places for buses. No person stall park a Vehicle in a designated hos stop zone oher than a bus which in louding or unlosding passenpers or goods. 17. No person shall park a Velicle, other than an authorised Vchicle, in any parking space, upon property owned by the Town where such spape has beon reserved by the Towm and legibly marked for a Vehicle operated by an employee of the Town 18. No person shall park a Vehicle upon land owned or controlled by the Town crcept in such parts an may be designated with a sign orsigns permitting vehicle parking 19. No person shall angle park a Vehicle which excoeds eight meges in overall length upon any Highway cacepi such locations as have been designated and market hiy sages pernoming such parlong. However, a person may temporarily park in such other spocified locations forsuch a penod of ame as may be signed bor much porposes 20. Where parking guidelines are visible on a Noodway no driver shall park a Vchicle cacept within the Imits of the lines designating a Parking Stand 2. No person shall park a Vehicle with the side thereof purallel so the Curh or edge of the Roadway when angle parking is permited or required. 22. No Vehicle may bo porked at an angle to die Curh in o col-de-sac unless that Velcle is porked in wich a manner as not to merlene with the fee flow of traffic in the col-de sc 4. No person shall park u Vehicle so that the bumper or side of the Vehicle is closer than sisty centimetres to the bumper or ade if'another Vehicle except where a Vehicle is parked an a parallel purkang zone. 5. 24 No person shall pari, or leave any Vehicle on priate land or property that has been clawly marked a such by a sign or signs crocled by the owner ur shei agent, unless wach person has obtamed the permission of the owner, tenant, occupant or person in charge or contrel of said land or propeny. 6. 25 No awner, tenant, occupunt or person in charge or contal of a private Roadway or property personally satisfied that a Vehicle is in violation of Section 12.24 of this Bylaw nay report to the Town of Vulcan Office - Bylaw Services, the license number and location of the Vehicle Any person making such report, shall give their own name and address 7. 26 No penon shall park a Vehicle in that part of a doveway which hes between a Cuch or Roadway and the property line which runs parallel to the said Curb or Roadway 21. Voless socifically regaired: permited, or probibied by other provisions of this Bylaw, no person shall park any Vehicle. a on any Haghway for a period of more than 72 consecutive hours, I in front of, or adjacent to, any building in the course of erechion or repair - 2N No perco shall park a Vchicle or Trailer on a Highway when such Highway or any portioo dierent is heing maintained, repaired or worked on in any matter whatsoever, including the rethoval of mow - Any person empowered to enforce the provisions of this Bylaw is hereby authoriped to place an erasable chal mack on the bead face of the tire of o parked or stopped Vchicle without that person or the Town incurring liability for seinp so. 30. In the event that a Vehicle or Trailer is parked in vislation of this Rylow, ung Pose Office, withoun liability, may cause such Vehicle or Trailer so be removed so a place designated hry the Chief of Police The Ooner of a Vehicle or Trailer so moved shall pay to the Town or to a contracted operator upon demand, the colt of removing such Vehicle or Trailer, atorage or other churges incurred in. respect therest and such cost shall be in addition to any fine or peralty in rospect to any such violation - Unless otherwise exempted by law, everyone shall stop or park a Velicle parallet to the Curb on any Roadwuy with the Carb-sade wheel of such Vehicle within 500 millioctes of bie Curb. - No person shall park a Vehicle: a such that the Vehicle interferes with she use of u fire or emergency caat from a bunking: ar b. in the entranceway to a Fire Hall, Police Station, or Hospital. - A person in charge or control of a garage, sonice station, radio shop or other promises where repain or installation are mode to Vehicles for compensation shall nut leave or cause or suffer or pomal to he led on a Highway a Vehicle left in their posseun 14. No Owner or operator af'any Vehicle incapable of being moved under its awn power shall cante or perman such Vehrale no be parked on a Highway: 2. Subseccion 12.35 of mis Bylaw does not apply to a Vebicle purked because of a breakdown or other emergency at the person in charge of control of tbe Vehicle can establish that they have taken immedase action to arrange for the removal ofibe Vehicle forthwith 3. 30 Where Vehicle parking spuces are outlined in yellow paint or by wooden or other material divisions, every driver of any Vchicle ung same, shall park their Vehicle wholly within ibe limits of each individual space 4. No person shall permit a Velicle to stand unattended upon a grade or slope wihout first having a effectively set the brake thereon, and b. timed the front wheel to the ocarent Curb or edge of the Roadway m such a manner as to impede any movenient of the Vehicle. ## 13. Handicapped Parking - The Town is hereby authonzed and empowered to estahlish such Parking Stands as deemed necesary for the cactusive use of handicapped persons who operate or travel by Vehicle - An Owner or operator of'a Vehicle used for the transportation of a handicapped person may apply to the Alberta Rehabiltation Cauncil for the Disabled for a portable placard enslyung the Vehicle an being used for the transporation of handicapped persons and that the molor Vehicle may be parked in a Parking Stand for handicappod periont. The placard mont be of a minuum wise of 85 millimeires by 85 millimetres 3. A placard issued parsuant to Seebon 13.2 ofthis Bylaw must be duploved on the driver's sude of the dashboard of the Vehicle to indicate that the Velocle may he porked on a Parking Stand designancd by the Town for the use of a handicapped person. + The uperutor of'a Vehicle not identified by a plocard issand purscant to Section 13.2 of this Bylaw shall not stop or park the Vehicle in a Parking Stand designated by the Town as being for the use of handicapped persons ## Temporarily Closing Traffie - In any case where by reason of an emergency or, of any special circumstances which in the pisans of the Chief Adminstrative Officer, the Peace Officer in charge of Operabions or his Cleatenale, or the Fire Chief make it desirable and in the puble interest lo so do, the Chief Admitrave Officer, the Peace Oricer in charve of Operations or his Designate, the Fire ClueT or odor persons acting in such capacity may temporanly close to traffic and Pedestriana any portion of a Highway ## 15 Shopping Carts - Every oner ef business premises, that produles shopping carts for cunsoner use, shall diplay therein at a conspicuous place a sign stating that shopping curts cannot be removed thorn said promises or as purking unca pursuant to this Bylaw. - Every owner of a shopping cart shall have the company name painted, posed or wamped thereon or plainly attiched by a plate or similar device so us to readily identidy the ownershup of the shopping cart - No custoner or odier porson shall remove a shopping can from any promises or parking wa referred wu in this Section. - Town personnel find a shupping cart abandoned on Town property they may toke possesson of it and store it under Town care and the owner way recover the said shopping cart on payment of Ten Dollars (510 00) handling fee per shopping cart, ## Electrical Cords - No person shall cause un clectrical cutension cord to be conveyed across a Sidewalk miess me elecincal extension cord ss: - i conveyed above the surface of the Sidewalk at a height of mut less than 2.15 metres: - b afa grade approved for outdoor use, and - E supported and conveyed above a Sidewall hy a murdy device of a nonconduchive mutenal not Misceptable to wind action. - The Town may issue an Coder an regards to removal of an eloctrical extension cond and portable supporting device - Upon failine of the owners, Leisees, Tenants or Agents of the owner to comply with the aforementioned Order, the Town nay: a enter upon the property inmediately to remove the electrical excesion cord and portable supporting device if a hazard exists; - b, within five days of the Order enter upon the property to remove te electrical exten ine cond and portable supporing device; and - E charge the cour of the work done to remove the clectrical cord and portable apporting device against the property as taxes due and owing and collectible in the same manner po taxes ## 17. Snow Routes &amp; Street Cleaning Routes - No person shall pork a Vehicle or permit a Vehicle to be parked on a Highway marked an a scow - The Town shall declare a sow roule by posting of signe - A snow roule shall be in cflect for 72 hours unless eatended by a further declaration foe another 72 bours - A Vehicle parked on a marked soow roule is subject to immediste removal us the expense of the Owner of the Vehicle - No person shall park a Vichicks or permit a Vehode so be parked we a Highway designated by the Town as a Street Cleaning Route" 6. The Town shall declare a Street Cleanng Route we effect by posting of signs, 7. A Street Cleaning Route shall be in effect for heelve hours - E. A Vehicle parked on a aged Street Cleaning Route is subject to immediate removal at the expense of the Owber of the Vehicle in addition to any other sanctioo spocified in this Bylaw. ## 18. Obstruction to Visino - The owner or occupant of propcity shall maintain all hedges, shrils or amall bees on the property on set forth in the This of Viewe Land Che Milaw <!-- image --> ## 19. Bicycles - No person ever the age of ten years shall ride a Bicycle or sanbuont on u Sodewall or Boulevard. - Many Bicycle or power eyele is left shandoned or ummended fora penud of 45 days, the unchumed Bicycle or power cycle becomes the possession of the Town Unelaimed Bicycles ar poweriyales shall be sold at public auction afer the lapse of said 45 days; ## 20. Anitak - No anitals, excepting small peti on a leash, shall be ridden, driven or walked in or on a Sidewalk, Boulevard, park, or any other Public Pisce, Except for a Roadway of Alley. - 2 Section 20.1 of this Bylaw shall not apply to Rodeos, Parades, or acher activities approved in ung by the Town. 3. A driver or a person in charge of a horse-drawn sehicle on a Higliway shall renin upon such subriele wale it is in monon, or shall wall beside the horse drawing such vehicle ## 11. 26 No person shall pod or put up any lodoodot placard, writing or picture or wale any indecent word or make any indecent picture or drawing on any public or private building, wall, fence, wigs monument, post, sidewalk or prisement in any of the streets, parks or other pallic places of the Town - Any Peace Oficer is hereby authorised to remove or cause to be rumoved, any whiche ur tratier: - parked it contravention of a provision of this Bylaw, or - &amp; where emergency conditions may require such remoral from a highway, Such vehicle may be removed to a place designated hy the CAO where it will rentin impounded until claimed by the owner or his/her agent - 2 A notice or connonly called a Traffic Tag, having printed wonding approved by the CAO may he issued by a Peace Officer in Bylaw Enforcemtot Officer, to any person alleged 1a have breached any provisions of this Bylaw The said notice shall requme forfeiture and payment of the appropriate find as specified in Schedule 'C-Penaloes - Voluntary payment, as indicated, on a notice oe Traffie Tag shall be made payable to The Town of Vulcan, at the Town Office durng normal business hours - Failure to rent Vuluntary poyment walun Fourteen (14) days, from the dile of Hance of the nolice or Traffic Tug will result in prosecution -
