Severability ...................................................... 27 _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 1 ARRÊTÉ E-1 (2025) ARRÊTÉ SUR LES ARBRES ATTENDU QUE le conseil municipal de la Ville de Dieppe a adopté une vision écoresponsable et un plan de développement durable en harmonie avec les meilleures pratiques de gestion du territoire; et ATTENDU QUE la protection des arbres joue un rôle essentiel dans les objectifs et des principes du développement durable, de bien-être pour la santé des résidents et de protection de la biodiversité; et PAR CONSÉQUENT, en vertu des pouvoirs que lui confère la Loi sur la gouvernance locale, chapitre 18, le conseil de la Ville de Dieppe, dûment réuni, adopte ce qui suit : 1. Définitions Les définitions qui suivent s'appliquent au présent arrêté : « agent d'exécution des arrêtés » Personne nommée et désignée agent d'exécution des arrêtés par le conseil municipal de Dieppe (by-law enforcement officer); « analyse géotechnique » échantillonnage terrain des conditions souterraines d'un site réalisé par une entreprise spécialisée en analyse des sols et limité à l'emprise nécessaire pour la circulation de la machinerie (geotechnical analysis); « arboriculteur » Spécialiste en soin et en entretien des arbres, qui peut être diplômé en technologie forestière, un forestier professionnel accrédité, ou un architecte paysager (arborist); « arbre » Toute espèce de plante vivace ligneuse, y compris son système racinaire, d'un minimum de dix (10) cm de DHP, qui a atteint ou peut atteindre une hauteur minimale de quatre cent cinquante (450) cm lorsqu'elle parvient à sa maturité physiologique et tout arbre à planter n'ayant pas encore atteint dix (10) cm de DHP (tree); « arbre à planter » Produit de pépinière utilisé pour BY-LAW E-1 (2025) TREE BY-LAW WHEREAS the Council of the City of Dieppe has adopted an eco-responsible vision and a sustainable development plan in harmony with the best management practices of the territory; and WHEREAS the protection of trees plays an essential role in the objectives and principles of sustainable development, the well-being of residents and the protection of biodiversity; and NOW THEREFORE, the Council of the City of Dieppe, duly assembled, pursuant to its authority under the Local Governance Act, Chapter 18, enacts as follows: 1. Definitions The following definitions apply to this By-law: "arborist" means a specialist in the care and maintenance of trees, who may be a graduate in forestry technology, a registered professional forester, or a landscape architect (arboriculteur); "appeal committee" means a committee formed by three (3) people duly appointed by the Council of the City of Dieppe, and mandated to conduct appeal hearings of the Director's decisions to refuse applications for certificates of authorization under this by-law (comité d'appel); "applicant" means the person submitting a request for a certificate of authorization under the present By-law to the City (demandeur); "boundary tree" means a tree that has a portion of its trunk growing over one or more property lines (arbre mitoyen); "by-law enforcement officer" means a person appointed and designated as a by-law enforcement officer by Council of the City of Dieppe (agent d'exécution des arrêtés); _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 2 remplacer un arbre ou compenser la création d'infrastructure civile, commerciale, industrielle et résidentielle, soit un produit de pépinière feuillu d'un calibre d'au moins quatre cm et demi (4,5) de diamètre à quinze (15) cm du sol et de deux cents (200) cm de hauteur, soit un produit de pépinière conifère d'une hauteur d'au moins cent cinquante (150) cm, soit un autre arbre approuvé par le directeur (planting tree); « arbre d'intérêt » Tout arbre ayant un DHP d'au moins trente (30) cm, dont la longévité est suffisante et dont la vigueur est adéquate et dont l'essence ne possède pas de caractères écologiques indésirables comme par exemple une espèce envahissante (tree of interest); « arbre mitoyen » Arbre dont une partie du tronc pousse au-dessus d'une ou de plusieurs limites de propriété (boundary tree); « arbre municipal » Un arbre dont le tronc ou plus de la moitié de la base du tronc est situé sur la propriété publique. Tout arbre municipal est considéré comme une propriété de la Ville (municipal tree); « arbre à protéger » Tout arbre identifié comme arbre à protéger dans un certificat d'autorisation; il peut s'agir d'un arbre ou d'une zone boisée, d'un arbre d'intérêt, ou tout autre arbre désigné par le directeur (protected tree); « arbuste » Plante vivace ligneuse dont la croissance en hauteur n'atteint pas plus de sept (7) m et dont la tige se ramifie près du sol (shrub); « certificat d'autorisation » Certificat d'autorisation émis par la Ville pour la coupe et la plantation d'arbre à planter (certificate of authorization); « comité d'appel » Comité de trois (3) personnes dûment nommées par le Conseil de la Ville de Dieppe, et mandaté de procéder aux audiences d'appel de décisions du directeur de refuser des demandes de certificats d'autorisation sous le présent arrêté (appeal committee); « demande de permis reçue et payée » Toute demande de permis d'aménagement, de lotissement "certificate of authorization" means a certificate of authorization issued by the City for the cutting and planting of trees (certificat d'autorisation); "corporation" business or legal entity in charge of producing goods or services (personne morale); "destroy" means to remove, cut, or alter a tree or any part thereof to such an extent that it cannot recover (détruire); "diameter at breast height" or "DBH" means the width of the trunk of a tree measured at one hundred and thirty (130) cm from the ground, where the first branching occurs below one hundred and thirty (130) cm, the cumulative diameters of the three largest trunks at one hundred and thirty (130) cm height are added together (diamètre à hauteur de poitrine, DHP); "director" means the person responsible for issuing the certificate of authorization or any of their agents, unless otherwise specified in this By-law (directeur); "frontage" means the horizontal distance between the side lot lines measured along the front lot line; in the case of a corner lot, the front and flank lot lines are deemed to extend to their hypothetical point of intersection for the purpose of calculating the frontage (façade); "geotechnical analysis" means a field sampling of subsurface conditions on a given site, carried out by a firm specializing in soil analysis and limited to the right-of-way required for machinery circulation (analyse géotechnique); "good arboricultural practices" means the harvesting, pruning, maintenance or protection of trees in a forest or urban setting to reduce damage or loss to those same trees or surrounding ecosystems, or to enhance productive, aesthetic or recreational functions (saines pratiques arboricoles); "intervention zone" means that portion of the City designated as an intervention zone as illustrated in Appendix A (zone d'intervention); _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 3 ou de construction jugée recevable et payée au Service de planification et de développement de la Ville ayant été assignée à un numéro de dossier (permit application received and paid); « demandeur » personne qui soumet une demande de certificat d'autorisation en vertu du présent arrêté à la Ville (applicant); « détruire » Enlever, couper ou altérer un arbre ou une de ses parties à un point tel qu'il ne peut s'en remettre (destroy); « diamètre à hauteur de poitrine » ou « DHP » Largeur du tronc d'un arbre mesurée à cent trente (130) cm du sol, dans le cas où le premier embranchement survient en dessous de cent trente (130) cm, les diamètres cumulatifs des trois plus gros troncs à cent trente (130) cm de hauteur sont additionnés (diameter at breast height, DBH); « directeur » Responsable de l'émission du certificat d'autorisation ou l'un ou l'autre de ses mandataires, sauf indication contraire dans le présent arrêté (director); « essence » Espèce ou variété d'arbre (tree species); « étude arboricole » Rapport sur les arbres présents sur un site ou en périphérie préparé par un arboriculteur et autres informations selon les lignes directrices fournies par la Ville (tree study); « façade » La distance horizontale séparant les limites latérales mesurées le long de la limite avant; dans le cas de lot de coin, les limites avant et de flanc sont réputées s'étendre jusqu'à leur point hypothétique d'intersection pour le calcul de la façade (frontage); « personne morale » Corporation ou entreprise en charge de produire des biens ou services (corporation); « rue » L'emprise intégrale de chaque route publique ou chemin public ou accès privé (street); « saines pratiques arboricoles » Opérations de récolte, d'élagage, d'entretien ou de protection des arbres en milieu forestier ou urbain visant à réduire "municipal tree" means a tree in which the trunk or more than one-half of the base of the trunk is located on public property. All municipal trees are considered to be city property (arbre municipal); "permit application received and paid" means an application for a development, subdivision or building permit that has been accepted and paid to the City's Planning and Development Department and has been assigned a file number (demande de permis reçue et payée); "planting tree" means a nursery product used to replace a tree or to compensate for the creation of civil, commercial, industrial and residential infrastructure, and includes a deciduous nursery product that is at least four and one-half (4.5) cm diameter at fifteen (15) cm above soil line and two hundred (200) cm in height, a coniferous nursery product that is at least one hundred and fifty (150) cm in height, or another tree that is approved by the Director (arbre à planter); "protected tree" means any tree identified as a protected tree in a certificate of authorization and may include a tree or wooded area, a tree of interest, or any other tree designated by the Director (arbre à protéger); "protection zone" means the area on the ground from the trunk as defined in the table to Section 29 (zone de protection); "public utility" means a network, work, plant, equipment or service, whether public or private, that is intended for use by the public, and includes water, sewage and storm water systems, gas pipelines, treatment facilities, lift stations, pumping stations, telephone lines, cable lines and power lines (service public); "shrub" means a woody perennial plant that grows to a height of not more than seven (7) m and has a stem that branches near the ground (arbuste); "street" means the entire right-of-way of every public road or public way or private access (rue); _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 4 les dommages ou les pertes de ces mêmes arbres ou des écosystèmes avoisinants, ou à l'amélioration des fonctions productives, esthétiques ou de plaisance (good arboricultural practices); « service public » Réseau, ouvrages, usine, équipement ou services, publics ou privés, destinés à l'usage du public; la présente définition vise notamment les réseaux d'eau et d'évacuation des eaux usées et des eaux pluviales, les gazoducs, les installations de traitement, les stations de relèvement, les postes de pompage, les lignes téléphoniques et les lignes de câblodistribution et de transport d'énergie (public utility); « zone boisée » Groupement d'arbres divers et les plantes du sous-étage incluant les plantes herbacées, arbustives ainsi que la régénération arborescente dont la coupe n'est pas effectuée sur une base régulière (wooded area); « zone de protection » Aire au sol à partir du tronc, définie selon le tableau à l'article 29 (protection zone); « zone d'intervention » S'entend de la partie de la Ville désignée comme zone d'intervention telle qu'illustrée à l'Annexe A (intervention zone) . Section 1 - Conditions générales 2. Généralités Les désignations au pluriel incluent le singulier, le cas échéant, à moins qu'un nombre soit précisé. 3. Champ d'application Le présent arrêté s'applique à l'ensemble du territoire de la Ville tel que défini par l'arrêté concernant les quartiers et la composition du Conseil en vigueur. 4. Conditions (1) À l'exception d'un arbre municipal, lorsqu'un arbre mitoyen touche à la fois à deux propriétés privées ou plus, l'arbre est la responsabilité du propriétaire dont la plus "tree" means any species of woody perennial plant, including its root system, of a minimum of ten (10) cm DBH, which has reached or is capable of reaching a minimum height of four hundred and fifty (450) cm when physiologically mature, and any planting tree that has not yet reached ten (10) cm DBH (arbre); "tree of interest" means any tree with a DBH of at least thirty (30) cm, with sufficient longevity and adequate vigor, and whose species does not possess undesirable ecological traits such as an invasive species (arbre d'intérêt); "tree species" means a species or variety of tree (essence); "tree study" means a report on the trees on or around a site prepared by an arborist and other information according to guidelines provided by the City (étude arboricole); "wooded area" means a grouping of various trees and understory plants including herbaceous, shrubby and regenerating trees that are not cut on a regular basis (zone boisée). Part 1 - General conditions 2. Generalities Designations in plural include the singular, where applicable, unless a number is specified. 3. Application This By-law applies to the entire City as defined by the current Wards and Composition of the Council By-law. 4. Conditions (1) With the exception of a municipal tree, where a boundary tree abuts two or more private properties, the tree is the responsibility of the owner whose property _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 5 grande partie de la base du tronc est située sur son terrain. Exemptions Le présent arrêté ne s'applique pas : (1) à l'arpentage sur une largeur maximale de deux (2) m en soumettant un plan fourni par une personne accréditée par l'association des arpenteurs-géomètres du Nouveau-Brunswick; (2) aux activités d'analyses géotechniques de qualité et de structure du sol avec documentation fournie par une entreprise spécialisée; (3) à une société de la Couronne; (4) à un arbre situé dans un bâtiment, un solarium, une cour intérieure ou sur une toiture-jardin; (5) à une entreprise exploitant un verger, une érablière, ou une pépinière en activité; (6) à la coupe ou l'entretien des branches qui nuisent à la sécurité publique tel que décrit au paragraphe 9(2); (7) au détenteur d'un permis de construction ou d'aménagement émis avant le 12 juin 2023; (8) au demandeur d'un permis de construction ou d'aménagement dont la demande est dûment reçue et payée au Service de has the greater part of the base of the trunk on the property. (2) The terms and conditions of a certificate of authorization issued under this By-law are transferable to any individual or corporation taking possession of the subject lot or any person doing work on the lot. (3) A certificate of authorization issued under this By-law shall be valid for a maximum of two (2) years, after which time the applicant shall reapply and pay the applicable fee. 5. Exemptions This By-law does not apply to: (1) the surveying of a maximum width of two (2) m with the submission of a plan by a person licensed by the Association of New Brunswick Land Surveyors; (2) geotechnical analysis activities to assess soil quality and structure with supporting documentation submitted by a specialized firm; (3) a Crown Corporation; (4) a tree located in a building, sunroom, interior courtyard or on a roof garden; (5) a business operating an orchard, maple grove, or an active tree nursery; (6) The cutting or maintenance of branches that interfere with public safety as described in Subsection 9(2); (7) the holder of a building or development permit issued prior to June 12th, 2023; (8) an applicant for a building or a development permit whose application is duly received and paid for at the Planning and _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 6 planification et de développement avant le 12 juin 2023. 6. Interdictions (1) Nul ne peut endommager ou détruire un arbre, ou en permettre la destruction ou l'endommagement ainsi que le remblai ou le creusage à l'intérieur de la zone de protection d'un arbre. (2) Nul ne peut planter un arbre sur un terrain appartenant à la Ville. 7. Déclaration et certificat d'autorisation (1) À l'extérieur de la zone d'intervention, nonobstant l'article 6, toute personne désirant couper un arbre doit fournir des informations à la Ville selon la procédure en vigueur, notamment : a) Le nombre et l'essence des arbres coupés; b) L'emplacement des arbres ou la superficie coupée; c) Le plan de plantation le cas échéant, incluant les essences et la taille des plants; d) Toute autre information pertinente demandée par la Ville afin d'effectuer ses analyses. (2) À l'intérieur de la zone d'intervention, nonobstant l'article 6, la plantation d'un arbre sur un terrain de la Ville ou l'endommagement ou la destruction d'un arbre peu importe sa localisation est autorisé lorsqu'un certificat d'autorisation est émis à la suite d'une demande complète déposée à la Ville. Section 2 - Processus de demande de certificat d'autorisation Development Department prior to June 12th, 2023. 6. Prohibitions (1) No one shall damage or destroy, or permit the destruction or damage of, a tree, or fill or excavate within the protection zone of a tree. (2) No one shall plant a tree on land owned by the City. 7. Notification and certificate of authorization (1) Outside the intervention zone, notwithstanding Section 6, any person that desires to cut down a tree shall notify the City with appropriate information following the current procedure, including: a) The number and species of trees cut; b) The location of the trees or the surface area cut; c) The planting plan, if applicable, including species and size of plants; d) Any other relevant information requested by the City for the purpose of conducting its analysis. (2) Within the intervention zone, notwithstanding Section 6, the planting of a tree on City property or the damaging or destroying of a tree regardless of its location is authorized when a certificate of authorization is issued following a complete application filed with City. Part 2 - Application process for a certificate of authorization _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 7 8. Demande de certificat d'autorisation (1) Quiconque entend endommager ou détruire un arbre situé à l'intérieur de la zone d'intervention doit au préalable présenter au directeur une demande de certificat d'autorisation en suivant la procédure en vigueur. (2) Quiconque entend couper plus du quart des branches vivantes d'un arbre situé à l'intérieur de la zone d'intervention doit au préalable présenter une demande de certificat d'autorisation en suivant la procédure en vigueur. 9. Arbres dangereux ou posant un risque pour la sécurité publique (1) Lorsque l'abattage d'urgence d'un arbre est nécessaire, lorsque la probabilité d'une chute de l'arbre est imminente et qu'un arbre ou une partie d'un arbre présente un risque extrême, le propriétaire peut procéder immédiatement à la coupe de l'arbre ou ses parties mais doit avertir la Ville dans les sept (7) jours suivants l'événement et fournir des pièces justificatives, sans s'y limiter, un rapport d'arboriculteur ou validation d'un employé de la Ville, et des photographies de l'arbre, l'espèce et les caractéristiques de taille et de hauteur de l'arbre et de la distance par rapport au bâtiment, le cas échéant. (2) La Ville peut faire ou faire faire des travaux d'élagage ou d'émondage d'arbres ou de parties d'arbres selon de saines pratiques arboricoles, par exemple coupe d'une branche jusqu'au tronc, s'il est démontré que l'arbre ou ses parties empiètent sur les infrastructures municipales notamment dans les cas suivants : a) À deux (2) m au pourtour de tout panneau de signalisation ou tout panneau de nom de rue; b) Cinq (5) m au-dessus de la chaussée d'une rue; 8. Application for a certificate of authorization (1) Any person who intends to damage or destroy a tree within the intervention zone shall first apply to the Director for a certificate of authorization following the current procedure. (2) Any person who intends to cut more than one-quarter of the live branches of a tree located within the intervention zone shall first apply to the Director for a certificate of authorization following the current procedure. 9. Dangerous trees or trees that pose a risk to public safety (1) Where emergency cutting of a tree is necessary, where the likelihood of the tree falling is imminent and a tree or part of a tree poses an extreme risk, the owner may immediately proceed with the cutting of the tree or part thereof but must notify the City within seven (7) days of the event and provide supporting documents, including, but not limited to, an arborist's report or validation from a City employee, and photographs of the tree, the species and characteristics of the size and height of the tree and the distance from the building if applicable. Étude arboricole Toute coupe d'arbre doit faire l'objet d'une étude arboricole effectuée dans les dix-huit (18) mois précédant la date de demande, afin d'analyser la demande de certificat d'autorisation. Tree study All tree cutting shall be subject to a tree study conducted within eighteen (18) months prior to the date of application, for the purpose of analyzing the application for a certificate of authorization. The requirements for a tree study may include the following: (1) contact information of the lot owner; (2) contact information of the contractor and authorized agent; (3) location of trees to be removed or wooded areas; (4) species; (5) DBH; (6) height; (7) crown condition and growth form; (8) tree condition or vigor index; (9) stand description of wooded areas if applicable; (10) applicant's reasons for removal; _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 9 (11) recommandations de l'arboriculteur; (12) plan des tracés utilisés pour l'inventaire dans les zones boisées; (13) plans ou croquis indiquant l'emplacement des arbres; (14) mesures de protection des arbres proposées; (15) confirmation et consentement pour les arbres en limite de propriété; (16) renseignements sur les arbres à planter proposés s'il y a lieu; (17) renseignements supplémentaires; (18) réglementation fédérale et provinciale; (19) déclaration volontaire; (20) date de l'évaluation; (21) toute autre information pertinente requise par le directeur. 11. Person authorized to provide a tree study The tree survey may be conducted by a qualified City staff member or may be provided by the applicant if it has been conducted by an arborist. If the applicant requires the City's services, the order of priority for processing files shall be on a first-come, first-served basis. 12. Validation of the tree study (1) All tree studies submitted as part of an application for a certificate of authorization may be validated by the City. (2) If inaccuracies are noted, the City may require that the tree study be corrected or redone. _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 10 13. False information from an arborist (1) Any arborist who knowingly provides a report containing false or misleading information concerning the health, size, location, species, or any other aspect related to the protection and conservation of trees shall be subject to a fine and a prohibition from submitting any tree study or technical documents relating to the By-law for a period of two (2) years in the case of a first offence and four (4) years in the case of a subsequent offence. (2) The discovery of false or misleading information in the survey provided by an arborist shall be validated in writing by an expert appointed by the municipality. (3) Before applying the penalty provided for in Subsection (1), the municipality shall notify the affected arborist of the discovery of the false or misleading data and provide the arborist with an opportunity to present their defence in writing. (4) The decision of the Director shall be communicated to the arborist in writing, setting out the reasons and evidence upon which the decision is based and the process for appeal. (5) The affected arborist shall have thirty (30) days from notification of the decision to appeal the sanction to the clerk's office. The sanction shall not be enforceable while the appeal is being considered. (6) Upon confirmation of the penalty by the Clerk's Office, the arborist shall immediately be prohibited from submitting tree studies or other technical documents relating to the By- law. _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 11 (7) À l'issue de la période d'interdiction, la Ville acceptera de recevoir des études arboricoles de la part de l'arboriculteur. 14. Consent All applications for a certificate of authorization must be accompanied by a written consent, where required, from the owner(s) of the land in question as well as from any owner whose trees are boundary trees. 15. Issuance of a certificate of authorization The Director may issue or amend a certificate of authorization to an applicant allowing damage or destruction of trees if the Director determines that the analysis of the file demonstrates one or more of the following conditions: (1) that the damage or destruction is the only reasonable option for carrying out a project subject to a properly issued development, construction or demolition permit; (2) the removal of hazardous, dead, diseased or severely damaged trees or branches is necessary for safety reasons; (3) the trees in question damage or may damage a load-bearing structure or roof structure; (4) that the damage or destruction is necessary to remediate the contaminated soil; (5) that the trees will be transplanted and properly prepared for transplantation; (6) the damage or destruction is necessary for the installation, operation or maintenance of utility, water or wastewater infrastructure required for the construction or use of a building or structure; _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 12 (7) qu'un plan de plantation et de protection des arbres répond aux exigences de l'arrêté; (8) que l'endommagement ou la destruction sont conformes à de saines pratiques arboricoles; (9) qu'il existe d'autres circonstances que le directeur juge appropriées. 16. Conditions of the certificate of authorization The Director may attach conditions to a certificate of authorization including: (1) measures to be taken during the work for trees to be protected or wooded areas, if any, in accordance with Sections 29 to 31 of this By-law; (2) the application of good arboricultural practices; (3) conditions in relation to planting trees; (4) the requirement to have an arborist carry out or supervise the destruction of the tree(s); (5) the circumstances and timing of the damage to or destruction of the tree(s); (6) the compensation measures if the trees of interest or wooded areas cannot be retained; (7) any conditions recommended by an arborist. 17. Appeal process (1) Within fifteen (15) days of receiving notice of the decision, the applicant may request an appeal by notifying the City Clerk in writing and stating the grounds for the appeal. (2) Upon receipt of a request for an appeal, the Clerk shall form an Appeal Committee from _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 14 personnes admissibles et leur transmet le dossier, y compris tout document relatif à l'enquête et à la décision. In its sole discretion, and only in exceptional circumstances, the Appeal Committee nevertheless has the authority to postpone or adjourn a hearing. (6) The members selected to hear the appeal or referral shall designate among themselves the chairperson of the hearing. (7) The chairperson shall have control of the proceedings. The hearing shall be informal and public and shall not be subject to the ordinary rules of evidence and shall be conducted in one of the two official languages chosen by the appellant. (12) Within five (5) days of receiving the Appeal Committee's findings, the Clerk shall forward a copy to the appellant. Part 3 - Creation of housing, commercial or industrial space, new street or project on vacant lot within the intervention zone 19. Minimum planting requirements For any proposed new residential, commercial, or industrial space, or new street development, whether or not trees are cut, the applicant shall plant a minimum of: (1) one (1) tree per dwelling unit and per ninety- three (93) m2 of commercial or industrial space; and _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 16 (2) un (1) arbre à planter par tranche de dix (10) m de façade de nouvelle rue. 20. Conservation of wooded area and trees of interest For an application for a certificate of authorization on projects as described in Section 19, tree conservation measures exempt the applicant from planting trees under the following conditions: (1) Conservation of a wooded area of at least two (2) m wide identified in the tree study exempts the applicant from planting trees at a ratio of one (1) tree per one twenty-five (25) m2 of wooded area preserved; (2) The conservation of a tree of interest identified in the tree study exempts the _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 17 demandeur de planter des arbres selon les ratios décrits à l'article 20. 22. Part 4 - Other project within the intervention zone 24. Replacement for tree cutting With the exception of a tree that is dead, poses an immediate hazard or is affected by a disease or pest, or its cutting is required for public utility installation or maintenance, any authorized tree cutting resulting in the loss of a healthy tree shall be replaced in accordance with the following table: DBH of the tree being cut down rounded up to the nearest whole number Planting tree (cm) 10-29 1* 30-40 4 41-50 5 51-60 6 61-70 7 71-80 8 81-90 9 91-100 10 _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 18 101-110 11 111 et + 12 *Sauf s'il reste sur le site un minimum d'un (1) arbre par dix (10) m de façade de rue, toute fraction d'arbre à planter devant être arrondie à l'entier supérieur. 25. Arbres morts, malades ou dangereux Nonobstant l'article 24, tout arbre retiré parce qu'il est malade, mort ou dangereux doit être remplacé par un (1) arbre à planter à moins qu'il reste au minimum sur le site un (1) arbre par dix (10) m de façade de rue, toute fraction d'arbre à planter devant être arrondie à l'entier supérieur. Section 5 - Conditions générales relatives au certificat d'autorisation 26. Conditions for planting trees (1) The minimum size of the planting tree shall be: a) a deciduous nursery stock of at least fourty-five (45) mm at fifteen (15) cm above soil line and two hundred (200) cm in height; b) a coniferous nursery stock that is at least one hundred and fifty (150) cm in height. Display of the certificate of authorization At least five (5) days prior to the cutting of the tree, the holder of a certificate of authorization shall post the certificate of authorization in a clearly visible location on the tree or trees to be cut or in any other location visible to the public on or near the works. 32. Revocation of a certificate of authorization The Director may revoke a certificate of authorization if: (1) the certificate of authorization was issued on the basis of inaccurate, misleading, false or erroneous information; (2) the certificate of authorization was issued in error; _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 22 (3) le propriétaire ou le titulaire demande par écrit que le certificat d'autorisation soit révoqué; (4) le propriétaire ou le titulaire enfreint les conditions du certificat d'autorisation. 33. Stop work order (1) Where the Director determines that a contravention of this By-law has occurred, the Director may issue an order requiring the person who committed, caused or permitted the contravention to cease the contravening activity. (2) A stop work order shall describe in sufficient detail the nature and location of the contravention and the date by which it must be complied with. (3) No one shall violate a stop work order that has been delivered. (4) A stop work order issued under this Section may be delivered in person by a by-law enforcement officer, posted in a visible location on the property where the violation occurred or sent by email or registered mail to the person violating the By-law. (5) A stop work order personally served by a by- law enforcement officer is deemed to have been served on the day it is delivered to the person or persons affected. (6) If a stop work order is posted on the land, it is deemed to have been served on the day it was posted. Part 6 - Fees related to the certificate of authorization 35. Application fee (1) Except as provided for in Subsection (2), an application for a certificate of authorization shall be accompanied by a standard administrative fee of thirty-five dollars ($35) plus one hundred dollars ($100) per hectare of land if the land is greater than one (1) hectare; (2) The application fees shall not be collected in the following cases: a) pruning is prescribed by an arborist to ensure the health, good condition of the tree and public safety, and is done in accordance with good arboricultural practices; b) an authorized representative of the City confirmed that the tree is dead, diseased, or hazardous tree before or after cutting; c) a mandatory declaration for tree cutting outside the intervention zone. _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 24 36. Deposit and delivery of security (1) Except for a project already subject to a landscape security deposit, prior to issuance of the certificate of authorization, the applicant for the certificate of authorization shall provide a letter of credit or security deposit for planting trees and trees to be protected near the project in the amount of each of the following: a) five hundred dollars ($500) per planting tree; b) five hundred dollars ($500) per ten (10) cm DBH for protected trees, with the DBH being rounded up to the nearest ten; c) five hundred dollars ($500) per one hundred (100) m2 of wooded area to be protected. (2) The security shall be released to the holder of the certificate of authorization upon completion of the planting and protection of the trees to the satisfaction of the City. (3) The City shall activate the letter of credit or cash in part or all of the amount of the security in the event that a Certificate of Approval holder has not planted the required trees within the prescribed time frame or the work has resulted in the damage or death of trees to be protected. 37. Financial compensation (1) The certificate of authorization shall specify a total number of planting trees in accordance with the conditions set out in Sections 19 to 25. For each tree that cannot be planted on the project site or on another site approved by the Director, a financial compensation of five hundred dollars ($500) per planting tree shall be payable to the City prior to the issuance of the certificate of authorization. _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 25 Ville avant l'émission du certificat d'autorisation. Use of funds Fees collected under this By-law shall be used by the City for sustainable development purposes such as tree planting on public or private lands, financial assistance program for trees that have died of natural causes, natural disasters or any other similar purpose. Part 7 - Application of the by-law 39. Fines Any individual or corporation who occupies, uses, authorizes the occupation or use of, or erects or permits the erection of a structure on, a lot or any part of a lot, land or structure, or who furnishes false information in contravention of any of the provisions of this By-law, commits an offence and is liable to the fines provided for as follows: (1) Any person who violates subsections 6(1), 6(2), 7(1), 9(1), or 28(1) commits an offence and is liable to a fine of not less than two hundred dollars ($200) and not more than two thousand one hundred dollars ($2,100) per tree or per one hundred (100) m2 of wooded area affected in the case of an individual and to a fine of not less than five hundred dollars ($500) and not more than two thousand one hundred dollars ($2,100) per tree or per one hundred (100) m2 of wooded area in the case of a corporation. _____________________________________________________________________________________ Arrêté E-1 (2025) By-law E-1 (2025) 27 (2) Quiconque enfreint les paragraphes 9(2), 13(1), 27, 28(3), 28(4), 28(5), 30, 31, 39(2) ou 39(4) commet une infraction et est passible d'une amende minimale de cent dollars (100 $) et maximale de deux mille cent dollars (2 100 $) par infraction dans le cas d'une personne physique et d'un minimum de deux cents dollars (200 $) et maximum deux mille cent dollars (2 100 $) par infraction dans le cas d'une personne morale. Severability If any provision of this By-law or part thereof is declared by a court of competent jurisdiction to be invalid, the remainder of this By-law shall continue in force unless the court orders otherwise. REPEAL By-Law E-1 (2024) entitled Tree By-Law, ordained and passed on February 26, 2024, is repealed.
