## TOWN OF ANTIGONISH
## SEWER CHARGES BYLAW
1. In this Bylaw, unless the context otherwise requires, the expression:
- a) "Building" means any dwelling, house, shop, store, office or any structure which would require sewerage services;
- b) "Engineer" means the Engineer for the Town and includes the Public Works Working Supervisor;
- c) "Town" means the Town of Antigonish
- d) "Municipality" means the Municipality of the County of Antigonish;
- e) "Owner" means a part owner, joint owner, tenant in common or joint tenant of the whole or any part of any land or building and includes a trustee, an executor, an administrator, a guardian, an agent, a mortagee in possession or any other persons having the care and control of any land or building in case of the absence or disability of the person having title thereto, and includes anyone with any legal interest in a building;
- f) "Sewer" means a pipe, conduit or drain, used for the collection and transmission of waste water;
- g) "Sanitary Sewer System" means all pipes, mains, equipment, buildings and structures for collecting, pumping or treatment of wastewater and operated by the Town, but does not include a storm sewer;
- h) "Storm Sewer System" means all pipes, mains and related structures designed exclusively for the collection and transmission of uncontaminated water, stormwater, drainage from land or from any watercourse or any of them;
- i) "Water Utility" means the Water Utility of the Town of Antigonish;
- j) "Year" means the fiscal year of the Town;
- k) "Council" means the Town Council of the Town of Antigonish
- I) "Subdivision" has the same meaning as defined in the Planning Act.
2. Every owner of land
- 1) On which any building is connected to a sewerage system;
"OR"'
- 2) On which a building is situate that Council has ordered connected to a sewerage system or that the Town has allowed connection to a sewerage system;
shall pay to the Town an annual "Sewer Service Charge" for the construction and maintenance of the sewerage system of the Town.
3. Owners shall be billed for sewer services using one of the following methods:
- a) Metered customers - Those owners whose water service is metered shall pay a sewer usage charge for each meter equivalent to a percentage of the total water rates assessed. This percentage shall be calculated annually and together with sewer charges to non-metered customers shall reflect what sum(s) are required to equal expenditures budgeted for in each year. Further to this there shall be a minimum yearly charge applicable for each water meter equivalent to the per unit calculation determined under Clause 3 (b).
- b) Non-metered customers - For non-metered customers the Town shall annually calculate the Sewer Service Charge by dividing the total cost of the sewer system by the total number of equivalent user units within the system. Each owner will be billed for the costs of the sewer system on a pro-rated basis in accordance with Schedule "A" attached hereto. Further to this calculation a minimum annual service charge for a single user unit shall apply, as provided in the Town of Antigonish Municipal User Fees Policy. Equivalent User Units are set out in Schedule "A" of this Bylaw.
4. 1. Sewer Service Charges shall be levied on the owners of all properties liable to pay the same commencing at the earliest full quarter (three months) billing period and bi-monthly billing period as appropriate.
2. For the purposes of this Bylaw, a sewer has been installed when the Town Engineer has certified that the system or project of which the sewer forms part is substantially complete.
5. a) The Sewer Service Charge shall be billed quarterly for unmetered customers as well as ", 3/4" 1" and 1 ½" metered customers. Sewer service charges shall be billed bimonthly for all 2", 3", 4", 6" and 8": metered customers.
- b) The Sewer Service Charge shall be due and payable 30 days after billing.
- c) The Sewer Service Charge, if not paid by the due date, shall bear interest charges equivalent to an additional 1.5% per month calculated on the unpaid balance.
6. 1) The Sewer Service Charge is a lien on the whole of the property and has the same effect as rates and taxes under the Assessment Act.
- a. The Sewer Service Charge and penalty thereon may be sued for and collected in the same manner as other rates and taxes.
- b. Land is liable to be sold for unpaid Sewer Service Charges in the same manner and with the same effect as for unpaid rates and taxes pursuant to the Assessment Act.
7. 1. Where a new sewer connection has been requested or installed between April 1 and November 30 (inclusive), a $300.00 connection fee shall apply.
2. Where a new sewer connection has been requested and installed between December 1 and March 31 (inclusive), a connection charge equal to the actual cost to the Town of installing the service shall apply. A minimum connection charge of $1,000.00 shall apply in these circumstances.
3. For this purposes of this bylaw, a sewer has been installed when the Town Engineer has certified that the system or project of which the sewer forms part is substantially complete.
4. The sewer connection charge is a lien and may be collected in the same manner as the sewer service charge.
