1 TOWN OF BRIDGEWATER POLICY CLOSURE OF CERTAIN PUBLIC STREETS - LOGAN ROAD (PORTION) PURPOSE It shall be the policy of the Town of Bridgewater to permanently close any street or part of a street, in accordance with the Municipal Government Act. POLICY Town Council for the Town of Bridgewater shall close to public use portions of Logan Road in two phases, and those portions of the street to be closed are described as follows: ALL and singular that certain parcel or tract of land, situated, lying and being at Town of Bridgewater, Lunenburg County, Nova Scotia, being designated Lot TOB-1 and Lot TOB-2, a portion of Logan Road to be acquired by Michelin North America (Canada) Inc. Michelin Amerique Du Nord (Canada) Inc., and being more particularly shown on Plan of Survey No. 22,684, prepared by Berrigan Surveys Limited, Nova Scotia Land Surveyors, dated January 27, 2023, which said lot may be more particularly described as follows: Phase 1 (Lot TOB-1): BEGINNING at a point marked by a survey marker, marking the northwestern corner of the herein described lot, which said point marks the most southern corner of Parcel C, property of Michelin North America (Canada) Inc., the northeastern corner of Lot IP-107C2, property of His Majesty the King in Right of the Province of Nova Scotia (Department of Transportation and Active Transit) and the southwestern corner of Logan Road. THENCE from said point so located North 59 degrees 15 minutes 34 seconds East (grid bearings), 49.498 metres to a survey marker, marking the most northern corner of the herein described lot and the northwestern side line of Lot IP-1, property of Michelin North America (Canada) Inc. THENCE southwesterly along the northwestern side line of Lot IP-1, along the arc of a curve to the left, having a radius of 1,110.851 metres, an arc distance of 20.598 metres to a point, tie line between the last mentioned point and survey marker described as South 21 degrees 33 minutes 54 seconds West for a distance of 20.598 metres. THENCE North 75 degrees 14 minutes 41 seconds West along the northern side line of Lot TOB-2, 30.544 metres to a point, marking the southwestern corner of the herein described lot and the southeastern side line of Lot M-2, property of Michelin North America (Canada) Inc. Michelin Amerique Du Nord (Canada) Inc. THENCE North 21 degrees 10 minutes 41 seconds East along the southeastern side line of Lot M-2, 12.181 metres to a survey marker, marking the southeastern corner of Lot M-1, property of Municipal Enterprises Limited. THENCE North 20 degrees 39 minutes 21 seconds East along the southeastern side line of Lot M-1, 21.233 metres to a survey marker, marking the most southern corner of Lot IP-105, other property of Municipal Enterprises Limited. THENCE North 21 degrees 06 minutes 43 seconds East along the southeastern side line of Lot IP-105, 106.718 metres to an iron bolt, marking the most southern corner of Lot IP-107C1, property of His Majesty the King in Right of the Province of Nova Scotia (Department of Transportation and Active Transit). THENCE North 21 degrees 04 minutes 30 seconds East along the southeastern side line of Lot IP-107C1 and Lot 1P-107C2, 101.703 metres to a survey marker marking the place of beginning. The herein described lot of land contains an area of 7,899.0 square metres. Phase 2 (Lot TOB-2): BEGINNING at a point marked by an iron bolt, marking the most southern corner of the herein described lot, which said point marks the northeastern side line of St. Phillips Street, the most western corner of Lot B, property of Town of Bridgewater and being located at a bearing of North 34 degrees 26 minutes 37.0 seconds West (grid bearings) for a distance of 2,734.312 metres from Nova Scotia High Precision Network Coordinate Monument No. 200809. THENCE from said point so located North 72 degrees 18 minutes 45 seconds West along the northeastern side line of St. Phillips Street, 26.326 metres to an iron bolt, marking the southwestern corner of the herein described lot and the most southern corner of Lot B, other property of Town of Bridgewater. THENCE North 17 degrees 44 minutes 11 seconds East along the southeastern side line of Lot B, 18.821 metres to a point. THENCE northeasterly along the southeastern side line of Lot B, along the arc of a curve to the left, having a radius of 77.261 metres, an arc distance of 20.572 metres to a survey marker, marking the most southern corner of Lot A, property of Michel North America (Canada) Inc. Michelin Amerique Du Nord (Canada) Inc., tie line between the last mentioned survey marker and point described as North 10 degrees 06 minutes 29 seconds East for a distance of 20.512 metres. THENCE northwesterly along the northeastern side line of Lot A, along the arc of a curve to the left, having a radius of 77.261 metres, an arc distance of 50.632 metres to a point, tie line between the last mentioned point and survey marker described as North 16 degrees 17 minutes 39 seconds West for a distance of 49.731 metres. THENCE North 54 degrees 55 minutes 53 seconds East along the northeastern side line of Lot A, 2.438 metres to a point. 3 THENCE North 35 degrees 04 minutes 07 seconds West along the northeastern side line of Lot A, 18.093 metres to a point. THENCE northwesterly along the northeastern side line of Lot A, along the arc of a curve to the right, having a radius of 117.122 metres, an arc distance of 64.004 metres to a point, marking the most southern corner of other property of Town of Bridgewater, tie line between the last two mentioned points described as North 19 degrees 15 minutes 06 seconds West for a distance of 63.210 metres. THENCE northeasterly along the eastern side line of said Town of Bridgewater property, along the arc of a curve to the right, having a radius of 117.122 metres, an arc distance of 19.440 metres to a point, tie line between the last two mentioned points described as North 01 degree 09 minutes 30 seconds East for a distance of 19.417 metres. THENCE North 75 degrees 53 minutes 53 seconds West along the northeastern side line of said Town of Bridgewater property, 11.886 metres to a point, marking the southeastern side line of Lot M-2, property of Michelin North America (Canada) Inc. Michelin Amerique Du Nord (Canada) Inc. THENCE North 21 degrees 04 minutes 30 seconds East along the southeastern side line of Lot M-2, 10.930 metres to a point. THENCE North 21 degrees 10 minutes 41 seconds East along the southeastern side line of Lot M-2, 34.430 metres to a survey marker, marking the most northern corner of the herein described lot and the southwestern corner of Lot TOB-1. THENCE South 75 degrees 14 minutes 41 seconds East along the southern side line of Lot TOB-1, 30.544 metres to a point, marking the northeastern corner of the herein described lot and the southwestern side line of Lot IP-1, property of Michelin North America (Canada) Inc. THENCE South 21 degrees 04 minutes 30 seconds West along the northwestern side line of Lot IP-1, 44.992 metres to a survey marker, marking the northeastern side line of Lot A-B, other property of Michelin North America (Canada) Inc. THENCE North 75 degrees 30 minutes 25 seconds West along the northeastern side line of Lot A-B, 3.294 metres to a point. THENCE southeasterly along the western side line of Lot A-B, along the arc of a curve to the left, having a radius of 101.882 metres, an arc distance of 69.955 metres to a point, tie line between the last two mentioned points described as South 15 degrees 21 minutes 46 seconds East for a distance of 68.589 metres. THENCE South 35 degrees 04 minutes 07 seconds East along the southwestern side line of Lot A-B, 35.448 metres to a point. THENCE southeasterly along the southwestern side line of Lot A-B, along the arc of a curve to the right, having a radius of 81.680 metres, an arc distance of 54.305 metres to a survey marker, marking the northwestern corner of Lot B, tie line between the last mentioned point and survey marker described as South 16 degrees 01 minute 21 seconds East for a distance of 53.310 metres. THENCE southwesterly along the northwestern side line of Lot B, along the arc of a curve to the right, having a radius of 81.680 metres, an arc distance of 21.152 metres to a point, tie line between the last mentioned survey marker and point described as South 10 degrees 26 minutes 34 seconds West for a distance of 21.093 metres. 4 THENCE South 17 degrees 51 minutes 41 seconds West along the northwestern side line of Lot B, 19.202 metres to an iron bolt, marking the place of beginning. The herein described lot of land contains an area of 5,241.0 square metres. And in particular, the parcel now or formerly identified as PID 60383535 as shown on a Plan of Survey as filed under Plan #122957195 on August 23, 2023, at the Lunenburg Land Registration Office, and shall form part of Logan Road being a public street located within the boundaries of the Town of Bridgewater, in conjunction with the Statutory Declaration filed under Document#122957229 on August 23, 2023, at the Lunenburg County Land Registration Office. And that the two portions of the street above described be closed, and that all rights of public user therein be forever extinguished, and that the town may sell and convey the said lands. This street closure shall be referred to as Policy 112 of the Town of Bridgewater as approved this 27th day of March, 2023, with the first revision on the 9th day of September, 2024 and the second revision on this 9th day of December, 2024.
