## CAPE BRETON REGIONAL MUNICIPALITY
## BY-LAW NUMBER C-200
## CIRCUS ANIMAL PROHIBITION BYLAW
A bylaw in and for the Cape Breton Regional Municipality enacted under the authority of Scapter 72) of the heres on with and ent animals in any clear permane for the amusement of any audience or the public.
## Short title:
1. This Bylaw may be referred to as the "Circus Animal Prohibition Bylaw" of the Cape Breton Regional Municipality.
## Definitions:
2. In this Bylaw:
2. "Animal" means for the purposes of this bylaw those animal listed in Appendix A.
3. "Circus" means a travelling company of performers that may include acrobats, clowns, trained animals, trapeze acts, musicians, hoppers, tightrope walkers, jugglers, unicyclists and other stunt-oriented artists.
## Conditions:
3. Subject to Section 4 herein, no person shall operate or carry on, in the Cape Breton egional Municipality, the business of a circus or similar performance in which any wil r exotic animals. listed in Schedule A, which is attached and forms a part of this bylaw perform tricks, or participate in performances of any kind for the amusement of the audience.
## Exceptions:
4. Nothing in this bylaw shall prohibit or restrict the following:
2. (a) Exhibitions or performances in which individuals ride horses or ponies;
3. (b) Exhibitions or displays of animals in agricultural fairs, exhibitions, or pet shows;
4. (c) Horse races or dog races;
5. (e) The use of animals in magic acts;
6. (d) Rodeos;
7. (f) The use of animals exclusively for educational purposes.
## Penalty:
- 5.1 Subject to Section (4), the owner of any circus who fails to comply with this bylaw is guilty of an offence and is subject to a penalty of $2000.00.
- 5.2 For the purpose of this bylaw each animal, as listed in schedule A, is deemed to be a separate offence and every day during which the condition is not remedied is a separate offence.

The following list of animals, listed by species, includes all such animals whether wild or captive bred and also includes all their hybrids with domestic species. The words in parentheses are only examples of a particular group and are not to be construed as limiting the generality of the group.
- All non-human Primates (such as gorillas and monkeys)
- All Felids (such as tigers, leopards and panthers)
- All Canids (such as dogs)
- All Ursids (such as bears)
- All Elephants
- All Pinnipeds (such as seals, fur seals and walruses)
- All Crocodilians (such as alligators and crocodiles)
- All Marsupials ( such as kangaroos and opossums)
- All Snakes
- All Artiodactylus Ungulates (such as goats, sheep and pigs)
- All Perissodactylus Ungulates (such as horses and mules)
- All Hyaenas
- All Birds
- All Mustelids ( such as skunks, weasels, otters and badgers)
- All Procyonids (such as raccoons and coatis)
- All Edentates (such as anteaters, sloths and armadillos
- All Viverrids (such as mongooses, civets and genets)
- All poisonous tarantulas and scorpions
- All venomous amphibians (such as frogs, salamanders, toads, and other reptiles)
