BEITENACTED bytheCapeBreton Regional Council thatBylaw _____ Respecting OpenAir Burning ishereby enacted: CAPEBRETONREGIONALMUNICIPALITY BYLAWNUMBERB _______ RESPECTINGOPENAIRBURNING Title 1. ThisBylaw shallbeknown asthe "CapeBreton Regional Municipality Burning Bylaw". Definitions 2. InthisBylaw; a) " FireChiefmeans , forthepurposes ofthisBylaw, theCaptain orChief Officerof firedepartment" or "firecompany", orhisdesignate, inandforthefireprotection districtoftheMunicipality inwhichthefireisproposed tobeignited; b) " FireProtection District" means thatareaoftheMunicipality whichafire department orafirecompany serves andforwhichitisresponsible. c) " Municipality" means CapeBreton Regional Municipality; d) " Permit" means aPermitforburning intheopenairissued bytheFireChief under theauthority ofthisBylaw; e) " Suitably Equipped" means beinginpossession oftoolsorequipment, including without limitation, brooms, rakes, back-tanks, shovels, hosesandanadequate water supply, whichmaybeusedtocontain and/orprevent thespread ofafire ignitedintheopenair; f) " Grate" meansametalracksupported onanon-combustible enclosure; g) OpenAir" means notwithinabuilding; AreaofApplication 3. a) ThePermitting provisions ofthisBylaw shall applytothoseareasofthe Municipality listedinSchedule "A". b) Burning isprohibited intheareasoftheMunicipality listedinSchedule "B". Prohibition 4. ( 1) Notwithstanding anyotherprovision ofthisBylaw, butsubjecttoSection 4 (3) and (4), noperson shalligniteafireintheopenairinanyareaoftheMunicipality identified inSchedule "B" attached toandforming partofthisBylaw. 2) Except ashereinafter provided, andwhileaPermitisinforce, noperson shall light, igniteorstarttoalloworcausetobelighted, ignited orstarted, afireofany kindwhatsoever intheopenairwithout firsthaving obtained aPermit todoso fromtheFireChiefintheformsetoutatSchedule "C" attached toandforming partofthisBylaw. 3) Nothing inthisBylaw shallprohibit themaking ofafirebyaperson travelling in thewoods forthepurpose ofcooking orobtaining warmth orasadistress signal ifthefireismadeinasuitable place andprecautions aretakenagainst the spreading ofthefire. 4) ThisBylaw doesnotapplytofiresmadetocookfoodinbarbecues, grates, or othercooking appliances. PermitApplication 5. ( 1) Anyperson whoproposes toigniteafireshallmake application totheFireChief foraPermit. 2) TheFireChief mayissueaPermit whereitisdetermined thattheprovisions of thisBylaw aremetandthattheproposed burning doesnotposeahazardto persons orproperty. 3) Inmaking adetermination undersubsection (2) theFireChief shalltakeinto consideration thefollowing: a) thenumber ofPermits issuedonaparticular day; b) thevelocity ofthewind; c) thegeneral weather conditions prevalent; d) whether ornottheapplicant issuitably equipped toensure thefireis maintained andundercontrol; e) theproposed manner andmethod ofburning; f) whether theapplicant ownsoristheoccupant ofthelanduponwhichthe burning isintended tooccur, orhasthewritten consent, produced prior totheissuance ofthePermit, oftheownerofthelanduponwhich the burning willoccur; g) whether theapplicant is19yearsofageorolderandensures thatatleast oneotherperson, of19yearsofageorgreater, suitably equipped to control thefire, willbepresent whilethefireisburning orsmouldering; h) anyothermatterthattheFireChief determines isrelevant tosafety. 4) APermit issued under theauthority ofthisBylaw mayberevoked bytheFireChiefat anytimewhereitisdetermined thattheproposed burning willposeahazard topersons or property; 5) Where theFireChiefdetermines thattheproposed burning wouldbeahazard tosafetyor wherethereisafailure tomeettherequirements oftheBylaw, theFireChief shallrefuse toissueaPermit. 6) TheFireChiefmaydesignate thelocation where andhoursduring which applications for Permits shallbereceived. 7) TheFireChiefmayspecify onthePermit thehoursofthedayandthenumber ofdays during whichthePermit shallbevalid, andinsodoing, maydistinguish between Permits issuedforcommercial orotheruses, butnoPermit shallbeissuedforaperiod exceeding twoweeks. 8) a) ADomestic Permit maybeissuedtoalandowner, oranoccupant withthe landowners permission, toburnPermitted material onasinglelot. b) ADomestic Permit maybeissuedtoPermit burning ofblueberry fields undertwohectares. c) AnIndustrial/Commercial Permit shallberequired for: I) blueberry burning inexcess of2hectares II) anyburning thatanindividual orcontractor hasbeenpaidtodo d) Thefeesforburning Permits shallbe: Domestic NotDetermined Industrial e) Thefeesforburning Permits willnotbeaddedtothosealready required fromtheDepartment ofNatural Resources. 9) Taking intorespect allother conditions, theissuingofaPermit toburnatanytimeof year, during ourfrequent periods ofwetweather, mayapply. i.e. grass, sticks, garden stumble, etc. maybepiledandprotected byatarpuntilrainyweather. Restrictions 6. Thefollowing requirements shallapplyatalltimestothemaking ofthefireforwhicha Permitisissued: a) theholder ofthePermit shallensure thatthePermitisavailable atthesceneofthe fire; b) noperson shallburnrubber tires, oil, plastic, petroleum products orotherlike materials; c) allmaterial tobeburned shallbepiledandplacedatleast15metres fromother combustible material; d) wheretwoormorepilestobeburned aresituate onasinglesite, onlyonepile maybeburned atatime; e) nofireshallbeignited whenthewindisblowing offsufficient velocity such thatitmayjeopardize thePermit holder'sabilitytocontrol thefire; f) thepersontowhomaPermitisissued shallensure thatthefireisnotleft unattended andthatallsmouldering embers arecompletely extinguished after burning iscompleted; g) thepersontowhomaPermitisissued shallensure thatthemethod ofburning and material burned isconsistent withtheinformation provided totheFireChief whenthePermit wasissued; h) thefiredepartment shallbenotified immediately ifthefireisorappears tobe getting outofcontrol; i) noburning shallcommence before8:00amandfiresmustbeextinguished by 9:00p.m. ofthesameday; j) ThePermit Holder mayberequired topayallexpenses incurred incontrolling or extinguishing anyfirewhichmaygetbeyond control orbeindangerofdoingso orextendtolandsofothers. Penalty 7. ( 1) Anyperson whomakes, lights, ignites, orstartsorallowsorcausesafiretobe lighted , ignitedorstartedintheopenairwithout aPermit shallbeliabletoa penalty onconviction ofnotlessthanOneHundred Dollars ( $100) andnotmore thanFiveThousand Dollars ( $5000) orindefaultofpayment, toimprisonment foraperiodnotexceeding thirty (30) days; 2) AnypersontowhomaPermit hasbeenissuedwhofailstocomply withany provision ofthisBylaworanyPermit issued hereunder oranycondition ofsuch aPermit shallbeliabletoapenalty onconviction ofnotlessthanOneHundred Dollars ($100) andnotmorethanFiveThousand Dollars ($5000) orindefaultof payment, toimprisonment foraperiodnotexceeding thirty (30) days. ComplianceWithOtherActs 8. Nothing inthisBylaw servestoexempt anyperson fromobtaining anylicense, permission, Permit, authority orapproval required byanyotherBylaworregulation oftheMunicipality oranystatuteorregulation oftheProvince ofNovaScotia. PreviousBylawsRepealed 9. AllBurning Bylaws orsimilar Bylaws adopted bytheformer municipalities ofCape Breton County toregulate andprohibit openairburning arehereby repealed andthe provisions ofthisBylaw substituted therefore.
