SUBJECT:
SIDEWALK CONSTRUCTION
PREAMBLE:
This Policy shall apply to the Municipality of the County of Inverness and
all its residents.
TERMS: The Municipality of the County of Inverness may participate in sidewalk
construction projects in built up areas of the Municipality in accordance
with the following criteria.

Primary consideration will be given to the main business (shopping)
district of a community where the main commercial, tourist, shopping and
service facilities are accessed by the community on a regular basis.
Sidewalks will only be constructed on a cost shared basis; i.e., when
sharing of at least two third of the cost is provided by other levels of
government, or by some other source, leaving the Municipality's share at
one third the overall cost.
Of the Municipality's one third share of the cost, one-half of that one-third
(i.e., one-sixth) will be charged to the residents of the area benefitted by
the sidewalk, by way of an area rate or uniform charge on all the taxable
property and occupancy assessments in the area, set pursuant to Section 75
of the Municipal Government Act.
The area to be charged with a rate will be determined at a publicly
advertised meeting of the whole area to be charged, at which meeting a
majority vote approving the one-sixth charge is obtained.
In addition to the above construction, the Municipality may make a further
contribution to the cost of a sidewalk project in exceptional circumstances
where the need is urgent, safety requires it, some special circumstance or
event makes the project particularly commendable at the time, the one-
sixth sharing would be too onerous considering the general circumstances
of the area, or some other extraordinary circumstance.

Notwithstanding the foregoing paragraphs of the policy, the Municipality
may at any time construct a sidewalk in any area of the Municipality and
recover all or any portion of the cost thereof from the area by means of an
area rate or a uniform charge on all taxable property and occupancy
assessments in the area pursuant to Section 75 of the Municipal
Government Act.
