P a rkin g By-la w
Title
1. This by-law is entitled the "Parking By-law".
Definitions
2. For the purposes of this by-law, the following definitions shall apply:
a. Motor Vehicle Act means the Motor Vehicle Act R.S.N.S. 1989 c. 293 as amended.
b. "Park" or "Parking" means the standing of a vehicle, whether occupied or not,
otherwise than temporarily for the purpose of and while actually engaged in
loading or unloading.
c. "Vehicle" means every device that can transport people or property except
wheelchairs or devices that use human power in whole or in part as a means of
propulsion (i.e. bicycles or-ebicycles).
Terms
3. The Town of Mahone Bay is hereby authorized to erect parking signs with the terms or
conditions with which vehicles may be parked in parking lots owned, maintained or
operated by the Town of Mahone Bay; or on streets or highways or portions thereof in
the Town of Mahone Bay.
4. The terms and conditions per Section 3 shall be determined by motion of Council.
5. Every person shall comply with the directions set forth on any sign posted pursuant to
this by-law.
Winter Parking - Temporary Regulations
6. No owner, or driver, or person having control or custody of any vehicle shall during the
period from one (1) hour after any snowstorm has started until two (2) hours after any
snowstorm has stopped, leave a vehicle unattended on any street or highway in the
Town of Mahone Bay.
7. The Traffic Authority, per section 202(1) of the Motor Vehicle Act is empowered to
make and enforce temporary regulations to cover emergencies or special conditions.
Enforcement and Penalties
8. A person who is alleged to have violated any of the provisions in this bylaw and is
given notice of the alleged violation may pay a penalty in the amount of $15.00 to the
Town of Mahone Bay, provided that said payment is made within sixty (60) days
following the alleged violation. If said payment is not made within sixty (60) days of
the alleged violation, the penalty shall be in the amount of $61.60.
9. Any person who pays a parking penalty within ninety (90) days of the alleged violation
shall not be liable for prosecution under this By-Law.
10. A peace officer or by-law enforcement officer appointed under the Police Act, if
satisfied that a vehicle has been left standing in a parking area or facility in violation of

this by-law may cause the vehicle to be removed and detained until the expense of
the removal and detention are paid to the Town of Mahone Bay.
