## Town of Mulgrave Driveway Culvert Policy
## Title:
1. This Policy is entitled the "Driveway Culvert Policy".
## Interpretation
2. The Town agrees to cover the cost of purchasing an initial or first driveway culvert to the maximum of the cost of a culvert of 20 feet and 12 inches in diameter. The property owner will be responsible for the cost of any culvert over 20 feet and 12 inches in diameter.
3. More than one driveway culvert is permissible; however the homeowner or taxpayer will be responsible for the cost of installation, maintenance and replacement of each additional culvert.
4. The cost of replacing or resetting a driveway culvert will be the responsibility of the Town of Mulgrave. The Superintendent of Public Works shall determine the necessity of installing, replacing, or resetting a culvert. The town will perform all work unless specific written approval is obtained from the Superintendent of Public Works prior to the work being performed.
5. Notwithstanding the other provisions of this policy, the Town of Mulgrave will not be responsible or installing, replacing or resetting a culvert if the homeowner, taxpayer, or his agents, cause the condition which necessitates that a culvert to be installed, replaced or reset. The intent of this section is to place responsibility on the homeowner if he causes his own need for work to be performed, and to place responsibility on the Town if environmental or other uncontrollable factors cause the need for work to be performed. By way of example, and not limitation, a homeowner would be responsible for the cost of repairing or replacing a culvert if he ran over the end of it with a vehicle and closed off the end, or if he paved a large area and directed the run-off toward a culvert that was too small. The Town would be responsible in such cases as rusted out culverts or culverts that had risen due to frost action.
6. Written approval for a driveway entrance must be obtairied from the Superintendent of Public Works before any new culverts are installed.
7. All driveway culverts shall be a minimum of 12 inches in diameter and 20 ft in length, the Superintendent of Public Works may require that a larger diameter culvert be installed if deemed necessary.
8. All culverts, regardless of whom they are installed by, should be set in gravel of good quality, and designed so as to allow the free flow of water through them. The area around the mouths of the culvert should be graded such as to prevent soil erosion.
9. All former policies with respect to driveway culverts are hereby repealed and this policy rubstituted therefore.
