Policy Subject / Title - Contaminated Soil Disposal

GENERAL:
1.
This Policy regulates the admission and disposal of contaminated soil at the
Region of Queens Solid Waste Management Facility.
2.
In this policy:
a)
"Contaminated Soil" means soil, which has been contaminated with any of
those substances listed in Tables A or B attached hereto to the levels as
identified therein and which soil is subject to an off-site removal directive
by the Nova Scotia Department of Environment and Labour, an
Engineering Consultant or is admitted to be contaminated by the party
seeking to dispose of the soil;
b)
"Contractor" means a person or company conducting the excavation and
transporting of contaminated soil to the landfill;
c)
"Landfill" means the Region of Queens Municipal Solid Waste
Management Facility located at 3750 Highway #8, Milton, Nova Scotia.
d)
"Operator" means the operator of the landfill;
e)
"Generator" means the owner of land on which the contaminated soil as
defined above is situate;
f)
"Engineer" means Director of Engineering and Public Works or his
designate;
g)
"Region" means the Region of Queens Municipality.
DISPOSAL AT THE LANDFILL:

a)
All contaminated soil brought to the Region's Landfill for disposal shall be
free of waste and other materials and all the contaminants must be fully
absorbed in the soil such that no free product is present.
b)
The Region's Engineer shall be authorized, prior to acceptance of any
contaminated soil at the Landfill, to ask to be provided with copies of any
testing results done on the subject soil and to demand such additional
testing as he in his discretion may deem necessary or advisable.

4.
All generators shall be required to give advance notice to the Engineer and shall
fill out an Acceptance Form for Contaminated Soil on the form attached as
Schedule "A" hereto at the Region's Office and shall show proof of receipt of
acceptance upon delivery at the Landfill.
5.
Contaminated soil shall be off-loaded in accordance with the Operator's
instructions.

a)
Subject to subsection 6 b) hereof, the Region shall charge generators for
the disposal of contaminated soils in accordance with the fees as
established by the Council of the Region of Queens Municipality from time
to time.
(i)
Generators may elect to have the Region charge the
Contractor for the disposal fees payable.
b)
The disposal fees otherwise payable hereunder shall be waived by the
Region in all instances where the generator meets the following criteria:
(i)
it is a non-profit organization located within the boundaries of
Queens County;
(ii)
and it is exempt from municipal and / or provincial taxation
under the provisions of any of the Region's bylaws or the
Municipal Government Act or the Assessment Act;
(iii)
and it is not a municipal, provincial or federal government
nor a department thereof.
