Municipal of the District of St. Mary's STREET LIGHT POLICY Purpose: The purpose of this policy is to provide a consistent approach to installing new street lighting in the municipality and to ensure a fair and regulated payment system is in place whereby streetlights are paid for by the property owners in the area served by the streetlights. Definitions: "Streetlight Area" occurs where a series of streetlights service a continuous residential/commercial properties within a community. Modification of "Streetlight Area": In the case of gaps of 5 or more poles between streetlights, owner of property frontage within the Streetlight Area may appeal to Municipality to have a light installed. Addition of "Streetlight Area": 1. The Municipality will consider requests in the form of petitions from the property owners within the areas in question, for a new Streetlight Area, modifications to an existing Streetlight Area including lengthening or shortening of an existing Streetlight Area at the ends, or removal of an existing Streetlight Area. a. Petitions will require the absolute majority (more than fifty percent of the property owners in the area) to be considered by Council. b. Petitions will be reviewed by staff to determine if the requests meet municipal policy and a report and recommendation will be prepared for Council's consideration. 2. In approved areas, streetlights will be placed based on the following spacing between dwelling units: Number of poles between Dwellings Spacing of Streetlights Less than 5 poles Every second pole 6 to 8 poles Every fourth pole Greater than 8 poles No lights 3. Where there is spacing between dwelling units of greater than eight (8) poles in an area to be lit, the streetlights will stop at the last occupied property and will begin at the next occupied property in the area to be lit. 4. Requests for additional individual lights will be considered if the property to be lit is within eight (8) poles of an existing streetlight system. "Streetlight Area" Rate: 1. The Municipality will set one flat area rate, on an annual basis, for all Streetlight Areas served within the municipality. The flat rate will be based on the overall cost for streetlights as determined and charged by Nova Scotia Power Inc. to the municipality and divided by number of properties served by the Streetlight Area 2. The area rate determine will be applied to all residential and commercial assessed properties fronting a "Streetlight Area" including those within 200 feet before and after the said Streetlight Area. 3. Where a single residential or commercial lot possesses frontage on more than one Street, the tax account will be billed only one Streetlight Area Rate Approved by the Saint Mary's Municipal Council on This 14th day of March 2016.
