Whereas the Council deems it necessary, for the protection of Town owned lands as a
resource for the benefit of all Town residents, and based upon Council's concern for
public safety, protection of Town properties and the Town's own legal liability, to
prohibit all, except what Council deems necessary on a case-by-case basis, off-road
vehicle use on lands owned by the Town of Truro;
Now therefore Town Council for the Town of Truro hereby enacts this bylaw:
Definitions
1.
"Off-Road Vehicle": means any motor vehicle designed for or capable of cross-
country travel on or immediately over land, water, sand, snow, ice, marsh,
swampland or other natural terrain; and includes, but is not limited to, all-terrain
vehicles (three- or four-wheeled), motorcycles and snowmobiles.
Prohibition
2.
No person shall operate, or be in the care and control of, an off-road vehicle on
land owned by the Town of Truro unless that person has obtained and is in
possession of written permission from Town Council for the Town of Truro.

Notwithstanding Section 2 of this bylaw, a peace officer, municipal employee, or
an agent or contractor of the Town of Truro, carrying out the duties of his/her
office, agency, or contract, may operate an off-road vehicle on land owned by the
Town of Truro without a permit.
Penalty
4.
Any person who violates this bylaw shall be subject to a fine of one-
thousand dollars ($1,000.00) for each offence.
5.
Any person who violates this bylaw is subject to the immediate seizure of the off-
road vehicle found in violation of this bylaw.
6.
A fine imposed in accordance with Section 4 of this bylaw shall constitute a first
lien upon the off-road vehicle found to be in violation of this bylaw.
