TOWN OF WINDSOR BYLAW # 14 SWIMMING POOL FENCES BYLAW 14.01 "Swimming Pool" shall mean any construction whether above or below ground which is erected to hold water and which is more than twenty-four (24) inches in depth. 14.02 Every owner of a swimming pool in the Town of Windsor shall erect and maintain a fence around such swimming pool. 14.03 A swimming pool fence shall not be less than four (4) feet in height above grade and the bottom of the fence shall not be more than three (3) inches above grade. 14.04 (a) Where a fence is constructed under this Bylaw such fence may be constructed of wood, brick, stone, metal fencing, plastic, fibreglass, or like material; (b) Where such fence is constructed of wood, the pickets or board shall be upright and shall not have any spaces between boards or pickets more than three (3) inches in width; (c) Where such fence is constructed of brick or stone, there shall be no opening more than three (3) inches square; (d) Where such fence is constructed of wire or steel mesh, there shall be no opening more than three (3) inches square. 14.05 Where any fence is erected under this Bylaw, such fence shall have one or more gates and when the swimming pool is not in use such gate or gates shall be kept securely fastened. 14.06 Where any person fails to comply with any of the provisions of this Bylaw, he shall be liable on summary conviction to a penalty of not less that One Hundred Dollars ($100.00) and not more than One Thousand Dollars ($1000.00) and in default of payment to imprisonment for a period of not less than ten (10) days nor more than ninety (90) days.
