## 1. Purpose
To establish a practice whereby through the CAO's Office, Council will be informed of any disagreements regarding municipal properties that may result in the municipality entering into a form of responsive legal action or require a decision of Council.
## 2. Objective
The objectives of this policy are:
- a) To provide the CAO with guidelines for identifying potential matters regarding municipal property requiring the attention of Council.
- b) Ensure disputes are communicated to Council in a timely manner to promote a high standard of professional conduct and transparency.
## 3. Definitions
CAO is the Chief Administrave Officer
Council means the Council members elected to represent West Hants Regional Municipality.
Land Dispute means when there are conflicting claims to rights in land by two or more parties, focused on a particular piece of municipal land
Legal Dispute is defined as a disagreement, argument, or controversy-often one that gives rise to a legal proceeding (such as arbitration, mediation, or a lawsuit).
## 4. Responsibility
It is the responsibility of the CAO to address all land and legal disputes as soon as they arise. The CAO will communiciate to Council all critical issues pertinent to municipal business that have potential to result in legal action or require the approval of Council as described in the Nova Scotia Municipal Government Act (NSMGA).
It should be expected that these matters will be reviewed during a meeting of Council or Committee of the Whole during in-camera, as directed in the West Hants Regional Municiaplity's Meeting and Committee Procedural Policy RCOGE-003.00 or the NSMGA.
