<!-- image --> ## Hamlet of Arviat, Nunavut ## SNOW PILING AND REMOVAL BY-LAW No. 354 A By-law of the Municipal Corporation of the Hamlet of Arviat in the Nunavut Territory to manage the collection and removal of snow pursuant to the provisions of the Hamlets Act, R.S.N.W.T 1988, c.H-1,ss, 54.2,54.3, 72, 74. WHEREAS the Hamlet of Arviat experiences ongoing challenges related to snowstorms, blowing snow, and drifting of snow; AND WHEREAS the municipality of Arviat deems it necessary to regulate the piling and removal of snow in private and public places in the interests of the health, safety and welfare of the residents of this municipality; NOW, THEREFORE the Council of the Hamlet of Arviat, in regular session duly assembled, enacts as follows: ## SHORT TITLE 1. This by-law may be cited as the "Snow Piling and Removal By-Law". ## INTERPRETATION ## 2. In this by-law: "compliance notice" "Council" "private homeowner" "individual" - "intersection" means the area closed by the imaginary extension and the connection of means a formal notice served personally or sent by registered mail to a property owner. means the elected council of the Hamlet of Arviat sworn to office. means any owner/lessee that is an individual(s). means a human being. | | the edges of roadways that intersect or join at an angle. | |--------------------|----------------------------------------------------------------------------------------------------------------------| | "major snow event" | means any weather event that results in significant snowfall or snow drifting that requires removal. | | "municipality" | means the Municipal Corporation of the Hamlet of Arviat. | | "organization" | means any owner/lessee that is a company, corporation, government, partnership, firm, association, society or party. | | "roadway" | means the part of the road that is improved, designed or used for the passage of vehicles. | ## SNOW REMOVAL REGULATIONS 3. Within 48 hours of the end of a major snow event, organizations offering essential services, including health care centres, grocery stores, and gas bars shall remove all snow from their parking areas, stairs, ramps and landings to ensure the proper functioning of their properties. 4. Within 10 days of the end of a major snow event, all organizations shall remove: - b. snowdrifts or piles greater than 2 m in height that are located within 6 m of a lot line facing a public road right-of-way. - a. snow from their parking areas, ramps, stairs and landings to ensure the proper functioning of their property, 5. Despite Sections 3 and 4, the Hamlet shall be responsible for clearing and/or removing snow from properties as required to access trucked service connections. The Hamlet shall not be responsible for any damage to equipment or property left in the trucked service access lane. 6. No organization or private homeowner shall push snow or pile snow outside the boundaries of their lot into a roadway or on any lands within the Municipality, except in areas designated for such purpose by the Municipality. Refer to Schedule 'A' for snow dumping locations. ## SNOW PILING REGULATIONS 7. No organization or private homeowner shall pile snow within their front yard. 8. All organizations shall locate snow piles in an area deemed safe for pedestrian and vehicle traffic that is away from roadways, intersections, and water fill and sewage pump-out connections ## ENFORCEMENT 9. The provisions of this Snow Piling and Removal By-law apply to all organizations and private homeowners and shall be enforced by the Municipality. 10. Where the Municipality deems that snow should be removed from a property for the safety of the public and to reduce potential flooding risks, the Municipality ray issue a compliance notice to an organization to remove such snow within 5 working days. 11. Where an organization fails to remove snow as required under Sections 3, 4, or 11, the Municipality may remove the snow and recover the costs of removal from the property owner or tenant in accordance with the Municipality's Equipment and Labour rates, as established in the Service Rates By-law, as amended. ## SEVERABILITY 12. If any provision of the by-law is declared invalid because any word, phrase, clause, sentence, paragraph or section of this by-law, or any documents which form part of this by-law or an application thereof to any person or circumstance is declared invalid, the remaining provisions shall not be affected and shall remain in force. ## EFFECT 13. This by-law comes into force on the day of Third Reading.
