THE CORPORATION OF THE TOWN OF WASAGA BEACH
BY-LAW 2025-66
A By-law to establish fees and charges to be collected by the
Corporation of the Town of Wasaga Beach
WHEREAS pursuant to section 9 of the Municipal Act, 2001, a municipality has the
capacity, rights, powers and privileges of a natural person for the purpose of exercising
its authority under this or any otherAct;
AND WHEREAS pursuant to section 8. (1) of the Municipal Act, 2001, the powers of
a municipality under this or any other Act shall be interpreted broadly so as to confer
broad authority on the municipality to enable the municipality to govern its affairs as it
considers appropriate to enhance the municipality's ability to respond to municipal
issues;
AND WHEREAS Section 391 of the Municipal Act, 2001, provides that a municipality
may pass by-laws imposing fees or charges on persons for services and activities
provided or done by or on behalf of it, for cost payable by it for services or activities
provided or done by or on behalf of any other municipality or local board, and for the
use of its property including property under its control;
WHEREAS By-Laws imposing such fees and charges are authorized by the Municipal
Act, 2001, and various other statutes;
AND WHEREAS Section 69(1) of the Planning Acf, R.S.O. 1990, Chapter P.13, as
amended, provides that a municipality may establish a tariff of fees for the processing
of applications in respect to planning matters;
AND WHEREAS Section 7 of the Building Code Act, 1992, S.O. 1992 c.23, as
amended, authorizes a municipal Councilto pass by-laws concerning the issuance of
permits and related matters requiring the payment of fees on applications for and on
the issuance of permits;
AND WHEREAS the Council of the Town of Wasaga Beach deems it expedient to
pass such a by-law and consolidate and update the fees and charges to be collected
by the various departments of the Town of Wasaga Beach;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
WASAGA BEACH HEREBY ENAGTS AS FOLLOWS:
1. That Council hereby establishes the fees and charges as set out in Schedules
"4" to "O", as amended from time to time, which form part of the by-law and
shale be paid for the services or activities noted.

Z That the fees and charges as listed in the schedules attached hereto and forming
part of this by-law will be subject to tax where applicable in addition to the fees
listed in the schedulesattached.
3 That this by-law shall be cited as the "Fees and Charges $law".
4 That the schedules attached are a consolidated list of approved fees and charges
that will be reviewed annually and may be amended from time to time as approved
by Council, with an amendment to the schedules attached, and further that the
consolidated list of fees and charges be updated from time to time to reflect
Council's approval.
5 That where this by-law established a fee and charge for a fee that also exists in
another by-law that predates the effective date of this by-law, the fee and charge
in this by-law shall be the applicable fee and charge and the other by-law is
hereby effectively amended.
6 All fees and charges listed in this by-law or its associated schedules are due
immediately at the time the service is requested, delivered or the application is
submitted unless otherwise specified. Where an invoice is issued, the due date
will be indicated on the invoice.
7. Where any fee or charge imposed under this by-law remains unpaid beyond the
due date, the Town may, where permitted by law, add the unpaid amount
including any interest or penalty to the tax roll for any real property in the Town
of Wasaga Beach owned by the party or parties responsible for payment of the
fee or charge and collect it in the same manner as municipal taxes, in
accordance with section 398 of the Municipal Act, 2001, as amended.
& Where an application or service request is submitted by an agent, consultant or
other third party acting on behalf of a property owner, the property owner shall
be jointly and severally liable for all fees and charges incurred under this by-law,
including those under the Planning Act and Building Code Act, unless othenryise
stated in the applicable schedule.
9. Should any part of this by-law, including any part of the schedules attached be
determined by a Court of competent jurisdiction to be invalid or of no force and
effect, it is the stated intention of Council that such invalid part of the by- law
shall be severable and that the remainder of this by-law including the remainder
of the schedules attached, as applicable, shall continue to operate and to be in
force and effect.
10 That By-Law 2024-89, as amended, and any other by-laws or resolutions or parts
of by-laws or resolutions inconsistent with this by-law to establish fees and
charges are herebyrepealed.
11. That this By-Law shall come into force and effect on the final passage thereof

Response Cost Recovery Fees shall be the total of:
a) Current MTO rate per unit per hour or portion thereof for each unit
b) rate per person per hour or portion thereof for each firefighter
c) other costs including but not limited to; Foam, Metered Water, Air
Tank Re-filling, Cleaning Equipment, DSPA or similar type units,
cost to replace damaged or destroyed equipment, specialized
response costs such as Water Bomber Drops
The MTO rate per unit per hour is set by the Ministry of Transportation.
This rate is adjusted periodically in accordance with the consumer price
index.
Such fees shall be charged and calculated on the basis of each Fire
Department vehicle attending, each firefighter attending and resources
consumed in attendance to the property incident. The time shall be
measured from the time of departure of each unit from the Fire
Department's facilities to the time the unit is cleared for the next call out.

All costs
Retaining necessary contractors and/or equipment to facilitate fire
suppression efforts, preserve property, prevent fire spread, make safe or
othenruise eliminate an emergency or hazardous situation and to aid in
origin and cause determination and investigation.
TECHNICAL / SPECIALIZED RESCUE
All costs
Retention of other agencies, technicians or specialized rescue personnel
to assist with technical rescue operations (such as ice/water rescue,
confined space, high angle, trench, elevator, vehicle extrication and
hazardous materials incidents) when necessary as determined by the
Wasaga Beach Fire Department.

Permit fee calculations are based on the formula below, unless otheruvise specified in this schedule

The Chief Building Official reseryes the right to assign a permit fee based on the approved
schedule to a category deemed appropriate. In cases where there is dispute over the
categorization of permit application fees it shall be the Chief Building Official's decision that is final

BUILDING DEPARTMENT
Gonstruction Without a Permit
lf construction begins before the issuance of a building permit, there may be an additional
administrative fee equal to 100 percent of the full permit fees or $165.00 whichever is
greater, to a maximum additional fee of $20,000.00.
Permit to Revise an lssued Permit
Greater of $56.00 per page, or $84.00 per hour of examination and inspection time.
Revision to an application during plans review prior to permit issuance
$56.00 per page where the applicant is requesting changes to the proposed application.
Transfer of Permit
$155.00 per permit transfer of ownership.
Model Home Agreement Permit
lf the project is a Model Home under Agreement, there will be an additional fee of $280.00
per permit, and is non-refundable. This permit can only be applied for if the Proposed
Subdivision has been approved for Model Homes by Council.
Conditional Foundation Permit
lf the project has a footprint of more than 6460 sq. ft. and has received all applicable law
approvals, but has not finalized the above grade design a formal request can be made to the
Chief Building Official for consideration. An application does not constitute a guarantee of
permit. An additional administration fee equal to 25% will be added to the total permit
application fee but in no case shall be less than $840.00, with no maximum. This additional
fee is non-refundable even if the Chief Building Official decides not to issue a Conditional
Permit.
Certification of Models Prior to Draft Plan Approval
lf the project is in the Draft Plan Approval Process, a concurrent review of the building permit
application can be commenced. The fee per model is $480.00. Upon issuance of the first
building permit for a specific model, 75% of the $840.00 will be refunded. Refund applies to
the first permit issued for a specific model, subsequent permits are subject to full permit fees.
Lot Grading Review
Where Lot Grading Review is required (as defined within the lnfill Lot Grading Policy) the
application fee is $500.00. A $1,000.00 refundable deposit is to accompany the application

Application Fees are cumulative in respect of flat fees for applications,
prescribed fees and instances where multiple matters are being considered as
noted above.

Determination of application fees, in terms of major, minor, incidental, revision,
adjustment, etc. categories, is at the discretion of the Director of Planning in
consideration of the scope, scale and complexity of the application, the extent
of service being provided and in consideration of the guidance provided above

PLANNING DEPARTMENT
The Director of Planning may waive fees at their discretion, and applicants, if
not satisfied, may address the Council or the Committee of Adjustment as the
case may be.
ln the case where a Draft Plan Approval lapses, new application fees are required
and a new application submitted.
ln the case of a Site Plan Control application and a resubmission by a person other
than the original applicant, new application fees are required and a new application
submitted.
The determination of what qualifies as an incidental Minor Variance application is at
the discretion of the Director of Planning; but shall generally be limited to the
following:
a. Additions and alterations to existing single detached, semi-detached, street
townhouse, townhouse, duplex or link dwelling units.
b. Recognizing non-conforming setbacks, lot coverage, height, etc. for "as-
constructed" dwelling unit types as described in Note 10 (a) above.
c. New or additions and alterations to buildings, structures or uses that are
accessory to the dwelling unit types as described in Note 10 (a) above.
Parking Exemption applicants must review the Town of Wasaga Beach Cash-in-Lieu
of Parking Policy.

Upon the Building Department's successful ("passed") inspection of a water service connection, the
temporary construction rate (noted above) shall commence being charged to the property.
Third Time lnsoection Fee
A third time inspection fee of $75.00 will be charged if Public Works staff attends the same property
for the same complaint upon a third visit.
lmoroper lnstallation
An incentive rate shall be charged for the improper installation of a meter or installation of a non-
functioning meter. The incentive rate shall be double the base rate and shall be charged to the
property one month after the municipality has verified the improper installation.
FIat Rate Charoe
For a single family residential unit, where the Town has determined a meter cannot be installed for
any reason, a flat water and sewer rate will be charged based on current rates applied against an
average level of household consumption.
Penalty and Addition to Tax Rolls
Pursuant to the Municipal Act 2001, S.O. 2001, c.25, Section 345 and Section 398, and O. Reg.
581/06, any amount unpaid on an account upon the due date which the accounts are rendered
may be added to the tax rolls and charged 1.25o/o per month interest.
