## Town of Alberton, PEI A Bylaw with respect to the Regulation of Livestock Bylaw # 1 - 2026
BE IT ENACTED by the Town of Alberton as follows:
## PART I - APPLICATION AND INTERPRETATION
## 1. Title
- 1.1 This bylaw shall be known and cited as the "Livestock Regulation Bylaw."
## 2. Authority
- 2.1 Section 180(b)(i) of the Municipal Government Act, RSPEI 1988, Cap. M-12.1, permits a council to pass bylaws respecting the control, health and safety of, and protection from, wild and domestic animals.
## 3. Definitions
## 3.1. In this bylaw:1
- (a) "Act" means the Municipal Government Act, RSPEI 1988, Cap. M-12.1.
- (b) "At Large" means, in respect of Livestock, Livestock that is found in any place other than the premises of the Owner of the Livestock and not under the direct and continuous control of any Person.
- (c) "Council" means the duly elected council of the Town.
- (d) "Enforcement Officer" means any individual or group of individuals as may be appointed pursuant to the Town's Enforcement and Summary Proceedings Bylaw #2021-4.
- (e) "Livestock" means any domestic fowl (including chickens, geese, ducks, turkeys, guinea fowl, etc.), horse, donkey, mule, bull, ox, cow or other cattle, goat, swine, sheep, llama, mink, fox, emu or ostrich or the young thereof; but specifically excludes dogs and cats.
- (f) "Owner" means a Person who owns or has care or control of Livestock.
- (g) "Person" means an individual, corporation, partnership, or other legal entity, and includes the heirs, executors, administrators, successors, and assigns thereof where the context permits.
- (h) "Town" means the Town of Alberton.
## Interpretation
- This bylaw is to be given a broad, liberal interpretation in accordance with applicable legislation and the definitions set out in it.
- 3.3. In this bylaw words importing the singular shall include the plural and words importing the masculine gender shall include the female gender and vice versa.
## 4. Severability
- 4.1. It is the intention of the Council that each separate provision of this bylaw shall be deemed independent from all other provisions of this bylaw, such that, if any provisions of this bylaw is declared invalid, all other provisions of this bylaw shall remain valid and enforceable.
5. Regulations
- Council may, by simple resolution, make such regulations to this bylaw as are necessary for the carrying out of the purposes of this bylaw.
## 6. General Prohibition
- 6.1. No Person shall keep Livestock within the boundaries of the Town.
- 6.2. Section 7.1 shall not apply to the areas known as:
- (a) the Agricultural Reserve (A1) Zone;
- (b) the premises of an accredited veterinary facility under the supervision of a veterinarian licensed pursuant to the Veterinary Professions Act;
- (C) any area lawfully used as an exhibition grounds for the purposes of agricultural exhibitions, fairs, competitions, petting zoo, or other shows, parades, or festivals as may be approved by Council, and subject to any conditions imposed, including duration, location, fencing, supervision, and animal welfare
- Section 7.1 shall not apply to any Person lawfully keeping Livestock in the Town immediately prior to the date of the coming into force of this bylaw and said Person may continue to keep such Livestock until they are no longer in the possession of such Livestock, provided that:
- (a) the Livestock remain on the same property as they were kept on the date of the coming into force of this bylaw;
- (b) the number of Livestock is not increased;
- (C) the Livestock shall not be replaced;
- (d) the right to continue shall cease if the keeping of Livestock is discontinued for a period exceeding six (6) months; and
- (e) the keeping of Livestock does not (i) create a nuisance under the Town's Nuisance and Noise Control Bylaw #2021-3 or (i) result in an offence being committed under any of the Town's bylaws.
- 6.4. No Owner of Livestock shall permit any Livestock to run At Large in the Town.
- 6.5. Where Livestock is found At Large, the Owner of the Livestock is deemed, in the absence of evidence to the contrary, to have permitted the Livestock to be At Large.
- 6.6. An Enforcement Officer (or a Person authorized and appointed by Council to assist an Enforcement Officer with the administration and enforcement of this Act) may seize and impound:
- (a) any Livestock kept contrary to this Bylaw; and
- (b) any Livestock found running At Large in the Town.
- 6.7. Any Livestock impounded under section 7.6 shall be kept in a secure facility or location designated by the Town for that purpose.
- Where the Owner of any impounded Livestock is known, the Town shall make reasonable efforts to notify the Owner of the impoundment.
- 6.9. Where the Owner of any impounded Livestock is unknown, the Town shall post public notice of the impoundment at the Town Hall and on the Town's website for a minimum of fourteen (14) days.
- 6.10. The Owner of any impounded Livestock is entitled to recover his or her Livestock if:
- the Owner pays the costs and expenses that the Town incurred to seize, impound and keep the Livestock and any fines or penalties imposed under this bylaw or any other of the Town's bylaws; and
- the Owner is able to demonstrate to the satisfaction of the Town that the Livestock will be kept in compliance with this bylaw.
- 6.11. If impounded Livestock are not reclaimed by the Owner within fourteen (14) days of the date of impoundment, the Town may sell, transfer, or otherwise dispose of the Livestock in a humane and lawful manner, and shall apply the proceeds toward the costs and expenses that the Town incurred during the lawful seizure, impoundment, or disposition of the Livestock. Any amount outstanding after the disposition of the Livestock is a debt owing from the Owner to the Town, if known. Any remaining balance shall be paid to the Owner, if known.
## 7. Enforcement and Penalties
- 7.1. l The provisions of the Town's Enforcement and Summary Proceedings Bylaw #2021-4, or any successor bylaw thereto, shall apply to the enforcement of this bylaw.
- 7.2. Any Person who keeps, permits or causes to be kept any Livestock contrary to the provisions of this Bylaw or who permits or causes any Livestock to be At Large, is guilty of an offence punishable on summary conviction and liable to:
- (a) a minimum fine of not less than $200 and not more than $500 for a first offence and a minimum fine of not less than $500 and not more than $1,000 for any subsequent offence;
- (b) imprisonment for a term not exceeding ninety (90) days; or
- (c) to both;
and in default of payment of any fine imposed, to a further term of imprisonment not exceeding ninety (90) days.
- For each offence and where an offence under this bylaw is committed or continued to be committed for more than one day, the Person who committed the offence is liable to be convicted for a separate offence for each day the offence is committed or continued.
## 8. Limitation of Liability
- The Town, its employees or its duly authorized agents, and any person who, in good faith, assists the Town in the seizure of Livestock under this bylaw, are exempt from any prosecution, action or other proceeding for damages for any act done or omitted to be done in good faith pursuant to or in the exercise or intended exercise of any power or function under this bylaw.
## 9. Adoption and Approval
- 9.1. This Livestock Regulation Bylaw # 1 - 2026, shall be effective on the date of approval and adoption below.
## First Reading:
The Livestock Regulation Bylaw # 1- 2026, was read a first time and approved by a majority of members present at the Council meeting held on the \_9th day of February 2026.
## Second Reading:
The Livestock Regulation Bylaw # 1 - 2026, was read a second time and approved by a majority of members present at the Council meeting held on the 9th day of February 2026.
## Approval and Adoption by Council:
The Livestock Regulation Bylaw # 1- 2026, was adopted by a majority of Council members present at the Council meeting held on the 9th day of March, 2026.
