## Bylaw for the Community of O'Leary Pertaining to Loitering/Peace and Enjoyment Bylaw # 9 - 98 Pursuant to the Municipalities Act R.S.P.E.I. 1988 Cap. M13 Part XI Sec. 57 Be it hereby enacted by the Community Council of the Community of O'Leary, P.E.I., as a Bylaw regulating and ensuring the Peace and Enjoyment of the Community by its residents and visitors, and to read as follows: - 1) a. No person or persons shall gather, congregate or otherwise loiter around, or on the streets, parking lots, parks or vacant properties within the boundaries of the community after 11:00 P.M. unless in the process of doing business, attending a public function or otherwise has obtained proper authorization from Council to do so. - b. No person or persons shall obstruct, harass or otherwise annoy, by way of action or language, any individual who is rightfully using any street, parking lot or other property within the boundaries of the community. - c. No person shall leave any litter or debris of any form on any public or private property within the boundaries of the community. 2)a. Any person or persons in violation of the provisions of this by-law shall be guilty of an offense and is liable to a fine of not less than $100.00 and not more than $500.00 plus all costs incurred by the community. - c. All prosecutions for any violation of this or any other by-law shall be heard before a Judge of the Provincial Court of P.E.I., or a Judge of the Youth Court of P.E.I. - 3) a. This by-law replaces by-law #4 of the Community of O'Leary which was enacted on July 7, 1987. FIRST READING THE 11TH DAY OF JUNE, 1998. SECOND READING THE 10T# DAY OF SEPTEMBER, 1998.
