## PURPOSE
To ensure that the proper procedures are in place for the provision of domestic and commercial water to the Town of Stratford
## THE POLICY
The Town of Stratford gives the Stratford Utility Corporation the authority to implement the policy for takeover of existing water systems.
1. The following steps must be followed prior to the Utility Corporation making any decisions to takeover an existing water system:
- A written request must be received from a private developer to take over a system along with permission for a representative of the Utility Corporation to access the property to conduct any necessary tests.
- The Utility Corporation has to take into consideration the system reliability.
- The Utility Corporation reserves the right to determine if a system meets certain standards. The standards cannot be below the provincial requirements
- There will be no monetary value paid to the private developer and all costs associated with testing and legal fees will be borne by the developer.
- Water quality and quantity tests must be carried out.
- Any costs associated with fees for permits are the developers responsibility.
8. The following information must be provided to the Utility Corporation:
- As-built drawings
- Certificates of approval from the Department of Environmental Resources
- Copies of any easement plans and agreements
- Financial information relative to feasibility of the Utility Corporation taking over system
- Maintenance Records
- Any other related information as deemed necessary
3. Once all the information, testing and analysis of data is completed, the Utility Corporation will make the final determination for takeover of the system. At that time a formal response will be given to the private developer on the decision of the Utility Corporation to proceed with the acquisition.
16. If the Utility Corporation is in agreement to take over the system, the private developer is responsible to make arrangements for the preparation and registration of any legal agreements or documentation. As well, the private developer is responsible for any costs associated with the legal fees.
## DEFINITIONS
- a) "Utility Corporation" means the Stratford Utility Corporation.
- b) "Private Developer" means the owner of any water system within or serving the Town of Stratford other than the Utility Corporation.
- c) "Private Water System" means a system that supplies piped water for human consumption and has at least 15 service connections or 25 or more persons who are served by the system 60 or more days each year.
- d) "Domestic Use" is the consumption by private homes and other living facilities and usually fluctuates by the time of day, day of the week, and time of year.
- e) "Commercial Use" is the water used by stores, offices and other businesses.
- f) "Industrial Use" is the water used by factories and industries.
