Be it enacted and it is hereby enacted by the City Council of the City of Summerside, pursuant to Sections 21, &amp; 70 of the City of Summerside Act, Stats, P.E.I. 1994, Cap. 59 and amendments thereto and pursuant to the Highway Traffic Act R.S.P.E.I., 1988, Cap. H-5 and amendments thereto: ## 1. Name This bylaw may be referred to as the "Summerside Traffic and Parking Bylaw". ## 2. Definitions In this Bylaw: - a. "highway traffic act" means the Highway Traffic Act, R.S.P.E.I.,1988, Cap. H-5 and amendments thereto and regulations made thereunder; - b. "council" means the council of the City of Summerside; - c. "city" means the City of Summerside as established by the City of Summerside Act, Stats. P.E.I. 1994, Cap. 59; 4. "traffic authority" means the council of the City of Summerside; - e. 'peace officer' includes any police officer, traffic officer, Special Constable or Police Commissionaire employed or appointed by the City of Summerside for the preservation and maintenance of the public peace and order, or for the service or execution of judicial process. I Amended October 17, 2011] Except where specifically provided otherwise in this bylaw or the regulations made thereunder, all definitions of terms contained in the highway traffic act shall be the definitions of the same terms where used in this bylaw or the regulations made thereunder. ## 3. Traffic Authority The traffic authority shall exercise all powers conferred upon it by the provisions of the highway traffic act, together with such further and other powers as may be conferred upon it by this bylaw or any other bylaw of the city. ## 4. Regulations The traffic authority may, by simple resolution, make regulations not contrary to the provisions of the highway traffic act, respecting the following: - the naming of persons or a class of persons identified by job description authorized to remove snow from the streets of the city; - the fixing and enforcing of the rate of speed within the city; - C. the setting aside for a specific time of a specified highway within the jurisdiction of the city or part of such highway, for speed test, races or other special purposes to be conducted under proper restrictions and supervision; - the speed at which motor vehicles, or any class of motor vehicle, the weight of which, unloaded, exceeds 2.5 t, may be driven thereon; - parking of vehicles; - f. the prohibition of parking at certain times upon streets within the City during winter months to facilitate snow removal; - g. one-way streets; - h. pedestrian traffic; - i. safety zones; - j. the prevention of unnecessary noise from motor vehicles; - k. traffic on the streets in the vicinity of public schools; - I. traffic at intersections; - m. traffic lanes; - the right of way of one vehicle over another or of a pedestrian over a vehicle, or conversely; - the directions that vehicles must follow on certain streets or roadways; - p. traffic signs; 9. heavy trucks; - r. establishment of fire lanes and tow away zones in private and public parking lots; - s. the establishment of loading zones; - t. the establishment of truck zones; - the setting of weight restrictions for traffic upon the streets in the city; - v. the issuing of special permits to authorize the operation of special mobile equipment having movable tracks with transverse corrugations upon the periphery of the movable tracks, or farm tractors, or other farm machinery, the operation of which upon a street or roadway would otherwise be prohibited; and - w. Any other matter pertaining to traffic and the movement of vehicles not contrary to the highway traffic act. and the power to regulate shall include the power of prohibition and penalty incidental to regulations. ## Highway Traffic Act Except where specifically provided otherwise in this bylaw or the regulations made hereunder, all the provisions of the highway traffic act shall continue in force within the city and any violation of the provisions of the highway traffic act if committed within the city shall be an offence against the highway traffic act; provided that when the method of ascertaining the dimensions of any type of zone restricting or controlling parking or stopping differs between the regulations made pursuant to this bylaw and regulations made pursuant to the highway traffic act, the regulations containing the method of ascertaining the dimensions as aforesaid which are most restrictive shall apply in all circumstances. ## 6. Prima Facie Evidence The existence on or near a street, roadway or parking lot within the city of a traffic control device referred to in this bylaw or regulations made hereunder is prima facie evidence that the traffic control device was duly erected and is maintained by the traffic authority in accordance with this bylaw if the traffic control device purports to regulate the use of the street, roadway or parking lot. ## Offence - a. Any person who violates any provision of this bylaw or regulations made hereunder or who fails to perform any act required hereunder or does any prohibited act, shall be guilty of an offence and liable for the penalties as set out in Schedule "A". - b. The owner of a motor vehicle is liable for and incurs the fines and penalties provided for any violation of this bylaw or any regulations made hereunder, unless at the time of the violation the motor vehicle was in possession of a person other than the owner without the owner's consent, and the driver of a motor vehicle not being the owner is liable for and incurs the fines and penalties provided for the violation. ## 8. Traffic Ticket The traffic authority may determine from time to time the form of traffic ticket for any offence under this bylaw or regulations made hereunder and the words or expressions used on the traffic ticket to designate a violation shall be deemed sufficient for all purposes to describe the offence designated by such word or expression. The ticket shall consist of: a. A Notice of Violation; b. A Copy of Notice of Violation; A Summons to Accused; d. e. An Information; A Report of Proceedings; and ## f. A Police Record - a. Summary Offence Information [Amended March 19, 2001] - b. Police Record [Amended March 19, 2001] - c. Report of Conviction [Amended March 19, 2001] - d. Summons to accused [Amended March 19, 2001] ## Penalties The traffic authority may, by simple resolution set out in Schedule "A", the minimum and maximum penalties and out of court settlements, to be imposed for violations of any provisions of this bylaw or regulations made hereunder. ## 10. Enforcement - a. Offences against this bylaw and the highway traffic act shall be prosecuted in accordance with the procedure set out in: - i. The Criminal Code (Canada) and amendments thereto; - ii. The Summary Proceedings Act, R.S.P.E.I. 1988, Cap. S-9 and amendments thereto; and - ili. This bylaw and the regulations made hereunder. - b. All Police Officers or Traffic Officers issuing traffic tickets for any violation of this bylaw or regulations made hereunder shall: - i. Report in the traffic ticket the location of the vehicle in respect of which the violation has occurred, the nature of the violation, the make of the vehicle, the vehicle license number, the year and province of registration, the time and date of the violation, and the officer issuing the ticket shall affix his/her signature thereto; 2. Deliver to the owner or operator of the vehicle a serially numbered copy of the notice of violation portion of the traffic ticket or to attach to such vehicle the said serially numbered copy of notice of violation portion of the traffic ticket, directed generally to the owner or operator of the vehicle and requiring him/her to report to the officer on duty at the City Police Station and to present such notice; and - ili. Retain the remaining portions of the ticket at the City Police Station. 4. €. Each owner or operator may, within seven (7) days of the time when the copy of the notice of violation is delivered to him/her or attached to his/her vehicle, remit payment to the city police station, the "minimum fine" amount as set forth in Schedule "A", as a penalty for and in fult satisfaction of such violation; - C. Each owner or operator may, within fourteen (14) days of the time when the copy of the notice of violation is delivered to him/her or attached to his/her vehicle, remit payment to the city police station, the "minimum fine" amount as set forth in Schedule "A", as a penalty for and in full satisfaction of such violation; [Amended March 18, 2002] - d. Upon failure of the owner or operator to make the payment within seven (7) days as required by the copy of the notice of violation, he/she shall become liable for prosecution under this bylaw and a summons to accused to appear before a justice of the peace to enter a plea shall be served to the owner or operator by: - d. Upon failure of the owner or operator to make the payment within fourteen (14) days as required by the copy of the notice of violation, he/she shall become liable for prosecution under this bylaw and a summons to accused to appear before a justice of the peace to enter a plea shall be served to the owner or operator by: ; [Amended March 18, 2002] - i. Personal delivery to the owner or operator; or - ii. Regular mail and addressed to the owner or operator at his/her last known address as shown in the records of the Highway Safety Division, Department of Transportation and Public Works. - e. Upon receiving the summons to accused and prior to or on the date set to appear before the justice of the peace to enter a plea, the owner or operator may: - i. Plead guilty and pay a fine in the amount prescribed for "out of court settlement" for such offence in Schedule "A". 12. Plead not guilty whereupon the case will proceed to the court and any person convicted of an offence against this bylaw shall be adjudged to pay a fine of an amount not more than the "maximum fine" nor less than the "minimum fine" amount prescribed for such offence in Schedule "A". ## 11. Police Committee The Police Committee as established by the Committee ByLaw of the City of Summerside SS-04 shall advise and make recommendations to the traffic authority on all matters pertaining to this bylaw. ## 12. Existing Regulations The traffic and parking regulations in existence in the city on the effective date of this bylaw shall remain in effect until they are replaced by regulations made under this bylaw. On the effective date of this bylaw, all traffic control devices in existence in the city shall remain at their location until they are relocated or removed by regulations made under this bylaw. ## 13. Access Control Where council deems it necessary for the safe regulation of traffic, it may by resolution close, relocate or change the size of any existing access from private property to any street, road or highway in the city, provided that no access from private property shall be closed if by so doing, the private property would be isolated from all streets, roads or highways. ## 13. Repeal of Existing Bylaw Bylaw Number 95-09, the Summerside Traffic and Parking Bylaw which was adopted on April 15, 1996 is hereby repealed ## 14. Effective Date The effective date of this bylaw is March 15, 1999. Stewart, Mayor [SIGNED] Terry Murphy, Chief Administrative Officer [SIGNED] <!-- image --> ## CORPORATION OF THE CITY OF SUMMERSIDE REGULATIONS: BYLAW NAME: SS-07-01 Traffic and Parking Bylaw SS-07 BYLAW #: ## Authority These regulations are made pursuant to Section 4 of the Summerside Traffic and Parking Bylaw (SS-07). ## 2. Snow Removal Designees The following class of persons is authorized to remove snow from the streets of the city: - a. All employees of the Municipal Services Department of the city and any independent contractors including the Government of Prince Edward Island, engaged by the city for that purpose together with their agents, servants and employees. ## No Parking Zones - a. In addition to the limitations set out by the provisions of the highway traffic act, no person shall stop, stand or park all or any part of a vehicle on or within a "NO PARKING" zone identified in Appendix A of these regulations. - b. A "NO PARKING" zone shall be identified by signs having the words "NO PARKING" inscribed thereon or by signs as depicted in Diagram 1, Appendix A of these regulations and /or by white lines painted on the pavement or the curbs. - c. A "NO PARKING" sign as prescribed by Subsection b. shall be erected at the points of commencement and of termination of a "NO PARKING" zone and at spaces no greater than thirty (30) metres throughout the zone. ## 4. Controlled Parking Zones - a. No person shall stop, stand or park all or any part of a vehicle on or within a "CONTROLLED PARKING ZONE" identified in Appendix B of these regulations contrary to any limitation indicated by the sign(s) which identify the zone. 2. A "CONTROLLED PARKING ZONE" shall be identified by a "PARKING CONTROL" sign as depicted in Diagram 2, Appendix B of these regulations. - C. A sign of the form prescribed in subsection b. may be varied by the insertion on the sign of such symbols, words, figures or letters as may be required to indicate the duration of the parking, the time of the day and/or the days of the week for which the sign is to be effective. - d. A "PARKING CONTROL" sign shall be erected at the points of commencement and termination of a "CONTROLLED PARKING ZONE" and at spaces no greater than thirty (30) metres throughout the zone. ## 5. Time Limited Parking Zones - a. No person shall stop, stand or park all or any part of a motor vehicle for a continuous period of time in excess of that designated in a "TIME LIMITED PARKING" zone identified in Appendix C of these regulations. - b. A "TIME LIMITED PARKING" zone shall be identified by Parking Control Signs as prescribed by Section 4 or by signs with "(insert time limit) PARKING ONLY" inscribed thereon. - C. A "TIME LIMITED PARKING ONLY" sign shall be erected at the points of commencement and termination of a "TIME LIMITED PARKING" zone and at spaces no greater than thirty (30) metres throughout the zone. ## 6. No Stopping Zones - a. No person shall stop, stand or park all or any part of a motor vehicle on or within a designated "NO STOPPING" zone identified in Appendix D of these regulations except in accordance with the restriction(s) applicable thereto. 2. A "NO STOPPING" zone shall be identified by a "NO STOPPING" sign as depicted in Diagram 3, Appendix D of these regulations. - C. A sign of the form prescribed in subsection b. may be varied by the insertion on the sign of such symbols, words, figures or letters as may be required to indicate the time of day and/or days of the week for which the sign is to be effective and/or designating types of vehicles which are exempt. - d. A "NO STOPPING" sign shall be erected at the points of commencement and termination of a "NO STOPPING" zone and at spaces no greater than thirty (30) metres throughout the zone. ## 7. Restricted Parking Zones - a. No person shall stop, stand or park all or any part of a vehicle on or within a "RESTRICTED PARKING" zone identified in Appendix E of these regulations except in accordance with the restriction(s) applicable thereto. - b. A "RESTRICTED PARKING ZONE" shall be identified by a sign which has the words "Restricted Municipal Parking" inscribed thereon together with a red letter "M" enclosed by a green circle and such arrows or words as may be necessary to indicate the commencement, termination or continuation of the zone. - c. A "RESTRICTED PARKING" sign shall be erected at the points of commencement and termination of a "Restricted Municipal Parking" zone and at spaces no greater than thirty (30) metres throughout the zone. - The operators of fire department vehicles, police vehicles, and vehicles with a municipal parking sticker with the designation "M" as issued by the chief of police shall be the only persons permitted to stop, stand or park a vehicle on or within these restricted areas designated as "Restricted Municipal Parking". ## 8. Bus Stop Zones - a. No person shall stop, stand or park all or any part of a vehicle on or within a "BUS STOP PARKING" zone identified in Appendix F of these regulations except in accordance with the restrictions) applicable thereto. 2. A "BUS STOP" shall be identified by a sign which has the words "BUS STOP" inscribed thereon. A "BUS STOP" shall be a rectangular area fifteen (15) metres by three (3) metres which exists immediately to the front and left of the said sign with the sign being a corner of the rectangular area. - c. The operators of buses shall be the only persons permitted to stop, stand or park all or any part of a vehicle on or within those restricted areas designated as a "BUS STOP". ## Disabled Parking Zones - a. No person shall stop, stand or park all or any part of a vehicle on or within a "DISABLED PARKING" zone identified in Appendix G of these regulations except in accordance with subsection c. - b. A "DISABLED PARKING" zone shall be an area of seven (7) metres by four (4) metres identified by a sign which has the words "DISABLED PARKING" inscribed thereon and/or by a parking space demarcated by blue paint with the symbol as depicted in Diagram 4 of Appendix G of these regulations. - c. Disabled persons, or the operators of vehicles containing disabled persons or passengers shall be the only persons permitted to stop, stand or park all or any part of a vehicle on or within those restricted areas designated as "DISABLED PARKING", provided that such vehicle must prominently bear a sticker, plate or other emblem or sign clearly identifying the vehicle as being owned, operated or used for the transportation of a disabled person or persons. ## 10. Loading Zones - a. No person shall stop, stand or park all or any part of a vehicle on or within a "LOADING ZONE" identified in Appendix H of these regulations except in accordance with subsection c. 2. A "LOADING ZONE" shall be identified by a sign as depicted in Diagram 5, Appendix H of these regulations which has the words "LOADING ZONE" inscribed thereon. - C. The operator of a vehicle engaged in the delivery or pickup of commercial produce, merchandise or supplies shall be the only persons permitted to stop, stand or park a vehicle on or within those restricted areas designated as "LOADING ZONES". Said operator shall only stop, stand or park a vehicle on or within the said "LOADING ZONES" for a maximum time period of 15 minutes between 8:00 a.m. and 5:00 p.m., Monday through Saturday. ## 11. Fire Lanes - a. No person shall stop, stand or park all or any part of a vehicle on or within a "FIRE LANE" identified in Appendix I of these regulations on public or private property at any time. 2. A "FIRE LANE" shall be identified by signs having the words "FIRE LANE" inscribed thereon, followed by the words "NO PARKING" or the words "TOW AWAY ZONE" and that portion of the street or private or public property to which the sign is applicable shall be clearly indicated by yellow or white lines or words or markers thereon or by reference to another sign erected thereon. ## 12. Overnight Parking In order to facilitate snow removal from the streets of the city, during the period of November 1st to April 30th, no person shall park a motor vehicle on any streets within the city or on property owned by the city between the hours of 1:00 a.m. and 6:00 a.m., except with the permission of the chief of police or his/her designate. ## 13. One Way Traffic - a. No person shall travel in a direction on a street identified in Appendix J of these regulations opposed to the direction designated as one way. - b. A "ONE WAY" street shall be identified by signs in accordance with the traffic sign regulations of the highway traffic act. - c. "ONE WAY" signs shall be erected at the point of commencement and termination of a "ONE WAY" street and at intervals along the street where necessary and "DO NOT ENTER" signs shall be erected at the point of termination of a one way street. ## 14. Prohibited Turning - a. No person shall turn in a direction at an intersection where it is prohibited to do so as identified in Appendix K of these regulations. - b. A sign that prohibits turning in a direction at an intersection shall be identified by a sign in accordance with the traffic sign regulations of the highway traffic act. - C. A prohibited turning sign shall be erected at the point of commencement of the intersection. ## 15. General Parking Prohibition No person shall stop, stand or park all or any part of a vehicle on: - a. A street so as to obstruct free passage of traffic on the street, unless a vehicle is disabled such that it is not practicable to avoid stopping and temporarily leaving it on the street; 2. A sidewalk or an area generally used or intended for use by pedestrians; - c. In front of a public or private driveway so as to not obstruct the view of the vehicle which may be exiting the driveway; 4. Within a crosswalk; - e. Within 2.5 m from the point on the curb or edge of the street immediately opposite a fire hydrant; - f. The street side of a vehicle stopped or parked at the edge or curb of a street; - g. The side of a street other than on the right side of the street parallel to that side and, where there is a curb, with the wheels within 300mm of the curb; - h. The street in a position or condition or under circumstances likely to cause danger to other persons using the street. ## 16. Offences Any person who commits an offence contrary to the provisions of any of Sections 3 - 15 of these regulations shall be guilty of an offence and liable for a penalty pursuant to Section 7 of the Traffic and Parking Bylaw (SS-07). ## 17. Removal of Vehicles - a. If a motor vehicle is stopped, standing or parked on a street within the city contrary to Sections 3 - 15 of these regulations, a traffic officer may move a vehicle or cause it to be moved or require the driver or person in charge of the vehicle to move it to a position determined by a traffic officer and all costs or charges, if any, for moving the vehicle shall be a lien upon the vehicle. 2. Where a traffic officer moves a vehicle, causes it to be moved, or requires the driver or person in charge of the vehicle to move it in accordance to Subsection a., the risk of any damage to property occasioned thereby shall be borne by the owner of the vehicle. ## 18. Enforcement Offences against these regulations shall be prosecuted according to Section 10 of the Traffic and Parking Bylaw (SS-07). ## 19. Speed Limit No person shall drive a motor vehicle at a greater speed than forty (40) kilometres per hour within the city except where stated otherwise in Appendix L of these regulations. ## 20. Chief of Police Authority The chief of police or any officer acting under his/her authority and supervision may, when circumstances warrant or during emergencies, direct traffic contrary to the provisions of these regulations and may, without limiting the generality of the foregoing, direct traffic against the designated directions on a "ONE WAY" street, direct traffic to turn left at "NO LEFT TURN" intersections, or right at a "NO RIGHT TURN" intersection, direct traffic to proceed contrary to operating traffic signals, direct traffic to park in "NO PARKING" zones, temporarily designate a street as a "ONE WAY" street and post temporary signs and blockades indicating same or temporarily close a street to all motor vehicle traffic. ## 21. Exempt Vehicles Sections 3 - 15 and 19 of these regulations shall not apply to police, ambulance or fire fighting vehicles or vehicles owned by members of the police or fire services bearing stickers identifying them as such while the operators thereof are involved in the execution of their duties and are utilizing emergency lighting or to the vehicles owned by the city while the operators thereof are involved in the execution of their duties and are utilizing emergency lighting. ## 22. Parades - a. No person shall organize, conduct or take part in any parade unless the parade has been authorized by the chief of police or his/her designate. 2. Upon application the chief of police may authorize parades. - c. In deciding to authorize or to refuse to authorize a parade, the chief of police may take into account the following considerations: - i. The desired parade route; - ii. The date and time for closing of streets; - iii. The duration of the parade; - iv. The availability of police manpower; - V. The purpose of the parade; and - vi. Other relevant considerations; 10. Persons who are desiring to conduct a parade shall make application to the chief of police providing therewith information relevant to the considerations in subsection b. and such other information as the chief of police may request. - e. Any person who violates this section shall be guilty of an offence. ## 23. Street Closure - No person shall close any street or any portion thereof without the written permission of the chief of police or his/her designate. - Any person who violates this section shall be guilty of an offence and liable for a penalty pursuant to Section 7 of the Traffic and Parking Bylaw (SS-07). ## 24. School Crossing Guard - a. The traffic authority may place at an intersection or street crossing indicated in Appendix M of these regulations, near schools in the city at such times as indicated, a person to safeguard all students using the intersection. 2. Such person, who is designated to safeguard students at any such intersection shall be distinguished by wearing an orange vest, shall carry a stop sign and shall, when so placed and distinguished, have the same control over traffic at such intersection as any police officer or traffic officer. - c. All drivers of vehicles proceeding through an intersection, where a person is designated to safeguard the students using the intersection, shall obey the instructions of the designated person. ## 25. Municipal Parking Lots The Municipal Parking Lots referred to in these regulations shall be as described in Appendix N of these regulations. ## 26. Motorized Snow Vehicles No person shall operate a motorized snow vehicle on public property, streets or right of ways in the City of Summerside except in areas and under conditions designated in Appendix O of these regulations or in the case of an emergency by the Chief of Police. ## 27. Weight Restrictions The city may enter into an agreement with the Prince Edward Island Department of Transportation &amp; Public Works wherein the city may adopt the Vehicle Weight Regulations made pursuant to the Roads Act, R.S.P.E.I., 1988 Cap. R-15 and amendments thereto for vehicles travelling in the city and wherein the enforcement of said regulations may be carried out by such officers as may be employed by the Prince Edward Island Department of Transportation &amp; Public Works. ## 28.
