## VILLAGE OF ABBEY ABBEY, SK BYLAW NO. 08-1
## A BYLAW TO CONTROL THE OWNERSHIP OF ANIMALS
The Council for the Village of Abbey in the Province of Saskatchewan enacts as follows:
1. This bylaw may be referenced as "The Animal Ownership Bylaw".
2. For the purpose of this bylaw, the expression:
- "cattery" shall mean a place where cats are bred or looked after;
- "domesticated" shall mean to accustom animals to live near the habitation of humans; to tame;
- "dovecote" shall mean a structure for housing pigeons;
- "even-toed hoofed animals" shall mean mammals having reduced number of functional toes and that rest their weight equally on the third and fourth toes of each foot - Examples include but are not restricted to cattle, pigs, deer, antelope, camels, llamas, sheep, goats;
- "fur farm" shall mean a place where animals are bred for fur;
- "kennel" shall mean a breeding or boarding establishment for dogs;
- "odd-toed hoofed mammals" shall mean mammals having a reduced number of toes, each encased in a protective horny sheath or foot, and the weight is carried by the middle digit of each foot - Examples include but are not restricted to horses, asses, mules;
- "poultry" shall mean domesticated birds kept for eggs or meat - Examples include but are not restricted to chickens, turkeys, ducks, geese, fowl, pheasants, pigeons, ostriches;
- "Municipality" shall mean the Village of Abbey
- "rodent" shall mean a mammal with strong incisors and no canine teeth Examples include but are not restricted to rabbit, chinchilla.
3. No person shall herd domesticated, even or odd-toed hoofed mammals at any time within the limits of the Municipality.
4. No person shall graze domesticated, even or odd-toed hoofed mammals at any time within the area of the Village which lies South of the Southwesterly Boundary of the Canadian Pacific Railway Right of Way.
5. No person shall keep domesticated, even or odd-toed hoofed mammals, poultry at any time within the area of the Village which lies South of the Southwesterly Boundary of the Canadian Pacific Railway Right of Way.
6. No person shall keep domesticated, even or odd-toed hoofed mammals, poultry or rodents at any time beyond the area designated in Section 4 and 5 except within a barn, shed, pen, fence or structure especially erected for such purpose and in accordance with municipal bylaws and provincial legislation including but not restricted to the Stray Animals Act.
7. No person shall keep a "cattery" or a "kennel".
8. This bylaw shall not apply to dogs or cats with the exception of references to "cattery" and "kennel".
9. Any person found guilty of an infraction of any of the provisions of this bylaw shall be liable to the penalties provided for in the General Penalty Bylaw.
## Voluntary Payment Tickets
10. a) Where a Bylaw Enforcement Officer believes that a person has contravened any provision of this bylaw, he may serve upon such person a Bylaw Violation Tag, (Form A) as provided by this section either personally or by mailing or leaving same at his/her last known address and such service shall be adequate for the purpose of this Bylaw.
- b) Such notice shall be deemed to have been served:
- i) on the expiration of twenty-four hours after it is posted, if the notice is mailed;
4. ii) on the day of actual delivery, if the notice is served personally; or
5. iii) on the business day following the transmission, if given by facsimile.
- c) A tag shall state the section of the bylaw which was contravened and the amount of $100.00 that will be accepted by the Village in lieu of prosecution.
- d) Upon production of a Bylaw Violation Notice issued pursuant to this section within fifteen (15) days from the issue thereof, together with the payment of the fee as provided for in Section 9(c) to the Administrator of the Municipality, the person to whom the ticket was issued shall not be liable for prosecution for the contravention in respect of which the ticket was issued
- e) When any person contravenes the same provision of this Bylaw two or more times within one twelve month period, the specified payment payable in respect of the second or subsequent contravention is double the amount shown in Section 9(c) of this Bylaw in respect of that provision.
- f) Notwithstanding the provisions of this section, a person to whom a Bylaw Violation Notice has been issued pursuant to this section may exercise his/her right to defend any charge of committing a contravention of any of the provisions of this Bylaw.
