## TOWN OF ARBORFIELD ## BYLAW No. 2016-006 TRAFFIC BYLAW ## A BYLAW TO REGULATE THE OPERATION AND PARKING OF VEHICLES AND THE USE OF THE ROADWAYS The Council for the Town of Arborfield in the Province of Saskatchewan, enacts as follows: ## 1. Definitions For the purpose of this bylaw, the following terms and words shall have the following meanings: - a. "angle parking" means the parking of vehicles with the right front wheel drawn up on the righthand side of the roadway, or at a distance of not more than thirty (30) centimeters from such curb, the vehicles to be placed at an angle of forty-five (45) degrees with the curb; - b. "administrator" means the Administrator of the municipality; - c. "all-terrain vehicle" and/or "ATV" means all-terrain vehicle as defined in The All-Terrain Vehicles Act; - d. "council" means the Council of the Town of Arborfield; - e. "curb" means the lateral boundaries of a roadway, whether or not marked by curbing; - f. "roadway" means a road, parkway, driveway, square or place designated and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area and does not include a provincial highway within the municipality as designated pursuant to the provisions of The Highway and Transportation Act, 1997; 7. g· "municipality" means the Town of Arborfield; - h. "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of a roadway, or a distance of not more than thirty (30) centimeters from such curb; - i. "parking" means parking as defined in The Traffic Safety Act; - j. "place of public assembly" means schools, theatres, churches, rinks and halls; - k. "power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking; 1. "designated officer" means the Administrator, Police Officer, Town Foreman, Bylaw Enforcement Officer or any other person appointed by council to enforce municipal bylaws; - m. "speed zone" mans any portion of a roadway within the municipality, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto; - n. "U-Turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such a turn; - o. "vehicle" means a vehicle, trailer, or semi-trailer or a motor vehicle as defined by The Traffic Safety Act. ## 2. Scope - a. "Stop" Streets: roadways as listed in Appendix 1; - b. "Yield" Streets: roadways as listed in Appendix 2; ## 3. Infractions - a. "Stop" Streets: the provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "stop" sign erected and maintained in accordance with the provisions of subsection 4(a). 2. "Yield" Streets: the provisions of The Traffic Safety Act shall apply to all traffic approaching and facing a "yield" sign erected and maintained in accordance with the provisions of subsection 4(b). ## c. Miscellaneous Signs: - i. No person shall, except where authorized by resolution of Council, or when duly authorized by law, erect upon or immediately adjacent to any roadway, any sign, marker, signal, light or any advertising sign or device; - ii. No person shall deface, damage, destroy, or remove any sign or marker erected pursuant to this Bylaw. ## d. School Bus Safety Lights and Stop Arm: - Subject to clause 3(d)(ii), the operator of a school bus when operating a school bus on public roadways in the municipality shall activate the safety lights or stop arm; - ii. Provision of clause 3(d)(i) shall not apply at the locations listed in Appendix 4. ## e. Parking: - i. Except as otherwise provided herein, the parking of vehicles is permitted on all roadways within the municipality. - il. (a) Subject to the provision of subclause 3(e)(ii)(b), no person shall park a vehicle in any lane, or in any street so as to obstruct the entrance to any lane or to a driveway or approach leading to a private premises; 3. (b) Notwithstanding to provisions of subclause 3(e)(ii)(a), a vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such vehicle shall be parked for a period exceeding thirty (30) minutes at one time, unless written permission has first been obtained from the Administrator of the municipality for an extension of such time; - iii. (a) Subject to subclause 3(e)(iii)(b), every person parking a vehicle upon a roadway within the municipality where parking is permitted, shall parallel park the same on the right side of the roadway within thirty (30) centimeters of the curb, in the proper 5. (b) Every person parking a vehicle upon a roadway listed in Appendix 5 shall angle park; - iv. No person shall park a vehicle in any "No Parking" areas as designated in Appendix 6 at any time whether such areas are marked on the curb or otherwise by signs erected and maintained in accordance with the provision of subsection 4(d) to indicate that parking therein is prohibited; - v. No person shall park a vehicle within two (2) meters of any fire hydrant; - vi. No person shall park a vehicle within five (5) meters of any roadway intersection; - vii. No person shall park a vehicle on any roadway at one place for any period of time exceeding forty-eight (48) consecutive hours; - vili. Each private residence is allowed up to two (2) personally-owned vehicles to be parked on a roadway at any given time, subject to clause 3(e)(vii); - ix. No person shall leave a travel trailer or semi-trailer parked on a roadway which is unattached from a vehicle used for moving the same, subject to clause 3(e)(vii); - x. No person shall park any vehicle in any private place or on any private property unless they are the owner, occupant, licensee, or permittee of the parking place or private property, except with the consent of such owner, occupant, licensee or permittee; - xi. (a) Subject to subclause 3(e)(xi)(b), no person shall park any vehicle designated for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within thirty (30) meters from any building in the municipality used to intended for use, in whole or in part, as a place of dwelling, a hotel, or place of 14. (b) Nothing in subclause 3(e)(xi)(a) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo; - xii. No person shall park a vehicle with a manufacturer's rated capacity in excess of 5,500 kg on any streets or avenues designated in Appendix 7; - xili. No person shall park any part of a vehicle on any boulevard or sidewalk within the municipality exceeding forty-eight (48) consecutive hours; - xiv. (a) No person shall park a vehicle in designated Handicap Parking areas unless the vehicle displays a handicap placard in the vehicle's front windshield; 18. (b) Clause 3(e)(xiv) (a) does not apply to Emergency Vehicles; ## f. Power Turns: The operator of a vehicle shall not execute "power turns" or cause the vehicle to make excessive noise on any roadway in the municipality. ## g. Snowmobiles: Notwithstanding the provisions of The Snowmobile Act: - i. The operation of snowmobiles is permitted on any roadway or any signed snowmobile trails within the limits of the municipality, for the purpose of a direct route to and from the boundaries of the municipality. ## h. Speed: No person shall operate a vehicle in the municipality at a speed greater than forty (40) kilometers per hour. ## i. U-Turns: No person shall cause a vehicle to make a U-Turn at the intersections designated as "no U-Turn" intersections as listed in Appendix 3. This shall apply to all traffic approaching and facing a "No U-Turn" sign erected and maintained in accordance with the provisions of subsection 4(c). ## j. All-Terrain Vehicles: Notwithstanding the provisions contained in The All-Terrain Vehicles Act: - i. The operation of ATV's is permitted on any roadway within the limits of the municipality, for the purpose of a direct route to and from the boundaries of the municipality. - ii. The operation of ATV's is permitted for the purpose of private property maintenance. ## k. Golf Carts: - i. It shall be lawful to operate a golf cart on all public roadways within the limits of the municipality; - ii. No person shall operate a golf cart on the public roadway within the limits of the municipality without a valid driver's license; - ili. Any person operating a golf cart shall require third party liability insurance coverage. ## I. Weight Restrictions - Truck Routes: - i. No person shall operate any vehicle weighing with or without its load more than 12,000 kg on or over the public roadways listed in Appendix 8; - ii. Subject to clause 3(I)(i), no person shall operate any vehicle on any roadway within the municipality designated as a "Truck Route" as listed in Appendix 9, that with or without the load exceeds the following weight: - iii. Clause 3(I)(i) does not apply to passenger buses or recreational vehicles; - iv. Clause 3(I)(i) shall not apply to vehicles making delivery on any roadway in the municipality provided that the operator of the vehicle(s) uses the most direct route from and to the truck route as listed in Appendix 9. - (a) Steering Axle 5,500 kg - (b) Single Axle 8,200 kg - (c) Tandem Axle 14,500 kg - (d) Tridem Axle 20,000 kg ## 4. Signs - a. Council shall cause to be erected and maintained at all stop streets in Appendix 1, at a distance of approximately three (3) meters from point of intersection, an appropriate sign containing the word "Stop", so placed to face the traffic approaching the intersection. - b. Council shall cause to be erected and maintained at all yield streets listed in Appendix 2, at a distance of approximately three (3) meters from point of intersection, an appropriate "Yield" sign, so placed to face the traffic approaching the intersection. - c. Council shall cause to be erected and maintained at all "No U-Turn" intersections as listed in Appendix 3, at a distance of approximately three (3) meters from point of intersection, an appropriate sign prohibiting U-Turns, so placed to face the traffic approaching the intersection. - d. Council shall cause to be erected and maintained at all "No Parking" areas as listed in Appendix 6, appropriate signs or curb markings. Such signs or curb markings shall be visible from that part of the highway to which the restriction applies. - e. Unless otherwise directed by a designated officer, pedestrians or drivers of vehicles shall comply with all permanent and temporary signs, traffic control systems and any marking, barrier or device that has been placed or is maintained by the authority of the Council or another designated officer. ## 5. General ## a. General - i. All traffic on the roadways and sidewalks, notwithstanding the provisions of this Bylaw, will be subject to any temporary or emergency direction of a designated officer for the purpose of relieving congestion of traffic, preventing accidents, performing maintenance or street cleaning or meeting unforeseen conditions; ## b. Temporary Street Closures 1. Notwithstanding any other provision in this Bylaw, the Administrator or Council shall have the authority to temporarily close roadways to vehicular traffic or restrict traffic, parking or stopping on any street for the purpose of: 2. (a) enabling work to be carried out by or on behalf of the municipality including road maintenance, street cleaning, snow removal or sewer or water construction, repair or improvements. 3. (b) facilitating the moving of any building, structure, machine or other object for which a permit has been issued by the municipality; 4. (c) facilitating the construction, repair or demolition of a building, structure or other object for which a permit has been issued by the municipality; 5. (d) facilitating public gatherings. - ii. Notwithstanding any other provision of this Bylaw, a designated officer hired to enforce this Bylaw shall have the authority to temporarily close roadways to vehicular traffic or restrict traffic, parking or stopping on any street to avoid traffic congesting, danger, accident, or other emergency; - ili. Where a roadway has been closed pursuant to clause 5(b)(i), the municipality shall install such temporary stop, yield, parking or detour signs as may be required; - iv. For the purpose of street repair and maintenance, the municipality may move, for such distance as necessary, any vehicle that is parked on any street or portion thereof which is roped off, barricaded or indicated by notice or sign as being closed;. - v. No person shall drive, park or stop a vehicle or walk on any street portion thereof that is roped off, barricaded or indicated by sign or notice as being closed; 10. Notwithstanding any other provisions of this Bylaw, a designated officer is hereby authorized to direct traffic in any manner they deem necessary to expedite traffic, safeguard pedestrians, prevent accidents or meet any unforeseen conditions, whether or not in conformity with this Bylaw or The Traffic Safety Act, in event of a fire, accident, or other emergency; 11. Notwithstanding any other provision of this Bylaw, in the case of fire or other emergency and no designated officer or authorized municipality employee is present, an officer of the Fire Department is authorized to direct traffic in such a manner as they deem necessary whether or not their directions are in conformity with the provisions of this Bylaw or The Traffic Safety Act. ## c. Obstruction Sidewalk or Roadway - i. No person shall obstruct the free passage of traffic on any sidewalk or roadway without first informing the municipality; - ii. Clause 5(c)(i) shall not be construed as prohibiting the gathering of individuals on any sidewalk or roadway for lawful purpose so long as the proceedings there are peaceable and orderly and sufficient space is left both on the sidewalks and roadways to accommodate traffic. ## 6. Penalties ## a. Sign penalties: Any person who contravenes any of the provisions of clauses 3(c)(i) and 3(c)(ii) of this Bylaw is guilty of an offence and liable on summary conviction to the penalty of $60 for unlawfully erecting or defacing/damaging a sign. ## b. Detailed penalties: A person who contravenes any of the provisions of this Bylaw or fails to comply therewith or with any of this Bylaw or fails to comply therewith or with any notice or order given there-under shall be guilty of an offence and upon summary conviction, shall be liable to penalties as follows: - i. Clause 3(e)(ii)(a) - $60 Obstruct lane or entrance 2. Clause 3(e)(ii)(b) - $60 Exceed 30 minutes to discharge cargo 3. Clause 3(e)(iii)(a) - $60 Park on right side of roadway 4. Clause 3(e)(iv) - $60 Park in "No Parking" area - V. Clause 3(e)(v) - $60 Park within two (2) meters of a fire hydrant 6. Vl. Clause 3(e)(vi) - $60 Park within five (5) meters of a roadway intersection - vii. Clause 3(e)(vii) - $60 Park continuously over forty-eight (48) hours 8. Viii. Clause 3(e)(viii) - $60 More than two (2) vehicles on street per residence - ix. Clause 3(e)(ix) - $100 Park trailer/semi-trailer unattached on roadway - X. Clause 3(e)(x) - $60 Park on private property without consent - XI. Clause 3(e)(xi) - $100 Park with inflammable, combustible material 12. XiI. Clause 3(e)(xiii)- $60 Park on boulevard over forty-eight (48) hours 13. Xili. Clause 3(e)(xiv) - $100 Unauthorized parking in "Handicap Parking" ## c. Notice of Violation: - i. A violator of any of the subsections of this Bylaw, upon being served with a Notice of Violation, may during the regular office hours, voluntarily pay the penalty at the municipal office within seven (7) days and upon payment as so provided, that person shall not be liable to prosecution of the offence. - ii. The Notice of Violation shall be in Form 1, Appendix 10, attached to and forming part of this Bylaw. ## d. Traffic Violations The penalty for all traffic violations under The Traffic Safety Act, The Snowmobile Act, The AllTerrain Vehicles Act and The School Bus Operating Regulations shall be liable to the penalties imposed by The Summary Offences Procedure Act and/or any other applicable legislation. ## General Penalty Except where otherwise specified in this Bylaw, any person who contravenes any provision of this Bylaw is guilty of an offense punishable on summary conviction by a fine in an amount not exceeding two thousand ($2,000) dollars. ## 7. Impounding - a. In addition to and notwithstanding any provisions contained within Section 7 hereof, any person appointed as a designated officer pursuant to this Bylaw: 2. May remove or cause to be removed, may seize, impound or store any vehicle that: 3. (a) Is unlawfully placed, left or kept on any street, public parking place or other public place; 4. (b) Is unlawfully parked pursuant to clause 3(e)(vii) when requested by the owner, occupant, licensee or permit holder of said land. - b. The municipality may retain a vehicle which has been impounded or stored at any place authorized by the municipality after it has been removed under subsection 7(a) until the amount of outstanding fines, if any and the costs incurred in removing and impounding or storing the vehicle have been paid and upon payment of said outstanding fines and costs, the vehicle shall be released to the owner. 6. ·ll the fines and costs described in subsection 7(b) have not been paid within a period of thirty (30) days, the municipality shall have the right to recover same from the owner of the vehicle by legal action in a court of competent jurisdiction, sale through public auction or by private sale of the vehicle. - d. Prior to the sale of a vehicle which has been impounded or stored under this section, the municipality shall provide notice designating the time and place of the sale at least fourteen (14) days prior to the sale by: - i. Publishing a notice in a newspaper circulating in the municipality; - ii. Sending a copy of said notice by regular mail to the owner at the address last appearing on the vehicle registration; and - ili. By any other means which council may consider appropriate. - e. The proceeds from such sale shall be applied firstly on the fines and costs described in subsection 7(b) and the balance remaining, if any, shall be paid to the owner. - f. If the proceeds from such sale are insufficient to satisfy the fines and costs described in subsection 7(b), the amount of the shortfall shall be a debt due and owing from the owner and enforceable by the municipality in any manner allowed by law. ## 8. Contravention of Bylaw - a. When a person authorized by the municipality to enforce this Bylaw has reason to believe that a person or vehicle has contravened any provision of this Bylaw, the person authorized to enforce this Bylaw may issue a summons or ticket to the person. Service of the summons or ticket may be made by anyone of the following methods, and if so made shall be deemed to be effective service for the purposes of this Bylaw: - i. By delivering it personally to the individual; - ii. By placing the summons or ticket on the vehicle in respect of which an offence is alleged to have been committed; - ili. By sending it registered mail to the individual's last known address; - iv. In case of a parking violation, by regular mail. - b. No person, other than a person authorized by the municipality to enforce this Bylaw, shall place a summons or ticket on any vehicle. - c. No person other than the owner or operator of the vehicle shall remove a summons or ticket from a vehicle. - d. A person authorized by the municipality to enforce this Bylaw may cancel any summons or ticket where that summons or ticket was issued improperly or in error. - e. Notwithstanding any other provisions of this Bylaw, the registered owner of any vehicle shall be liable for a violation of any provision of this Bylaw, as well as the person who committed the breach, unless the registered owner proves to the satisfaction of the judge trying the case that, at the time of the breach, the vehicle had been stolen from them or taken without their consent express or implied, out of their possession or out of the possession of a person entrusted by them with its care. ## 9. Impoundment of Obstructions, Encumbrances or Encroachments Where an obstruction, encumbrance or encroachment is created or left on any roadway, boulevard or sidewalk, any person authorized by the municipality may remove or cause to be removed that obstruction, encumbrance or encroachment at the cost of the person who caused the same and may destroy or otherwise dispose of the same. ## 10. Prosecution for Damages Nothing in this Bylaw shall be construed to curtail or abridge the right of the municipality to prosecute an action for damages by reason of damage suffered to any municipal property resulting from the contravention of any of the provisions of this Bylaw. ## 11. Severability If a court of a competent jurisdiction should declare any section or subsection of this Bylaw to be invalid, such section or subsection shall not be construed as having persuaded the Council to pass the remainder of the Bylaw and it is hereby declared that the remainder of the Bylaw shall be valid and remain in force. ## 12. Repeal Bylaw No. 2-1960, Bylaw No. 2/74, Bylaw No. 1/76, Bylaw No. 4/85, Bylaw No. 1/2001 are hereby repealed. ## 13. That Section 3(I)(ii) Weight Restrictions - Truck Routes of Bylaw No. 2016-006 be amended as follows: ## Section 3(I) Weight Restrictions - Truck Routes - ii) Subject to clause 3(I)(i), no person shall operate any vehicle on any roadway within the municipality designated as a "Truck Route" as listed in Appendix 9, that with or without the load exceeds the weight restrictions for Highway 23 as regulated by the Province of Saskatchewan. 2.
