TOWN OF CARLYLE
BYLAW NO. 2019-03
A Bylaw to Regulate the Operation & Parking of Vehicles and the Use of Highways
The Council of the Town of Carlyle, in the Province of Saskatchewan, enacts as follows:
1. This bylaw may be referred to as the Traffic Bylaw.
2. Definitions:
For the purpose of this Bylaw, the following terms and words shall have the following meanings:
a. "angle parking" means the parking of vehicles with the right front wheel drawn up on the right-
hand side of the highway, or at a distance of not more than thirty (30) centimeters from such
curb, the vehicles to be placed at an angle of forty-five (45o) degrees with the curb; for parking
on Main Street, angle parking means the parking of vehicles with the left front wheel drawn up
on the left hand side of the highway, or at a distance of not more than thirty (30) centimeters
from such curb, the vehicles to be placed at an angle of forty-five (45o) degrees with the curb
b. "administrator" means the administrator of the municipality;
c. "all terrain vehicle" and or "ATV" means all terrain vehicle as defined in The All Terrain
Vehicles Act;
d. "council" means the council of the Town of Carlyle;
e. "curb" means the lateral boundaries of a roadway, whether or not marked by curbing;
f.
"highway" means a road, parkway, driveway, square, or place designated and intended for or
used by the general public for the passage of vehicles, but does not include any area, whether
privately or publicly owned, that is primarily intended to be used for the parking of vehicles and
the necessary passageways on that area and does not include a provincial highway within the
municipality as designated pursuant to the provisions of The Highways and Transportation Act,
1997;
g. "justice" means a justice of the peace as per The Interpretation Act, 1995;
h. "lug vehicles" means any vehicle with a portable engine or tractor engine having metal spikes,
lugs or cleats projecting from the face of the wheels or tires thereof, or having metal track tread;
i.
"municipality" means the Town of Carlyle;
j.
"one-way highway" means highway ascribed to it by The Traffic Safety Act;
k. "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to
the curb on the right-hand side of the highway, or a distance of not more than thirty (30)
centimeters from such curb;
l.
"parking" has the meaning ascribed thereto by The Traffic Safety Act;
m. "place of public assembly" means schools, theatres, churches, rinks, and halls;
n. "power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to
depart from its ordinary line of progress by the sudden use of acceleration and/or braking;
o. "designated officer" means the Administrator, Royal Canadian Mounted Police, Sheriff, or any
other person appointed to enforce municipal bylaws;
p. "speed bump" means an uneven patch on the highway, constructed of asphalt, concrete or
other like material for the purpose of controlling speed;
q. "speed zone" means any portion of a highway within the Town of Carlyle, as designated
herein, and identified by a sign erected and maintained at each end thereof, indicating the
maximum speed applicable thereto;
r.
"u-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction
from which it was proceeding immediately prior to the commencement of such turn;
s. "vehicle" means a vehicle, trailer or semi-trailer or a motor vehicle as ascribed to by The Traffic
Safety Act.
3. Scope:
a. "Stop" Streets: highways listed in Appendix 1;
b. "Yield" Streets: highways listed in Appendix 2;
c. "No U-turn" Intersections: intersections of the highways, approached from all four directions,
listed in Appendix 3;
d. "One-way" Streets: highways listed in Appendix 4;
e. "Loading Zones": highway locations listed in Appendix 5.
4. Infractions:
a. "Stop" Streets: the provisions of The Traffic Safety Act shall apply to all traffic approaching
and facing a "stop" sign erected and maintained in accordance with the provisions of
subsection 5(a).
b. "Yield" Streets: the provisions of The Traffic Safety Act shall apply to all traffic approaching
and facing a "yield" sign erected and maintained in accordance with the provisions of
subsection 5(b).
c. Miscellaneous Signs:
1) No person shall, except where authorized by resolution of Council, or when duly
authorized by law, erect upon or immediately adjacent to any highway, any sign,
marker, signal or light or any advertising sign or device.
2) No person shall deface, damage, destroy, or remove any sign or marker erected
pursuant to this bylaw.
d. School Bus Flashing Lights:
1) The use of school bus flashing lights shall be permitted on all streets in the Town of
Carlyle, except as indicated in Appendix 6.
e. Lug Vehicles:
1) No person shall propel, operate, or drive any lug vehicle upon any highway within the
municipality without first obtaining from the administrator, a permit in writing authorizing
same.
2) The administrator is hereby authorized to issue permits in writing for the purpose of
clause 4(e)(1) of this bylaw, in any case where the applicant therefore has signed a
written undertaking in Form 1, Appendix 7. Provided that the administrator shall not
issue any such permit unless he/she is satisfied that, with reasonable care in operation,
the lug vehicle may be propelled or driven over any highway without damage resulting
thereto or to any bridge or culvert thereon.
3) Nothing contained in clause 4(e)(1) shall be deemed to preclude the transport of a lug
vehicle as herein defined over any highway where same is being carried by means of a
rubber-tired trailer or other conveyance equipped with rubber tires.
f.
Parking:
1) Except as otherwise provided herein, the parking of vehicles is permitted on all
highways within the municipality.
2) a) Subject to the provisions of subclause 4(f)(2)(b), no person shall park a vehicle in
any lane, or in any street so as to obstruct the entrance to any lane or to a driveway or
approach leading to private premises;
b) Notwithstanding the provisions of subclause 4(f)(2)(a), a vehicle may be parked in
any lane for the purpose of taking on or discharging cargo, provided no such vehicle
shall be parked for a period exceeding thirty (30) minutes at one time, unless written
permission has first been obtained from the administrator or a special constable of the
municipality for an extension of such time.
3) (a) Subject to subclause 4(f)(3)(b), every person parking a vehicle upon a highway
within the municipality where parking is permitted, shall parallel park same.
(b) Every person parking a vehicle upon a highway listed in Appendix 8 shall angle park
same.
4) No person shall park a vehicle in any "No Parking" area as designated in Appendix 9 at
any time whether such areas are marked on the curb or otherwise by signs erected and
maintained in accordance with the provisions of subsection 5(d) to indicate that parking
therein is prohibited.
5) No person shall park a vehicle within five (5) meters of any street intersection or fire
hydrant.
6) No person shall park a vehicle within three (3) meters of any lane intersection.
7) No person shall park a vehicle on any sidewalk or boulevard.
8) No person shall park a vehicle on any highway at one place for any period of time
exceeding forty-eight (48) consecutive hours.
9) No person shall park a vehicle on any highway where there is restricted parking, in
accordance with Appendix 13.
10) No person shall park any vehicle in any private place or on any private property unless
he is the owner, occupant, licensee or permittee of the parking place or private
property, except with the consent of such owner, occupant, licensee or permittee.
11) (a) Subject to subclause 4(f)(11)(b), no person shall park any vehicle designated for
carrying or intended for carrying of oil, gasoline, or other flammable, combustible or
explosive material, within thirty (30) meters from a building in the municipality used or
intended for use, in whole or in part, as a place of dwelling, a hotel or place of public
assembly.
(b)
Nothing in subclause 4(f)(11)(a) shall be deemed to restrict the parking of any
such vehicle for such period of time as may be necessary to take on or discharge
cargo.
12) (a) Handicapped parking will be provided for people with disabilities. The Handicapped
Parking spaces will be specifically designated by signage on Main Street.
(b)
Any person who contravenes this provision shall be liable to a penalty of $50.00.
g. Power Turns:
The operator of a vehicle shall not execute "Power Turns" on any highway in the
municipality.
h. Speed:
1) Subject to subclause 4(h)(2) and (3) no person shall operate a vehicle in the
municipality at a speed greater than forty (40) kilometers per hour.
2) No person shall operate a vehicle on that portion of provincial highways within the town
limits at a speed greater than that established by the Ministry of Highways and
Infrastructure.
3) No person shall operate a vehicle in excess of thirty (30) kilometers per hour on any
highway designated in Appendix 11.
4) No person shall operate a vehicle in excess of 10 kilometers per hour in or through the
area known as Lion's Park, including the swimming pool area.
i.
U-Turns:
1) No person shall cause a vehicle to make a U-turn between intersections, at the
intersection of a highway with a lane or an alley in the municipality.
2) No person shall cause a vehicle to make a U-turn at the intersections designated as
"No U-turn Intersections" as listed in Appendix 3. This shall apply to all traffic
approaching and facing a "No U-turn" sign erected and maintained in accordance with
the provisions of subsection 5(c ).
j)
Vehicles on Public Reserves, etc.:
1) No person may operate or park a vehicle on any area designated on Appendix 12.
2) The provisions of clause 4(j)(1) shall not apply to maintenance vehicles or vehicles
using a designated parking area.
k) Bicycles:
1) No person shall operate a bicycle without having at least one hand on the handle bar.
2) No person shall operate a bicycle on a sidewalk.
3) No person shall leave a bicycle lying down on a public sidewalk.
4) Every person riding a bicycle upon a street in company with other bicycle operators
shall do so in single or double file. At no time shall the bicycles be ridden three or more
abreast.
5) No person shall ride a bicycle except on a seat attached to same.
6) No person riding a bicycle shall tow or drag any person or other vehicle; nor shall any
such operator wheel another vehicle along side the bicycle being ridden unless the
vehicle is specifically designed for these purposes which include a rigid tow bar.
7) No person riding a bicycle shall attach same or himself to any moving vehicle.
8) Every person riding a bicycle shall ride as close as possible to the right hand curb or to
any person who may be riding a bicycle on his right side. This shall not apply when the
rider is approaching an intersection and indicates his intention to turn from a direct line
by giving a visible signal.
9) Every bicycle shall be equipped with a brake adequate to control its movement and to
stop whenever necessary. Such brake shall be maintained in efficient working order at
all times.
l)
One Way Highway:
Except as otherwise provided herein, a person may operate a vehicle in either direction on
all highways within the municipality.
m) Loading Zones:
1) No operator of a vehicle shall remain in a loading zone for a period exceeding two (2)
minutes for the purpose of embarking or disembarking passengers, provided that on
the expiration of the two minute period, the onus of proving the loading and unloading
of passengers shall rest with the driver of any vehicle found in such a loading zone.
2) No operator of a vehicle shall remain in a loading zone for periods exceeding ten (10)
minutes for the purpose of loading or unloading goods.
n) Snowmobiles:
Under the provisions of The Snowmobile Act and The Snowmobile Regulations, 1998, and
subject to clause 4(n)(2):
1) It shall be lawful to operate a snowmobile between the hours of 7:00 a.m. and 10:00
p.m. on any highway except on Main Street from Railway Avenue to Coteau Avenue,
solely for the purpose of leaving the municipality by the most direct route or returning to
a residence by the most direct route.
2) Notwithstanding clause 4(n)(1) of this bylaw, it shall be lawful to operate a snowmobile
on the portion of Main Street for the purpose of crossing Main Street at the
intersections of Souris Avenue and Coteau Avenue.
3) Notwithstanding clause 4(n)(2) of this bylaw, all Provincial highway crossing must be
assessed by traffic operations staff from the Ministry of Highways and Infrastructure to
ensure that any crossing safety issues are addressed. All snowmobile trails that run
inside the right-of-way of a provincial highway must be permitted in writing by the
Ministry of Highways and Infrastructure. All snowmobile trail permit applications must
be sent to the Saskatchewan Snowmobile Association, who will forward any
applications that they deem as requiring a permit to the Ministry of Highways and
Infrastructure.
4) All snowmobile operators shall yield the right-of-way to vehicles on Highway No. 9 and
Highway No. 13 before crossing the highway.
5) Any snowmobile crossing a public highway must come to a full stop prior to crossing
and must take the most direct route across the highway.
6) Any snowmobile entering onto a public highway shall do so from an established public
highway approach.
o) All Terrain Vehicles:
Under the provisions of The All Terrain Vehicles Act,
1) It shall be lawful to operate an all terrain vehicle between the hours of 7:00 a.m. and
10:00 p.m. on any highway except on Main Street from Railway Avenue to Coteau
Avenue, solely for the purpose of leaving the municipality by the most direct route or
returning to a residence by the most direct route.
2) Notwithstanding clause 4(o)(1) of this bylaw, it shall be lawful to operate an all terrain
vehicle on the portion of Main Street for the purpose of crossing Main Street at the
intersections of Souris Avenue and Coteau Avenue.
3) All all terrain vehicle operators shall yield the right-of-way to vehicles on Highway No. 9
and Highway No. 13 before crossing the highway.
4) Any all terrain vehicle crossing a public highway must come to a full stop prior to
crossing and must take the most direct route across the highway.
5) Any all terrain vehicle entering onto a public highway shall do so from an established
public highway approach.
p) Pedestrians
Rules regarding pedestrians will be as outlined in The Traffic Safety Act, section 223.
5. Weight and Size Restrictions:
a. In this section, gross vehicle weight shall mean the same as defined in The Highways and
Transportation Act, 1997.
b. No person shall operate or cause to be operated any vehicle registered with a gross vehicle
weight in excess of 5,500 kilograms on any street in the Town except those streets as listed in
Appendix 10 of this bylaw.
c. No person shall operate or cause to be operated any vehicle registered with a gross vehicle
weight in excess of 45,000 kilograms on any street in the Town.
d. Notwithstanding subsection (b), no person shall operate or cause to be operated any vehicle
with a tandem rear axle on any street in the Town except those streets listed in Appendix 10 of
this bylaw.
e. The operator of a vehicle as described in this section who may require to deviate from the
designated truck route, shall prior to deviating in any manner, obtain a permit from the Town
Administrator, indicating the date, time and designated route such vehicle will be traveling.
f.
Permits issued pursuant to subsection (e) may be revoked at any time and for any reason
whatsoever, by verbal or written notice by the Town Administrator, a Council member, or any
person designated by Council, and nothing shall be construed that the Town is required to
issue any permit. The decision to issue or revoke any permit lies solely with the Council of the
Town of Carlyle.
g. No person shall operate or cause to be operated any motor vehicle or combination of vehicles
that exceed twelve (12) meters in length on that portion of Main Street between Railway
Avenue and Coteau Avenue.
h. A Certificate of the Administrator for Saskatchewan Government Insurance, Motor Division,
shall be sufficient proof of the gross vehicle weight of a vehicle.
i.
Except for the purpose of loading and unloading, no person shall park a vehicle which is 5,500
kilograms or more on any street in the Town.
6. Signs:
a. Council shall cause to be erected and maintained at all stop streets in Appendix 1, at a distance
of approximately three (3) meters from point of intersection, an appropriate sign containing the
word "Stop", so placed to face the traffic approaching the intersection.
b. Council shall cause to be erected and maintained at all yield streets in Appendix 2, at a
distance of approximately three (3) meters from point of intersection, an appropriate sign
containing the word "Yield", so placed to face the traffic approaching the intersection.
c. Council shall cause to be erected and maintained at all No U-Turn streets as listed in Appendix
3, at a distance of approximately three (3) meters from point of intersection, an appropriate sign
prohibiting U-Turns, so placed to face the traffic approaching the intersection.
d. Council shall cause to be erected and maintained at all No Parking areas as listed in Appendix
9, appropriate signs and/or curb markings. Such signs or curb marking shall be visible from
that part of the highway to which the restriction applies.
e. Council shall cause to be erected and maintained at all "Speed Bump" locations as listed in
Appendix 13, at a distance of approximately ten (10) meters from the speed bump, an
appropriate sign warning of the bump and identifying the maximum speed at which it is safe to
proceed over the speed bump, so placed to face the traffic approaching the speed bump.
f.
Council shall cause to be erected and maintained appropriate signs indicating the locations
where the use of ATV's and Snowmobiles is prohibited, as set out in Appendix 14.
7. Penalties:
a. Signs:
b. Any person who contravenes any of the provisions of Section 4(c) of this bylaw is guilty of an
offence and liable on summary conviction to the penalties provided in the General Penalty
Bylaw of the municipality.
c. Any person who contravenes any of the provisions of Section 4(a), (b), (d), (h), and (l) of this
bylaw shall be liable to the penalty imposed by The Traffic Safety Act.
d. Any person who contravenes any of the provisions of Section 4(n) of this Bylaw is guilty of an
offence and liable on summary conviction to the penalties provided in The Snowmobile Act.
e. Any person who contravenes any of the provisions of Section 4(o) of this Bylaw shall be liable
to the penalty imposed by section 32 of The All Terrain Vehicles Act.
f.
Any person who commits a breach of any of the provisions of Section 4(a), (b), (d), (f), (g), (h),
(i), (j), (l), and (m) of this Bylaw shall be fined in accordance with Section 210 of The Traffic
Safety Act of Saskatchewan.
g. Notice of Violation
i)
A violator of any of the subsections of this bylaw listed in Section 6(e), upon being
served with a Notice of Violation, may during the regular office hours, voluntarily pay
the penalty at the municipal office within seven (7) days and upon payment so
provided, that person shall not be liable to prosecution of the offence.
ii) The Notice of Violation shall be in Form 2, Appendix 15, attached to and forming part
of this bylaw.
h. Bicycle Contravention
The penalty for the contravention of section 4(k) of this bylaw is as follows:
i)
for the first infraction impounding the bicycle for ten (10) days; and
ii)
for the second or additional infractions, impounding the bicycle for thirty (30) days.
8. Impounding:
a. In addition to and notwithstanding any provisions contained within Section 6 of this bylaw, any
police officer or person appointed as a designated officer pursuant to this bylaw may, without
warrant, seize, remove or cause to be removed any vehicle that is parked, placed, left or kept
on any street, lane, public parking place or other public place in contravention of any section of
this bylaw regulating the parking of vehicles.
b. For the purposes of this section, the term "vehicle" shall not mean and include bicycles, which
are ruled upon by Section 6(f) of this bylaw.
c. The municipality may retain a vehicle which has been impounded or stored after it has been
removed under subsection 7(a) until the amount of outstanding fines, if any, and the costs
incurred in removing and impounding or storing the vehicle have been paid, and upon payment
of said outstanding fines and costs, the vehicle shall be released to the owner.
d. If the fines and costs described in section 7(c) have not been paid within a period of thirty (30)
days, the municipality shall have the right to recover same from the owner of the vehicle by:
i.
legal action in a court of competent jurisdiction;
ii.
sale through public auction; or
iii.
by private sale of the vehicle.
e. Prior to the sale of a vehicle which has been impounded or stored under this section, the
municipality shall provide notice designating the time and place of the sale at least fourteen
(14) days prior to the sale by:
i.
publishing a notice in a newspaper circulating in the municipality;
ii.
sending a copy of said notice by regular mail to the owner at the address last
appearing on the vehicle registration; and
iii.
by any other means which council may consider appropriate.
f.
The proceeds from such sale shall be applied firstly on the fines and costs described in
subsection 7(c) and the balance remaining, if any, shall be paid to the owner.
g. If the proceeds from such sale are insufficient to satisfy the fines and costs described in
subsection 7(c), the amount of the shortfall shall be a debt due and owing from the owner and
enforceable by the municipality in any manner allowed by law.
9. Repeal
Bylaw No. 2820 and all bylaws amending Bylaw 2820 including: 2825, 2908, 2010-07, 2010-11, 2010-12,
2011-04, 2012-18, 2014-09, 2015-03, 2015-08, 2016-02, 2016-03, 2016-05, 2018-02, are hereby
repealed.
10. Coming into Force
This bylaw shall come into force and take effect on the date of the final reading thereof.

I declare that:
(1) I will use reasonable care in propelling, operating or driving such lug vehicle(s) over the highway to prevent
any damage resulting to the highway.
(2)
I will, when operating such lug vehicle over any bridge or culvert on any highway or on any specified bridge
or culvert thereon, first lay down on such bridge or culvert planks or timbers of not less than 5 cm in thickness and
extending a minimum of 300 mm wider on each side that the maximum outside width of the lugs; such planks or
timbers to be laid lengthwise across the bridge or culvert in the direction in which the lug vehicle is proceeding in
such a manner that they will support the wheels or tread of the lug vehicle on both sides thereof throughout its
entire passage over such bridge or culvert.
(3) I will pay for all damages caused to such highway or to any bridge or culvert thereon as a result of propelling,
operating or driving such lug vehicle thereon.
(4) I understand that lug vehicles are not allowed to travel on or across provincial highways unless a written
permit is obtained from the Ministry of Highways and Infrastructure.
(5) I understand that all municipal bridges have secondary weight limitations unless posted otherwise and I will
ensure that I comply with any and all weight restrictions.
