## BYLAW NO. 6 of 1978

A BYLAW OF THE TOWN OF CORONACH, IN THE PROVINCE OF SASKATCHEWAN, IO REGULATE THE OPERATION OF VEHICLES WITHIN THE TOWN.
The Council of the Town of Coronach, in the Province of Saskatchewan, enacts as follows:
## SECTION 1 - DEFINITIONS
For the purpose of this bylaw the expression:
1. (1) (a) "Act" means the Vehicles Act, RoS.S. 1978, Chapter V-3, and amendments thereto; and the Urban Municipality Act and amendments thereto;
2. "Alley" means the stréet intended primarily to give access to the rear of real property;
3. "Council" means the Council of the Town of Coronach; (c)
4. (a) "Curb" means the actual curb or curbstone and if there is no curb or curbstone at the place in question, it means the dividing line marking the boundary between the street and the real property abutting thereon which is intended for use by pedestrians;
5. (e) "Parade" means a procession or body of pedestrians numbering more than Iwenty-five (25) who are standing, marching or wälking on any street sidewalk (except displays by the armed forces) and means any organized procession of vehicles numbering ton (10) or more standing or moving on any street (except when in a funeral procession);
6. "Person" includes any man, woman, child, partnership, association of individuals, and bodies corporate or politic;
7. (g) "Police Officer" means a member of the Royal Canadian Mounted Police or Police hired by Council;
8. "Private drivoway" means every road or driveway which is not open to be used by members of the public at large for passage of vehicles or traffic and includes every road or driveway on private property;
9. "Property Line" means the line marking the boundary between lobe, or blocks according to a registered plan of survey and means the line marking the boundary between any other lots or blocks or other ree! property however deseribed;
10. "Sidewalk" means that portion of the street or that area adjacent to street which is used primarily by pedestrians;
11. (k) "Sidewalk crossing" means that portion of the sidewalk permanontly improved and or designated for the passage of vehicular traific;
- (1) "Street" means a public highway;
13. (m) "'Town" means the town of Coronach;
- (1) "Town Clerk" means the person occupying the positon of Town Clerk of the Town of Coronach;
- (0) "'Town Official" includes the Town Clerk, Town superintendent, fire chief, and includes the person or persons employed by the Council to carry out the duties of the aforesaid persons in their ebsence;
16. "Traffic" neans pedestrians, animals, vehicles, buses, motor vehicles, and all other conveyances, either singly or together while using any street, alley, or sidewalk, and includes the movement of nedes. trians, animals, vehicles, buses, motor vehicles and other convey ances upon any street, alley or sidewalk;

- (1) (9) "Traffic sign" means any signal, sign, marioing or obner device placca, painted, or errected for the guidance, regulation, warning, direction, or prohibition of traffic;
2. (r) "UTurn" means to turn a vehicle on a street so as to proceed in the opposite direction.
- (3) This bylaw and all matters referred to herein shall be interpreted as having application only to the territory within the corporate limits of the Town. Nothing contained in this bylaw shall to route (s) of the Provincial Highway (5) lying within the incor orate area of the Municipal boundaries which Highways shall be governed by the Provisions fixed by or under the Vehicles Act Saskatchewan and Highways Act Saskatchewan.
- (3) This bylaw shall be interpreted as having application only to those matters within the jurisdiction of the Town
## SECTION 2 - AUTHORITY OF POLICE
- 20 (1) Any police officer is hereby authorized to direci trafric to conform with the provisions of this bylaw, The Urban Municipalitios Act and the Vehicles Act.
- (2) Any julice officer may direct traffic in any marner which ho deens necessary in order to expedite the flow of traffic, any emergency condition which has arisen or which he considers likely to arise.
- (3) No person shall direct or attempt to direct traffic unless enthor to do so by a police officer or Town official except in the event of an emergency requiring the direction of traffic.
- (4) (a) Any portion of a street may be temporaiily clösed to vehicular traffic by a police officer in order that pedestrians may have the exclusive use thereof.
- (b) Any police officer or Town official shall have avthority to temporarily prevent parking on any street or portion thereof when; in his judgement it may be necessary in order to prevent tratric
- (c) Notwithstanding any other provision of this bylaw, any police officer or Town official shall have the authority to prevent parking and to prohibit traffic on any street or portion thereof to allow any work to be carried out by or on behall of the town and to erect: or cause to be erected traffic signs indicating the exercise of such authority.
- (5) No person shall drive a vehicle through or upon any street or portion thereof which is coped or barricaded or upon which a traffic sign has been placed indicating that the street has been closed by a police officer or Town official.
3.0 (1)
## SECTION 3 - TRAFFIC CONTROL DEVICES
Stop signs shall be located as follows:
- (a) On Centre Street at the intersection with Railway Avenue and the intersection with Second Street Hest.
- 3184(6) On First Street East at the intersection with Railway Avenue and the intersection with South Avenue.
- (c) On Second Street East at the intersection with First Avenue and the intersection with South Avenue.
- (a) On First Street West at the intersection with Railway Avenue and at the intersection with Centre Street·
- (e) On Third Street West at the intersection with Crawford Avenue and at the intersection with First Avenue.
- On Fourth Street West the intersection with Crawford Avenue and the intersection with First Avenue.
- (g) On King Street at the intersection with First Avenue and the tu intersection with South Avenue.
- (h) On Patricia Drive at its easterly intersection with Crawford Avenue.
- (i) On Stone Place at its intersection with Crawford Avenue.
- (3)) On First Avenue at the intersection with Second Street West, with First Street West, with Centre Street, with First Street East and its southerly intersection with Poplar Street.
- (k) On First Avenue South at the intersection with Centre Streeb.
- (1) On Churchill Avenue at the intersection with First Street Vest and the intersection with Second Street West.
- (m) On South Avenue at the intersection with Second Street West,
- (n2) 'On Crawford Avenue at the intersection with Second Street West and the intersection with Railway Avenue.

Yeild signs shall be located as follows:

- (c) On Westview Drive at its intersection with Fourth Street west, with First Avenue and with King Street.

- (4) The Council may authorize the eration of such waring or information signs as it may consider necessary or advisable for the proper carrying out of the provisions of this bylaw. In the event of an emergency, any police officer or Town official may crect or auth orize the erection of such traffic signs as he deems necessary or advisable for the direction or control of traffic.
- (5) The Town official or any police officer may authorize the placing of signs prohibiting parking in the vicinity of any fineral home church when a funeral is taking place or is about to take place. OL:
- (6) No person shall wilfully deface, injure, knock down, remove, obscure or interfere in any way with any warning or traffic sign erected or maintained by the council or pursuant to this bylaw or pursuant to the Act.

## SECTION 4 - STOPPING. STANDING AND PARKING
4. (1) No person shall stop a motor vehicle:
2. (a) within an intersection, except where allowed by (6) and (8) of Section 144 of the Vehicles Act:
3. (b) on a sidewalk;
4. (c) ön à sidewalk crossing
5. (a) on a pedestrian crossing;
6. (e) on a boulevara;
7. (f) to the left of another vehicle which is stopped, standing, or parked at the curb on the same side of the street;
8. (g) except on the right side of the street;
9. (h) within twenty (20) feet of any pedestrian crossing an intersec tion of a street where angle parking is permitted;
10. (i) within fifteen (15) feet of any pedestrian crossing at an inter. section of a street where parallel parking is permitted;
11. (j) within ten (10) feet of any pedestrian crossing at an intersoction in any area zoned as a residential area.
Where there is no clearly marked pedestrian crossing, the distance mentioned in (h), (i) and (j) hereof shall be measured from the prolongation of the nearest lateral boundary line of the intorsecting sidewalk at the nearest end of the block®
- " (2) No person shall park a motor vehicle:
- (a) In an alley;
- (b) Within fifteen (15) feet of the entrance to an alley on' all streets where angle parking is permitted;
- as to obstruct access by vehicles to vehicles fron a private dirveway, except if such vehicle is occupied and controlled by a licenced operator at all time while it is so stopped and then only temporarily for the purpose of and thile actually engaged in loading or unloading.
- (3) No person shall park any vehilce on a street or alley where a tractic sign has been placed or erected to indicate that parking is prohibited.
- (4) No person shall park any vehicle on a street for a longer tine than is állowed by traffic signs**..
- (5) Except where otherwise permitted herein, no person shall stop, stand or park any vehicle where the curb has been painted yellow.
- (6) Анти тов ма , порто прото о віто, All parking shall be parallel except on Center Street from Railway and First Avenue from First Street Fast to First Street West, north side only and First Street East from First Avenue to South Avenue, east side only, on which, vehicles will park at a 45 degree angle to the curb with the right front wheel not more than one linear foot from curb or sidewalk.
- (7) No vehicle shall be parked on any street for a continuos period in excess of twenty-four (24) hours.
- (8) No vehicle which does not display licence plates for the current year issued in accordance with the Act shall be parked upon a strest.
- (9) No operator of a vehicle shall stand or park such vehicle backed up to a curb.
- (10) No operutor of a semi-trailer or trailer combination shall stand or park the trailer portion of such vehicle backed up to a curb.. Tine power unit thereof must stand parallel to the curb and face 'in the direction of the lawiul flow of traffic while actually being Loaded and unloaded.
- (11) No person shall stand or park or leave any vehicle more than eight (8) hours on any street if the vehicle has been placed on a jack or jacks and one or more wheels have been renoved from 16 or part of the vehicle has been raised.

- (13) Any Town official upon being satisfied that it is necessary or advisable in the circumstances, is hereby authorized to issue a pernit allowing an applicant or applicants to stop, stand or park a vehicle or vehicles in a street or lane, for such tine or cines; and in any other manner otherwise prohibited by this bylaw upon such terms and conditions council or the lown official may prescribe.
- (14) No vehicle having a gross weight in excess of 10,000 pounds or on overall length in excess of twenty-three (23) feet shall be parked anywhere on centre street.

- (15) Any vehicle which is stopped, standing or parked contrary to any provision of this bylaw may be removed upon the direction of a police officor or Town official and placed in storage. Thencosts of such romoral and storage, if any, shall be paid by the ower or operator of such vehicle before the same is released from custody. Such costs shall constitute a lien upon the said vehicle and if the owner or operator of such vehiclo fails to pay such costs within fourteen (14) days after the day upon which the vehicle was placed in storage pursuant hereon, the vehicle may be sold for the purpose of recovering said costs, and the provisions of Section 9 and 10 of the Garagekeepers Act R. S. So 1979, Chapter G? and amendments

## SECTION 5 - RULES FOR OPERATION AND CONDITION OF VEHICLES
5. (1) No operator of a vehicle shall at any time cause or permit the portion of such vehicle to probeed around a corner at an intersection
2. in advance of the first portion of such vehicle.
- (2) No person shall operate a vehicle in reverse along any street or onto any street except when reasonably necessary in entering or leaving a porking space in lawful manner.
- (3) No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is safe to do so; nor shall any person leave a door of a motor vehicle open except
5. actually engaged in loading or unloading therefron,
- (4) No operator of a vehicle shall start, stop or turn from a direct line before first ascertaining that such movement can be made with out interfaring with other traffic and that such movement con be made without injury to person or damage to property.
- (5) No operator of a vehicle shall follow another vehicle more closely reasonable and prudent having due: regard for the speed of tha amount and nature of traffic and the condition of
- (6) Every operator of a vehicle shall reduce the speed of the vehicle which he is operating and take such other precautions as are necessary to avoid splashing any pedestrian with water, mud and slush.

- (8) Notwithstanding any other provisions hereöf to the contrary, no person shall drive, stand or park a vehicle upon any street, allar, sidewalk or sidewalk crossing in such a manner as to block, chstruct, impede or hinder traffic and the lawful movement of trattic thereon unless he is possessed of a permit from a Town official issued pursvant, hereto permitting him to do so in the circumstancesa
- (9) No operator of a vehicle shall drive within any sidewalk arco or

15. No operator of vehicle shall drive upon any pedestrian path in a public park.

17. No person shall drive any motor vehicle on a public highway in the Town of Coronach at a speed in excess of forty (40) kilometers per hour unless otherwise specified by traffic sign or signal.
- (12) No person shall operate a vehicle in such a manner as to cause the rear of the vehicle to depart from an ordinary line of progress»

- (14) No operator of a vehicle shall cause or permit the wheels or other mechanical part of such vehicle to pass over or to come into contact with a hose of the Fire Department.
- (15) No person shall pull any vehicle upon any street if the connection is so arranged that the towing vehicle and the vehicle being towed are separated by more than eight (8) feet and in no event shall more than two (2) vehicles be towed by a towing vehicle at any one
- (16) No person shall push or cause a vehicle to be pushed at a speed in excess of thirty (30) kilometres per Hours

- (18) No person shall cause a vehicle to cross a street except at an intersection by another street.

## SECTION 6 - NOISE ABATEMENT
6. (1) No operator of a public passenger vehicle shall solicit businees by oral communication while travelling on a street.
- (2) No person shall stop, stand, or park any motor vehicle with its motor running continuously for fifteen (15) minutes or more betveon the hours of eleven o'clock (11; 00) P.M. and six o'clock (6:00) A.l. the next day following.
## SECTION 7 - PEDESTRIANS
7. (1) No parade shall be held on any street, alley or lane unlose written permission has first been granted therefore by a lown officiel» Every person participating in a parade for which writton permission from a Town official has not been obtained is guilty of a breach of this section.
- (2) No person shall, by word or action, solicit a ride fron the operato: of a moving motor vehicle other than a public passenger vehicles
## SECTION 8 - BICYCLES
8. (1) No person shall ride a bicycle abreast of any to (2) other narcong riding bycycles on a street. except for the purpose of passing.
- (2) Every operator of a bicycle shall have at least one (1) hand on the handle bar at «ll times.
- (3) Every operator of a bicycle shall proceed at «ll times as close as possible to the right hand curb except when approaching an interm section at which he has visibly signalled his intention to naks a left turn.
- (4) No person shall ride or operate a bicycle on any aidewalk or pathwas within the Town which is reserved for pedestrians, nor upon any highway within the Town at a speed greater than forty (40) kilometers per hour.

## SECTION 8 - BICYCIES (continued)
- (5) No bicycle shall be ridden or operated on any highway within the Limits of the Town of Coronach except it be licenced under this bylaw and hus attached to it, its licence tag; hereirafter, roterred to, and unless im complete compliance with the regulations hereir

- (6) The owner of every bicycle, before it is ridden or operated upon any highway within the Town of Coronach shall procure therefore, from the Licence Inspector or the Town Clerk, a licence tag and shall pay the fee hereinafter prescribed therefore.
- (7) The fee payable for each bicycle licence tag shall be $2.00 and every bicycle securely afficed therto, in a position where it may easily and readily be seen at all times while being ridden or operated and tha absence of such tag so affed shall be prima facie evidence that such bicycle is not licenced." The said licence tag shall apply only to the bicycle in respect to which it was originally issued and slei not be transferable from one owner to another owner nor from ove bicycle to another bicycle; except in the case of a licenced bicyclo which is exchanged by the owner for another and then only with the knowledge and acquiescence of the Licence Inspector after the circumstances of the cases have been reported to him.
5. Any person violating the provisions oi Section 8 (1) to $ (7) choil be deemed guilty of an infraction thereof and shall, therefore, be subject to a penalty as prescribed in Section 10 (3) of this bylaw; and in addition thereto the bicycle concerned in the alleged infraction shall be subject to impoundment and pounded by the Police Officer acting in discharge of his duties as such, within the Town, pending the case before the Court and for a further period therafter, declared by the said Court as an additional penalty for the alleged If the person violating any of the provisions of this a Juvenile, then the bicycle concerned may bo so impounded by the Police Officer without Court Action for a period of not moro than seven days on the first offence or fourteen days on the second
- (8) subsequent offences.
## SECTION 9 - PRESEEVATION OF ROADWAYS & SIDEWALKS
9. (1) No vehicle, contrivance or conbination of vehneles which tsar combined with the river on combination et vehicles
2. (a) Eight and one - half (8}) feet in width;
3. (b) Thirteen and one - half (13l) feet in height; or
4. (c) Sixty - five (65) feet in length;
may be operated or moved or transported over or upon any strect, sidewalk or alley except if the owner or operator of the some has first obtained a special permit to do so from a lown officil,
- (2) No person shall permit or cause any tractor or other vehicle or having à gross weight in excess of 10,000 pounds having lugged wheels, or which is by any other reason capable of damaging, or making indentation in the paved or asphalt-oiled streets of the Town, to enter upon any such street, pontions of street or lanes within the Town except that such vehicles ei objecta shall be permitted to enter upon any such street, lanes or portions thereof as having been specifically designated by Council by resolution of the Council.

- (3) All fines or penalties imposed for the violation of the provisions of this section shall be in addition to any, assessment for damages which may be made at lsw agüinst the owner or operator of any such tractor, vehicle, machine or object which causes damages to Town Property.
- (4) Provided however, that this section shall not apply to buses, tractors or trucks while making a delivery or pick up within the Town by the most direct route from and back to the nearest place of access to or egress from the truck route, nor shall it apply to trucks or tractors going to or coming from a garage for the purpose of effecting necessary repairs thereto.
- (5) No person shall litter, nor shall any person cause (other than road building materials) which constitutes or which may constitute a threat, hazard, danger or obstruction to persons, or property or traffic to be thrown, placed or spilled upon a street, or sidewalk. violate this section shall, in addition to any other penalty provided therefore, be responsible for the costs or removing such litter or materials from the streat, alley or sidewalk.
## SECTION 10 - ENFORCEMENT
10. (1) All persons, who pursuant to the authority vested in them by this violate any provision of this bylaw in carrying out that authority or who, in enforcing any provison hereof, violate any provision of the bylaw in the course such enforcement duties, are excepted from the application of any part of this bylaw·
- (2) A person, who, having obtained a permit pursuant to any provision hereof, violates any term or condition upon which such permit was granted, is guilty of a violation of this section.
- (3) That any person or persons found guilty of a breach of Bylaw of the Town of Coronach for which no other penalty is provided, shall, upon convition before a Justice of the Peace or a Judge of the Provincial Court, forfeit and pay a penalty not exceeding Three Hundred dollars ($300,00) and costs for each offence.
- (4) The minimum penalty for a breach of any of the proceeding sections shall be the sum set out in the following schedule.
- (5) In the case of a violation of any of the provisions of Section 4. (1) to 40(13) inclusive, the penalty for each violation shall be of Five dollars ($5.00) if the same is paid within a period of Forty-eight (48) hours of the issue of à Voluntary Penalty Traffic Ticket by the person or on behalf of the person committing the offence, to the Town Clerk's office. In default of the volutary payment provided for, herein, the alleged offender shall be subject. to prosecution and upon convition to a fine or penalty in accordance with Section 10(3).
