BYLAW NO. 3/2019 A BYLAW OF THE VILLAGE OF DEBDEN TO CONTROL THE REMOVAL OF SNOW FROM PRIVATE PROPERTIES The council for the Village of Debden, in the Province of Saskatchewan enacts as follows: SHORT TITLE 1. This Bylaw may be cited as the Snow and Ice Removal Bylaw. PURPOSE 2. The purpose of this Bylaw is to regulate the removal and/or placement of snow on private property and to prevent injury or inconvenience to pedestrians. DEFINITIONS 3. In this Bylaw: a) "Adjoining property" means a parcel of land next to a sidewalk; b) "Debris" includes loose dirt, mud or organic material likely to interfere with pedestrian traffic; c) "Occupant" means an occupant as defined in The Municipalities Act; d) "Owner" means an owner as defined in The Municipalities Act; e) "Public Place "includes all or any part of a street as defined by The Municipalities Act, a park, a municipal reserve, buffer strip, drainage ditch or other property of The Village of Debden; f) "Roadway" means the part of the street adapted to the use of or ordinarily used by vehicles; g) "Sidewalk" means the part of the street adapted to the use of or ordinarily used by pedestrians; h) "Village" means the Village of Debden REGULATIONS 4. In this Bylaw: a) Residents and business owners will be responsible for clearing the snow, ice and/or loose debris from adjacent sidewalk. b) Residents and business owners will be responsible for clearing the snow, ice and/or loose debris from adjacent sidewalk within 48 hours from when the snow, ice or other loose debris was formed or deposited therein. c) No person shall push, blade, shovel, blow, place or deposit snow that has accumulated on private property onto any sidewalk, street or public place. d) No person shall push, blade, shovel, blow, place or deposit snow that has accumulated on private property other than their own. e) The owner or occupier of property shall ensure that when clearing or removing snow or ice or other loose debris, that he or she shall refrain from causing injury or unduly interfering with any person lawfully using the sidewalk, street or public place and shall refrain from causing damage to the sidewalk, street or public place. f) The owner or occupier of property shall ensure that snow disposal be undertaken in such a manner that it does not create a hazard or interfere with the use of streets, sidewalks or public place. PRIORITY 5. In the event of a snowfall, the following will be given priority in the manner listed as follows as Identified in Policy 1/2019. a) Emergency Routes b) School Routes c) Business d) Retirement Home e) Residential f) Alleys g) Recreation & Culture h) Custom Snow Clearing ENFORCEMENT 6. a) In the event that the bylaw is contravened, the Village may, by written order, require the owner or Occupant to remove the snow or ice or other accumulation from the street, sidewalk, or public place. Failing to do so, the Village may take whatever action or measures are necessary to remedy a contravention of the Bylaw, including removal of accumulation. b) A person who contravenes the provisions of this Bylaw is guilty of an offense and upon conviction shall be liable to the penalty provided by the General Penalty Bylaw of the Village. c) In addition to any fines, the cost of removing snow from the public place will be added to the property taxes of the individual or the business.
