PURPOSE AND DEFINITIONS Purpose 1. The purpose of this bylaw is to regulate vehicular and pedestrian traffic within the Town of Duck Lake. Definitions 2. In this bylaw: (a) "Act" means The Traffic Safety Act, and amendments thereto; (b) "All-Terrain Vehicle" and/or "ATV" means all-terrain vehicle as defined in The All Terrains Vehicle Act; (c) "Administrator" means the Administrator of the Town of Duck Lake as defined in The Municipalities Act for the Province of Saskatchewan; (d) "Angle parking" means the parking of vehicles with the right front wheel drawn up the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimeters from such curb, the vehicle to be placed at an angle of forty-five (45) degrees with the curb; (e) "Boulevard" means that portion of right-of-way that extends from the edge of the street to the property line of the adjacent property, not including the sidewalk; (f) "Council" means the Council of the Town as defined in The Municipalities Act for the Province of Saskatchewan; (g) "Curb" means the dividing line of the street between that part of the street intended for use of vehicles and that intended for pedestrians whether marked with a curbstone or not; (h) "Disabled Persons Parking Area" means all that portion of any street or other public place that has been designated by sign or other marking for the exclusive parking of disabled persons; (i) "Double Parking" means the parking of a vehicle whether occupied or not, parallel to a vehicle parked beside the curb in a designated parking area or parking to the rear of any vehicle that is angle parked at the curb in a designated angle parking area; (j) "Driver" means any person who drives or operates or is in charge of a vehicle on a public highway and includes an operator; (k) "Highway" means a road, parkway, driveway, square or place designed and intended for or used by the general public for the passage of vehicles, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area and does not include a provincial highway within the Municipality as designated pursuant to the provisions of The Traffic Safety Act; (l) "Heavy vehicle" means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed, has a gross vehicle mass (GVM) of more than 4.5 tonnes; (m) "Lane" means a public right-of-way which primarily gives access to the rear of property -------- -------- Mayor CAO 4 | P a g e Bylaw 2021-14 Traffic Bylaw and shall include alley; (n) "Lane Crossing" means the prolongation of the lateral boundary lines of the adjacent sidewalks; (o) "Loading Zone" means that portion of a right-of-way adjacent to the curb designated by signs and/or markings for the exclusive use of vehicles loading and unloading passengers or goods; (p) "Marking" means any marking installed on the street for the guidance, regulation, warning, direction or prohibition of traffic; (q) "Municipality" means the Town of Duck Lake; (r) "Other Meanings" All other meanings shall be as defined in The Traffic Safety Act for the Province of Saskatchewan; (s) "Public Works Manager" means the Public Works Manager of the Town of Duck Lake or anyone authorized to act on the Public Works Manager's behalf; (t) "Parade" means any group of pedestrians numbering thirty or more marching or walking along a street or sidewalk, and/or group of vehicles numbering ten or more proceeding along a street under a common leadership, but does not include funeral processions; (u) "Park" has the meanings ascribed thereto by the Traffic Safety Act; (v) "Parking" means the standing of a vehicle, whether occupied or not, other than temporarily for the purpose of, and while actually engaged in, loading or unloading or in obedience to traffic regulations, signs or signals; (w) "Parking Area" means any private or publicly-owned area primarily intended to be used for the parking of vehicles and the necessary passageways thereon; (x) "Parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the highway, or at a distance of not more than thirty (30) centimeters from such curb; (y) "Pedestrian" means a person travelling by foot, wheelchair, carriage sled or hand- pushed cart; (z) "Police Officer" means a member of the Royal Canadian Mounted Police; (aa) "Place of public assembly" means schools, churches, hockey and skating rinks, and public assembly halls; (bb) "Power turn" means to maneuver a vehicle in such a manner to cause the rear of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking; (cc) "Power Unit" means a power unit as defined by The Traffic Safety Act; (dd) "Private Driveway" means every road or driveway which is not open to be used by members of the public at large for passage of vehicles or traffic and includes every road or driveway on private property; (ee) "Recreational Vehicle" means a self-propelled or towed vehicular-type unit, primarily designed as temporary living quarters for recreational, camping or travel use and which is used solely as a family or personal conveyance and is in no way used for a commercial purpose. Without limiting the foregoing, recreational vehicles include: i) travel trailer; ii) cabin trailer; iii) tent trailer; iv) truck camper; v) motorhome; vi) park trailer; and -------- -------- Mayor CAO 5 | P a g e Bylaw 2021-14 Traffic Bylaw vii) fifth-wheel trailer; (ff) "Road Maintenance Equipment" includes sanding trucks, snow plows, de-icers, graders, backhoes and other similar equipment operated by an employee or agent of the Town while actually engaged in road maintenance; (gg) "Sidewalk" means the portion of right-of-way whether marked by elevated cement or other material, intended for the passage of pedestrians; (hh) "Special Constable" means the RCMP, Bylaw Officer, or a person appointed to enforce municipal bylaws; (ii) "Speed Zone" means any portion of a street within the Town of Duck Lake, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto; (jj) "Stopping" means: i. When required, a complete cessation from movement; and ii. When prohibited, any stopping, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or a traffic-control signal; (kk) "Street" means a road, alley or other place designed and intended for or used by the general public for the passage of vehicles and pedestrians, but does not include a parking lot, whether privately or publicly owned; (ll) "Town" means the Town of Duck Lake in the Province of Saskatchewan; (mm) "Traffic Signs" means any signal, sign, marking, or other device placed, painted, or erected for the guidance, regulation, warning, direction or prohibition of traffic; (nn) "U-turn" means turning a vehicle so as to cause it to proceed in the opposite direction from that in which it was proceeding immediately prior to the commencement of such turn; (oo) "Vehicle" means a vehicle, recreational vehicle, boat, trailer or semi-trailer, or a motor vehicle as ascribed to by The Traffic Safety Act. PART II - TEMPORARY STREET CLOSURES Temporary Street Closure 3. (a) A police officer, special constable or the Public Works Manager may temporarily close to vehicular or pedestrian traffic, or temporarily prohibit parking on any street or portion thereof in order to avoid traffic congestion, danger, accident or for construction or maintenance purposes and the Public Works Manager may install such temporary stop, yield or detour signs as may be required. (b) A person shall not drive, stop or park a vehicle or walk on any street or portion thereof which is roped off, barricaded or indicated by notice or sign as being closed. Movement of Vehicles to Accommodate Street Repair, Snow Removal, Street Sweeping or Other Street Maintenance 4. For the purpose of street construction, paving, street repair, snow removal, street sweeping or any other necessary street maintenance, the police, special constable or the Public Works Manager may, without notice, move, for such distance as is necessary, any vehicle that is parked on any street or portion thereof which is roped off, barricaded or indicated by notice or sign as being closed or as being a no-parking zone. -------- -------- Mayor CAO 6 | P a g e Bylaw 2021-14 Traffic Bylaw PART III - TRAFFIC CONTROL DEVICES Traffic Control Devices 5. The Council may, by bylaw, provide for the erection and maintenance on any street, or designated point thereon, of such traffic signs, markers, signals or lights as it deems necessary as per the Schedules of this Bylaw. Obedience to Signs 6. The operator of a vehicle or a pedestrian shall obey any applicable instructions or directions indicated on any traffic sign or marking installed on any street, or in any park, unless otherwise directed by a police officer. Unauthorized Signs Prohibited 7. Unless authorized by Town Council, a person shall not install a sign, signal or marking on a street, sidewalk or Town boulevard. The Public Works Manager, special constable or the police may remove, without notice, any such prohibited sign, signal or marking. Removal of Signs 8. A person shall not remove or deface any sign or notice put up in accordance with this Bylaw. PART IV - STOPPING AND PARKING Method of Parking 9. (1) The operator of a vehicle shall not stop or park the vehicle on any street, with the exception of designated angle parking streets as outlined in Schedule 5, other than parallel with the curb, with the right-hand wheels of the vehicle within 300 mm (12 inches) of the edge of the curb and face the vehicle in the direction of traffic. (2) If no curb exists, then a minimum of 1 meter off the edge of the paved surface. (3) In designated angle parking areas on a street, the operator of a vehicle shall stop or park the vehicle on any street at an angle with the right curb of between 40 and 60 degrees. No-parking Locations 10. The operator of a vehicle shall not park a vehicle on a street in any of the locations listed in Schedule 1. Parking Prohibited 11. (1) No person shall park a vehicle on a Public Right of Way; Town owned property or Crown Land maintained by the Town. (2) No person shall park a vehicle on a boulevard or sidewalk. (3) No person shall park a vehicle over a utility curbstop. -------- -------- Mayor CAO 7 | P a g e Bylaw 2021-14 Traffic Bylaw (4) No person shall park a vehicle in any lane, or in any street so as to obstruct the entrance to any lane or to a driveway or approach leading to private premises; (5)(a) No person shall park any commercial vehicle designated for carrying or intended for the carrying of oil, gasoline or other inflammable, combustible or explosive material, within 30 meters from any building in the municipality used or intended for use, in whole or in part, as a place of dwelling, a hotel or place of public assembly: (b) Nothing in subsection (a) shall be deemed to restrict the parking of any such vehicle for such period of time as may be necessary to take on or discharge cargo. (6) No person shall leave a trailer parked on a public street which is unattached from the vehicle used for moving same. (7) No person shall park a vehicle, except a vehicle identified as being operated by a disabled person, or by a person transporting a disabled person, in any area specified in Appendix 11. Parking Limits 12. The operator of a vehicle shall not park the vehicle on a street for more than forty-eight (48) hours. No Stopping in Certain Locations 13. The operator of a vehicle shall not stop the vehicle in any of the places listed in Schedule 2 except when necessary to avoid collision or conflict with other traffic or in compliance with the direction of a police officer or traffic sign or signal. Use of Space in Front of Fire Hydrant 14. (1) The driver of a vehicle shall not park within 3 meters (10 feet) of the fire hydrant curb access point as described in Subsection (2) unless: (a) the driver remains at the wheel of the vehicle and is at all times ready to move the vehicle upon request by the police, special constable or Town personnel. (2) The fire hydrant curb access point referred to in Subsection (1) will be determined by drawing a line perpendicular to the curb from the fire hydrant to the curb. Double Parking 15. A person shall not double park a vehicle on a street. An exception will be made for delivery trucks during delivery only. Unlicensed Vehicle Parked on Street 16. The operator of a motor vehicle or trailer which must be registered under The Traffic Safety Act shall not park an unregistered vehicle on any street. Vehicles found in violation will be ticketed and may be removed and stored at the owner's expense. -------- -------- Mayor CAO 8 | P a g e Bylaw 2021-14 Traffic Bylaw Private Parking Place 17. The operator of a vehicle shall not park the vehicle on any private parking place or on any private property except with the consent of the owner or occupant of the private parking place or private property. Recreational Vehicle Parking 18. (1) An owner or operator of a recreational vehicle shall not park the recreational vehicle on a residential street in the Town for more than forty-eight (48) consecutive hours following which the owner or operator shall move the recreational vehicle to an off- street location for a period of not less than forty-eight (48) consecutive hours before the recreational vehicle may be parked again on a residential street. (2) The owner of a recreational vehicle which is detached from the vehicle used for moving the same shall block one front tire and one back tire, both located on the same side of the recreational vehicle, with devices sufficient to prevent unattended movement of the recreational vehicle and such devices shall be removed from the street upon the removal of the recreational vehicle. (3) No owner or operator of a recreational vehicle shall park the recreational vehicle on any residential street pursuant to this subsection in such a manner as to constitute a hazard to other persons using the street. (4) Any recreational vehicle parked on a residential street pursuant to this subsection shall display a current plate. (5) No owner or operator of a recreational vehicle shall park the recreational vehicle on any boulevard or sidewalk or in a manner that obstructs a sidewalk. Vehicle Repair on Street 19. Except for making emergency repairs, a person shall not use any street for vehicle repair or vehicle maintenance. Motor Vehicles in Parks 20. (1) A person shall not drive or park a motor vehicle in a park, playground, school ground or public reserve. (2) Subsection 20(1) does not apply to that area in a park constructed and designated as a road or a parking lot for vehicles or to a person operating a vehicle or equipment while carrying out construction, repair or maintenance of the park. Motor or Other Vehicles Displayed for Sale 21. A person shall not display for sale a motor or other vehicle on any street or boulevard. -------- -------- Mayor CAO 9 | P a g e Bylaw 2021-14 Traffic Bylaw PART V - DRIVING AND OPERATING VEHICLE Vehicle Not to be Driven on Sidewalk 22. A person shall not drive or park or use a motor vehicle or heavy equipment on any sidewalk area unless the written permission of the Public Works Manager has been received, such permission only to be granted if precautions have been or will be taken to protect the sidewalk against damage and that the use of the sidewalk by the motor vehicle equipment will not unduly obstruct pedestrians. Towing Vehicles 23. A person shall not tow a vehicle on a street in an unsafe manner or with an unsafe tow rope, tow chain or other connecting device. Maximum Speed 24. A person shall not drive any vehicle on a street at a speed greater than the speeds permitted in Schedule 7. Stop Streets/ Yield Streets/Crosswalks 25. The provisions of the Traffic Safety Act shall apply to all traffic approaching and facing a "stop" sign erected and maintained by the Town as per Schedule 3. 26. The provisions of the Traffic Safety Act shall apply to all traffic approaching and facing a "yield" sign erected and maintained by the Town as per Schedule 4. 27. The provisions of the Traffic Safety Act shall apply to all traffic approaching and facing a "crosswalk" sign erected and maintained by the Town as per Schedule 6. Power Turns 28. The operator of a vehicle shall not execute "power turns" on any highway within the municipality. U-Turns 29. No person shall cause a vehicle to make a U-turn at the intersection of a street with a lane or an alley in the municipality. Snowmobiles/ATVs/Golf Carts/Mini-Bikes 30. (1) While following the provisions of the "Snowmobile Act" it shall be lawful to operate a licensed snowmobile between the hours of 7:00 a.m. and 11:00 p.m. on any public highway, except Provincial Highways No. 212 and No. 11, within the municipality. -------- -------- Mayor CAO 10 | P a g e Bylaw 2021-14 Traffic Bylaw (2) Notwithstanding section (30) (1) of this bylaw, it shall be lawful to operate a snowmobile on the portion of Provincial Highways No. 212 and No. 11 for the purpose of crossing the same. 31. No person shall drive a mini-bike, golf cart or a two, three or four wheeled motorized vehicle (All-Terrain Vehicle) that is not capable of being licensed under the Traffic Safety Act of The Province of Saskatchewan, on any sidewalk, park, playground or public reserve, or on any property owned or controlled by the Town, or on any private property unless owner approval has been obtained. 32. No person shall drive a mini-bike, golf cart or an All-Terrain Vehicle in an unsafe manner and the "All-Terrain Vehicle Act" and "Traffic Safety Act" must be followed at all times PART VI - PERMITTED VEHICLE WEIGHTS Damage to Streets 33. A person shall not use a vehicle on a street if the vehicle would cause damage to the street surface. Vehicle Weights and Routes 34. A person shall not operate a vehicle having a maximum gross vehicle weight of more than 8,000 kg (17,640 lbs.) through or within the Town except on routes as listed in the Town of Duck Lake Managing Vehicle Weights Bylaw #2015-07. Authority of Police and Special Constable 35. The operator of any vehicle shall, upon the request of a police officer or special constable, take the vehicle to any scale designated by the police officer or special constable and have the vehicle weighed. PART VII - STREET AND SIDEWALK OBSTRUCTION Obstructing Sidewalk or Street 36. (1) A person shall not obstruct the free passage of traffic on any sidewalk or street without the written permission of the Town. (2) Nothing in Subsection 28(1) shall be construed as prohibiting the gathering of individuals on any street for a lawful purpose so long as the proceedings thereat are peaceable and orderly, and sufficient space is left both on the sidewalks and street to accommodate the ordinary traffic on the sidewalks and street. Parades 37. (1) A parade shall not be held without first obtaining written permission from the Town who, in conjunction with the Public Works Manager, will designate and approve the hour and route of the parade. (2) A person shall not participate in a parade for which permission has not been granted. -------- -------- Mayor CAO 11 | P a g e Bylaw 2021-14 Traffic Bylaw (3) The Public Works Manager is hereby empowered to barricade whatever streets he deems necessary during the passage of any parade and to divert traffic to other streets. During any parade, all pedestrians not taking part therein shall be restricted to the use of the sidewalk. PART VIII- EMERGENCY CONTROL MEASURES 38. (1) A police officer or designated officer is hereby authorized to direct traffic in conformity with the provisions of this bylaw and the Traffic Safety Act.. (2) In the case of fire or any other emergency or in order to expedite traffic or safeguard pedestrians or prevent accidents or meet any unforeseen conditions, a police/designated officer, fire chief and/or municipal official is hereby authorized to direct traffic in such manner as he/she may deem necessary whether or not in conformity with the provisions of this bylaw or the Traffic Safety Act. (3) Every person shall comply with any traffic signal or direction of a police/ designated officer, fire chief and/or municipal official given pursuant to this Section. (4) No person shall drive a vehicle through or over any barricade. (5) No person shall remove any barricade erected unless authorized by a police/designated officer, fire chief and/or municipal official. PART IX- SITE LINE RESTRICTIONS 39. The owner or occupant of a lot which abuts more than one street, at the intersection thereof shall not: (1) grow or allow growth of any tree, shrub or any plant; or (2) build or maintain any fence or other structure which would obstruct traffic or cause a dangerous situation to occur at any intersection within the municipality. (3) Council shall, by resolution, order that any hedge, tree, shrub, fence or other structure that obstructs any intersection to be removed or shortened to such a height as may be deemed necessary to overcome such danger. PART X - ENFORCEMENT Penalty 40. (1) A person who contravenes any provision of this bylaw is guilty of an offence. (2) The penalty for breach of any provisions of this bylaw shall be $50.00 -------- -------- Mayor CAO 12 | P a g e Bylaw 2021-14 Traffic Bylaw (3) Unless a justice orders otherwise, a fine for an offence is due and payable 15 days after its imposition. (3.1) Subject to Subsection (3), the payment of a fine for an offence is in default when all or any part of the fine is due and unpaid after 15 days. (3.2) If all or part of a fine for an offence is in default, the vehicle owner shall continue to be liable to pay the fine imposed, and in addition, is liable to pay a late payment charge in the amount of $40.00. (4) The court may, in default of payment of a fine imposed under this bylaw, order imprisonment of an individual for a term not exceeding one year. PROCEDURE FOR NOTICE OF VIOLATION OFFENCES 41. (1) Where a person commits or is alleged to have committed an offence by contravening the provisions of this Bylaw, a police officer or special constable shall give to such person or attach to that person's vehicle in such a manner that is visible to the operator of the vehicle, a Notice of Violation. The Notice of Violation shall be substantially in the form shown in Schedule 12 or in such other form as may from time to time be approved by the Town of Duck Lake. (2) If payment of the penalty is made within 15 calendar days or where the penalty is mailed and postmarked by Canada Post within 15 calendar days of the date of the Notice of Violation, then the operator or owner of the vehicle shall not be liable to prosecution for the violation indicated on the Notice of Violation; (3) A receipt shall be issued upon payment of the penalty. (4) If payment is not made as provided in Subsection 41(2) of this schedule but the amount of the penalty and late payment charge is paid prior to the date when the owner of the vehicle is required to appear in court to answer the charge for the alleged violation, then he/she shall not be liable to prosecution of that violation. Vicarious Liability 42. Notwithstanding any other provision of the bylaw, the owner of any vehicle shall be liable for a violation of any provision of this bylaw, as well as the person who committed the offence, unless the owner proves to the satisfaction of the judge or justice of the peace trying the case that, at the time of the offence, the vehicle was not being operated and had not been parked or left by any authorized person in charge of the vehicle. PART XII - REPEAL AND COMING INTO FORCE 43. Bylaws No. 2011-11, 2016-04, 2014-02, 2016-02, 9301, 2012-03, 2013-04, and 2013-02 are hereby repealed. 44. This bylaw shall come into force and take effect on August 5th, 2021. -------- -------- Mayor CAO 13 | P a g e Bylaw 2021-14 Traffic Bylaw Introduced and read a FIRST time this 5th day of August, 2021.
