Bylaw to Manage Vehicle Weights
Town of Duck Lake
Bylaw No. 2021 - 15
A BYLAW OF THE TOWN OF DUCK LAKE, IN THE PROVINCE OF SASKATCHEWAN, TO PROVIDE FOR
REGULATING THE WEIGHTS OF VEHICLES OR VEHICLES WITH THEIR LOADS ON ROADS WITHIN THE
TOWN
The Council of the Town of Duck Lake, in the Province of Saskatchewan, enacts as follows:
PART I - PURPOSE & DEFINITIONS
Purpose
1. The purpose of this bylaw is to establish a vehicle weight management system to regulate the
weight of vehicles, or vehicles with their loads using a particular municipal highway.
This bylaw shall be referred to as the Vehicle Weight Management Bylaw
Definitions
2. Except as hereinafter provided, words used in this bylaw will have the meanings ascribed to them
in The Vehicle Weight and Dimension Regulations, 1999.
In this bylaw:
a) "Administrator" shall mean the administrator of the municipality, appointed pursuant to
section 2 of The Municipalities Act; or a designate approved by Council;
b) "Council " shall mean the council of the municipality;
c) "Municipality" shall mean the Town of Duck Lake;
d) "Committee" means a road committee established in accordance with section 81 of The
Municipalities Act for the purpose of issuing orders; and,
e) "Minister "means the member of the Executive Council to whom for the time being the
administration of The Highways and Transportation Act, 1997, is assigned.

PART II - VEHICLE WEIGHTS
Weight Limits on Certain Roads
3. No person shall, without a permit issued:
a) pursuant to section 5 of this bylaw, and as shown in Appendix "A"; or
b) by the Minister pursuant to section 36 of The Highways and Transportation Act, 1997,
operate or cause to be operated or moved on or over any of the roads within the geographic
boundaries of the Town of Duck Lake, the gross vehicle weight of which exceeds 8 tonnes (16,000
pounds).
Exemptions
4. The restrictions set out in sections 3 of this bylaw shall not apply to:
a) those vehicles described in section 3 of The Vehicle Weight and Dimension Regulations, 1999; or
b) vehicles travelling on the truck routes shown on the map in Appendix "B".
Permits
5. The Administrator may provide permits where the 8 tonne vehicle weight limit is exceeded, but
where travel within the town in the town is deemed necessary, provided a route and time period
minimizing the impact of the approved vehicle(s) on municipal highways are agreed to and followed.

PART III - ENFORCEMENT
Penalty
6.
(1) A person who contravenes any provision of this bylaw is guilty of an offence.
(2) Any person guilty of any infraction to any of the provisions of this bylaw shall upon
summary conviction, be liable to a fine of:
First offence:
$100.00
Second offence:
$250.00
Third and any additional offences:
$500.00

Plus, a $10.00 fine for every 50 kilograms over the maximum allowable limit of 8 tonnes.
The total penalties cannot exceed those provided for in the Town of Duck Lake General Penalty
Bylaw, 2019-06.
Signage
7. Notice of this bylaw shall be posted conspicuously at each end of any applicable road and at any
junction or intersection considered advisable.
PART 1V- REPEAL AND COMING INTO FORCE
8. Bylaws #2015-7 and 2017-02 are hereby repealed.
9. This bylaw shall come into force and take effect on the 8st of September, 2021.

Appendix "A"
TOWN OF DUCK LAKE
OVERWEIGHT TRANSPORTATION PERMIT
In accordance with the provision of Section 21 of the Municipalities Act, and Bylaw No. 2021-15 of the Town of Duck Lake
Conditions of Permit
1. This permit shall not be valid on any road, public or private, other than the public roads stated herein.
2. The issuance of this permit does not allow the permit holder to exceed 10kg per mm width of tire (manufacturers stamped
dimension) on any wheel or group of wheels unless the tire size and axle loadings are specified in the permit.
3. The issuing of this permit shall not relieve the holder thereof from responsibility for any damage caused to said road or to any public
improvement, or to any other person on property, by reason of the operations covered by this permit. The holder of this permit agrees
that he will carry out his operations as to cause a minimum of interference with the traffic on the said road and must also indemnify the
Municipality and Department of Highways and Infrastructure against any claims in connection with traffic accidents which occur as a
result of said operations.
4. The issuing of this permit does not relieve the holder thereof from the requirements of any legislation whether federal, provincial or
municipal.
5. No movement of overweight vehicles will be permitted during adverse road and weather conditions. During such conditions an
enforcement officer may temporarily void the permit until such time as it is in his opinion, safe to proceed.
6. The permit holder shall before crossing any bridges or culverts, which are inadequate to carry the vehicle and its load, reinforce
them to the extent necessary.
7. The permit holder shall pay and hereby undertakes to pay to the municipality on demand such sum as may be required to remedy
any damage caused to the said roads, bridges or culverts through the operation of the said vehicle or vehicles or in any way arising from
the said operations covered by this permit.
8. It is the responsibility of the permit holder to ensure that the vehicle has adequate insurance coverage and is properly licensed to
transport the load specified on the permit. (This permit does not allow for weight in excess of the registered gross vehicle weight of the
vehicle).
9. This permit shall be carried in the unit at all times and be available on request for traffic officers or a Municipal representative.
