## TOWN OF ITUNA
Bylaw No. 6-2025
## A BYLAW TO REGULATE THE OPERATION & PARKING OF VEHICLES AND THE USE OF THE HIGHWAYS
The Council of the Town of Ituna of in the Province of Saskatchewan enacts as follows:
## Part 1- Interpretation
## 1. Short Title
- 1.1 This bylaw may be cited as "The Traffic Bylaw"
## 2. Purpose
- 2.1 The purpose of this bylaw is to establish clear regulations regarding the operation and parking of vehicles and the use of roadways within the Town of Ituna.
## 3. Definitions
- 3.1 In this bylaw:
- a) "accessible parking" refers to designated parking spots marked with the international wheelchair symbol, reserved for vehicles displaying a valid SaskAbilities placard.
- "administrator" means the administrator of the municipality;
- "all-terrain vehicle" and/or "ATV" means a prescribed vehicle;
- "certificate of registration" means a valid certificate of registration issued to a person pursuant to The Traffic Safety Act.
- e) "children-at-play" means the areas surrounding a public park or playground
- f) "council" means the council of the Town of Ituna;
- g) "curb" means the lateral boundaries of a roadway, whether marked by curbing or not;
- h) "designated officer" means the Administrator, Bylaw Enforcement Officer, Royal Canadian Mounted Police, Sheriff or any other person appointed to enforce municipal bylaws;
- i) "driver's licence" means a valid licence issued pursuant to The Traffic Safety Act.
- j) "farm implement" a prescribed vehicle or class of vehicles used in an agricultural, horticultural or livestock operation;
- k) "golf cart" means a prescribed vehicle;
- "heavy vehicle" means a motor vehicle with or without load which alone or together with any trailer, semi-trailer or other vehicle being towed, weighs four and a half (4.5) tonnes or more;
- m) "justice" means a justice of the peace as per The Legislation Act
- n) "lug vehicles" means any vehicle with a portable engine or tractor engine having metal spikes, lugs or cleats projecting from the face of the wheels or tires thereof, or having metal track tread;
- o) "median" means a physical barrier or area that separates lanes of

- p) "mobility aid" means a device that is manufactured for operation by a person who requires the device for mobility due to a physical disability and:
- (1) is a wheelchair; or
3. (ii) is a motorized device that is used in a normal seated orientation and has:
- a. a maximum speed capability of not more than 15 kilometers per hour;
- b. a maximum width of not more than 81.2 centimeters; and
- q) "motorcycle" means a prescribed vehicle;
- c. a maximum mass of not more than 226 kilograms;
8. г) "municipality" means the Town of Ituna;
- s) "parallel parking" means the parking of a vehicle with both right wheels thereof drawn up to the curb on the right-hand side of the highway of the highway, or a distance of not more than thirty (30) centimeters from such curb;
- t) "parking" means the standing of a vehicle, whether occupied or not, on a highway, other than standing temporarily:
11. (i) for the purpose of and while actually engaged in loading or unloading; or
12. (ii) in obedience to traffic regulations, traffic control devices or the directions of a peace officer;
- u) "peace officer" means:
- i. a member of a police service in Saskatchewan;
- ii. a person or class of persons designated by the Lieutenant Governor in Council as traffic officers; or
- ili. any person appointed pursuant to The Police Act, 1990 as a special constable for the enforcement of this Act;
17. "pedestrian" means:
- i. a person on foot; or
- ii. a person in or on a mobility aid
- w) "place of public assembly" means schools, theatres, churches, rinks, and halls;
- x) "power turn" means to maneuver a vehicle in such a manner to cause part of the vehicle to depart from its ordinary line of progress by the sudden use of acceleration and/or braking
- y) "power unit" means a motor vehicle designed and used primarily for pulling a semi-trailer;
- z) "power-assisted bicycle" means a prescribed vehicle;
24. aa) "provincial highway" refers to the streets in the Town of Ituna connecting that include Main Street North intersected by 6th Avenue N to Main Steet S intersected by 5th Avenue SW, 5th Avenue SW to Main Street, and Mainstreet North and 1st Avenue NE that connect to Highway 310 and Highway 15.
25. bb) "riding lawn mower" means a prescribed vehicle;
26. cc) "roadway" means a highway, road, parkway, driveway, square or place designed and intended for or used by the general public for the passage of vehicles within Town of Ituna limits, but does not include any area, whether privately or publicly owned, that is primarily intended to be used for the parking of vehicles and the necessary passageways on that area;
27. dd) "school zone" means the area between the traffic control device or sign identifying an area of a school zone and that traffic control device or sign that identifies the end of the school zone.
28. ee) "sign" mean a sign, pavement marking, barricade, traffic control device or object that the minister responsible for The Highways and Transportation Act, 1997, a municipality or other public authority authorizes to be erected, placed, used or painted on the roadway or right of way of a public or provincial highway for the lawful control, warning,

## 4. Speed
- 4.1 No person shall drive a vehicle on the roadway at a speed greater than the maximum speed indicated by any signs that are erected on the roadway or where no such signage exists, greater than 40km/ hour withing the town limits.
- 4.2 The maximum speed in a school zone or children at play zone is 30 km/hour.

guidance, direction of, or the provision of information to, traffic on the public or provincial highway;
- ff) "semi-trailer" means a vehicle that is at any time drawn on a highway by a vehicle and that is designed for the conveyance of goods or a living quarters for persons and so that its weight and the weight of its load is carried partly on its own axles and partly on another vehicle;
- gg) "snowmobile" means a snowmobile as defined in The Snowmobile Act;
- hh) "speed bump" means an uneven patch on the highway constructed of asphalt, concrete or other like material for the purpose of controlling
- ii) "speed zone" means any portion of a highway within the Town of Ituna, as designated herein, and identified by a sign erected and maintained at each end thereof, indicating the maximum speed applicable thereto;
- jj) "stop" means:
- i. when required, a complete cessation from movement; and ii. when prohibited, any stopping, even momentarily, of a vehicle, whether occupied or not, except when necessary to avoid conflict
- with other traffic or
- ili. in compliance with the directions of a peace officer or a traffic control device;
- kk) "traffic control device" means a sign, signal, marking or device that is placed, marked or erected for the purpose of regulating, warning or guiding traffic;
- Il) "traffic lane" means a longitudinal division of a highway of sufficient width to accommodate the passage of a single line of vehicles;
- mm) "trailer" means a trailer other than a semi-trailer, that is at any time drawn on a highway by a motor vehicle and that is designed for the conveyance of sporting equipment such as boats, goods, or as living quarters for persons;
- nn) "u-turn" means the turning of a vehicle so as to cause it to proceed in the opposite direction from which it was proceeding immediately prior to the commencement of such turn;
- 00) "vehicle" means a device in, on or by which a person or thing is or maybe transported or drawn on a highway and includes any load on the vehicle but does not include vehicles running only on rails or solely on railway company property
- pp) "wheelchair" means a device that is:
- mounted on wheels;
- driven by muscular or any other kind of power; and
- ili. used solely by a person who requires the device for mobility by reason of a physical disability
- qg) "working order" means a vehicle can be driven, does not require significant repairs, have a flat tire, or any other impediment that would make it unsafe for highway travel at the speed limit.
- rr) "yield" means:
- i. to reduce speed when approaching an intersection and to give the right-of-way or stop if other traffic is in or approaching the intersection
- ii. in compliance with the directions of a peace officer or a traffic control device.
- 4.3 The maximum speed around a daycare is 20 km/hour.
- 4.4 No person shall drive a vehicle at a speed on a roadway that impedes the normal and reasonable movement of traffic on the highway except when necessary for the safe operation of the vehicle.
- 4.5 No person shall drive a vehicle on a roadway more than 20km/hour when passing:
- A public works employee, whose presence on the roadway is marked;
- b) Emergency vehicles and their personnel when stopped on or along a roadway;
- c) Any roadway equipment that is in use including but not limited to graders, plows, bobcats, lifts, backhoes, gravel trucks, or cranes; and
- d) Any flag person or officer directing traffic by voice, hands, signs or other signals in attempt to control traffic.
## 5. Authority to Operation of Vehicles on Roadways
- 5.1 The Town of Ituna is not liable for any vehicle authorized for operation or for the operators, or the actions of operators of any such vehicles within the Town limits by providing authority to use said vehicles within Town limits as indicated in this bylaw.
- 5.2 Prescribed vehicles may operate on a roadway provided the appropriate license to operate is held where required and the operator is observing the rules of the road including:
- a) Road vehicles including but not limited to cars, trucks, sport utility vehicles, public transport vehicles, and emergency vehicles;
- b) Commercial vehicles including but not limited to semi-trucks, vans, flatbed and hauler trucks;
- c) Farm implements; and
- d) Motorcycles
- 5.3 Prescribed vehicles that are restricted may operate on a roadway with limited capacity:
- a) Snowmobiles to get to a trail outside of Town being driven in a manner as prescribed in the Snowmobile Act
- b) Golf carts for the purpose of going to and returning from the golf course.
- C) Mobility Aids
- d) Riding mowers for the purpose of travelling between worksites.
- a) Electric bicycles and pedal bikes
- f) All Terrain Vehicles for the purpose of heading to trails.
- 5.4 Restricted vehicles may operate on the roadway provided that:
- a) Where required by law, a license to operate is held;
- b) The operator is observing the rules of the road;
- The operator is going from their residence or start location to a specific location or returning using the most direct route;
- these vehicles are being operated within the hours of 6AM to 10PM daily where noise is a factor;
- e) operation of these vehicles are prohibited on Highway 310 & Highway 15 except for the purpose of crossing the highway;
- f) operators shall yield the right-of-way to vehicles on Highway 310 & 15 before crossing the highway.
- g) entering onto the Highways of 310 & 15 shall be done from an established public highway intersection.

- h) proper safety gear and lights, reflectors or other means allow for the operator to travel safely and are visible to other drivers
- i) except for riding lawn mowers and mobility aids, vehicles shall not be driven on any municipal land, private land or any Crown land other than a roadway in the municipality
3. 5.4 Heavy vehicles that exceed 4.5 tonnes are not permitted on roadways in the Town of Ituna except for the provincial highway connections of:
4. Main Street North intersected by 6th Avenue N to Main Steet S intersected by 5t Avenue SW
5. 5th Avenue SW to Main Street, and
- C) Mainstreet North and 1st Avenue NE.
7. 5.5 The use of engine retarder brakes within Town limits is prohibited.
8. 5.6 Lug Vehicles
9. Any person intending to propel, operate or drive any lug vehicle upon any roadway within the municipality must obtain a permit from the administrator by completing Form 1.
10. A permit shall be issued if the administrator is satisfied that with reasonable care in operation that the lug vehicle may be propelled or driven over any roadway without damage resulting thereto. c)
11. The administrator is hereby authorized to issue permits in writing for the purpose of subclause (i) of this bylaw b)
12. The cost of a permit to operate a lug vehicle is $100. d)
13. Permit fees shall be collected prior to the issuance of the permit. e)
14. Lug vehicles travelling more than 2 blocks need to be transported on a trailer unless permitted by the Town of Ituna. f)
15. No lug vehicle shall cross the railway without rubberized matting. g)
## 6. Parking
- 6.1 Except as otherwise provided herein, the parking of vehicles is permitted on all highways within the municipality.
- 6.2 No person shall park a vehicle in any lane, or in any street so as to obstruct the entrance to any lane, or to a driveway or approach leading to private premises.
- 6.3 No vehicle shall be parked within 6 meters or 20 feet from an intersection.
- 6.4 No vehicle other than a fire truck shall be parked within 1 meter of a fire hydrant.
- 6.5 No vehicle shall be parked on a town sidewalk without permission from council.
- 6.6 A vehicle may be parked in any lane for the purpose of taking on or discharging cargo, provided no such vehicle shall be parked for a period exceeding fifteen (15) minutes on a provincial highway or (30) minutes on any other roadway, unless written permission has first been obtained from the administrator or a designated officer of the municipality for an extension of such time;
- 6.7 Every person parking a vehicle upon a roadway within the municipality where parking is permitted, shall parallel park.

- 6.8 No person shall park a vehicle in any "No Parking" areas as designated at any time whether such areas are marked on the curb or otherwise by signs erected to indicate that parking therein is prohibited.
- 6.9 No person shall park in front of any fire hall, police station, ambulance bay, or emergency loading zones in a manner that impedes free movement of emergency vehicles in the event of an emergency or to block or impede these vehicles when responding to an emergency; any vehicle in violation may be immediately towed without warning.
- 6.10 No person shall park a vehicle on a roadway in one place for any period-oftime exceeding twenty-four (24) consecutive hours unless the roadway is directly in front of the vehicle owner's property provided:
- a) the vehicle is parallel parked as prescribed;
- b) the vehicle is in working order as prescribed;
- c) the vehicle is not being repaired other than for reasons of changing a tire;
- d) the public roadway is wide enough to have a parking lane;
- e) the vehicle is not parked within six (6) meters of an intersection or one (1) meter of a fire hydrant;
- f) the vehicle does not need to be removed for the purposes of snow clearing, road construction, road maintenance, or access to utilities; and
- g) unless he/she is the owner or occupant of the private property, except with the consent of such owner or occupant;
- h) in the case of a provincial highway there is no exception.
- 6.11 No person shall park any vehicle designated for carrying or intended for the carrying of oil, gasoline or other flammable, combustible or explosive material, within 30 metres from buildings in the municipality used or intended for use, in whole or in part, as a place of dwelling, a hotel or place of public assembly, or a commercial building not in the business of selling oil, gasoline or combustible material.
- 6.12 No person shall park on the roadway overnight on the provincial highways of
- Main Street North intersected by 6t Avenue N to Main Steet S intersected by 5th Avenue SW
- b) 5th Avenue SW to Main Street, and
- c) Mainstreet North and 1st Avenue NE.
- 6.13 No person shall park for a period exceeding two (2) hours on both sides of 5th Ave NE between 3rd St NE and 4h St NE around the Integrated Care Centre.
- 6.14 No person shall park between the hours of 8:00 a.m. to 4:00 p.m., Monday through Friday inclusive, along the West side of 2nd St SW, as posted between signs.
## 7. Signage
- 7.1 All signage as it is replaced in the Town of Ituna will match the sign guidelines found in Appendix 1 or as laid out in the SGI Driver's Handbook whichever being the most current guidelines for Saskatchewan.
- 7.2 All signage as it is replaced in the Town of Ituna will match the colour guidelines found in Appendix 2 or as laid out in the SGI Driver's Handbook whichever being the most current guidelines for Saskatchewan.
- 7.3 Council may by resolution provide for the erection of signage on any roadway and at any designated point or points thereon, of such signs as it may deem expedient for warning, guidance, directions or information thereon.

- No person shall, except where authorized by resolution of Council, or when duly authorized by law, erect upon or immediately adjacent to any roadway, any sign, marker, signal or light or any advertising sign or device.
- 7.5 No person shall deface, damage, destroy or remove any sign or marker erected pursuant to this bylaw.
- 7.6 Council shall cause to be erected and maintained at all stop streets in Appendix 3, an appropriate sign containing the word "Stop", so placed to face the traffic approaching the intersection.
- 7.7 Council shall cause to be erected and maintained at all yield streets listed in Appendix 4, an appropriate "Yield" sign, so placed to face the traffic approaching the intersection.
- Council shall cause to be erected and maintained at all "No U-Turn" intersections as listed in Appendix 5, an appropriate sign prohibiting UTurns, so placed to face the traffic approaching the intersection.
- Council shall cause to be erected and maintained at all "No Parking" areas as listed in Appendix 6, appropriate signs and/or curb markings. Such signs or curb markings shall be visible from that part of the highway to which the restriction applies.
- 7.10 Council shall cause to be erected and maintained at all "School Zone" areas as listed in Appendix 7, an appropriate sign containing the speed regulation so placed to face the traffic approaching the intersection;
- 7.11 Council shall cause to be erected and maintained at all "No Parking" or "Accessible Parking" areas as listed in Appendix 8, such signs or curb markings shall be visible from that part of the highway to which the restriction applies.
- 7.12 Council shall cause to be erected and maintained at all "Speed Zone" areas as listed in Appendix 9, an appropriate sign containing the speed regulation so placed to face the traffic approaching the intersection.
- 7.13 Council shall cause to be erected and maintained at all "Crosswalk" areas as listed in Appendix 10, an appropriate sign indicating the crosswalk will be so placed to face the traffic approaching the crosswalk.
- 7.14 Council shall cause to be erected and maintained at all other signage areas as listed in Appendix 11, an appropriate sign indicating the type of signage will be so placed to face the traffic approaching the sign.
- 7.15 The Department of Highways maintains crosswalks and painted lines that occur on provincial highways.
## 8. PENALTIES
- 8.1 Any operator of a vehicle in violation of the speed limit within Town shall be subject to the penalties and fines as issued by the RCMP or Saskatchewan Highway Patrol.
- 8.2 Any operator found operating a vehicle in contravention to the rules of the road or for not adhering to traffic control device may be subject to penalties or fines as issued by the RCMP or Saskatchewan Highway Patrol.

- 8.3 The Town of Ituna will issue a penalty for the following infractions reported within 12 months of the previous offence:
- a) Parking Infractions as described in section 6 of this bylaw; and b) Contraventions to the Operation of Restricted Vehicles as defined in subsection 5.3 and the clauses listed therein are subject to the following penalties:
- 8.4 In addition to subsection 6.9 of this bylaw the Town of Ituna may have towed or impounded any vehicle that has an infraction of the parking regulations as set out in this bylaw after
- The owner or operator of the vehicle owes three (3) or more outstanding fines to the municipality for parking offences;
- b) The vehicle shall be towed at the owner's expense;
- C) The owner will be notified of the impound location;
- d) The impounder has the right to sell, auction or dispose of any vehicle that is unclaimed or where the fees for impounding are not paid as per their regulations; it is the responsibility of the owner to get clarification from the impounder on their policies and timelines required to have their vehicle retrieved and the fees paid; and
- Fines and towing fees shall still be due to the municipality and if uncollected after 90 days will be applied to the taxes; where the owner is not the homeowner to residence in which they occupy for fee collection.
- 8.5 The Town will work with the RCMP and Saskatchewan Highway Patrol to issue fines related to weight that exceeds 4.5 tonnes or 4500kg for streets other than a provincial highways and for the use of engine retarder brakes used within Town limits at the following rates:
- 8.6 The Town will issue to following fines to those operating a lug vehicle within Town limits without a permit at the following rates:
- 8.7 Removal, moving vandalizing or destroying a traffic control device or sign are subject to the following rates:
- 8.8 Unpaid fines or additional charges incurred by Bylaw infractions may be added to the taxes of the individual in violation or where the offender is a minor the parents of the individual after 90 days of being unpaid in accordance with the Municipalities Act.
- 8.9 Any individual receiving a fine has the right to appeal to council within 30 days of a registered letter being delivered; all letters are considered delivered after seven days of mailing in accordance with the Municipalities
- i) 1st Offence: A warning
- il) 2nd Offence: $ 50.00;
- ili) 3rd Offence: $150.00; and
- iv) Each Offence there after: $ 250.00
- i) 1s* Offence:
$100.00;
- il) 2nd Offence:
$1000.00; and
- ill) 3rd Offence:
$2500.00.
- i) 1st Offence:
$100.00;
- il) 2nd Offence:

## 9. REPEAL
Bylaws No. 3-2013 and the amendments to this bylaw 5-2013, 6-2016 of the Town of Ituna are hereby repealed.
## 10. COMING INTO FORCE
This bylaw shall come into force and effect on the 2nd day of January in the year 2026 as approved by the Highway Traffic Board.

## Appendix 1 Basic Sign Shapes
Due to different regulations some signs erected in the Town of Ituna match older regulation. As Town signs are replaced, they will comply to the current standards as outlined in this bylaw in Appendix 1 and 2 or SGI Saskatchewan Driver's Handbook whichever is the most current version according to regulations on signage.

- (2) I will, when operating such lug vehicle over any bridge, railway or culvert, first lay down rubber matting, planks laid lengthwise across the surface of not less than 5 cm in thickness or less than 4 meters in length in the direction in which the lug vehicle is proceeding in such a manner that they will support the wheels or tread of the lug vehicle on both sides thereof throughout its entire passage over such bridge, railway or culvert.
