( ## TOWN OF KINISTINO ## BYLAW NO. 01/15 ## A BYLAW TO PROVIDE FOR SNOW REMOVAL AND STREET SWEEPING AND FOR THE REMOVAL OF SNOW, ICE, DIRT AND OTHER OBSTRUCTIONS FROM SIDEWALKS WHEREAS Section 8 of The Municipalities Act provides, in part, as follows: - "8(1) A municipality has a general power to pass any bylaws for the purposes of the municipality that it considers expedient in relation to the following matters respecting the municipality: - (b) the safety, health and welfare of people and the protection of people and property; - (g) streets and roads, including temporary and permanent openings and closings." Therefore, the Council of the Town of Kinistino, in the Province of Saskatchewan, enacts as follows: 1. After a snowfall in excess of 5 centimeters, all vehicles shall be removed from the street, roadway or public highway to allow for snow removal. 2. The Administrator of the Town of Kinistino or an agent thereof shall have the authority to request any Owner or Occupant of property, within the municipality, to remove any vehicles as defined in The Highways and Transportation Act, 1997 for the purpose of removing snow, ice or any form of dirt or debris on any street, sidewalk, roadway, lane or public highway. Owners and Occupants will be given twenty-four (24) hours notice for removal of all vehicles or the said vehicles will be removed by the municipality at the owners'/occupants' expense and impounded as set out in the Town of Kinistino's Bylaw to Regulate the Operation of Vehicles. 3. Owners or Occupants of property within the Town of Kinistino shall cause to be removed all snow, ice, dirt and other obstruction from sidewalks adjoining premises owned or occupied by them. When removing snow or ice from a sidewalk, the snow or ice shall be placed on private property. If this is impractical the snow or ice may be placed on the boulevard adjacent to the sidewalk in such a way that it does not create a hazard or interfere with the use of the roadway. When removing snow or ice from a driveway, the snow or ice shall be placed on private property. No snow or ice shall be placed on streets or roadways. ( 4. Anyone in contravention of this bylaw is subject to the following penalties: - a) the first offence $100.00. - b) each subsequent offence is double the previous fine. - c) All outstanding fines will be added to the property owner's taxes. 5. Bylaw No. 02/11 is hereby repealed.
