- ## VILLAGE OF LAIRD BYLAW 6-2014 ## A BYLAW OF THE VILLAGE OF LAIRD TO CONTROL THE REMOVAL OF SNOW FROM PRIVATE PROPERTY AND PUBLIC SIDEWALKS. The Council of the Village of Laird in the Province of Saskatchewan enacts as follows: ## PART 1 - INTRODUCTION - Title This bylaw shall be referred to as the Snow Removal Bylaw. - Purpose The purpose of this bylaw is to regulate the removal and/or placement of snow on private and public property and to prohibit the placement of such snow on roadways, public drainage ditches and public property. ## PART 2 - DEFINITIONS - 3) Whenever in this bylaw the following words or terms are used, they shall, unless the text otherwise provides, be held to have the following meanings: - a) "public place" includes all or any part of a street as defined by the Municipalities Act, a park, a municipal reserve, environmental reserve, buffer strip, drainage ditch or other property of the Village of Laird; - b) "sidewalk" shall mean a sidewalk within the meaning of the Municipalities Act; c) "street" means a street within the meaning of the Municipalities Act. ## PART 3 - REGULATIONS - 4) No person shall push, blade, shovel, blow or place snow that has accumulated on private property onto any sidewalk, street, alley way, or other public place. 2. No person shall push, blade, shovel, blow or place snow that has accumulated on private property onto others private property unless prior consent by the landowner is given. - 6) The Village may designate areas for disposal of accumulated snow and upon such designation being made the owner or occupier of property may dispose of snow upon such places, notwithstanding that such places are public places. - 7) The owner occupier of property shall ensure that when clearing or removing snow or ice or loose debris, that he or she shall refrain from causing injury or unduly interfering with any person lawfully using the sidewalk, street, alleyway or other public place, and shall refrain from causing damage to the sidewalks, streets, public places or other private property. - 8) The owner or occupier of property shall ensure that snow disposal be undertaken in such / - a manner that it does not create a hazard or interfere with the use of streets, sidewalks, alleyways, other public places, or other private property. - Where the Village's bylaw enforcement officer, public works manager or his alternate is of the opinion that a violation of this bylaw has occurred, that the Village employee is hereby authorized to cause all obstructions to be clearly removed from the sidewalk, street, alleyway or other public place affected at the expense of the owner. Any unpaid expenses and costs incurred by the Village for removing the accumulation shall be added to the tax roll. ## PART 4 - ENFORCEMENT - 10) Proceedings to enforce this bylaw shall be in accordance with the provisions of The Summary Offences Procedure Act, 1990 and amendments thereto. - 11) Any person found guilty of a breach of any of the provisions of this bylaw shall be liable on summary conviction to the fines as stated below: - a) In the case of an individual $100.00 fine 4. b) 5.
