## TOWN OF LUSELAND BYLAW NO. 2026-05
A BYLAW OF THE TOWN OF LUSELAND TO REGULATE THE OPERATION, SAFETY REQUIREMENTS, AND PARKING OF ELECTRICK SCOOTERS AND POWER ASSISTED BICYCLES WITHIN THE TOWN OF LUSELAND.
## 1) SHORT TITLE
a. This Bylaw may be cited as the E-Scooter and E Bike Bylaw
## 2) LEGAL REQUIREMENI
Safety Act and its Regulations.
a. This bylaw has been created to comply with and is enacted pursuant to the authority of The Municipalities Act, including the broad authority to govern municipal matters and regulate safety, welfare, and activities in or near public places. b. This Bylaw is intended to operate in addition to (and not in conflict with) The Traffic
## 3) PURPOSE
The purpose of this Bylaw is to:
b. reduce conflicts between micro mobility users, pedestrians, and vehicles;
a. promote safe and orderly use of e-scooters and e-bikes;
c. regulate operation and parking on or near public places; and
- d. support active transportation while managing risk and nuisance impacts.
## 4) DEFINITIONS
a. "Bicycle" has the meaning given in The Traffic Safety Act and includes a powerassisted bicycle where applicable.

## 7) WHERE E-SOOTERS AND E-BIKES MAY OPERATE
a. E-Bikes may be operated:
on Multi-Use Pathways unless restricted by signage or Schedule "A".
I. on streets and lanes, subject to provincial rules;
b. E-Scooters may be operated:
on streets with a posted speed limit of 50 km/h or less;
in bicycle lanes where available; and
- III. on Multi-Use Pathways unless restricted by signage or Schedule "A".
## 8) SIDEWALK RESTRICTIONS
- a. Sidewalk riding is prohibited for E-Scooters and E-Bikes, unless:
signage explicitly permits it in a specific area; or the Operator is dismounted and walking the device.
b. The Town may designate limited "sidewalk-permitted zones" by Schedule "A" and signage where necessary (e.g., short connections with no reasonable alternative).
## 9) SPEED LIMITS IN TOWN CONTROLLED AREAS

a. On Multi-Use Pathways and in parks, the maximum permitted speed is:
l. 15 km/h in parks and high-pedestrian areas;
Il. 20 km/h on Multi-Use Pathways unless otherwise posted.

- b. On streets and in bicycle lanes, the maximum operating speed is the lesser of:
Il. 40 km/h where posted or designated by the Town for safety.
## 10) AGE AND HELMET REQUIREMENTS
a. E-Bikes: Operators must meet Saskatchewan requirements for age and helmet use applicable to power-assisted bicycles. No person under 14 may operate an E-Bike in a Public Place.
b. E-Scooters: Operators must meet Saskatchewan requirements for age and helmet use applicable to electric kick scooters. No person under 16 may operate an EScooter in a Public Place.
c. Helmets are mandatory for all Operators of E-Scooters and E-Bikes on Public Places. A helmet must meet the standards of The Canadian Standards Association.
## 11) EQUIPMENT REQUIREMENTS
a. No person may operate an E-Scooter or E-Bike unless it is in safe working condition, including:
I. functioning brakes;
II. a bell or horn (or other audible warning device);
III. a front white light and rear red light/reflector when operating at night or in low visibility.
## 12) PARKING AND STORAGE RULES
a. No person may park or leave an E-Scooter or E-Bike in a manner that:

## 13) RESTRICTED AREAS

## 14) ENFORCEMENT

## 15) OFFENCES AND PENALTIES
a. A person who violates any provision of this Bylaw is guilty of an offence. Any person convicted of a breach of the provisions of this bylaw shall forfeit and pay a penalty of not less than $50.00 and not more than $500.00.
b. Penalties:
1. Operating in a prohibited area / boulevard / sidewalk riding: $100.00

Unsafe operation / excessive speed in parks/pathways: $100.00

Repeat offence (within 12 months): $100.00 + possible impound c. Where a violation continues, each day constitutes a separate offence. provided however that if the payment is made within seven (7) days of the service of the ticket or notice, the penalty will be reduced to $50.00.
e. Payment of Fees The Town of Luseland Police Service, Bylaw Enforcement Officer, Peace Officer, any of the provisions of this Bylaw specified hereof, a ticket may be enforced by Where any person has committed or is alleged to have committed a breach of or other person authorized by the Town.
Such person served with a ticket or notice may pay same at the Luseland Municipal Office between the hours of 8:30 a.m. and 4:30 p.m., excepting Saturdays, Sundays, and public holidays, in lawful money of Canada in an amount equal to the fine fixed in the said Section 15.b, provided that payment must be made within a period of seven days from the service of the said ticket or notice. If payment is made within such time and accepted, then that person shall not be liable to prosecution for the offense.
Service of such ticket or notice may be made by attaching the ticket or notice to ticket or notice addressed to the person who has committed the offense.

## 16) SEVERABILITY
a. If any section of this Bylaw is found invalid, the remaining sections continue in force.
## 17) CONFLICT / PARAMOUNTCY

## 18) EFFECTIVE DATE
a. This Bylaw comes into force on the date of final passing.
