## Snow Removal Bylaw
## RESORT VILLAGE OF NORTH GROVE
BYLAW NO. 2014-09
## A BYLAW TO REGULATE SNOW REMOVAL FROM STREETS & SIDEWALKS
Where as Section 8 of the Municipalities Act, in part, as follows:
- "8(1) A municipality has a general power to pass any bylaws for the purposes of the Municipality that it considers expedient in relation to the following matters respecting the municipality:
- (b) the safety, health and welfare of people and the protection of people and property;
- (g) streets and roads, including temporary and permanent openings and closings;
NOW THEREFORE the Council of the Village of North Grove enacts as follows:
## 1. Short Title
This Bylaw may be cited as "The Snow Removal Bylaw"
## 2. Definitions
In this Bylaw:
- a) Municipality means the Resort Village of North Grove.
- b) "Occupant" /'Owner" shall have the meaning given thereto by rhe Muncipalities Act
## 3. Objectives and Initiatives
- 3.1 To facilitate the handling of emergencies by Police, Fire and Ambulance services during the winter;
- 3.2 To reduce the hazards of icy conditions for motorists and pedestrians;
- 3.3 The Village of North Grove Public Works and Utilities Department is responsible for responding to snow events. It is dangerous to initiate a snow clearing program during a storm when visibilities are reduced. It is also ineffective to clear streets that are passable until it stops snowing, as the traffic, additional snow accumulation, and winds tend to nulify any efforts made. Typically, a major snow clearing program is not initiated until the snow fall has stopped.
## 4. Street Priority
- 4.1 The Snow Clearing Program map, attached to and forming part of the Bylaw as Schedule "A" illustrates the order of snow removal priority routes, as well as a general direction of work flow for snow removal throughout the municipality. Priority 1 consisting of Daniel Drive.

## 5. Use of Salt and Sand on Village Streets
- 5.1 The Village of North Grove will monitor streets and salt and/or sand as required. In the event of a substantial snowfall, streets will be cleared first, followed by application of salt and/or sand.
## 6. Snow Piles
- 6.1 The Village of North Grove will monitor snow piles for the safe sight distances at key intersections and remove them at the discretion of the Municpality, Priorities are given to intersections and open lane entrances in the vicinity of school bus drop off/pick up. In years of significantly above normal snowfall it may be impractical to remove every snow pile and priorities will be devoted to areas of higher traffic volume at major intersections.
## 7. Windrows or Edge Ridges Affecting Private Driveway Approaches.
- 7.1 The Municipality is not responsible for clearing ridges from driveways.
- 7.2 The Muncipality will remove snow in an upmost efficent manner; however, it is at the discretion of the Municipality as to how the snow will be removed.
## 8. Owner/Occupant Accountability
- 8.1 No person shall place any snow, ice, dirt or other obstruction, shoveled, swept or cleaned from private property onto any street, sidwalk or lane.
- 8.2 Pushing snow into the streets creates more snow for the grader to plough which may result in larger ridges in your own drivway as well as the driveways immediately adjacent. This Bylaw and its fines will be enforced and Muncipal crews will not asist in the removal of boulevard windrows that are augmented by residents pushing their own snow into the streets.
8.3 Residents clearing their driveways in a timely manner will greatly assist the Municipality crews in identifying private driveway locations and utilizing the wing appropriately.
8.4 It is recommended that home owners avoid leaving extremely high piles of snow at the corners of their driveways as the graders wing cannot be raised high enough to clear these. This will cause additional snow to be ridged on the driveway and will be the owner/occupant responsibility to remove.
8.5 No home owner shall construct any fence/flowerbed or landscaping materials such as stones/bricks on Municipal property in front of the easement area that would hinder snow removal.
## 9. Parked Vehicles
9.1 It is advised that residents avoid parking their vehicles on the streets during a snow clearing program. It is the owner/occupants responsibility to dig their vehicle out if it gets surrounded by windrows or snow ridges. It significantly slows the clearing program down, and is hazardous for the grader as well as other traffic. Residents are to move their cars to an alternate location (driveway) where possible. The Municipality is not responsible for clearing the windrows away from vehicles that are parked in the streets during plough operations.
9.2 The Muncipality shall have the authority to request any owner or occupant of property within the municpality to removing snow, ice or debris on any street, sidewalk or lane. Owners and occupants will be given twenty four hours notice for removal of all vehicles or the said vehicles will be removed by the municipality at the owner/occupants expense.
## 10. Infractions of the Bylaw
10.1 Any person or persons who contravene the provisions of this Bylaw are guilty of an offence and shall be liable upon summary conviction to a fine of not less that $150.00 and not more than $10,000.00
10.2 A Designated Officer who has reason to believe that a person has contravened any provision of this bylaw may serve on that person a Notice of Violation, which Notice of Violation shall indicate that the Municipality will accept voluntary payment in the sum of one hundred dolars ($100.00) to be paid to the Municipality within fifteen days
10.3 Where the Municipality receives voluntary payment of the amount prescribed under section 10.2 within the time specified, the person receiving the Notice of Violation shall not be liable to prosecution for the alleged contravention.
10.4 Payment of any Notice of Violation does not exempt the person from enforcement
of an order pursuant of this bylaw.
## 11. Coming Into Force
11.1This bylaw shall come into force on the day of its final passing.
