## Animal Keeping Bylaw No. 06 (2024)
## A Bylaw of the Town of Outlook in the Province of Saskatchewan to License, Regulate, Control and Prohibit the Ownership and Possession of Certain Animals
The Council of the Town of Outlook in the Province of Saskatchewan enacts as follows:
## 1. DEFINITIONS
- a) "Livestock" as used in this bylaw shall mean cattle, goats, sheep, swine, horses, and all fur bearing animals domesticated or wild, not including hens, dogs, cats, or other caged household pets; whether kept for profit or pleasure;
- b) "Poultry" shall mean male chickens (rooster), ducks, geese and turkeys;
- c) "Hen" shall mean a domesticated female chicken that is at least four months old
- d) "Bees" means any of certain insects, which store up the pollen of flowers for food or that makes honey and wax.
- e) "RA - Residential Acreage District" means a zoning district established by the Town of Outlook Zoning Bylaw and amendments thereto;
- f) "FUD" - Future Urban Development District means a zoning district established by the Town of Outlook Zoning Bylaw and amendments thereto;
- g) "Agriculture" - Agriculture Land means a zoning district established by the Town of Outlook Zoning Bylaw and amendments thereto;
- h) "Pet" means any animal(s) or bird(s) that are: tamed or domesticated and kept as a companion and; not raised for profit; not customarily raised for human consumption.
2. No person(s) shall own or harbor any animal, or hybrid of any animal, of the kind listed in Schedule B for any purpose.
3. Livestock is not permitted within the Municipality with the following exceptions and pursuant to Section 4 of this bylaw:
- a) A maximum of three (3) adult horses per two (2) acres of pasture land are permitted and the horses are kept penned, fenced or tethered entirely on their owner's property when left untended in the Agriculture (Ag), Residential Acreage (RA) and Future Urban Development (FUD) Zoning Districts only.
- b) Cattle will be permitted on the land in the Agriculture Zoning District (Ag) or Residential Acreage Zoning District (RA) West of the River only.
- c) A maximum of Five (5) hens shall be allowed, in aggregate, on any parcel located in any Agriculture Zoning District (Ag) and Residential Acreage Zoning District (RA).
- d) Bees and Bee keeping shall be allowed, in aggregate, on any parcel located in any Community Service (CS), Agriculture Zoning District (Ag) and Residential Acreage Zoning District (RA).
- e) In the case of a riding arena located on any parcel of land located in any Community Service (CS) Zoning District,
- i. livestock will be permitted in the riding arena and on adjacent land in the CS Zoning District between the hours of 7 am and 11 pm, and,
- ii. livestock will be permitted on land adjacent to the riding arena in the CS Zoning District from 11 pm to 7 am for a maximum of two subsequent nights to enable transportation between events in other locations
- f) In the case of special event(s) held on any parcel located in any Community Service (CS) Zoning District or on municipal roadways involving livestock regulated by this
19. bylaw, expressed written permission for exemption from the development officer of the Town of Outlook will be required.
- g) Permission under subsection f of Section 3 of this bylaw will specify the dates and time frame involved as well as any requirements including compliance with sections 5, 6 and 7 of this bylaw.
- h) Special events mentioned under subsection f of Section 3 of this bylaw include, but are not limited to: parades, rodeos, jackpot events, roping and bull riding schools,
## 4. The following limitations exist:
- a) At the Discretion of the Bylaw Enforcement Officer should the keeping of hens at that location be designated a nuisance under the nuisance bylaw of the Town of Outlook or should the harbourer of the animals be found to be non-compliant with Sections 5 or 6 of this bylaw;
- b) All manure shall not be permitted to accumulate so as to provide a nuisance;
- c) A rodent control program shall be maintained and;
- d) Dead animals shall be removed and disposed of as required by regulations under the Public Health Act.
## 5. Owning and Harbouring of Hens
- a) A person who keeps hens must:
- i. Provide each hen with at least 0.37M2 of coop floor area, and at least 0.92 m2 of roofed outdoor enclosure;
- ii. Provide and maintain a floor of any combination of vegetated or bare earth in each outdoor enclosure;
- ili. provide and maintain, in each coop, at least one perch, for each hen, that is at least 15 cm long, and one nest box;
- iv. keep each hen in the enclosed area at all times;
- v. provide each hen with food, water, shelter, light, ventilation, veterinary care, and opportunities for essential behaviors such as scratching, dust bathing, and roosting, all sufficient to maintain the hen in good health;
- vi. maintain each hen enclosure in good repair and sanitary conditions, and free from vermin and obnoxious smells and substances;
- vii. construct and maintain each hen enclosure to prevent any rodent from burrowing underneath or within it or within its walls, and to prevent entrance by any other animal;
- viii. keep a food container and water container in each coop;
10. keep each coop locked from sunset to sunrise;
- X. remove leftover feed, trash, and manure in a timely manner;
- xi. all manure must be removed to an appropriate site by the harbourer and not by municipal staff, such as the Outlook Regional Landfill and can be handled similarly to compost materials:
1. follow biosecurity procedures recommended by the Canadian Food Inspection Agency
- xii. Keep hens for personal use only, and not sell eggs, manure, meat, or other products derived from hens;
- xili. not slaughter, or attempt to euthanize, a hen on the property
- xiv. not dispose of a hen except by delivering it to a farm, abattoir, veterinary, mobile slaughter unit, or other facility that has the ability to dispose of hens lawfully; and
- xv. not keep a hen in a cage.
- xvi. all residents must register with the Town their hens using Schedule A.
- b) An accessory building or other enclosure for keeping one or more hens must be:
- i. no more than 2 meters in height;
21. no more than 9.2 m2 in floor area;
- iii. no closer than 3 meters from any door or window of any dwelling;
- iv. situated only in a rear yard
24. at grade level
25. no less than 1 meter from any property line; and
- vii. in full compliance with the Zoning Bylaw
## 6. Accumulation of Animal Feces:
- a) Any person who owns, possesses, or harbours an animal and fails to remove the defecation as set out in Section 4 shall be deemed guilty of an infraction of this bylaw and shall be subjected to fines set out in the General Penalties Bylaw of the Town of Outlook.
- b) An owner or occupant of private property must not allow animal feces to accumulate on the property so as to create a health hazard.
- c) The Bylaw Enforcement Officer may serve an owner or occupant of private property with a written order to remove all animal feces from the property within seventytwo (72) hours of service of notice;
- d) The Municipality may remove the feces from the property at the cost of the property owner if:
- i. The person to whom the notice is made fails to remove the feces within seventy-two (72) hours; or
- ii. After reasonable inquiry, the whereabouts of the owners or occupant of the property cannot be determined.
## 7. Orders to Remedy Contraventions:
- a) Inspections to determine if a written order should be issued under this Bylaw shall be carried out in accordance with the Municipalities Act
- b) A person may Appeal an order given under this Bylaw in accordance with the procedures set out in the Municipalities Act.
3. The Municipality may, in accordance with the Municipalities Act, take whatever actions or measures necessary to ensure that an order given under this Bylaw is fully complied with;
- d) In an emergency, the municipality may take whatever actions or measures are necessary to eliminate the emergency in accordance with the Municipalities Act;
- e) Any unpaid expenses and costs incurred by the municipality that an order given under this Bylaw may be recovered either:
- i. By civil action for debt in a court of competence jurisdiction in accordance with the Municipalities Act or;
- ii. By adding the amount to the taxes on the property on which the work is done in accordance with the Municipalities Act.
8. Where the Bylaw Enforcement Officer revokes the animal keeping privilege, the Bylaw Enforcement Officer shall serve, by registered mail and/or in person, the owner or occupant with a letter of notice stating the reasons for this decision. The recipient of the letter of notice shall, within thirty days of receiving the notice, either take the action deemed necessary to correct, resolve and alleviate the reason | (s) for the Bylaw Enforcement Officer's decision or cease the keeping of livestock or pet(s).
9. In addition to the above provisions, any person(s) contravening any provisions of this bylaw shall be subject to the General Penalties Bylaw of the Town of Outlook.
10. Bylaw 10 (2023) is hereby repealed
11. This bylaw will come into force on the date of its final passing.

## Schedule B Prohibited Animals
The following is a list of animals the keeping of which is prohibited within the Town of Outlook:
- a) All animals being reared for the bearing of fur or food;
- b) All animals whose normal habitation is outside of urban centers (such as fox, deer, wolves, coyotes)
- c) All arachnids dangerous to humans (such as scorpions and tarantulas)
- d) All Artiodactyls Ungulates (such as goats, sheep, pigs, llamas)
- e) All bats
- f) All Can ids, except the domestic dog
- g) Wild fowl or poultry including roosters (not withstanding Hens in accordance with this Bylaw)
- h) All Crocodilians (such as alligators, crocodiles, and caimans)
- i) All Edentates (such as anteaters, sloths and armadillos)
- j) All elephants
- k) All Fe lids, except the domestic cat
- I) All hyenas
- m) All insects (not withstanding bees in accordance with the Bylaw) being raised for the purpose of profit or gain;
- n) All Livestock (not withstanding horses, chickens and cattle in accordance with this Bylaw)
- o) All Marsupials (such as Kangaroos and opossums)
- p) All Mustelids (such as skunks, weasels, otters, and badgers) except the domestic ferret;
- q) All non-human primates such as gorillas and monkeys)
- r) All Perissodactyls Ungulates (such as horses, donkeys, mules and asses)
- s) All Pigeons (unless specifically approved by Council)
- t) All Pinnipeds (such as seals, fur seals and walruses)
- u) All Procyonids (such as raccoons, coatis and cacomistles);
- v) All Raptor, diurnal and nocturnal (such as eagles, hawks and owls)
- w) All Ratite Birds (such as ostriches, rheas, and cassowaries)
- x) All Anseriformes (such as ducks and geese)
- y) All Galliformes (such as turkeys, grouse, quails and pheasants)
- z) All snakes of the families Pythonidae and Boidae;
27. aa) All Ursids (bears)
28. bb) All venomous Reptiles and Amphibians;
29. cc) All Viverrids (such as mongooses, civets and genets)
