This Bylaw has been consolidated under the authority of the City Clerk. It represents
proof, in absence of evidence to the contrary of:
a) the original bylaw and of all bylaws amending it; and
b) the fact of passage of the original and all amending bylaws.

BYLAW NO. 7640
A BYLAW OF THE CITY OF REGINA
TO CONTROL DOMESTIC PIGEONS

The Council of the City of Regina enacts as follows:
1.
This Bylaw shall be referred to as "The Domestic Pigeon Control Bylaw".
Definitions
2.
In this Bylaw:
(a)
"aviary" shall mean any pen or run enclosed by wire immediately adjacent to
the loft, into which pigeons can only enter directly from the loft;
(a.1)
"Bylaw Enforcement Officer" means any person employed by the City of
Regina in one of the following positions:
(i)
Manager of Bylaw Enforcement;
(ii)
Bylaw Standards Officer;
(iii)
Senior Bylaw Enforcement Officer; and
(iv)
Bylaw Enforcement Officer.
(b)
"loft" shall mean any building, structure or coop in which pigeons are housed
or kept;
(c)
Repealed. (#2009-71, s. 11, 2009)
(d)
"pigeon" shall refer to birds of this species other than racing pigeons or show
pigeons;
(e)
"racing pigeon" shall mean a pigeon banded with a seamless, numbered leg
band, issued by an active racing club or association, and raised for the
purpose of racing;
(f)
"show pigeon" shall mean a pigeon banded with a seamless, numbered leg
band, issued by an active show club or association, and raised for the
purpose of show or competition;
(g)
"supervised exercise" means that while the racing and/or show pigeons are
outside of the loft, the owner must be present on his property where the loft
is situated ensuring that his racing and/or show pigeons do not roost or linger
on a neighbour's property nor interfere with a neighbour's enjoyment of his
homestead.

(h)
"owner" shall mean any person owning, possessing or harbouring pigeons,
racing pigeons or show pigeons.

3.
No person may keep pigeons, racing pigeons or show pigeons, within the boundaries
of the City of Regina unless he complies with the provisions of this Bylaw and the
loft and aviary are constructed in accordance with the City of Regina Building
Bylaw No. 2023-59 and Bylaw No. 9250.

Permit:
4.
No person shall keep pigeons, racing pigeons or show pigeons within the City of
Regina without holding a valid permit as hereinafter referred to.
5.
Everyone who keeps or intends to keep pigeons, racing pigeons or show pigeons
within the boundaries of the City of Regina shall apply yearly to the Manager of
Bylaw Enforcement for a permit permitting the keeping of said pigeons, racing
pigeons or show pigeons.

6.
Any permit issued by the Manager of Bylaw Enforcement may be suspended or
cancelled by him if the provisions of this Bylaw are not being observed by the
permit holder.

7.
Everyone who keeps pigeons, racing pigeons or show pigeons shall at any time
permit a Bylaw Enforcement Officer to enter the loft for inspection.

8.
No person shall keep more than a total of ninety (90) pigeons, racing pigeons or
show pigeons and of that number no more than fifty (50) of such pigeons, racing
pigeons or show pigeons shall be over the age of one (1) month.
Loft:
9.
Every loft:
(1)
shall provide at least two square feet of floor space for each pigeon, racing
pigeon or show pigeon over the age of one month;
(2)
shall be constructed so as to be dry, airy and bright inside and have adequate
ventilation, having regard to the number of pigeons, racing pigeons or show
pigeons kept therein;

(3)
shall be maintained on the outside equally as well as other buildings on the
same lot and the inside shall be limewashed, painted or disinfected at least
twice each year and at such other times as may be directed by a Bylaw
Enforcement Officer;
(4)
shall be kept at all times in a sanitary condition, and the removal and
disposition of all refuse shall be done in a regular and sanitary manner;
(5)
or any part thereof, including an aviary, shall not be built closer than thirty
(30) feet from any school, church, dwelling or other premises used for
human habitation or occupancy, other than the premises occupied by the
keeper of such building or structures, or members of his immediate family,
in which case the loft, or any part thereof, including an aviary, shall not be
constructed closer than twenty (20) feet from the premises of the keeper or
members of his immediate family.

Pigeon Control:
10.
No person shall permit his pigeons, or pigeons under his control to be outside the
loft or aviary.
11.
(1)
No person shall permit racing pigeons or show pigeons to be outside the loft
or aviary except as follows:
(a)
for the purpose of supervised exercise each day to achieve and
maintain muscular condition which is necessary for races and shows
they participate in, providing that no more than one half (1/2) of the
owner's racing or show pigeons are released at any one time; or
(b)
when the racing pigeons are returning to the loft from a supervised
race or training flight.
(2)
No person shall permit his racing or show pigeons out of the loft for the
purpose of supervised exercise on any Saturday or Sunday between the hours
of 9:00 a.m. and 4:00 p.m., on any Monday which is a civic holiday, nor
between the hours of 9:00 a.m. and 4:00 p.m. on any other day of the week
during the months of May, June, July, August and September.
(3)
Notwithstanding Subsection (2), a person may allow his racing or show
pigeons out of the loft for the purpose of supervised exercise on any Monday
to Friday between the hours of 9:00 a.m. and 4:00 p.m. for one hour.

Offenses and Penalties:
12.
Any person who contravenes or disobeys, or refuses or neglects to obey any
provision of this bylaw, or order of a Bylaw Enforcement Officer is guilty of an
offence and liable on summary conviction to a fine of not less than fifty ($50.00)
dollars and not more than five Hundred ($500.00) dollars or, in default of payment
of the fine, to imprisonment for a period not exceeding 30 days.
