## BYLAW NO. 92U4
- PURSUANT TO SECTION 206 (2) (N) OF THE RURAL MUNICIPALITY ACT, 1989
- A BYLAW TO PROHIBIT OBSTRUCTIONS ADJACENT TO CERTAIN ROAD ALLOWANCES
1. The council of the Rural Municipality of Aberdeen No. 373, in the "*evince of Saskatchewan, enacts as follows:
For the purpose of this bylaw the expression:
- (a) "municipality" means the Rural Municipality of Aberdeen No. 373 of Saskatchewan;
- (b) "road" means any road allowance within the municipality other than:
- (1) a private road; or
- (11) any road within a Country Residential District
- a provincial highway; or
- (111) with the exception of Bettker Road
2. No person shall hereafter plant trees or shrubs or place stone, earth or gravel piles, portable structures, machinery or other objects (excluding fences) on private property within:
- 45 metres (150 feet) from the centre line of any road.
- 90 metres (300 feet) from the intersection of two or more roads,
3. The council may, by order, direct the owner of any private property upon which a tree or shrub has been planted, or a stone, earth or gravel pile, portable structure, machinery or other object (excluding fences) has been placed in contravention of the provisions of section 2 hereof, to remove the same within a time stated in such order and the provisions of Section 173 of The Rural Municipality Act, 1989, shall apply, mutatis mutandis, if the owner fails to comply with the order.
4. Any person who contravenes the provisions of Section 2 hereof is guilty of an offence and liable on summary conviction to the penalties imposed in the general penalty bylaw of the municipality.
