<!-- image --> ## BYLAW NO. 03-2019 A BYLAW TO PROVIDE FOR RESTRICTING THE OPERATION OF CERTAIN VEHICLES ON ROADS WITHIN THE RURAL MUNICIPALITY OF GREAT BEND NO. 405 The Council of the Rural Municipality of Great Bend No 405, in the Province of Saskatchewan enacts as follows: This bylaw shall be referred to as the Road Restriction Bylaw. 1. In this bylaw: - a) "Administrator" shall mean the administrator of the municipality; - c) "Municipality" shall mean the Rural Municipality of Great Bend No. 405; 4. "Council" shall mean the council of the municipality; - d) "Order" means and order issued by the road committee; - e) "Committee" means a road committee established in accordance with section 81 of The Municipalities Act for the purpose of issuing orders. 2. Council may by resolution establish a road committee for the purpose of issuing orders in accordance with The Municipalities Regulations Part III. 3. The committee shall consist of two (2) members of council and each appointment term shall be specified within council's resolution at the time of making appointments. 4. The committee may issue an order only if, due to inclement weather or unfavorable road conditions, the use of the road in the manner prohibited by the order would, in the opinion of the road committee reasonably be expected to result in: - a) Damage to the road; or - b) A high risk of property damage or personal injury to the public. 5. An order established pursuant to this bylaw may include provisions to: - Prohibit the operation of certain vehicles on specified roads and bridges. - Prohibit the operation of certain tractors/equipment on specified roads and bridge - Restrict the gross weight of tractors/equipment on specified roads and bridges or portion - Restrict the gross weight of vehicles on specified roads and bridges or portion thereo 6. Subject to the provisions of The Highways and Transportation Act, council may by resolution provide the committee with the authority on behalf of the municipality to opt in or out of the Provincial Road Bans. 7. An order issued under this bylaw must: - a) Be signed by the members of the road committee; - b) State the date on which it is signed and the date on which it takes effect; and - c) Be filed with the Administrator 8. Upon receipt of the order the Administrator shall; - b) Present a copy of the order at the next meeting of council and record so in the minutes - a) Promptly notify the permit officer in the Department of Highways and Transportation of the issuance or cancellation of any order; and 9. otice of the order shall be posted conspicuously at each of any applicable road and at any junctio r intersection the committee considers advisable 10. Any order issued pursuant to this bylaw shall be in the form of Schedule "A". 11. An order issued pursuant to this bylaw shall remain in effect until cancellation of the order by the committee and all notices posted in accordance with this bylaw have been removed. 12. Any person guilty of any infraction to any of the provisions of this bylaw shall upon summary conviction, be liable to a fine as per the General Penalty Bylaw. 13. Bylaw No. 2-86 is hereby rescinded. 14.
