## RURAL MUNICIPALITY OF LAKE LENORE NO. 399 BYLAW NO. 13/2020
## A BYLAW TO RESTRICT THE PLACEMENT OF SNOW CLEARED FROM PRIVATE LANDS ON ROADS
The Council of the Rural Municipality of Lake Lenore #399 in the Province of Saskatchewan enacts as follows:
1. This bylaw shall be referred to as the "Snow Piling Restriction Bylaw."
2. For the purpose of this bylaw, the following definitions apply:
3. . "Act" means The Municipalities Act, as amended from time to time;
- b. "municipality" means the Rural Municipality of Lake Lenore No. 399;
- c. "road" means a public highway as defined by The Municipalities Act
- d. "roadway" means that part of a public highway designed or intended for use by vehicles, including the shoulder.
3. When clearing snow from private property, including but not limited to driveways, snow shall not be piled:
- a. on the roadway; and
- b. anywhere within the road allowance, including the ditch, to a height higher than one (1) foot below the lowest part of the roadway.
4. Any person found guilty of an infraction of any provision of this bylaw shall be liable on summary conviction to the penalties imposed by Section 381 of the Act, and/or shall be liable for the cost incurred by the municipality to relocate the snow piled on the road or within the road allowance, including within the ditch. The cost shall be determined using current municipal custom work rates or the cost incurred from contracting the work out, whichever is applicable to the infraction.
5. This bylaw shall come into effect upon the third reading.
